#Resistance Hanging Judge Declares Roger Stone Jury Forewoman Didn't "Technically" Lie; Declares That Calling Trump's Supporters "Racist" Does Not Show Bias; Reads Stone's Complaint in Mocking Tone

She's making it extremely easy for Trump to pardon Roger Stone.

Updates below.

She seems to be looking into everything except the jury forewoman concealing -- or actively lying about -- her extreme political bias.

Update: She's now claiming that the forewoman didn't "technically" lie, and seems to be blaming Roger Stone for not researching this woman more thoroughly to discover her lies:

Update: This is bad. She's plainly lawless and trying to strike a blow for #TheResistance.

4 Making a pardon easy? She's making a new trial upon people almost inevitable, and one with a new judge and maybe a change of venue. Unless this is deliberate this lack of self-control is astounding.

Once Trump is re-elected, we are cruising to a new Supreme Court Justice or two.

This is why they are so maniacal. They see the writing on the wall and can do nothing about it.

Nothing.

So the newest attack is that Trump is not handling the virus well enough. Schumer saying he wasn't asking for enough money, etc. Every single day is an attack. If nothing is happening, they make stuff up. Sick people.

Trump's and America's reward SHOULD BE two new SC picks.

If we get the House and retain the Senate, he's gonna be collecting Deep State scalps, especially if he gets to replace RBG.

That's why they're running so scared.

Posted by: Joe Mannix (Not a cop!) at February 25, 2020 03:46 PM (hYcqw)

149 Jackson is much more than incompetent. Jackson is completely corrupt.

Jackson is part of the conspiracy we have witnessed in real time.

Her jury foreman lied and lied when she was asked if she had any bias against Stone, or Trump (this is a POLITICAL trial, not a criminal one). She could not erase all of her Twitter and Facebook entries over the years she had fast enough; she was caught.

Jackson let this pass; IMO Jackson LIED about it, just to insure she had crooked jurists to insure her POLITICAL trial outcome.

This was not an oversight; this was PLANNED.

Jackson was caught. And still, Jackson lets it happen. The jury foreman stayed.

Isn't conspiracy to commit a felony also another felony?

Any comment from a legal beagle I have read says that Stone obviously, immediately needs to be granted a new trial, with a non-corrupt judge this time.

Beoytch Jackson should be brought up on charges.

Fuching criminal judge.

219 I would be fine with this piece of judicial reform: if there is ever a mistrial due to prosecutorial or judicial misconduct, everyone ever prosecuted or tried by those people are released immediately. Yes, this is high-risk and will result in criminals going free, but when the system is dishonest the innocent don't have a chance. Aggressively dis-incentivize this kind of behavior.

I want lower courts to be able to overturn higher courts.

Depending on how much higher the court with the original opinion is than the courts doing the overturn action, there would have to be more of the lower courts banding together to do it.

Put some more democracy and checks on the court system.

Unless you think you are going to be on the run from home, you don't need 25 year freeze dried foods; canned goods will get you through just fine.

Buy what you normally buy, just extra. Check the ads and buy extra of what is on sale. Stick to brands you know and like. Some store brand soups and such are absolutely vile.

423 333, It was not an oversight by the framers for life appointment for judges. One, it only applied to the Supreme Court. Arguably Congress could create specified terms for lower court judges and they certainly could eliminate all federal lower court judges altogether by pensioning them off.

The major reaction was to the Crown's interference with colonial judges and the major donnybrook between the Stuart's view of divine rule of kings versus the establish court system during the 1600's which happened to be the era in which the colonies were established. Life terms were designed to preserve court independence from legislative and eventually executive overreach.

The Framers also did not anticipate that Presidents would limit themselves to two terms. Notice that FDR turned around a hostile court through the appointment power to a 8-1 majority of his appointees by the time he died.

1) Admit meat and fat is good for you and stop the "it kills gaia nonsense" that goes along with eating meat, and
2) Admit big government is wrong when it picks winners and losers in science. The low fat pseudoscience they adopted from their beloved Ancel Keys has screwed up the health of an entire generation of Americans.

I know that people think she's trying to force a Trump pardon, but at this point she's daring him to drag her away in handcuffs. At some point Bill Barr won't be able to explain how a florid NeverTrumper is violating all the laws needed for a fair trial in any known democracy, and Trump will lay down the law: bring her in line, or he'll make Rudy Giuliani AG.

Between Jackson, Schiff, Nadler, Yanukovich, the Vindman brothers, Feldman, Gerlan, and Gerhardt, there is a giant over-representation in the leadership of the specific legal coup against President Trump and the American people. Mr. Turley offered a good defense, though, so that evens the scales mildly.

571 514 trev006,

What you are seeing is about 40-50 years worth of legal mal education which is focused on using the law to cram down unpopular decisions among a restive population.

The original onus for this was post Carolene Products in 1938 and desegregation. Desegregation required that the court recognize the role that it played in making de jure segregation possible such as Plessy, the Civil Rights cases, Slaughterhouse, Cruikshank, etc. Post Civil War, the Supreme Court's record was appalling on civil rights. But once desegregation was accomplished, the court thought it now meant that the court was the Platonic guardian of all other sorts of rights that were not provided by the political system that were not included in the Constitution and Amendments.

Law schools changed their curriculum to match and insular minority status was used to leverage political power in substantive policies against the majority with the courts enthusiastic endorsement.

Oh absolutely, combined with an alien process of secularization and mass immigration that started in the 1960s. If you told the Founders that voluntary prayer would be banned in public schools, Patrick Henry would be outraged that there were public schools. The rest would be heating up the tar.

But if that were strictly the case, there would be a much wider variety of ethnicities involved in this prosecution and a smaller proportion of smaller minorities. I think this was done for many of the same reasons that Al-Qaeda found mainly middle-class Saudis to carry out 9/11.

I was thinking they were probably about as well educated as the kids we graduate from school today. They might have known Andy Jackson was a President and fluck all else about him.

Plus it's not like back then they would have emphasized how 'evil' Andy Jackson was, because back society didn't have our special view of judging people of their time based on standards we'd have in the 20th century, like we do.

Andy Jackson wasn't an evil demon yet, when I was a kid, but he was a President. And bein a President is a powerful thing to an uneducated collection of people who value powerful things.

650 606, Part of Andrew Jackson's reaction to the Trail of Tears and Georgia's actions was that the federal government did not live up to its deal when Georgia ceded its western reaches (Alabama and Mississippi).

Thus, he had little sympathy for John Marshall as the court refused repeatedly to enforce the federal compact which in itself is a dereliction of duty.

The federal government agreed to remove Native Americans from Georgia proper (what wasn't ceded to the feds) in the Compact of 1802 which was designed to address the fraud from the Yazoo land scandal in 1795. This is why Georgia acted the way that it did because they believed that the state already had valid title to the Cherokee and Creek lands by way of the cession. The bad blood between the Indian tribes was also due to pro-British activities done by Native Americans in the South, mostly Creek but some Cherokee against white settlers.

History mainly focuses on the removal, not the whole story.

Hell, depending on jurisdiction, such statements won't even be considered as part of the record on appeal for evaluation of the propriety of denial of new trial.

Discretionary ruling, baby!

This is all an attempt to goad Trump into pardoning Stone now so that it can be made a campaign issue.

Also, I do so adore the oh people might harass the jurors! Look. I've said loudly for years that people who make actual threats, not DIAF mouthing off but actual threats, need to be prosecuted because that is just not right. But if a juror makes a public statement, either prior or subsequent to jury service, that is relevant thereto, the public has every right to respond. That includes Trump and Tucker and Alex Jones.

It's nice to know my view of the judiciary can get lower though.

Probably comes from small landowners in the South who were of Welsh descent, and who's family slaves adopted the name.

I think I remember reading that even a lot of guys who had that name from before started going by their middle names, or a nickname, or whatever.

I'm kind of surprised that Adolph's Meat Tenderizer was never renamed.

716 626, trev006, I agree for the most part. Locke, for example, argues that an overwhelming sense of "justice" can often cause "injustices" in the service of the cause because no one can be a "judge" in a case where they are an advocate. That is where lawless Judge Amy disagrees, in her value system, the righteous justice of opposing the Orange Man and by direct statement, his followers, trumps any trivial injustices that might be rendered to a defendant in her court.

That right there is critical legal studies stuff talking right there. We have to commit injustice to individuals to achieve "social" justice.

Posted by: DamnedYankee at February 25, 2020 04:45 PM (e284m)

We forget now how *different* things looked to people in the past, even to slave. Washington and Jackson were FEDERAL Presidents, who embodied the power and authority of the FEDERAL government, and it was the FEDERAL government which had just defeated the Confederacy and freed all of the slaves. No one cared about their personal proclivities, they weren't SJW ninnies like today. They were picked because they were powerful Images and Names which represented Federal Power.

Posted by: Tom Servo at February 25, 2020 04:52 PM (Kpl3J)

732 668, Andrew Jackson was the real McCoy. In an 1835 assassination attempt, the assassin's two guns both misfired (which is almost impossible) and and elderly Jackson thrashed him with his walking
cane.

740 "Judge" Amy Jackson is just jacking Roger Stone around. She is just making him jump through hoops, going through an expensive and time consuming appeals process, which will get him a retrial, and he can do the exercise all over again. What a crock of shit poop!
Let's get this over with and done. Roger Stone challenges the witch to a duel with 1911A1 pistols, full magazines, one in the pipe, at 10 paces. Regardless of outcome, it will be over and done.

742 "She's making it extremely easy for Trump to pardon Roger Stone."

That's by design, Ace. Pardoning Stone is the goal--an Impeachment charge.

Weissman sent Russian Gennadiy Vasilievich Vostretsov to Stone about a dozen times with the promise of Hillary Dirt. It was just another set-up though Stone didn't bite. But they did get him for a process crime with no underlying crime. So Weissman used him as human bait for an Obstruction Trap.

When that failed, Judge Amy Shumer-Jermaine is using Stone for another Schiff Show. These vicious swine must be stopped by the Chief Justice, the AG or impeachment. But President Trump is almost the only leader with integrity this nation has.

748 She cannot argue that Stone's lawyers were at fault for not researching the jurors, without implying that the defendant suffered from ineffective assistance of counsel. That alone would be solid grounds for a new trial. She has put her ruling in a pickle, she will be tagged out somewhere between first and second.

Moreover, the judge seems not to be considering and weighing the evidence, she seems to be arguing the evidence. She is certainly going to rule against the motion. To prepare the opinion, she will have to torture the facts, logic, the rules of evidence, and the case law regarding jury misconduct to dismiss against the overwhelming evidence.

She is setting Stone's defense up for an epic appeal of biblical proportions. She will be reversed, the case will be remanded, the appellate opinion will take her to task for her handling of the case, and the Chief Judge will be required to step in and select a new judge to retry the case. At the point, the Justice Department should just drop the case entirely. Or let Stone cop to lying to Congress and recommend no jail time.

I guaranty you that if she conducted the entire trial, when conservative media wasn't paying attention, the way she has conducted herself over the last two weeks, this case was already ripe and running over with reversible error. I'd look closely at not only the evidentiary rulings and the rulings on jury instructions, but also at her gag orders and her conducting hearings in secrecy.

I believe that the Attorney General must instruct the prosecutors to move to set aside the verdict and for a new trial. The Justice Department should not be dragged through the appeals process on a case which it cannot reasonably and ethically defend.

Berman needs to resign from the bench and all the Mueller team member need to be unceremoniously terminated, forced to retire or reassigned to the US Attorney's Office for District of Nebraska. (Sorry, Omaha.)
