1. Former Democrat Presidential Candidate and Former CNN Permanent Guest Michael Avenatti Found Guilty on Three Counts of Extortion
2. Barr Appoints Independent Counsel to Review Flynn Case

Avenatti:

Here's the first bullet point from CNBC about Avenatti -- it's about Avenatti.

Disgraced lawyer Michael Avenatti was convicted of all three charges related to his efforts to extort up to $25 million from athletic apparel giant Nike.

Here are the second two bullet points from CNBC about Avenatti -- they're about, get this, Trump,

The verdict in Manhattan federal court came two years after Avenatti gained widespread notoriety for his representation of porn star Stormy Daniels in her legal disputes with President Donald Trump.

Trump’s then-lawyer Michael Cohen paid Daniels hush money to keep her quiet about claims of an affair with the president on the eve of the 2016 election.

Hey CNBC, if you're providing background information about him, how about mentioning he was a fixture on Liberal Democrat Propaganda Organs and was seriously touted as a possible president by liberal Democrat media types?

Update: Has anyone done a Wellness Check on Avenatti Super-Fan and Guest of the Qatari Government Rick Wilson?

A new outside prosecutor will review the handling of the Michael Flynn case.

Excellent.

The Department of Justice has tapped an outside prosecutor to review the case of former National Security Adviser Michael Flynn, Fox News has learned.

A senior Justice Department official told Fox News on Friday that Jeff Jensen, the U.S. Attorney for the Eastern District of Missouri, has been assigned to Flynn’s case.

Jensen will be working hand-in-hand with the lead prosecutor of Flynn case, Brandon Van Grack, according to the official.

You will once again notice the blatant double standards as people who are constantly urging every possible outside investigation of Trump suddenly start claiming that investigations are inherently corrupt and anti-American when the targets are the sources of their leaks.

Via bonginoreport.com -- which is a less c***s***ery version of the Drudge Report -- this story from The Federalist.

Short version: the fact that the government reversed its previous no-time plea agreement, then insisted on jail time, and only later re-reversed themselves and went back to the original plea creates a legal right for Flynn to withdraw his guilty plea, without the usual burdens and requirements attached to withdrawing a plea.

The government originally recommended probation for Flynn a year ago. Recently, however, the government reversed course and recommended a jail sentence but soon reverted back to its original position. Flynn’s counsel has now filed two separate motions seeking to withdraw his guilty plea. One is based on his former lawyers having a conflict of interest in his case. The other is on the ground that the government breached his plea agreement by changing its sentencing recommendation.

The withdrawal of a guilty plea in federal court is a difficult legal maneuver in a simple case, which this case surely is not. Withdrawing a plea is only possible with the approval of the judge...

How the Santobello Rule Affects Flynn's Case

Plea agreements function like written contracts in criminal cases, and the courts enforce them. Where the terms of a plea agreement are ambiguous or uncertain, they are interpreted against the government because of the unequal bargaining power between the two parties.

In 1971, the Supreme Court decided in Santobello v. New York that if the government breaches a plea agreement, a defendant can ask to withdraw his guilty plea without having to satisfy the other factors that normally apply to a request to withdraw it.

Anyone trying to defraud Nike starts with at least a bit of a default moral advantage. Kind of like sizing up the various extremely unsavory groups of savage nut-bags in Syria whom we can use to further our own objectives, temporarily. Avenatti clearly was not nearly smart enough to be useful in this sense.

But I cannot celebrate the verdict, given the target of his fraud.

Nope, after all the trials are done, Avenatti is looking at Life in federal prison, and I am not kidding one bit. Don't know what the sentence for this Nike idiocy will be, but this was just the warmup trial. He still has to go to trial for stealking all of Stormy Daniels money (HA!) and then the BIG ONE: In May, he goes on trial in Los Angeles for intentionally defrauding the IRS for over $1,000,000 and for stealing several times that amount from several of his clients, including a paraplegic. Whatever sentence Avenatti gets out of the Nike idiocy, he is gonna get 20 - 40 years tacked on after the LA Trial.

Now that the first conviction is in, I put him at a moderate Suicide risk. After LA is over, I put him at very high.

Nunes has been out there the last couple days telling us to stay tuned for tables turning on the Mueller lawyers in the next two weeks. This would suggest to me that the prosecuting team on the Flynn case might have other concerns, requiring a replacement.

85 I wonder if Flynn knows that this independent counsel is there to reinstate him serving prison time, much, much more prison time. The extra is for trying to withdraw his plea deal. Doesn't he know that's not allowed unless you're a Democrat in good standing with the Deep State?

Posted by: csmats at February 14, 2020 03:44 PM (X5VFN)

86 Avenetti was just a con man who kept the con going and suddenly hit the very, very big time with his Anti-Trump stuff at exactly the right moment. Like most con men, he has zero pity or remorse, and no empathy whatsoever with marks. They're just a way to make money.

Posted by: Christopher R Taylor at February 14, 2020 03:44 PM (KZzsI)

88 "80 I'm sure I'm missing something but why would the independent prosecutor reviewing the Flynn case be working with the guy who already prosecuted the Flynn case?
I'm having trouble seeing the logic in that."

So he didn't accidentally report something critical?

Posted by: Trump poisoned my cat at February 14, 2020 03:45 PM (puu6v)

89 Yeah, in the weeds detail and I won't bother my friend who knows to find out, but I'd think you'd bring in an outside set of eyes to just review the previous work, period. I wouldn't "work with" the object of my outside review other than to get all the info up front, like all in-house investigators do - maybe work more closely later, to clarify/question decisions etc. Meh, maybe that's the reality here.

Posted by: rhomboid at February 14, 2020 03:45 PM (El6T/)

90 I don't feel sorry for Avenatti's clients in the least no matter what he did to them. Not saying I mind him getting squashed like a bug for any of that misconduct, but his clients deserve the terrible things he did to them for hiring him. It's not like this guy's sleaziness and corruption weren't obvious.

Because it was a slam dunk of a case. avenatti extorted Nike. Nike asked him to repeat his demands the next day with the Feds recording it. avenatti repeated his demands and was thus caught on tape.

Important safety tip: when extorting someone, if they ask you to reiterate your demands and to speak into their flower lapel, don't.

Kavanaugh owes his seat to Avenatti's stupidity.

155 Avenatti has been so incredibly arrogant that it is great fun to watch him fall; and it is very rare for a man to act so Big and fail so spectacularly, due to his arrogance. It's already been said that the Nike case happened fast because Avenatti gave a full confession to everything he had done on the phone with 2 FBI Agents LISTENING in real time!!!!

and what makes the LA Trial so delicious, and also shows that this takedown has actually been in the works for a long time; Avenatti, as has been pointed out, owned that west coast coffee company which he used to launder all of the money he was stealing. He was a tyrant to his employees, threatening them and yelling at them whenever he showed up. One quiet girl working in his office got so disturbed that she thought he might harm her, so she contacted the Feds quietly. They made a deal with her - she kept very quiet, stayed completely obedient, and then she took a photo of every financial document that went through Avenatti's office for a full year and sent it straight to the Feds.

That's why the tax fraud and embezzlement charges are such a slam dunk, the Feds don't need any discovery; they have every single financial document he's ever made.

If there's a lesson here, it's Don't Piss Off your Office Help.

168 Avenatti has been so incredibly arrogant that it is great fun to watch him fall; and it is very rare for a man to act so Big and fail so spectacularly, due to his arrogance.

And if the human Umpire gets it wrong, then a robot arm shoots up out of the ground and punches him in the nuts. Also, same thing on the pitcher's mound if he beans a batter, although that one will be delayed, and the button activating it will be given to the player he beaned, to use at any time of his choosing.

See now stuff like that would make the game fun again!

We don't care that they got the ball down the middle call right, it's the stuff on the outside corner that he called a strike two innings ago but won't call a strike now that pisses us off.

It's a vagary of the game and I don't usually get worked up about it unless its a bad ump. A blown call doesn't bother me much - it's a marathon game in a marathon season and misses are going to happen unless we replace everyone including players with robots, in which case there's no point.

I do dislike the bad umps who are always inconsistent or playing favorites, though.

231 Sorry but ixnay on just about every counter-factual re You Know Who and WWII. He was way out of his league, of course, but nobody could have made his idiotic "strategy" work once the high-risk bets failed to pay out. The UK didn't fold. Beginning of end of story.

German industrial/economic planning and everything else was premised on defeating/getting a deal with the UK, and when that failed, knocking the Soviets out, *prior* to full US entry.

Oops.

And Baku wasn't doable, with/without Stalingrad. No resources to secure/use that kind of position with flanks that long (all the way back to central Europe), even if they had made it to the Caspian.

As with Midway, Stalingrad and Kursk affected cost/course/duration of the festivities, not the outcome.

One might also point out that they had another leg up by distributing command and control lower than most of the other nations.

Which is one of the things that made Kursk and Stalingrad so head bangingly frustrating, I would imagine.

Yes, I am thinking that a new law must be passed permitting defendants in cases with a political angle to change venues -- by right, not by request -- to a location which does not have DC's or any other Democrat big city's unconstitutional level of bias in the jury pool.

You're not getting a "jury of your peers" when all the jurors see you as a member of an enemy tribe.

More controversially, we may need a rule allowing PROSECUTORS to change venues when the defendant might get a special benefit from a biased jury.

But that's tricky, because generally the rule is that if defendants have some unfair advantage, they get to keep it.

This times 100. But will never happen because MLB is convinced that it's the long ball that puts butts in the seats. And forcing pitchers to serve the ball up on a tee is what they are going to continue to do.

Myself, I'd rather watching a 1-0 pitcher's duel.

Yeah call the high strike again. I know its confusing and upsetting when bender comes in at your eyes and ends up at your chest but that's technically a strike. Umps almost never call it and that cripples pitchers.

I agree with Ted Williams that if you hear a stadium roaring its almost never because the pitcher is doing well but still, its good baseball. 8000 home runs a season is not.

333 More controversially, we may need a rule allowing PROSECUTORS to change venues when the defendant might get a special benefit from a biased jury.

Perfect games end up being something like 2.25 hours instead of 3+.

Either embrace the longball and the long games that are part of it, or end the longball and get shorter games.

339 277, Generally jurisdiction is where the alleged offense occurs. However, a federal DA can be tasked to try a case in another jurisdiction via the AG or probably the ADAG.

What has to happen is that the alleged offenses occurred in some way outside of DC. There is also a set of jurisdictional laws covering offenses that occur outside of the US like the Foreign Corrupt Practices Act. Don't remember off hand if the jurisdiction that tries the case is specified or not in the bill or if there is some general legislation when such occurs. I do know that KSM was to be tried in the SD of New York for 9/11 even though he was captured overseas when Holder wanted to bring him here for trial.

381 It makes no sense that he would be working hand in hand with van Grack to review the case where van Grack was one of the lead attorneys.

I suppose it depends on what they mean by hand in hand. They necessarily have to work "together" to some degree to review the case and go over the information. That doesn't mean they are hot tubbing together, though.

Jeeps and trucks -- we cranked those out and those were great.

But we chose a plan for a tank that could be built using car manufacturers' assembly lines mostly unchanged. We pumped out thousands of barely-armored tanks with insufficient guns which could not breach German Panzer's armor. And then there is the airpower component where it gets ridiculous and there was a qualitative edge for the Allies in every category.

The Sovs had focused on building nothing but heavy industry for the previous 15 years or so. Combine that with a bloodthirsty willingness to dedicate every last bit of that industry to building tanks and fuck the needs of the population...

508 American tanks were, definitely, inferior to German ones early on (like the Grant). Lighter armor, slower, smaller guns, odd design flaws.

They got better over time, of course. The later tanks were never as great as the top of the line German ones, but they had so few of the really good ones it didn't matter. And of course the Russian tanks were even better...

I love how that happened. Germany before WW2 had secret factories in Russia building munitions, because they weren't supposed to make weapons under the Versailles Treaty. After a while, the Germans yanked their operations from Russia and put them in Germany but not before the Russians, carefully studying German engineering and techniques, had learned a great deal

514 ace it's true, German forces weren't very mechanized (and their armor, early on, was crap). Italy? Meh, their only land campaigns were farcical (Albania, Yugoslavia) and odd (North Africa).

Russia benefited greatly from US trucks starting in 1943 (many were shipped in pieces to Iran, assembled there, and driven north).

Hitler as well as everyone else recognized that a "long" war - one of attrition, where Germany faced the combined industrial might of US/UK/USSR, was likely hopeless - hence the attempt to 1) get the UK out of the war quickly via defeat or deal 2) knock the Soviets out of the war quickly, before full US involvement, which was sensibly seen as inevitable.

Oops. Neither strategery was realized.

Posted by: ace

Germany had a much smaller percentage of armored units compared to their entire army's strength than the other major combatants, including Italy and Russia.

Britain had the highest percentage of armored units.

The Germans excelled at small and medium unit tactics and had officers and non-coms exercising much more creativity and personal initiative than any of the other armies in the field.

And of course they were ruthless in pursuing annihilation of their enemies when given a chance.

Which is why they lost 5 million soldiers dead and managed to kill about 15 million enemy soldiers.

523 Another issue the Germans had beyond just resources- Hitler refused to just fricking decide on a tank design and stick with it. We modularized by upgrading the gun, changing the ammo, but sticking with a design that worked well enough. He wanted a brand new tank design every year to try to stay ahead of everyone else. That meant you could never settle down and refine manufacturing techniques, build spare parts, etc.

In addition to being a flaming nutbar, he was also kind of stupid in a lot of respects.

535 Just finishing up (finally) Wages of Destruction/Tooze, about the Nazi economy, from '33 to Gotterdammerung.

Lots of good purely economic/financial stuff, but once the shooting starts, also a good angle on Germany's hopeless resource/industrial inferiority.

No shock, but the leadership was really piss poor - they lurched from one gimmick or over-blown innovation to another, as the vice closed in. None of the "Wunderwaffen" - which were, technically, wondrous - ever had a chance of changing the outcome, even if they had been introduced/produced more effectively.

The fundamentals. As in sports, the key. But the leadership knew/acknowledged this, sometimes implicitly, from 1939 onwards, it wasn't a shock or unknown to them.

Posted by: Sebastian Melmoth at February 14, 2020 04:38 PM (Uytaa)

Sloped armor is the tits. Unless you have to actually fight from within the vehicle. Sloped armor means a cramped interior that is difficult to move around in.

By the way, speaking of myths, look at the front glacis of a Sherman.

Sloped. Armor.

In fact, the frontal armor of a Sherman (when you take the slope into account) was almost as heavy as the frontal armor of a Tiger. Seriously.

I love how the Sherman looks, its one of the most attractive tank designs ever. But the slope of the Sherman's front isn't that significant, its more curved.

We didn't just sent trucks, we sent the whole works - planes, guns, tanks, etc. Russia would have imploded if we hadn't propped them up. Kinda wish we didn't. Would have meant a longer slog without an Eastern Front, but also no post-war Soviet Bloc or betrayal of Poland.

Without an Eastern Front? There were one whole hell of a lot of men (one Germany's side) tied up there. IIRC something like 200 some odd divisions. If even a substatial proportion of those are available before we make the Normandy landings?

That is kind of a gruesome prospect. Still, nukes on the way.

Posted by: Aetius451AD Work Laptop at February 14, 2020 04:52 PM (cAKts)

552 Nooded/willowed, but -

Actually most of the advanced models (subs, tanks) were rushed into production, which accounted for the service/maintenance problems (with the subs, basically prevented them from ever becoming a player at all).

Panthers had lots of teething problems, were rushed in time for Kursk. Oops. Lots of problems.

And no Cato, Soviets likely would not have collapsed without Lend-Lease. They had the chance to collapse in '41 and spring of '42, before our aid was material to their operations. And you greatly under-state, to the point of simply being wrong, the impact of no eastern front. Up to 80% of German losses/resources were expended on that front. Without it, hard to exaggerate how much worse the west could have been.

553 Ace, some Operation Barbarossa German Army Order of Battle info for you, showing how much the Army depended on horse-drawn artillery, artillery ammo wagons, field-kitchens, and general supply wagons (the troops walked, yes walked, everywhere the division went, unless they could be moved by rail):

Infantry Divsion: ~5,300 horses, ~950 motor vehicles, 14 armored personnel carriers (APC), 3 armored cars, ~450 motorcycles.

Motorized Infantry Division: 0 horses, ~2050 motor vehicles, 105 APCs, 26 armored cars, ~1300 motorcycles.

Panzer Division: 0 horses, 110 APCs, 162 tanks, 68 armored cars, ~1300 motorcycles.

For the attack on Russia, the Wehrmacht deployed
120 infantry divisions,
14 motorized infantry divisions and
19 tank divisions
with a total of 3,680 tanks and 2.5 million men.

And, using the horse per division number above, 636,000 horses.

557 Van Grack will not be working hand in glove with Jensen. Van Grack is being shoved aside.

He is one of the "honest, hard-working 99%" at the Justice Department. He has tortured Michael Flynn in the most punctiliously legalistic fashion. He has forced Flynn to cop to a crime that the FBI itself (in the persons of Strzok and Pientka) did believe he had committed. He pressured Flynn to testify against his former partner, Bijan Rafiekian. Flynn claims he was asked to perjure himself, to lie to a federal court. Van Grack and his team have ruined Flynn financially. They have destroyed his reputation. Van Grack has repeatedly withheld exculpatory evidence and evidence regarding witness credibility. Powell asserts that he is withholding such evidence to this day. He still has not turned over the original 302s from Strzok's and Pientka's interview of Flynn. Powell asserts that those have been altered.
