The verdict in Manhattan federal court came two years after Avenatti gained widespread notoriety for his representation of porn star Stormy Daniels in her legal disputes with President Donald Trump.


Trump’s then-lawyer Michael Cohen paid Daniels hush money to keep her quiet about claims of an affair with the president on the eve of the 2016 election.

A new outside prosecutor will review the handling of the Michael Flynn case.

The Department of Justice has tapped an outside prosecutor to review the case of former National Security Adviser Michael Flynn, Fox News has learned.

A senior Justice Department official told Fox News on Friday that Jeff Jensen, the U.S. Attorney for the Eastern District of Missouri, has been assigned to Flynn’s case.


Jensen will be working hand-in-hand with the lead prosecutor of Flynn case, Brandon Van Grack, according to the official.

You will once again notice the blatant double standards as people who are constantly urging every possible outside investigation of Trump suddenly start claiming that investigations are inherently corrupt and anti-American when the targets are the sources of their leaks.

Via bonginoreport.com -- which is a less c***s***ery version of the Drudge Report -- this story from The Federalist.

Short version: the fact that the government reversed its previous no-time plea agreement, then insisted on jail time, and only later re-reversed themselves and went back to the original plea creates a legal right for Flynn to withdraw his guilty plea, without the usual burdens and requirements attached to withdrawing a plea.

The government originally recommended probation for Flynn a year ago. Recently, however, the government reversed course and recommended a jail sentence but soon reverted back to its original position. Flynn’s counsel has now filed two separate motions seeking to withdraw his guilty plea. One is based on his former lawyers having a conflict of interest in his case. The other is on the ground that the government breached his plea agreement by changing its sentencing recommendation.

The withdrawal of a guilty plea in federal court is a difficult legal maneuver in a simple case, which this case surely is not. Withdrawing a plea is only possible with the approval of the judge...

How the Santobello Rule Affects Flynn's Case

Plea agreements function like written contracts in criminal cases, and the courts enforce them. Where the terms of a plea agreement are ambiguous or uncertain, they are interpreted against the government because of the unequal bargaining power between the two parties.


In 1971, the Supreme Court decided in Santobello v. New York that if the government breaches a plea agreement, a defendant can ask to withdraw his guilty plea without having to satisfy the other factors that normally apply to a request to withdraw it.

Investigation of a couple of Officers misconduct was kicked to an IG, who took so long to report on it everyone was transferred out by the time the report came.

Nope, after all the trials are done, Avenatti is looking at Life in federal prison, and I am not kidding one bit. Don't know what the sentence for this Nike idiocy will be, but this was just the warmup trial. He still has to go to trial for stealking all of Stormy Daniels money (HA!) and then the BIG ONE: In May, he goes on trial in Los Angeles for intentionally defrauding the IRS for over $1,000,000 and for stealing several times that amount from several of his clients, including a paraplegic. Whatever sentence Avenatti gets out of the Nike idiocy, he is gonna get 20 - 40 years tacked on after the LA Trial.

Now that the first conviction is in, I put him at a moderate Suicide risk. After LA is over, I put him at very high.

A guy I know wants to see two umpires watching the plate via cameras. One sees a top view, the other sees a side view. They each have a Jeopardy style button. Top view guy clicks if the ball is over the plate. Side view guy clicks if the ball is above the knees and below the (armpits? belt? - I vote armpits). If both clicked, it is a strike.

Yeah that would help, so would reducing the number of calls you can challenge with video replay (in my opinion, only game-ending and playoff calls should use that). And limit the time they can take. Its minutes before you get an answer in those while everyone stands around looking stupid.

They can run ads up in the corner like they do with soccer games if they must run one.

It's a vagary of the game and I don't usually get worked up about it unless its a bad ump. A blown call doesn't bother me much - it's a marathon game in a marathon season and misses are going to happen unless we replace everyone including players with robots, in which case there's no point.

I do dislike the bad umps who are always inconsistent or playing favorites, though.

Yes, I am thinking that a new law must be passed permitting defendants in cases with a political angle to change venues -- by right, not by request -- to a location which does not have DC's or any other Democrat big city's unconstitutional level of bias in the jury pool.

You're not getting a "jury of your peers" when all the jurors see you as a member of an enemy tribe.

More controversially, we may need a rule allowing PROSECUTORS to change venues when the defendant might get a special benefit from a biased jury.

But that's tricky, because generally the rule is that if defendants have some unfair advantage, they get to keep it.

They got better over time, of course. The later tanks were never as great as the top of the line German ones, but they had so few of the really good ones it didn't matter. And of course the Russian tanks were even better...

I love how that happened. Germany before WW2 had secret factories in Russia building munitions, because they weren't supposed to make weapons under the Versailles Treaty. After a while, the Germans yanked their operations from Russia and put them in Germany but not before the Russians, carefully studying German engineering and techniques, had learned a great deal

514 ace it's true, German forces weren't very mechanized (and their armor, early on, was crap). Italy? Meh, their only land campaigns were farcical (Albania, Yugoslavia) and odd (North Africa).

Russia benefited greatly from US trucks starting in 1943 (many were shipped in pieces to Iran, assembled there, and driven north).

Hitler as well as everyone else recognized that a "long" war - one of attrition, where Germany faced the combined industrial might of US/UK/USSR, was likely hopeless - hence the attempt to 1) get the UK out of the war quickly via defeat or deal 2) knock the Soviets out of the war quickly, before full US involvement, which was sensibly seen as inevitable.

Germany had a much smaller percentage of armored units compared to their entire army's strength than the other major combatants, including Italy and Russia.

Britain had the highest percentage of armored units.

The Germans excelled at small and medium unit tactics and had officers and non-coms exercising much more creativity and personal initiative than any of the other armies in the field.

And of course they were ruthless in pursuing annihilation of their enemies when given a chance.

Which is why they lost 5 million soldiers dead and managed to kill about 15 million enemy soldiers.

We modularized by upgrading the gun, changing the ammo, but sticking with a design that worked well enough. He wanted a brand new tank design every year to try to stay ahead of everyone else. That meant you could never settle down and refine manufacturing techniques, build spare parts, etc.

His talks are great. His explanation of how logistics played a big role in the design is excellent. Plus, being a tanker meant you were pretty safe based on the deaths and wounds.

535 Just finishing up (finally) Wages of Destruction/Tooze, about the Nazi economy, from '33 to Gotterdammerung.

Lots of good purely economic/financial stuff, but once the shooting starts, also a good angle on Germany's hopeless resource/industrial inferiority.

No shock, but the leadership was really piss poor - they lurched from one gimmick or over-blown innovation to another, as the vice closed in. None of the "Wunderwaffen" - which were, technically, wondrous - ever had a chance of changing the outcome, even if they had been introduced/produced more effectively.

The fundamentals. As in sports, the key. But the leadership knew/acknowledged this, sometimes implicitly, from 1939 onwards, it wasn't a shock or unknown to them.

Sloped armor is the tits. Unless you have to actually fight from within the vehicle. Sloped armor means a cramped interior that is difficult to move around in.

By the way, speaking of myths, look at the front glacis of a Sherman.

Sloped. Armor.

In fact, the frontal armor of a Sherman (when you take the slope into account) was almost as heavy as the frontal armor of a Tiger. Seriously.

We didn't just sent trucks, we sent the whole works - planes, guns, tanks, etc. Russia would have imploded if we hadn't propped them up. Kinda wish we didn't. Would have meant a longer slog without an Eastern Front, but also no post-war Soviet Bloc or betrayal of Poland.

Without an Eastern Front? There were one whole hell of a lot of men (one Germany's side) tied up there. IIRC something like 200 some odd divisions. If even a substatial proportion of those are available before we make the Normandy landings?

That is kind of a gruesome prospect. Still, nukes on the way.

Actually most of the advanced models (subs, tanks) were rushed into production, which accounted for the service/maintenance problems (with the subs, basically prevented them from ever becoming a player at all).

Panthers had lots of teething problems, were rushed in time for Kursk. Oops. Lots of problems.

And no Cato, Soviets likely would not have collapsed without Lend-Lease. They had the chance to collapse in '41 and spring of '42, before our aid was material to their operations. And you greatly under-state, to the point of simply being wrong, the impact of no eastern front. Up to 80% of German losses/resources were expended on that front. Without it, hard to exaggerate how much worse the west could have been.

553 Ace, some Operation Barbarossa German Army Order of Battle info for you, showing how much the Army depended on horse-drawn artillery, artillery ammo wagons, field-kitchens, and general supply wagons (the troops walked, yes walked, everywhere the division went, unless they could be moved by rail):

Infantry Divsion: ~5,300 horses, ~950 motor vehicles, 14 armored personnel carriers (APC), 3 armored cars, ~450 motorcycles.

Motorized Infantry Division: 0 horses, ~2050 motor vehicles, 105 APCs, 26 armored cars, ~1300 motorcycles.

Panzer Division: 0 horses, 110 APCs, 162 tanks, 68 armored cars, ~1300 motorcycles.

For the attack on Russia, the Wehrmacht deployed
120 infantry divisions,
14 motorized infantry divisions and
19 tank divisions
with a total of 3,680 tanks and 2.5 million men.

And, using the horse per division number above, 636,000 horses.
