Prosecutors Set to Demand Seven to Nine Years in Prison For Roger Stone's Process Crimes;
DOJ Steps In

The lawyers who have picked up the torch from Mueller wanted seven to nine years incarceration for Roger Stone, while Comey and McCabe remain not even charged with a crime.

The DOJ has finally stepped in.

The Department of Justice is preparing to change its sentencing recommendation for Roger Stone after top brass were "shocked" at the stiff prison term initially being sought, according to a senior DOJ official.

“The Department was shocked to see the sentencing recommendation in the filing in the stone case last night,” the official told Fox News. “The sentencing recommendation was not what had been briefed to the Department.”

In documents filed on Monday evening, prosecutors from the U.S. Attorney’s Office in Washington recommended Stone serve 87 to 108 months after being convicted of lying to Congress and witness tampering. The department is now expected to scale that back.

“The Department finds seven to nine years extreme, excessive and grossly disproportionate to Mr. Stone’s offenses,” the source told Fox News, adding that the DOJ will clarify its position on sentencing later Tuesday.

Meanwhile, the judge in the Flynn case has postponed the sentencing hearing indefinitely because the prosecutors asked for extensions to their deadlines to respond to Flynn's filings.


The move by Judge Emmet Sullivan comes a day after federal prosecutors filed a rare Sunday motion to delay a number of approaching deadlines that would ultimately make Flynn’s Feb. 27 sentencing unlikely. The delay also comes weeks after Flynn withdrew his guilty plea.

In their filing, prosecutors argued that Flynn’s former attorneys should testify after he claimed to have received ineffective assistance from them. Flynn had previously hired the premier D.C. law firm, Covington & Burling. Federal lawyers also asked the judge to order that Flynn has his attorney-client privileges in his communications with Covington & Burling waived.

1. who found (as a legal term) that he lied
2. who (I don't know what the next step is) filed charges of lying to Congress
3. (again don't know next step) took it up as a matter for the courts (exactly which courts?)
4. actually brought the charges forward in a trial

Then explain where this has stopped in the legal process of finding that say Comey lied to Congress.

As far as I can tell, both of them are blowhards who have spent their careers talking shit about everything they've ever been involved with, and who no court should ever have believed on anything. The claim, per my understanding, is that Trump told Manafort to ask a subordinate to go to Stone to get the Wikileaks E-Mails from the DNC to use it for the campaign.

The problem is that:
1) The E-Mails were already public. The press claims that this was an attempt to front-run the document dump, but the dates don't line up.
2) It's patently insane. Why would Trump ask a guy to ask a guy to ask another guy to get information from another guy? It's laughable, especially in a small campaign with a lot of a delegation of powers.

The very first thing that a student learns upon entering law school is (and always remember this):

For every argument, there is a counter-argument. It need not have merit, it need not be logical, it may be fallacious, founded in untruth and intentional misrepresentation, but it must be made.

I have some number of friends who are lawyers. They all share one quality, at the drop of a hat, they will shift into lawyer mode. Even in the most casual of conversations. I have to remind them that they are making a lawyer's argument, rather having a discussion.

The problem for an institutionalist like Barr is how do you unscramble the omelet composed of bad eggs and good eggs? I think that Barr's approach is simply to wait them out, moving personnel around, and tidying up the crime scene.

An institutionalist believes that the institutions like the FBI and DOJ are basically good but with merely some bad people that need to be removed from power.

Thus, the risks to an institutionalist of widespread overturning of convictions and prosecutions due to airing FBI and DOJ due to misconduct is not worth that risk. My guess is that Trump replaces Barr and Wray after the elections in 2020 if he wins depending on control of the Senate. Right now, the corrupt folks in the Senate are more or less keeping fixing the problem at bay--see Chairman of Senate Judiciary Lindsay for example.

Prosecution laid out a good case, Avenatti demanded that the Judge strictly limit the content of any questions asked of him on the stand - Judge refused. So Avenatti has refused to testify at all in his own defense. (a defendant always has the right to choose that, although it is usually a bad move) Closing arguments should come today. I don't think it looks good for Avenatti.

472 438 rhomboid, I think that Barr is hiding massive misconduct by the FBI and DOJ using NSA intercepts as predicates to opening investigations. I base this on things like the abuse of Stinger cell phone intercepts and the merging of CIA/FBI honeytrap assets for example.

We are going to have to reduce the FBI into a regular law enforcement agency and return foreign intelligence to the military only. Perhaps, we should also create a separate counterintelligence civilian agency with no criminal investigatory powers that would be required to go through the DOJ for referral for criminal prosecutions.

If the military was involved in misconduct of surveillance, the UCMJ offers an excellent way to remedy this situation as opposed to civil justice as attorneys, judges, and the jury can be required to have security clearances, closed sessions involving sensitive programs can be closed, etc.
