Carter Page Sues the DNC, Perkins-Coie, and Two Founders of Fusion GPS for Damages Suffered Due to False and Malicious Slanders Contained in the "Dossier"

Good:

"This is a first step to ensure that the full extent of the FISA abuse that has occurred during the last few years is exposed and remedied," attorney John Pierce said Thursday. "Defendants and those they worked with inside the federal government did not and will not succeed in making America a surveillance state."

He added: "This is only the first salvo. We will follow the evidence wherever it leads, no matter how high. ...The rule of law will prevail."

Page first filed a defamation suit on his own against the parties in October 2018 in federal court in Oklahoma, but that suit was dismissed in January 2019 after the judge ruled the court lacked jurisdiction over the case because neither Page nor the DNC had strong enough ties to the state.

I'm not sure why Page is suing from districts where he has to make an argument about jurisdiction -- is he just trying to avoid suing in hyperliberal DC? That is probably the problem here.

Meanwhile, Michael Flynn got some good news. The government had agreed, as part of his plea deal over a fake crime that never happened, to not seek jail time.

People usually don't get jail time when they've done nothing wrong.

But the prosecutors didn't like Flynn questioning their ethics, so they then sought up to six months in jail for him.

So Flynn moved to withdraw his plea deal.

The prosecutors have now backed down and are no longer seeking jail time, but just probation.

I kinda think he should withdraw the plea anyway.

The queen of conspiracies immediately jumped to, get this, insinuating a conspiracy theory:

Twitter just added a new reporting feature: you can now complain over a tweet which, in the estimation of the reader, "misrepresents a news story."

They added this to appease the Stasi Culture of the left.

Pisses me off that the Secret Services refused to accept service. Those guards are paid for by us, the taxpayers, to protect presidents and their families from threats of physical violence -- not to protect them from process servers when they've been out defaming other Americans.

Under English Common Law, that was a crime called "Barratry" and it's still looked down on. But it is legal under American law, even though I do not think it should be.
Still, it's quite dangerous. Quite a few people got involved in financing Donziger's environmental jihad against Chevron a few years back, and they all suffered catastrophic losses when it blew up in their faces. The famous and powerful Patton Boggs Law Firm in DC was virtually destroyed by this back in 2014. They still live on as Squire Patton Boggs, but all of the original partners at the time took huge losses and were run out of the firm.

What happens most often in Corporate cases these days is that the target says "ok I don't know what's responsive, so here's electronic copies of 8 million documents from the last 3 years, you can go through them and see if you find anything."

I think one of the big Apple patent cases involved the submission of over 50 Million Pages of documents. (which clearly is the perfect way to hide anything)

not arguing here but I want to learn more about it. I get a lot of people don't like Dersh based on OJ back in the mid 1990s. I am one of them. But how is he trying to save himself from late night comedians 25 years later? Isn't he mainly known for defending Trump against absurd lawfare? Again, this is not a courtroom. They haven't done but a tiny amount of very basic work to establish any rules. NONE of the regular rules for evidence, testimony, procedure, and how to handle witnesses is established for the Senate hearings. They're just making crap up as they go along. A Customs and Border Patrol agent says the sections had recently been set in concrete that hadn't yet cured. No one was hurt.

The agent says it's unclear how long it will take to fix the panels.

Sure, the fastball/breaking ball thing is huge, but you still gotta hit it. Yes, batters are incredible (and the Astros had an amazing team) but its still the hardest job in sports. Its helpful, but not to the extent people are building it up to. And again, even the pitcher doesn't know exactly where that ball is going or what's gonna happen when he lets go. People usually bring up some of Dersh's sketchy past clients to smear him with, but I always recall an old interview with Richard "Racehorse" Haynes, one of the most famous Texas trial lawyers a few years back. Racehorse said that the key to being a Big Name Lawyer was that you had to cultivate relationships with Rich People who Get In Trouble, over and over again.

And Racehorse was right - if you don't have big, notorious clients, you'll never be a big name lawyer, no matter what else you do.

Sure, the fastball/breaking ball thing is huge, but you still gotta hit it. Yes, batters are incredible (and the Astros had an amazing team) but its still the hardest job in sports. Its helpful, but not to the extent people are building it up to. And again, even the pitcher doesn't know exactly where that ball is going or what's gonna happen when he lets go. Even the best of the best screw up.

381 If the Astros earned that much animosity so quickly there must have been a reason. That alone was good reason to play it straight. I have not followed the game closely over the last many years, but I don't recall a lot of animosity towards the Astros over the decades.

They were the team that never made it to the Series for many decades. There must be a reason other than that they won one and are small market. I believe Houston is the fourth largest city in the nation.

I cannot fathom getting around on even a 85 mph fastball, let alone a 85+. Yet, a couple of people I know who played in the minors say that knowing what pitch is coming is a huge advantage.

Heck, the late AD for the U of M Gophers, Paul Giel, had a funny story, involving Bob Uecker, natch.

Giel told a story, years ago, about playing minor league ball against Bob Uecker. Giel said he went up to the plate, and Uecker said, "fastball coming."

Giel steps out, "Say what?"

Uecker: "I don't like this guy, fastball coming."

If memory serves, the first AB, it turned out Uecker wasn't kidding, and Giel says he want on to hit something like .700 that game.

So, yeah, knowing the pitch is a huge advantage for hitters, especially if the guy is having trouble getting off-speed over.

That's a part of it, but the biggest part is wearing out. Even the home run derby, the winner usually went on to have a pretty poor next half of the season after muscling like 60 balls out of the park in about an hour. It takes tremendous effort to hit a baseball 400 feet. You get tired, and break down.

Steroids make you heal faster so you can keep doing it longer and without as much down time.

But you still gotta hit that ball.

It is completely and totally routine for litigants to try to avoid service. It's nothing new. The rules are designed assuming people will do so.

Story time! Old Firm was in a state that required that service be completed by the sheriff of the county where the person being served resided. This was a way for the sheriff's office to get money because you had to pay the sheriff to do that.

Old Firm sued person. Paralegal looks up the person's address on the police report, checks the google machine to see what county the address is in, sends it to that county. Sheriff replies nope, not us. This was in a town where part of the town was in one county and part in another.

I get asked to follow up so I check with the USPS to see what county the USPS shows. USPS says county B. Off to that sheriff. Nope, not us.

Fine. Next step, check with the tax department for each county to see what county has the property listed because that should be solid proof for the sheriff.

At which point it was discovered that this address wasn't on either county tax listing.

Yeah, someone's parents had carved out a piece of property and deeded it over and somehow that got missed and the person had been living there for 20 odd years without paying any property taxes. They were not best pleased when this got brought to light.

I listened to his comments this weekend with Wallace. I listened to his arguments last night, defending the Constitution and trashing his colleagues as partisan hack for their desire to turn the U.S. into a parliamentary democracy, where POTUS serves at the pleasure of the Congress, under dems' proposed impeachment standard.
He was great. The arguments were solid, devastating, and well-delivered. He earned my respect.

I have no dog in that right (Cardinals fan). But catchers do not use multiple signs if no runners on base, especially if no one on second. With runners on base teams expect runners to try to steal signs and are okay with that, as that is not in violation of any written or even unwritten rules. But when you are using the CF camera either w/wo electric devices (which are explicitly against the rules then you are cheating.

As a coach I have beat a team - that otherwise thumped us twice later in that season - by stealing signs from the catcher (he failed to hide them). I have also been 10 runned by a team (using my number one pitcher) that was stealing signs (our fault as our catcher did not use multiple signs like he should have) that had never beat us, or that pitcher, before, nor since.

Hitting is timing. Pitching is disrupting timing. If you know it's a fastball vs offspeed, pitchers just lost any advantage they had.

My uncle was a trial attorney of statewide fame and dealt with a case publicized on Dateline as his final criminal case before he became a trial judge.

I have also known more than a few and they are essential to making the criminal justice system have the fairness that it does. A lot of criminal trial attorneys lean liberal but not left because they are used to fighting government misbehavior and they adamantly support constitutional rights for the accused.

I always liked that guy. I remember as a kid seeing him hit a grand slam one year and then another the next year. I didn't watch many games and that stood out to me. It might not be some special baseball record but I will always remember that.

Oh sure, and it was a lot bigger back then. You had to go on memory and guesswork. These days they have a sleeve with what pitchers do in various counts at each point in the game, what the stadium's effects on pitches, what kind of game that catcher calls, etc. The effect is greatly reduced these days because batters know so much more.

Granted a lot of them are dumb enough they don't take enough advantage of it, like how they won't change their stance slightly to take advantage of the shift, but still, the info is out there.

yep, and it happens on every level. For instance where I am, in East Texas, I can see this happening on the city and county level every day. Some people get probation, some people get jail, depending mostly on if they picked the right person to work the network.

I know of a man who was offered 2 years probation, wouldn't take it because he said he was innocent, and he ended up with 15 years in the state pen mainly because he pissed off his attorney who had negotiated it. So the attorney sandbagged his case when it went to trial, just out of spite. AND then he would slyly mention it to future clients, if they ever thought about not taking his advice. (one of which told me the tale)

Yeah, county and cities screw this up a lot - I got a notice from the city code inspector about 5 years ago that a piece of what they thought was my property was not being kept up - when I went to city hall to fight it, it turned out it was actually the city's property and I had been charged property taxes erroneously for the last 20 years on this small piece of "public" land...so, thanks for citing me and then having to reimburse me, City Dumbasses!

I met a group of folks from the Texas Bar Association at a conference and their presentation was over the (at the time) the bizarre results on the appointed counsel system for defendants.

Those that contributed to the local judge's reelection campaigns were given day long at the most DUI cases. Those that did not, were appointed to represent defendants in death penalty cases taking weeks for about $300 or so if my memory serves me.

We had a similar system in our state where one appointed public defender did over 750 pleas and only took one of his cases to trial. The guy made his money by getting volume instead of quality.
