Federal Judge Orders Rare "Snap" Hearing, Demanding That the Department of Justice Explain Why It Is Keeping Documents About Imran Awan Secret

Is Trump president or not?

Some of this shit, he needs to straighten out personally.

I know the Deep State subverts him. But ultimately, the president has all the power of the Deep State and then some. He can just step into any office and declare that he'll be making all the decisions for the next several hours.

And it's about time he started to do so.

An apparently frustrated federal judge ordered attorneys for the Department of Justice (DOJ) to appear Wednesday in a "snap" hearing to explain why the government is not producing documents sought by Judicial Watch concerning former Democratic information technology aide Imran Awan....

"In a hearing last month, U.S. District Court Judge Amit P. Mehta expressed frustration and ordered the Justice Department to explain its failure to produce records by January 10 and to provide Judicial Watch some details about the delay," Judicial Watch said in a statement Tuesday about the snap hearing.
"Instead, the Justice Department made its filing under seal and has yet to provide Judicial Watch with any details about its failure to produce records as promised to the court," Judicial Watch said.

LBJ, for example, had the benefit of a partisan Congress, but if he hadn't, he knew how to do this and would have.

Trump's initial AG pick ought to have been proof that he understood this truism, ought to have been his first eminence grise. Obviously, he was not.
He ought to have learned by now that his will alone is insufficient. He must impart that will to others and tell them to go hunting, and fire them if they don't bring him scalps.

59 Something I've always wondered about: How easy is it for someone to destroy without a trace evidence that's supposed to be handed over? How often does "the smoking gun" disappear? We always say "the internet is forever," but when you're the government and own all parts of the chain of electronic evidence, is there a way to make sure things get erased completely? How often does the DoJ stall so that they have time to wipe their servers?
Yes, I know that destruction of evidence is illegal, but when has that stopped the Deep State from doing whatever it wants?

For ten years they've abandoned The Second Amendment and I frankly fear any ruling they will make on it. All signals are they will restrict a citizens rights rather than protect them.

That last part is the fly in the ointment: getting a judge who'd do so.

But the Refugee Resettlement program was passed by Congress and the legal theory is that by allowing Governors to deny it happen in their states, the Executive branch is granting "veto" power of that provision of the law

I have no doubt that will be the argument, but its flawed in several places. First, states are supposed to control what happens within their borders as long as its exclusive to their states. Who lives there seems a pretty obvious example of this. Granted, that's been enormously eroded, but it is a constitutional principle right from the beginning.

Second, assuming the federal government has absolute control over immigration policy does not end the way the open borders advocates prefer.

172 141 The brilliance of the fuckwads who really run our country is that they Gulliver Trump with a million threads to tie him down while he's busy trying to break Iran, keep the Norks in line and give US workers better jobs. I've been waiting for him to kick ass with the bureaucrats (domestic enemies) the way he does with our foreign enemies for a long time. Instead we get Wray at FBI, toughguy Barr at Justice and a hundred different Obama judges legislating away. Trying to think of some snappy line that will make me feel better... working on it...

This would work. Take his Marine guard with him to make the point.

I wouldn't mind seeing him forcibly recess Congress after he is acquitted and making some sweeping recess changes - including the elimination of entire departments. He can take over for an hour or a day and move the ball, but so very many things need to be completely gutted if there's any hope of moving forward well. This obstructionist nonsense of the Senate never recessing needs to end.

Posted by: Christopher R Taylor

I love you morons, but sometimes you live up to the name.

CT, as for your points, #1 Plenty of things "within a state's borders" are controlled by the federal government. Where federal law preempts the field, a state can do nothing on its own even within its borders. See: Maritime or Bankruptcy Law.

#2 Congress makes laws, the executive executes those laws. If Congress says: "The States shall take a proportionate share of refugees," then boy howdy, there they go! What you are conflating is the executive's ability to set policy in foreign relations with Congress' plenary (absolute) authority to decide what the policy of the nation is with respect to federal matters. If Congress declares war, the President cannot immediately surrender and draft a peace treaty.

That is why Andrew Johnson was impeached, for specifically defying an Act of Congress passed over a veto.

With respect to this program, it is a question of delegation. If Congress in an enacted law (signed by a president, not necessarily this one) has apportioned refugees in certain areas, then the President cannot then go and re-allocate based on the wishes of some governors. It just doesn't work like that.

Mostly correct; BUT if the President, in implementing that law, states that he wants to include a Governor's wishes in how the law is implemented, then he is using his Federal Power to carry out Federal Legislation. AFAIK, the law in question did not do any apportionment, that was left completely up to the Executive Branch. Since there are no specific implementation guidelines, the Judiciary should defer to the Executive Branch, which has the authority to work with State Governors, if it chooses to do so.

306 Trump also said Flynn lied to the FBI in that tweet. Do we have other reason to believe that Pence was doing anything than giving cover to the administration? Because he seems to be pretty reliable in not backstabbing Trump, although he doesn't really do much either.

It's about power. They got the brass ring. The war on drugs gave them nearly arbitrary power and the war on terror gave them fully arbitrary *and* secret power. They won. These are the fruits of their victory.

I'd be smug about it, too, if I were a shitbag power-monger with no scruples.

Update: Nothing happened today. The government is still telling the judge that the Awan case has to be secret for reasons that are, in themselves, secret -- making it impossible to argue against. Next date Feb. 10, likely to be similar. Some "mortgage matter," huh?

Except if that law is unconstitutional at not in keeping with what is defined under the rules of naturalization. To wit, "refugees" and some of the legislation by Congress involving that is considered unconstitutional as it is not a specific power delegated to Congress. Personally, I would roll the legal dice on it and at it is a violation of the Tenth Amendment to NOT give states a choice. But what do I know.

325 Barr is a company man. I think abhors what has happened but he doesn't want to take an ax to the thing, either. I think Barr wants to try to salvage it.

That's how I read him as well. Like Sessions, he thinks that he's dealing with a troubled agency with a few bad apples, not a rotten pile of swamp.

326 The Awan story should be knitted together with Hillary's use of a personal server to do gov't business, and other rich examples of why democrats cannot be trusted. The idea that using a family of Pakistanis to do IT for house dems ight be a potential security risk is another reason to argue that dems should never be given power.

328 Trump is only allowed to be President when his goals and desires serve the interests of the globalist-corporatist servants in the permanent bureaucracy.

The rest of the time he is a usurper who is to be resisted at all costs. His followers are to be punished for thinking they still have a voice in government, or for thinking their consent is needed to be governed.

AFAIK, the law in question did not do any apportionment, that was left completely up to the Executive Branch. Since there are no specific implementation guidelines, the Judiciary should defer to the Executive Branch, which has the authority to work with State Governors, if it chooses to do so.

Thx, Tom. You have me at a loss. I have not read the opinion or the act. I will later. What I will say is that I felt the same way about denying funds to sanctuary cities until I read the opinion and the funding act. My underlying objection is that too many of us here think that Trump can do much about the Deep State saboteurs. Or about federal judges. He can't (though he's making good progress on the judge front).

Interestingly, you might be right that immigration is less constitutionally grounded than I had assumed.

From my acquaintance Ilya Somin:

Careful, though, a lack of federa power over immigration at all would mean that NY and Cali let in as many people as they want, make them instant citizens, and poof! there goes the republic.
