The Rule Of Law Is A Marvelous Thing, Unless It Fails The People

Is this what is coming in America? When it is blatantly obvious that some are above the law, are the good and not-so-good people of this country going to take matters into their own hands?

India Police Kill 4 Rape Suspects Already In Custody

Police said they needed to question the suspects at the crime scene — before daybreak — to have them retrace their steps and collect more evidence.

But by sunrise, all four suspects had been shot dead by police. They had yet to be charged.

"Law has done its duty," the top police official on the case, V.C. Sajjanar, told reporters at a news conference.

Not for the failures of violent crime tactics (although there are numerous failings on that front) but for the increasingly common assumption that there certain classes of people, namely politicians and the rich, who are actively protected by the government legal apparatus. They are afforded privileges to which we have no access. And even worse, that government legal apparatus has been weaponized for the craven political and financial desires of the chosen few.

How will this play out? Will the elites -- the Deep StateTM -- win out? Will they retain control of the whip hand of government and continue their campaign to cow into total submission the people of America? Or will there be a sea change? One that takes back the power to control our government, rather than be controlled?

I have no idea.

17 I don't know either. It would seem on one hand that we won't get "there" through elections. On the other hand, elections gave us Trump, the single most important reform agent in our time. (Reagan was not a reformist; dealing with corruption was not his beat). Ultimately you must come up with the right (and right number) of people sufficient to implement reform across the sprawling reaches of the government. Don't you? How else can it be done?

I am optimistic. Not with the "we won't solve this at the ballot box" crowd at all. Because the ballot box has proven effective. Tea party revolution, Trump. We just need to be smarter. A lot smarter, leaner, meaner. Not take all for granted and constantly work at maintaining gains. And stop complaining.

25 Re-examining deTocqueville's observations of life in America in the 1830's he made a couple of relevant points.

1. At the time the relative paucity of a federal bureaucracy meant that towns and localities were relatively self-governed by civic minded citizens.

2. He predicted that rise of pure democracy or "mob-rule" would lead to erosion of the '"rule of law" to be replaced by rule by the passions of the people.

Witness today's Twitter mobs and doxxing, coupled with an unelected bureaucratic state.

One was about this girl that was Raped and Killed guys that did it real rich and what they did was they paid off witnesses so that he would be found not guilty, it's based on a true story

The other one is about the caste system, these little girls were turning up dead no one cared because they were from the lowest cast in India, and the new police chief that's in charge is from the big city and he doesn't get what's going on. I mean it was fascinating because some of the villagers would refuse to shake their hands or even be near them. I'm just glad we don't have that class system here yet I mean yet

If the 4 suspects were actually the violent thugs who raped and killed the victim I sympathize with the police for deciding not to risk the courts giving the thugs a pass. But I don't trust police anymore than the courts and if they don't face consequences for this even if they had the actual thugs; future police somewhere in India will end up shooting someone who was falsely accused of rape or murder by some vile coward looking for 3rd party revenge.

The next step is not voting, which brings in full on leftists. That's what they're banking on to stay in power, and they're mostly right.

The out-of-power left gets the NRA to push gun bans after a shooting that was forgotten the next week, and we get tax cuts that will expire with (R) majorities in Congress and and the most conservative president since Coolidge.

Prepare accordingly.

39 I suspect it's going to require a significant portion of the country (perhaps 1/3 as during the American Revolution) to have a "nothing left to lose" attitude ("Freedom's just another word ...), which will likely only result after some devastating black swan event like the economy crashing.

Another scenario that I've always believed would precipitate CWII would be when they start going door-to-door to confiscate firearms -- which I suspect would create a division in the military and LEO groups.

But yeah, I can see increased vigilantism before then with a nakedly overt in-your-face two-tiered justice system. Those who make criminal justice impossible will make vigilante justice inevitable.

Yes. I'm reminded of a story my dad told of being with an older liquor license investigator who had taken over a retiree's region of Detroit. They walked into a Chaldean immigrant's restaurant and the owner took them into tge office and offered them cash. The extortion was possible because the immigrant thought greasing the wheel was always how things are done.

God help us if/when Latin American-style corruption is the new normal.

I grew up in one. Though, TBF, adjacent small departments viewed our cops as corrupt, unhirable jokes. In fact, when they'd fire someone's dirty ass for corruption, Park County was the dumping ground. If you were crooked enough, and did enough dirt for Sheriff Wegener, you could make Undersheriff pretty quick.

He was finally, finally knocked out of office democratically last year. Because Sheriffs in Park County basically have plenary powers, he couldn't be fired for basically any reason. When it became clear that his twenty year reign of corruption was drawing to a close, the bastard bolted to Florida for early retirement, and his crooked deputies just sat on their hands for the rest of his term.

When the press protested his absence he tweeted photos of himself fishing as a response.

For an idea of the man's mindset, he had the word "Sheriff" tattooed in a large, old West style font on his fucking forearms. Total POS.

We have many more legal remedies. The families of the UPS driver hostage and the innocent bystander are going to sue and get millions, and while that will not bring their loved ones back, it can be argued that justice was done.
Also, as tight-lipped as the authorities might be right now, the inept police are not out of the legal woods yet.

The Dallas County's Constable's office became a snakepit of corruption a bit over a decade ago; it got broken up and came to light, and the details got printed. Basically the constables office does most of the grunt work, like serving papers and tracking warrants, but they are peace officers. So this group hit on the scheme of following illegals, but NOT to arrest them; instead, when they saw any of them with no car, they'd bust them, grab the keys, and tell them if they said anything they'd go back to Mexico that night. Then they'd sell the car (I think to organized crime characters who take flatbeds full of "used cars" to Mexico every week.) then the guys in the department would split the cash. I think they got to where they were grabbing and selling 30 or 40 new cars a month to "supplement their salary". Basically, they were just another extortion racket. And I'm sure they were grabbing and selling any drugs they ran across as well.

158 There's covert/de facto/camouflaged shredding of the rule of law [RoL] - bribes to local inspectors, dirty cops, corrupt local councils or boards. This in endemic and has always been/always will be a problem with human systems. Though on this, there are degrees of corruption and that matters - and that's probably getting worse/more extensive vs. 25 years ago [every metropolitan area going towards a Cook County/northern NJ norm].

Then there's the destruction of RoL we're seeing now - FBI/IC plotting against political figures, brazen revolt against all norms and many laws with "sanctuary" crap. Much higher level, systemic.

Barr obviously needs to deal with the former decisively if any credibility is to be salvaged. But so far the latter has run rampant, continues to grow, with impunity. As important, there is zero stigma connected to this, and mass public indifference [polling confirms huge super-majorities oppose it - but the public passively accepts it, for the most part].

Patriotic immigrant policeman gunned down on Christmas Day, leaving a young family, by an illegal alien who's been deported multiple times and has a record ...... 2-day story, "outrage" fades within hours. Lawless govt. pushing its revolt against sanity didn't even have to dissemble or mumble or hide - they quadrupled down in the months after. With political impunity.

We'll get just as much injustice and degradation as the populace will tolerate. It's been tolerating quite a bit. Tea Party and Trump may be corpse-twitches, we may see soon enough.

177 The rule of law is broken, probably has been for a long time, was probably never carried out perfectly at any time, but is an ideal that we should work to have in our society.

We, you and I, want a return to the rule of law. Those that benefit from the rule of man do not. They, according to their desire, work outside the law. We, according to our desire, try to work within the law.

Our dilemma is, what actions do we take, within or outside, of the law, to restore the rule of law.

The rape situation in India is pretty out there--recall the case a few years ago when a young woman went to a movie with a male friend, and a group of young men riding with their friend in an off-duty bus picked them up at a stop, beat the young man and gang-savaged the woman, including internal perforations from use of a metal pipe.
She was from a family with enough means to transfer to Singapore for surgery, but I don't remember how it turned out, other than that the crime, while horrific, was not completely out of the ordinary there.
that one got worldwide publicity because the woman and her friend were of a more-significant class than many victims.

You see this in every war but the Civil War is a great example So often leaders were promoted to the level of their incompetence. This was doubly true because so many commanders fell and needed to be replaced.

Hood was a classic example. He was considered the best brigade commander in the war. He was a so- so division commander, and a disaster as an army commander. There are lots of examples on both sides though.

We're bringing in a shit-ton of foreign workers on visas that are bringing it with them.

It makes for some really surreal interactions with people even in nice areas and professional environments; they'll see you do something innocuous that, to them, marks you as a lower caste - even though applying that to someone from another culture in another country that you're a guest in is utterly batshit - and then proceed to do absurd shit.
I'm talking like, random strangers demanding that you do something as if you're a servant, near-suicidal behavior resulting from pretending that you're not there, etc.

I maintain that the single most damaging contribution to the future of western culture that the Brits gave us was bringing the English language to India. Exactly. I was and remain pretty confused about the point being made by this post. The situation in India concerning this one specific case and with rape cases in general is totally out of control. Rape suspects are often freed from jail by vigilante mobs, while rape victims are often murdered or mutilated by vigilantes before the trial can even happen. I think the police were just getting sick and tired of it, and decided to become vigilantes themselves and just executed the rapists ahead of time, knowing that the trial would either be a farce, or would never happen, or anyone testifying against the rapists would be killed.

I'm not saying that police going rogue to administer justice is a good thing, but within the context of India and what happens there daily, it's an understandable, and explains why the general public (as described in the article) cheered the cops, rather than expressing outrage at an extra-judicial killing.

I also don't think this situation has much relevance to the US at the moment. The amount (and extent) of "police overreach" here is very very minor compared to what happens in almost every other nation. It happens, sure, but I really don't think that it's part of nor connected to "The Deep State." Every case I've head of is just some frustrated, scared, inexperienced or trigger-happy patrolman firing his weapon out of fear or personal rage -- not because he's part of some government oppression.

It isn't gravity. It isn't engineering, except in a very generalized manner.

The Rule of Law is not immutable.

It is a moving target, people.

A large fraction of establishment republicans are living in a total fantasy-land, focused on their gravy trains and tut-tutting about people that lack class.
On the older end, a lot of their warped reality comes from being completely cut off from modern communications. They read dead tree media and see cable news here and there, and that's largely it.

230 Sometimes, but allowing evil to prosper by saying "don't worry, it's all under control", is also counter productive. Especially when we are saying that the ballot box is not the answer. A lot of public anger about Mueller, would have made them think. They quelled the anger with the Q fiction.

That is not true.

The Law Transcends mankind.

What you may confuse for a malleable Rule of Law is actually not a definition issue, but an enforcement issue.

There has long been a demarcation in law between Mala In Se (evil in of itself) and Mala Prohibita (because we say so).

Rejection of the Imago Dei does not change the fact that humans are wired up to recognize a transcendent legal/moral standard. Rejection just means that you will be wrong in your assessment.

Yes. But the alternative is surrender. Not a good option.

I've had some whimsical thoughts about recruiting retired to folk to begin enrolling local colleges/universities. In some places 65+ means no tuition, at least for auditing courses.

The object would be to at least monitor and publicly, vociferously, report on the substance of classes.

There is also the possibility of actually challenging (diplomatically, assertively) mis-teaching and omission in the classroom. As a registered student, one acquires a standing that is not the case as an outsider.

The bad guys among police now know better than ever again to give their foes the time and notice to form up for another Bundy Ranch standoff.

Posted by: jdgalt at December 08, 2019 03:02 PM (3SFo/)

288 That sort of judicial murder isn't new for India. They even have a term for it: "Encounter killings". It became pretty common during the Punjabi uprising, to read that terror suspects were killed during an "encounter" with police. Everyone knew that the police had captured some suspects, then just executed them and claimed that they'd been trying to escape, or had opened fire on them.

What's different about the rape suspects in the story here is that the anti-terror executions were in line with government policy. Maybe not on direct orders of the government, but it was understood that such behavior by the police wasn't discouraged, and was even rewarded. Here, though, it sounds as if this might be a local reaction to a local situation, and that could be a sign of the central authorities losing control of the law officers at the ground level.

Those are totally different situations than what we're talking about here. Provincial cops at a local police station in some remote Indian mountain village shooting known rapists because the villagers demanded it, knowing that the rapists would never be brought to trial, is not the same thing as The Deep State in the US conspiring to oppress or silence critics. Nor are those instances the same thing as some scared highway patrolman shooting some drugged-out maniac who he mistakenly thought had a gun.

Smooshing together all these unrelated cases of "police overreach" into one ill-defined category merely muddies and confuses the issue.
