OMG: Judge in Covington Suit Makes It Official That The Politico-Media Class Has Greater Rights Than The Plebians, Ruling That Elizabeth Warren Cannot be Sued for Slandering a Child Because of "Sovereign Immunity"

This is huge.

Slandering children is part of Warren's official governmental duties, we are now informed.

Anything necessary to protect the Ruling Class from the dirty commoners.

A Kentucky judge has dropped presidential candidate Sen. Elizabeth Warren, D.-Mass., from a libel lawsuit filed by eight Covington Catholic High School students on grounds of sovereign immunity.

Only Warren and Rep. Deborah Haaland, D.-N.M., were dismissed from the suit. "Sovereign immunity 'extends to agencies of the United States' or 'federal officers [acting] in their official capacities,'" the decision by District Judge William O. Bertelsman read.

Sovereign immunity is the doctrine that the U.S. government or those acting on its behalf may not be sued without its consent.

The Fake Indian Elizabeth Warren had slanderously lied, claiming that the Lying Indian (who falsely claimed to be a "Vietnam Veteran" in his numerous media appearances over the years) had "endured hateful taunts."

He had not. It was the Covington kids who endured hateful racial taunts from the Black Israelites that the Lying Indian joined.

Commenting on Twitter -- about a controversy which the Senate was not investigating, about which the Senate was considering no legislation -- is now part of Warren's (or any government leftist's) "official duties," we are being told, and they have the right to slander Dirty Filthy Commoner Children without fear of lawsuit when the whim takes them.

Tim Pool makes a good point -- why has this doctrine never yet been used to excuse Trump from lawsuit?

By the way: Warren is claiming the federal government's sovereign immunity. But a sovereign may consent to be sued.

Why doesn't Trump just so decree it? I think he can withdraw Warren's alleged "sovereign immunity," though I am nowhere close to knowing that for a fact.

And we're still waiting for the judge to rule on media figures' immunity -- like Ana Navarro.

Given that this guy willfully misread the basic black-letter law on defamation to toss this suit the first time, does anyone doubt he'll likewise soon find that Ana Navarro has a special Media People Are Special dispensation to defame children and implicitly direct antifa violence towards them?

That was my reaction, too. IANAL, but if she been speaking on the floor of the Senate, that's one thing. But quacking elsewhere, on a matter that does not involve the Senate, she wasn't acting in an official capacity. This is what's called bootstrap.min. this judge should be embarrassed as I can't see an appellate court construing the same language of the statute the same way. The proper ruling would be for the senators to get legislation exempting themselves from liability that commoners would have. This ain't over yet. Now if the appellate Court and Supremes agree, then it is time to do something elsewithin the bounds of the law unless forced to do otherwise

Point: The Foreign Assistance Act [as amended] surely contains such a provision. If so, it is literally in there *in order to allow a president to use discretion of the sort involved in ANY "quid pro quo" interaction with a foreign country*.


It's slam-dunk that a president has this discretion under Article II powers anyway - but ffs that should have been the first point made in response to this stunningly frivolous faux impeachment crap.

Okay. On sovereign immunity since I used to do work in that area.

Sovereign immunity is wildly abused by the sovereign to keep from being sued. The standard is that the sovereign *when acting in its capacity as the sovereign* does an action, the sovereign cannot be sued. The immunity is deemed absolute and the sovereign can be sued to, and only to, the extent that the sovereign itself has graciously permitted such suits.

That is why the Federal Tort Claims Act exists. That is why states have state level variants of it.

But the act must be done by the sovereign in its sovereign capacity. It really isn't a hey I can murderate someone because I'm a state senator card.

The GOP house members do not run committees, do not set timetables, don't have the ability to select committee work and have one less vote on each committee. It's what happens when people decide to not vote for a GOP candidate because electing a democrat will show them we won't stand for impure voting records. So the Dems get in power and we have what we have now.

Imagine if the Senate was being run by Chuck Schumer. Trump would have been gone 12 months ago and we would be looking at an impeachment trial of Pence.

Trump has not been well served by his legal team. McGahan by all accounts was part of the problem aside from judges. Trump could not trust GW Bush's legal team for obvious reasons. His DOJ is filled with lawfare enablers leaking obvious crap and even supporters like Sessions turned their backs on defending the guy. I suspect he does not get the legal community in DC as his experience was that lawyers work for Trump Co. to find ways to accomplish what he wants.

In DC, the DOJ and his advisors work to thwart his policies rather than find ways to make them work because they more or less agree with their lawfare buddies. Mattis did the same thing to his eternal disgrace in the DOD as did McMasters and Kelley in the executive branch. Bolton is another but I suspect that Trump knew he was a snake in the grass. These folks value their associations, DC buddies, and policy ideologies over serving their elected president, country, and the Constitution.

My suspicion is that the legal guys are looking beyond their time in the Trump admin to keep their viability as far as lucrative legal careers. This means playing ball with the lawfare types etc., going soft on DC power players, etc. I see a similar dynamic going on with the ICA and Republicans in the Senate. Literally, Trump has an unprecedented problem in having very few people in DC he can trust to open up to and to vette bad ideas without spreading them out for the DC mafia in the executive, Congress, and the media.

Dred Justice Roberts is preventing any executive policies from going into effect by keeping the court from squashing these district judges with summary reversals. I suspect he would not be upset at all if Trump loses and RBG' seat is filled with a Dem. He is as bad as Burger as being unprincipled and is apparently playing for the praise of the other side-he dissents like a coward when he knows the other side will win. I was willing to cut him a break after the Obamacare decision to see how he played it out. His change in time in Obamacare has been replicated time and time again so he's dirty.

Truman had a similar stormy relationship when he inherited FDR cronies in the executive branch but Truman did have his friends back on Capitol Hill watching his back.

I really do not hope we emulate the fate of the Grachii brothers here but reformers often get destroyed. I hope Trump has the luck and ghost of Fiorello LaGuardia watching over him as one of the few reformers who made a hopeless wreck of a city better.

The theory is supposed to be that once empowered, they represent the will of the people (meaning the political class; this should be equivalent to those on the voting rolls but never stays that way) and if they are going to be treated like a normal citizen, some exception needs to be created or the losers need to wait for the next election.

Since the people don't have a will, the only way to produce one is to produce a person the people can agree on to exercise that will.

Sovereign immunity is a huge part of rule of law and the main reason why Trump isn't currently in some kind of kangeroo court with a new set of charges every day but must be impeached before they can even put him on trial.

In any case rule of law is a sort of content-empty concept in that just respecting the laws and following them without force doesn't tell you what people will do unless you know what the laws are.

The fact that this novel "sovereign immunity" idea has to be applied means that speech and debate didn't apply. She wasn't doing it in the course of her job, but in the course of her campaigning.

If senators can now trash private citizens in their campaigns for reelection or promotion, and have "sovereign immunity", that's frightening. I think this should be appealed, because a higher court is likely to see how this use of "sovereign immunity" is a perversion of our government structure.
