OMG: Judge in Covington Suit Makes It Official That The Politico-Media Class Has Greater Rights Than The Plebians, Ruling That Elizabeth Warren Cannot be Sued for Slandering a Child Because of "Sovereign Immunity"

This is huge.

Slandering children is part of Warren's official governmental duties, we are now informed.

Anything necessary to protect the Ruling Class from the dirty commoners.

A Kentucky judge has dropped presidential candidate Sen. Elizabeth Warren, D.-Mass., from a libel lawsuit filed by eight Covington Catholic High School students on grounds of sovereign immunity.

...

Only Warren and Rep. Deborah Haaland, D.-N.M., were dismissed from the suit. "Sovereign immunity 'extends to agencies of the United States' or 'federal officers [acting] in their official capacities,'" the decision by District Judge William O. Bertelsman read.

Sovereign immunity is the doctrine that the U.S. government or those acting on its behalf may not be sued without its consent.

The Fake Indian Elizabeth Warren had slanderously lied, claiming that the Lying Indian (who falsely claimed to be a "Vietnam Veteran" in his numerous media appearances over the years) had "endured hateful taunts."

He had not. It was the Covington kids who endured hateful racial taunts from the Black Israelites that the Lying Indian joined.

Commenting on Twitter -- about a controversy which the Senate was not investigating, about which the Senate was considering no legislation -- is now part of Warren's (or any government leftist's) "official duties," we are being told, and they have the right to slander Dirty Filthy Commoner Children without fear of lawsuit when the whim takes them.

Tim Pool makes a good point -- why has this doctrine never yet been used to excuse Trump from lawsuit?

By the way: Warren is claiming the federal government's sovereign immunity. But a sovereign may consent to be sued.

Why doesn't Trump just so decree it? I think he can withdraw Warren's alleged "sovereign immunity," though I am nowhere close to knowing that for a fact.

And we're still waiting for the judge to rule on media figures' immunity -- like Ana Navarro.

Given that this guy willfully misread the basic black-letter law on defamation to toss this suit the first time, does anyone doubt he'll likewise soon find that Ana Navarro has a special Media People Are Special dispensation to defame children and implicitly direct antifa violence towards them?

Breaking... Adam Schiff goes one step too far...

Adam Schiff Makes Up New Rules for Impeachment Inquiry

Restricts Republican Witness Questions

House Intelligence Committee chair Rep. Adam Schiff (D-CA) issued a set of restrictions on Thursday morning limiting Republicans to calling witnesses that can respond to three questions, all of which reflect Democrats' views.

The questions, detailed in a letter Wednesday from Schiff to ranking member Devin Nunes are:

Did the President request that a foreign leader and government initiate investigations to benefit the President's personal political interests in the United States, including an investigation related to the President's political rival and potential opponent in the 2020 U.S. presidential election?

Did the President -- directly or through agents-- seek to use the power of the Office of the President and other instruments of the federal government in other ways to apply pressure on the head of state and government of Ukraine to advance the President's personal political interests, including by leveraging an Oval Office meeting desired by the President of Ukraine or by withholding U.S. military assistance to Ukraine?

Did the President and his Administration seek to obstruct, suppress, or cover up information to conceal from the Congress and the American people evidence about the President's actions and conduct?

Schiff is also requiring Nunes to submit "detailed written justification" for each witness requested. In a letter to Nunes, Schiff lists the deadline as "Saturday," November 8, at 11:20 a.m. However, Nov. 8 is a Friday.

This is all vomit inducing.

When is the GOP going to grow some balls and shut this farce down right now?

After it's successful one week stay in Berkeley, the musical is undoubtedly ready for the eager Manhattan audiences.

262 But the suits against Trump all concern action prior to taking office, right? That might "explain" the difference on that point.

But speaking of laws, shame on me for not confirming - and 15K times the shame on the WH and idiot GOP for not making the point, if correct - but all [all] legislation regarding foreign policy and national security I've ever seen or worked on contains a "national interest waiver". Basically a combo of weaselish cowardice/flight from accountability and sound regard for the near-plenary executive discretion in foreign affairs led Congress to include a provision in these laws that the president can waive elements of the law or actions taken thereunder if "the national interest" is deemed to merit it.

Point: The Foreign Assistance Act [as amended] surely contains such a provision. If so, it is literally in there *in order to allow a president to use discretion of the sort involved in ANY "quid pro quo" interaction with a foreign country*.

It's slam-dunk that a president has this discretion under Article II powers anyway - but ffs that should have been the first point made in response to this stunningly frivolous faux impeachment crap.

283 As Dennis Prager, and I'm sure others have also noted, there are two parties in America.

The Evil Party, and The Stupid Party.

Anyone who's a conservative or who just wants to be left alone finds themselves on the side of The Stupid Party.

Paul Ryan & Mittens R are textbook examples of The Stupid Party. Ryan doing such a crap job as Speaker lead to the losses suffered by The Stupid Party in 2018, which has brought us to the sorry state the country is in right now.

298 Sovereign immunity is supposed to mean you can't sue the health inspector for shutting down your restaurant because it's a rat infested cesspit with cat feces smeared around the kitchen. It's not supposed to mean you can't sue a member of the gov't who, outside of their official duties, purposefully and maliciously smear your good name in the media for the purpose of scoring political points. That's not their g-ddamn job.

You can't sue the health inspector for shutting down your restaurant because it's covered in cat feces. You can sue the health inspector for shooting your cat when he's out for a morning jog, because that's not his damn job, even if he claims the cat was a health hazard and it's OK for him to kill it because it means the restaurant won't be coated in feces anymore.

Okay. On sovereign immunity since I used to do work in that area.

Sovereign immunity is wildly abused by the sovereign to keep from being sued. The standard is that the sovereign *when acting in its capacity as the sovereign* does an action, the sovereign cannot be sued. The immunity is deemed absolute and the sovereign can be sued to, and only to, the extent that the sovereign itself has graciously permitted such suits.

That is why the Federal Tort Claims Act exists. That is why states have state level variants of it.

But the act must be done by the sovereign in its sovereign capacity. It really isn't a hey I can murderate someone because I'm a state senator card.

390 As has been pointed out, we aren't voting our way out of this. America as many of us have known it is gone.

None of us wanted or voted for a country flooded with legal and illegal immigrants. (Even when the 1965 immigration law changed, it didn't have popular support.) Well, now we have have 22% of households that don't speak English at home. In some cities it tops 50%.

We aren't a country, we're an economic zone. Don't believe me, company nearby just outsourced over 300 (75%) of their IT staff to India. Nations with any pride and purpose don't allow that to happen.

It's time to consider what is next and how to shape it to what we want.

I don't know what people want the GOP to do, when they are not in power. I'm not making excuses for them, just stating facts. The GOP house members do not run committees, do not set timetables, don't have the ability to select committee work and have one less vote on each committee. It's what happens when people decide to not vote for a GOP candidate because electing a democrat will show them we won't stand for impure voting records. So the Dems get in power and we have what we have now.

Imagine if the Senate was being run by Chuck Schumer. Trump would have been gone 12 months ago and we would be looking at an impeachment trial of Pence.

It used to be a prestige/privilege thing based on rank. Now, senior officers A: may do a lot of work/communicating while the vehicle is moving, and B: enlisted Soldiers have lots of protections on how much they can be charged for damaging government property. Officer (especially commanders) can more easily be held liable for the full amount.

Never heard anything regarding lawsuits.

496 262 Rhomboid,

Trump has not been well served by his legal team. McGahan by all accounts was part of the problem aside from judges. Trump could not trust GW Bush's legal team for obvious reasons. His DOJ is filled with lawfare enablers leaking obvious crap and even supporters like Sessions turned their backs on defending the guy. I suspect he does not get the legal community in DC as his experience was that lawyers work for Trump Co. to find ways to accomplish what he wants.

In DC, the DOJ and his advisors work to thwart his policies rather than find ways to make them work because they more or less agree with their lawfare buddies. Mattis did the same thing to his eternal disgrace in the DOD as did McMasters and Kelley in the executive branch. Bolton is another but I suspect that Trump knew he was a snake in the grass. These folks value their associations, DC buddies, and policy ideologies over serving their elected president, country, and the Constitution.

My suspicion is that the legal guys are looking beyond their time in the Trump admin to keep their viability as far as lucrative legal careers. This means playing ball with the lawfare types etc., going soft on DC power players, etc. I see a similar dynamic going on with the ICA and Republicans in the Senate. Literally, Trump has an unprecedented problem in having very few people in DC he can trust to open up to and to vette bad ideas without spreading them out for the DC mafia in the executive, Congress, and the media.

Dred Justice Roberts is preventing any executive policies from going into effect by keeping the court from squashing these district judges with summary reversals. I suspect he would not be upset at all if Trump loses and RBG' seat is filled with a Dem. He is as bad as Burger as being unprincipled and is apparently playing for the praise of the other side-he dissents like a coward when he knows the other side will win. I was willing to cut him a break after the Obamacare decision to see how he played it out. His change in time in Obamacare has been replicated time and time again so he's dirty.

Truman had a similar stormy relationship when he inherited FDR cronies in the executive branch but Truman did have his friends back on Capitol Hill watching his back.

I really do not hope we emulate the fate of the Grachii brothers here but reformers often get destroyed. I hope Trump has the luck and ghost of Fiorello LaGuardia watching over him as one of the few reformers who made a hopeless wreck of a city better.

521 457 This was a thing even in Rome. The point is that once someone is elected, you can't sue them as a means to prevent them from doing their job (and other shenanigans.) The theory is supposed to be that once empowered, they represent the will of the people (meaning the political class; this should be equivalent to those on the voting rolls but never stays that way) and if they are going to be treated like a normal citizen, some exception needs to be created or the losers need to wait for the next election.

Since the people don't have a will, the only way to produce one is to produce a person the people can agree on to exercise that will.

Sovereign immunity is a huge part of rule of law and the main reason why Trump isn't currently in some kind of kangeroo court with a new set of charges every day but must be impeached before they can even put him on trial.

In any case rule of law is a sort of content-empty concept in that just respecting the laws and following them without force doesn't tell you what people will do unless you know what the laws are.

Campaigning isn't an "official act" of her government position and she should be free to be filleted.

578 Although there are a few shouted vocal parts on the backing track (like the "all right!" at the end of the song) the version of the song in the video is without the lead and backing vocals recorded for the released version. They and other 60's/70's bands always had vocal-less takes of their singles to sing live/mime playing to for videos or appearances on pop music tv shows of the time.

Posted by: CN at November 07, 2019 04:09 PM (U7k5w)

It's an internally consistent position - Trump is not actually a legitimate president thus nothing he does is legitimate. It's. Science.

My personal favorite subset of all of that are the people who think, really and truly think, that if Trump is removed from office then all the judges he appointed get removed from the bench and all the decisions they made get vacated.

Shoot one guard dead. Wound the other one and use him as a shield as you open the door you choose. If it's the one with the lion, throw the wounded guard at him and dodge out and through the other door.

596 I am as fed up with this crap as the next patriot, but one is almost drawn to the idea the left would LOVE us to go to the mattresses. Civil wars require armies, we don't have one. Further, any attempt to form said army would soon discover that every third member is an employee of LE. If it does go down, it will be more of a gorilla action, disruption, over the taking of strategic areas/infrastructure. There are just too many pigs at the trough to mount a nation wide uprising, we would make the Balkans look like a Chicago turf war.

Posted by: dj3way at November 07, 2019 05:42 PM (bhPL1)

610 The doctrine used to protect people like Sen. Warren is the "speech and debate" immunity related to what they say on the floor of Congress.

The fact that this novel "sovereign immunity" idea has to be applied means that speech and debate didn't apply. She wasn't doing it in the course of her job, but in the course of her campaigning.

If senators can now trash private citizens in their campaigns for reelection or promotion, and have "sovereign immunity", that's frightening. I think this should be appealed, because a higher court is likely to see how this use of "sovereign immunity" is a perversion of our government structure.

Posted by: artichoke at November 07, 2019 05:51 PM (ci4cc)

611 My understanding of this law that the judge cites, is that it only protects Government official from their actions in the capacity of their official duties.
