New York Times Runs Yet Another Smear Against Brett Kavanaugh; Alleged Newspaper Forgets to Mention 1, the Alleged Victim Denies Any Memory of This Silly Tale, and 2, The Person Claiming He Remembers Hearing About It Is... A Clinton Lawyer

What a fusion of common backgrounds, common social circles, and common political agendas.



The authors then bring forth a new allegation that they suggest bolsters her claim. They say that a former Clinton attorney named Max Stier told the senators and F.B.I. that he witnessed Kavanaugh, pants-down, at a party where a group of guys pushed the hand of a female student onto him.

What they neglected to mention, however, was that the Senate Judiciary Committee was not notified of this claim, according to counsel Mike Davis. Democratic Senate offices turned over several claims against Kavanaugh, some of them leading to criminal referrals for false statements. There were claims of a nationwide crime spree undertaken by Kavanaugh, although no evidence was found in support of any of the claims.

More importantly than the procedural issue, however, is that several friends of the alleged victim in question say she has zero recollection of such incident.

That salient detail was omitted by the reporters.



A correction was added to the end of the article late Sunday night, after a full day of histrionic media coverage: It reads:


Editors' Note: Sept. 15, 2019

An earlier version of this article, which was adapted from a forthcoming book, did not include one element of the book’s account regarding an assertion by a Yale classmate that friends of Brett Kavanaugh pushed his penis into the hand of a female student at a drunken dorm party. The book reports that the female student declined to be interviewed and friends say that she does not recall the incident. That information has been added to the article.

Howard Kurtz calls this "journalistic malpractice," and "black and white" as far as violations of so-called journalistic standards.

For the most part he's been solid. Way better than John Roberts. And when he was nominated, he was very much of an Establisment consensus guy.

I think there was like one abortion voted he went against us. For most of the major cases, he's been there.

Kavanaugh may have been a more Kennedy-type justice had none of this happened. John Roberts was pretty smooth sailing for his confirmation and I always wonder if it had been ugly, would he have done things differently.

No one agrees with anyone else 100% of the time, but I can't think of many cases in the last year where I disagreed with him.

It may surprise some to realize that I think there are decisions where the liberal wing gets it right, and the conservative wing gets it completely wrong. Doesn't happen all that often, but it does happen. Kagan and Brennan try to think things through, unlike Sotomayer.

My frat sat up on a hill over looking the rest of the campus. We had a flat roof that was accessible from a ladder through an access port. This was put in to do repairs on the roof. We used it create The Beach was a great place to party.

We also set up a slingshot with surgical tubing and a funnel attached to the chimney on one side and an antenna poll on the other. We could shoot projectiles hundreds of yards where they would rain down on unsuspecting outsiders. Water balloons, snowballs, other things we won't discusses were our weapons of war.

Because you don't understand what a Conservative Legal Philosophy is - it is NOT the same thing as a "conservative" political philosophy.

Liberal Legal Philosophy holds that judicial reasoning should be subjugated to Political Necessity, that standards and rulings should be made as demanded by left wing political orthodoxy, and that Court Rulings only exist to try and invent a legal justification for a decision based on nothing but pure Political Will. That's how Roe v. Wade was decided, after all.

Conservative Legal Philosophy is the opposite - it holds that political necessity should NOT be used as part of the decision process, but rather that Existing Law, as evaluated in light of the Constitution, should be the only standard used to decide a case.

Recognize that in many cases, deciding things the Conservative way is likely to come up with a result that may not be politically "conservative" - I could give many examples. Asking that conservatives vote in lockstep is asking that Conservatives Judges become Liberals, and admit that the Liberal Judicial Philosophy is correct, it just needs to be done with a different set of goals.

I fully expect NYSRPA v. New York City to be decoded for the plaintiff and at a minimum rule that The Second Amendment extends beyond the home and shall issue will be the law of the land. Again, at a minimum.

Go back and look at that decision, it was on Double Jeopardy, the 5th Amendment says that Defendants can't be charged twice for the same crime, without qualifications. Gorsuch and RBG wrote that the Constitution says you can't charge someone twice, that means you can't. Alito and the others said, oh but when it's the Federal Government it's just fine, especially when it's about guns.

I side with Gorsuch and RBG on that one.

Gorsuch and RBG wrote that the Constitution says you can't charge someone twice, that means you can't. 10th amendment restricts the federal government to what is in the Constitution. In the late 19th century one president understood this to prohibit emergency federal aid.

My too-glib take on this is that if the Founders didn't anticipate or desire scrutiny of a nominee's politics, they would not have entrusted the assessment of his qualifications to an inherently political body.
