Federal Appeals Court Reverses Illegally-Light Sentence Lower Judge Gave to Rand Paul's Attacker;
Lower Judge Had Given Him an Impermissibly Short Sentence Because He Was "Educated"

Had enough yet?

Federal prosecutors appealed this sentence as not permitted by federal sentencing guidelines. The appeals court agreed, and scolded the lower judge for illegally using the criterion that the attacker was "educated" as a reason for going outside the guidelines to give him the lightest of all taps on the wrist.

He could have gotten ten years; this judge sentenced him to merely 30 days. After all, he wasn't deplorable -- he had a "good background" and "education."

Boucher was originally charged with misdemeanor assault under Kentucky law, but the state charges were dropped in lieu of a federal felony prosecution. Boucher could have received up to 10 years in prison for an assault of a member of Congress that inflicted personal injury, but prosecutors sought 21 to 27 months in light of his acceptance of responsibility.

District Court judge Marianne O. Battani instead sentenced Boucher to only 30 days, arguing that Boucher had an "excellent background," was "an educated person," and "participated in the community in [his medical] practice and in [his] church." The Clinton-appointed judge also cited the character witnesses who testified on Boucher's behalf, including his pastor and the developer of his gated community.

Prosecutors appealed the case, arguing that the light sentence was "substantively unreasonable" compared with similar cases. The Sixth Circuit agreed Monday, noting that Congress specifically instructed courts not to give undue weight to class and education when sentencing defendants.

"To prioritize a defendant's education, professional success, and standing in the community would give an additional leg up to defendants who are already in a privileged position," wrote Obama appointee Jane Stranch for a three-judge panel.

Unfortunately, this case goes right back to the same judge. We'll see if she ups the sentence to 45 days.

I always say "The rules you make for us, you make for yourself as well."

There's a corollary to that: The laws you claim your tribe-members can ignore and have immunity from, are laws that I can also ignore, and which I also have immunity from.

yes but that's standard. An appeals court reverses a ruling, explains to the lower judge how she got it wrong, and sends it back to let that judge rule again, this time taking account of the errors pointed out.

When a court says "remanded," that's what they mean -- we've sent this back with instructions.

I think the judge has gotten the message that she cannot mention background or education or wealth as criteria, and she'll come up with other reasons to say he shouldn't have a heavy sentence. But, she might, I hope, at least understand she must give a sentence in line with the guidelines.

Of course, she will give a sentence that is at the absolute lowest end of guideline recommendations.

The story says that the Prosecution asked for 21 - 27 months, significantly less than the maximum 10 years, and I think that after this Judge has been slapped down by the Appeals Court, her safest play is to put her sentence at the midpoint of their recommendation. I'm going to cautiously predict that this case ends up with a sentence of 24 months in Club Fed.

If this neighbor guy had just picked up the phone or walked across the yard and rang Paul's doorbell and politely asked him not to pile tree debris in his yard (or have it hauled away more quickly, or whatever), then none of this would have happened. Paul wouldn't have life-long injuries to deal with, Boucher wouldn't be headed to federal prison and he also wouldn't have a $500k civil judgment to pay Paul. But no, basic civility was too much to expect from this fine, upstanding, well-educated doctor who was a pillar of his community.

One of Fox's WH reporters said that he was hearing off the record, so he couldn't name names, that senior officials in the WH were getting tired of Bolton coming to them with his opinion.
So the above is probably spot on. Trump has said he likes having people who have divergent opinions on his staff as he wants to hear all sides.

But as Mr. Jen said to me , from his experience, once you have given your opinion and the boss decides you are moving in the opposite direction as a team, you better get on that team, keep your opinion to yourself , and do everything you can to move the team forward as per the boss' direction. You cannot have someone on the team crying and whining to everyone else about the decision and doing everything they can to sabatoage the plan by trying to peel others off to their side.

There is a history of people in various agencies and departments setting policy that is opposed to the president's. This may be part and parcel of it (and a lot of the deep state nonsense also).

I don't see Trump seeing his role is to mediate between different groups who are setting policy; rather he sees it as he decides policy.

The story goes that Eisenhower brought this kind of leadership from the military to the White House. He had an intricate network of loyal workers, who were allowed to operate somewhat independently. As LONG as they remained loyal to the mission and respected the chain of command.

Still, there were snakes in Eisenhower's Administration, and they did much damage.

Since then, especially Republican White Houses have adhered to this type of structure. One of the drawbacks of course, is that often the President has no way of knowing who is doing what, in his Administration.

Yeah, the entire defense argument for giving Boucher a 30-day sentence was stupid, and the trial judge should have rejected it out of hand.

This was a federal law case, not a state law case, and the fact that KY state law typically gives 30-day sentences for assaults resulting in minor injuries was completely irrelevant. The injuries Boucher inflicted on Paul were NOT minor by any stretch of the imagination, so the argument that Boucher should only get 30 days was just silly. A competent judge would have ignored it.

Plus the judge completely ignored the federal guidelines and the federal case law that says that factors like a defendant's education, profession, social status, etc., are not factors that should be used to reduce a sentence. She just did what she wanted to do, and to hell with what the law requires. Like all lefties, she thinks that she is the law.
