property rights are a bit more unfettered in Texas. Inside incorporated city limits, Cities are allowed to place zoning restrictions on parcels of land. (Houston notably does not)
Outside city limits, no restrictions whatsoever, and that's why HOA's have gotten popular. If there's no incorporated city, and no HOA, and somebody wants to set up a hog slaughtering operation in the middle of group of rural houses, nothing anybody can do about it. This is an interesting (short) read:
Koch Exits Canadian Oil Sands ...The Globe and Mail cited information from the Alberta Energy Regulator, which said the assets involved in the sale consisted of five leases, with Koch abandoning the rest. ...Koch followed in the footsteps of other energy majors that decided to leave the Canadian oil sands over the past few years. Shell, ConocoPhillips, Equinor, and Devon Energy all left the oil sands to focus on lower-cost, quicker return projects. In the years prior to the asset sale, Koch has blamed the Alberta NDP government for the regulatory uncertainty that, the company said, forced it to suspend a planned US$601-million (C$800-million) project in the province. Even earlier than that, Koch said Canada's signing of the Kyoto Accord on emissions reduction was the reason for it to abandon another project, Fort Hills, which would have sucked in some US$2.6 billion (C$3.5 billion) in investments. Fort Hills is now Suncor property and operating, despite the Kyoto Accord. Regulatory obstacles are still one of the main reasons for the lukewarm investment climate in Alberta,... https://tinyurl.com/y3b42fz4 Now, back to reading outside in the sun... We're signing a contract today to buy 5 acres in MT. Water rights are a big thing here but strict zoning not so much. We're purchasing in a small planned community. Geared towards equestrian pursuits where we are allowed 5 or 10 animals, no goats/sheep/roosters. Against my better judgement we are purchasing in a development with a HOA. I hate naziland HOA's. Hoping this one is different. Since zoning is questionable we're hoping this keeps the wrecked cars, heaps of trash and homestyle car repair places at bay.

I like living in a 'hood where people have to keep their lawns looking good, can't park 5 cars in a 2 car driveway and can't own 5 dogs that bark all day long. What kills me though is people who move into an HOA fully knowing the rules then immediately bitching about having to follow the rules. Here, zoning laws a subservient to leftist's view. Say you have a property zoned R3 or worse live next to a property zoned R3. If the owner agrees to put low income units in that R3 will become an R5 because leftist reasons.
Conversely, same scenario but want to put two units up and live next to a leftist in the city government. You will be forced to only build one unit because leftist reasons. Posted by: Jukin the Deplorable and Profoundly Unserious at August 15, 2019 11:26 AM (pw+jk) 104
Oh, saw the sidebar thing about redoubt or doubt.
I've read enough old historical romances to have noticed that "doubt" is one of those words that has had an opposite meaning in the past. Sort of the way that a fighty nincompoop who gets emotionally wrought over the slightest thing might once have been said to have "an excess of sensibility." ie., feels too much. "Doubt" is sometimes used in these august texts as such... "I doubt that he'll be on time, he always is." It's given as a statement by these fictional Regency sorts as a statement of surety rather than a statement of skepticism. I did the HOA once. Will not be in a rush to do it again. We had a private road to maintain as well as shared leach field system (each house had a septic tank, but all drained into common leach fields). None of the homeowners wanted to pay into build up cash reserves to maintain these items. Plus there was the snow plowing and mowing. Homeowners weren't supposed to have a truck bigger than a 3/4 ton. Well -except for the builder's daughter and SIL - they could have their 1ton.

You are most likely in violation of at least 25 zoning laws at this very
moment. They don't write you up for them... but they can and that is a police state. Houston gets along quite nicely without zoning - it is also the only major city without a ghetto. While we have poorer sections of town their is nothing irredeemable. Zoning causes ghettos - once an area is zoned "low income housing" it is doomed. The Houston way is called freedom - the rest of you might try it. Posted by: An Observation at August 15, 2019 11:30 AM (53lEY) 125

Susan Collins and the GOP court Trump on guns https://politi.co/2OWzACc
..."The president is key on this," Collins said. "He does seem to be calling for some sort of background check tightening and also some sort of red flag bill. Now obviously the details matter a great deal but if he advocates those two positions that will help us with members of the Republican Caucus."... ..."My gut tells me that Leader McConnell wants to bring something to the floor for a vote," said freshman Sen. Mike Braun (R-Ind.), who spoke to Toomey and wants to focus on background checks and red flag laws. "This is the moment. When you have two incidents like that in the same weekend, I think conservatives and Republicans lose in the long run if we don't do something to change the dynamic. And I'm about as hard a Second Amendment guy as there is." Sen. Mitt Romney (R-Utah) said in a statement that he supports "enhancing existing background checks" that preserve Second Amendment protections. Sen. Martha McSally (R-Ariz.) has said she would consider new gun legislation and wants to make domestic terrorism a federal crime. Michigan Republican Senate candidate John James described expanding background checks in an interview as among the "reasonable things to consider." "There's an opportunity," said Sen. Marco Rubio (R-Fla.), who is more supportive of taking on red flags and straw purchases than background checks. "It will require becoming a priority for the White House," Rubio added in an interview. "It's tough to move on an issue as difficult and divisive as this is without executive engagement." Posted by: David at August 15, 2019 11:30 AM (jY1B4) 128

I hate mid 20s HR drones. My group is in a conference room with a sponsor (a Brigadier General) with a room reservation to 11:30. At 11:31 a group of drones barges in with their pizza and says they have the room at 11:30 for their pizza party and starts setting things up. The General used his Command Bearing to get them to leave for five minutes. What was funnier is the General then sat down and told us he'd have his CSM arrange a more appropriate "pizza party" for them if we wanted. Don't Ban Assault Weapons - Tax Them
https://t.co/i8KQsaeCr3. ...Surely even the most die-hard gun-rights supporter could not argue that, although it is constitutional to tax weapons and ammo to protect animals, it is not constitutional to tax them to protect people... ...One of the problems that gun bans pose is that that gun makers simply modify their weapons to make them street-legal. Moreover, gun bans do not address the problem posed by guns already in private possession. Rather than requiring an expensive buyback program, gun taxation would use a market-based strategy to reduce the number of guns in circulation by effectively raising the price of ownership... ...Tax policies could offer tax deductions for the purchase of gun safes or for the cost of safety courses. Weapons stored at federally licensed firing ranges or hunting lodges might incur no tax. But if you wanted the convenience of having such a weapon at home, you could be taxed for the privilege. Most Americans recognize that convenience usually comes at a price. Individuals could decide how much they value easy access to their guns and pay the tax on home storage... ...Tax incentives can nudge individuals toward safer behaviors and raise the cost of risky behaviors, such as stockpiling guns and ammunition and failing to adequately secure weapons... ...The problem was not that Americans did not own firearms-levels of gun ownership in America were much higher than in England-but that most Americans did not want military-style weapons. Such guns were relatively heavy, and not especially suited to shooting the critters that ate their crops or to hunting birds. Neither was the bayonet, a standard fixture necessary for military muskets, much use for farmers who wanted to have turkey for dinner... Posted by: David at August 15, 2019 11:44 AM (jY1B4) 199

The problem was not that Americans did not own firearms-levels of gun ownership in America were much higher than in England-but that most Americans did not want military-style weapons. Such guns were relatively heavy, and not especially suited to shooting the critters that ate their crops or to hunting birds. Neither was the bayonet, a standard fixture necessary for military muskets, much use for farmers who wanted to have turkey for dinner...

As someone who has been on both sides of a zoning fight, zoning per se is not the problem. It is an unrealistic expectation that one can do whatever one wants with property as it was never the case where our land laws or common law originated in England.
In the U.S. zoning laws replaced widespread ad hoc litigation using various common law approaches to damages with the ironic acceptance at the time by developers for predictability purposes and use of things like public nuisance laws to criminally and civilly charge folks. Laissez faire type property treatment in the U.S. came about primarily from the frontier mentality of endless abundance of land. As the frontier vanished and the U.S. became more densely settled, there was significant conflict in the courts over development. Developers make money by buying land cheap and then "improving it" to sell it for a higher price. Then, they are gone. Existing residents then may have issues like flooding, sediment deposits, decreased water pressure/sewage capacity, crowded schools and roads, and destruction of sightlines, noise and lighting , pollution, and so forth. And many of those factors can actually decrease the value of one's own home. The new purchasers of the property may be making a gain at the expense of existing residents. Thus, zoning laws proliferated especially after the Supreme Court gave its blessings in the 1920's and some states went as far as constitutional amendments to state constitutions giving localities and the state power to zone property for use. Thus, the public bodies in most localities are charged with balancing the existing quality of life for residents versus the prospective new buyers of such property and the property rights of the seller. Libertarians typically oppose zoning laws as they do restrict the rights of the seller, developer, and the prospective new residents for the same reason as they oppose immigration restrictions. Voters, however, and this is not a blue-red issue btw value what exists more than any potential gains/losses from a new development. Thus, developers with affiliate companies often are prominent contributors and players in local politics and are often opposed by odd citizen coalitions. Zoning laws affect development in highly sought after areas the most and are loosely if at all restrictive in depressed economic rural areas. Thus, most differences are settled in court or if the number of citizens are too few to make a difference in affecting the zoning body's decision. Citizens can rarely afford the individual costs of litigation up front to prevent changes in property zoning while the usual suspects consider legal costs and political contributions as part of the cost of development. Thus, citizens band together to use the main weapon that they have which are votes. The differences are hashed out in the courts and in the local governing bodies for the most part. And the lenders can *appoint* a temporary board, to hold sway until the homeowners elect a new HOA board. Regardless though, there is GOING to BE an HOA and it's board in that neighborhood. 280 Yo Horde,
I don't have my Scary Black Weapon Of War yet. What's a good to base model to look at? I'm assuming AR-15 but are there any others? What kind of features should I be looking for and what price points? Posted by: I Have Questions at August 15, 2019 11:59 AM (BvNzB) That's like asking what music you should listen to. The Orthodox are a diverse group. Some are fine; some are totally backward, clannish assholes. It just depends who you're interacting with.
I don't think anything should be done to infringe their rights (unless they are breaking the law of course). I'm also reluctant to wade into this, because the holier-than-thou attitude of Westernized Jews toward the Ashkenazi Orthodox has been a long-standing problem in Jewish communities. But to deny that some of them maintain a different holier-than-thou attitude toward their fully assimilated Jewish and Christian neighbors simply isn't true. Some of them can be extremely hostile. Even in Israel. The Mayor and the Town council are R's. I wonder what is going on there. It's a tiny town of 3800, but the Hasidim keep to themselves and don't typically bother others, from what I understand.
Posted by: Moki at August 15, 2019 11:56 AM (mFoNl) That can be read two ways. People who keep to themselves are often the best kind of neighbors. To a point. It's not that they don't "bother" their neighbors. The don't even bother "with" them. Their neighbors are invisible to them, dead to them. They don't give a fuck about their neighbors. But they make their neighbors give a fuck about THEM. Posted by: JoeF. at August 15, 2019 12:02 PM (NFEMn) 295
But at least I will be confident that they are in charge of their own inner circle, instead of surrounded by unprincipled cronies who keep their own boss in the dark while taking a hatchet to the Constitution. Is there anyone that Warren or former Vice President Joe Biden could bring to, say, the Justice Department, who I would fear more than an odious and sinister courtier like William Barr?
I never thought I could miss Eric Holder, yet here we are... Posted by: David at August 15, 2019 11:54 AM (jY1B4) --- Your type is sort of creating this problem that Nichols is complaining about. You've made it of such importance that nobody stands with Trump that plenty of resistance surges on the inside creating this chaos that you then complain about, including all the people that Trump has to fire because they turn out to band with the resisters in resisting Trump. Trump's not doing any of this. And after months of complaining that Bill Barr won't release the 4% of the Mueller report that was redacted for 2 months, you laud the first AG held in contempt for releasing 0% of thousands of subpoenaed documents for eight months. Hasidim isn't strange. It's a destructive criminal cult that has bilked the taxpayers of many upstate communities, robbed the public till and subverted both zoning and housing laws. They have a script, the enter a community, rob it and destroy it. There practices are demonstrably unhealthy for both the community and it's residents. Many are notoriously corrupt and they often succeed through bribes, extortion and political contributions. That's demonstrably true and if you've ever been to Rockland or Orange Counties you will find scores of residents who know it. Go look at their most recent handiwork in places like the Town of Ramapo, which they have virtually destroyed and decimated both the schools and tax base. Also take a look at how they leverage their citizenship with that of Israeli citizenship to undermine our immigration and tax laws.
Fuck them and a pox on all their criminal, non assimilating houses. Posted by: Marcus T at August 15, 2019 12:02 PM (VpIIl) 300
Ok a taste. Apologies to FiL is I mangle some of this.
The musket was useful in a military setting because it was fast to reload. No rifling, etc. The main issue was lack of range and accuracy, hence the tactics used (massed volleys, grouped fires, etc). If you showed up to muster with a rifle, you'd be placed with others in a more mobile unit, so for a set piece battle you may concentrate on cavalry (rifles had a 200 yard range or more with skill) or work to flank the enemy and try to take out some officers. The rifle was also greatly prized for guerilla operations. Two different tools. That said, muskets were cheaper and for a lot of families they were the primary arm owing to cost and such.

Just Say No.
Me likey. Emotional maturity is recognizing that a lot of bad stuff happens in life and you have to learn how to deal with it. Life isn't fair and never has been. And it's damned sure not perfect. Not everything will work out for the best. And some people are just no damned good. They'll do bad things just because they can and there's not always a reason for that. The really bad ones need to kept away from the rest of us, and if they insist upon doing really bad things, they need to be eliminated since they refuse to stop. Sorry, that's just the truth. If people can't deal with that, I suggest they figure out how to do so. If that fails and they persist in living in dreamland like a child where every story and problem has a fairytale ending, then I really don't know what to say to them to help. Life just sucks a lot of the time, more for some than for others. Deal with it or live a miserable existence. Posted by: BackwardsBoy - #PurgeProgressivism at August 15, 2019 12:23 PM (HaL55) 391

Why there isn't a hard and fast law that denies government the ability
to modify zoning and other regulations after a permit request is filed is simply beyond me. No hard and fast law, but Due Process does play a part. A D/P challenge should force an enacting body to justify the change; i.e., show a substantial and legitimate state interest. If they can't, the judicial arm of checks-and-balances, does have (potentially, anyway) the power to strike down an arbitrary re-zoning. The article does not mention it, but in some locales (including a town near me), the Hasidim declare their homes to be places of worship. This exempts them from property taxes. Naturally, the people who do pay property taxes resent this.
It is also common for local Hasidim to get married in a religious ceremony that is not recognized by the state. This allows the wives to claim government benefits as single moms. Posted by: sauropod at August 15, 2019 12:56 PM (+jJej) 433

I'd much rather live among the Hasidim, than among the violent anarchic black thugs I live with now. That said, "restriction of property rights limits economic growth" is a DUMB reason to FORCE people to integrate, and violates our freedom of association.
People should be able to found communities in which they can restrict ownership to people they love and trust, without the Federal Govt coming in with bayonets to force them to accept outsiders they don't want. We were able to do that until the 1940s, when SCOTUS removed that right. Now we joyfully celebrate the "Mississippi Burning" Fed Govt coming in and FORCING us to erect housing for people we hate. To read Donald Trump's tweets. And I do not have a Twitter account. They are available to anyone. P I never read responses to his tweets, the ones at the top are mostly Twitter-promoted lunatic wacko psychotics. Posted by: Anon at August 15, 2019 02:41 PM (yJy4c) 436
My Outlook constantly puts the PJ Media newsletter into the 'Junk Box'. I un-spam it every day and next day (or the day after) it's back in the 'Junk'.
I would have un-subscribed long ago except for this, it ticks me off! I wrote them a note about it... don't expect any reply of course. Posted by: 5Cats at August 15, 2019 03:18 PM (WFfld) 437
I also got kicked off a sub-reddit for saying (truthfully) that the DC Snipers were black, Muslim and gay. It was a discussion of how NO mass shooters EVER were liberals... if you can imagine that.

The news stories I've found say that it's a burden on the town to bus 30,000 kids to private schools when they only have 6,000 kids in public schools, but I don't understand the whole thing.
Posted by: Bandersnatch at August 15, 2019 11:25 AM (fuK7c) In NYS, transportation attaches to the student, whichever school he goes to. My public high school would have been a 10 or 15 minute walk from our house, vs the hour (in Long Island/NYC traffic) to the high school I actually attended. My first three years, the school district provided a bus. When the number of students going to schools in the same area fell below a bus worth, they brought a ticket on the Long Island, and bus fare from Jamaica Station (Change at Jamaica!) to school.
