Supreme Court May Be Leaning Towards Permitting Citizenship-Status Question on Census

Hawaiian judges had blocked the addition of the question -- which had previously been asked on the census -- claiming that there were some violations in procedure.

The leftwing justices -- the ones that NeverTrump has fought so hard to pack the court with -- seem to think that the question is illegal because it might reduce self-reporting of illegals on the census. Which could reduce their numbers as far as House of Representatives apportionment -- which strikes most of us as the proper outcome, because why should noncitizens be counted as citizens for purposes of allocating House seats?

The justices that NeverTrump fights to keep off the court signaled that they didn't understand why the census can ask so many intrusive questions but not this one.

It is a major fight over executive power with stark implications for the fight over immigration, and for national elections. Critics say adding the question would discourage many immigrants from being counted. How the justices rule could affect how many seats states have in the House of Representatives and their share of federal dollars over the next 10 years.

The 85-minute oral argument Tuesday grew testy at times, with several on the bench interrupting counsel repeatedly, and others offering lengthy explanations of their legal positions.

The four left-leaning justices pressed the solicitor general for the Justice Department to explain the reasoning behind the citizenship question, noting experts at the Census Bureau have said the citizenship question could lead to an undercount of as many as 6.5 million, especially in urban areas.

But several justices on the right questioned whether the citizenship question alone would cause an inaccurate census, saying the survey routinely asks a range of questions on the form, beyond the number of people in a household.

"The principal purpose is to count the population, but we've had demographic questions on the census," said Chief Justice John Roberts. "Sex, age, things like that."

It might decrease minority participation if the minorities in question are not citizens. If states want to harbor illegal immigrants, let them pick up the tab, but they can't have more seats in Congress because they are counting people who are not legal voters.

Meanwhile, Trump instructs a executive branch official to defy a congressional subpoena harassment.

The White House is telling a former official to ignore a subpoena from House Democrats, the Trump administration’s latest move to fight back against investigations into the president.

Carl Kline, a former White House official who had oversight of security clearances for the administration, was issued a subpoena and ordered to appear Tuesday for an interview by the House Oversight Committee. Late Monday, the White House told Kline not to appear for the deposition...

Trump lawyer Michael Purpura claimed the subpoena threatens confidential information, saying in a statement that it "unconstitutionally encroaches on fundamental executive branch interests."

The subpoena is about the #Resistance "whistleblower" who blocked a lot of Trump appointees from getting security clearances, and now complains that the president did what it is unquestionably his right to do -- he gave them security clearances.

The executive power is vested in a President. Lesser officials have powers delegated to them by the president. When he wants to take that back, because, say, he sees all of his appointees being roadblocked and slowrolled by #TheResistance, he can do so.

I had always assumed, based in my experience (or lack thereof), that the Census Bureau merely estimates the number of people in the US, and doesn't actually do a head count. But when I mentioned my never-been-counted experience in an earlier thread once, people told me that No indeed, they do an actual head count of every single person. Is that true? And if so, why have they never counted me?

The full census is only conducted every ten years. So it's not an annual thing, like filing taxes or renewing your car registration. You might have gotten a form in the mail and thought it was junk.

Just learned that 3rd party companies such as car mechanics and those quicky oil change places report your odometer readings to your insurance company.

I'll be contacting the ones I recently used telling them I will never use them again and will inform others in the form of negative reviews.

58 Every ten years the census is taken and for a deal of that time, where you were born, where were your father and mother born, year of birth, etc, was asked. The whole reason for a census is not just, hey how many humans occupy the territory of the United States, but how many citizens, ages, where did they migrate from, etc - so the US Government could more fully understand who they serve and protect. Its gob-smacking that anyone who would rise to the level of a SC Justice is incapable of surmising this.

Our 2017 Super Ultra Low Emissions Accord has to be tested annually. The 1991 Mitsubishi cruising around Charlotte with a solid black bumper above the exhaust is exempt, though.

Well, see, that's the real concern here. This isn't about legal issues or the census, this is about who gets what power, how the electoral college and congressional districts are drawn etc. Especially its about how much things change from 2010 when Obama took over the census and had his homeys run it.

California could easily lose a ton of power in congress and the EC by having illegals not counted. And the Democrats will do whatever they have to in order to stop that.

I heard on Beck's show the story of NFIB v. Sebelius. Apparently, the vote was 5-4 for knocking Abysmalcare out. And Roberts horse-traded his opinion with the libs, just lie a legislator does.

I used to think that it was enough that Roberts saved us from the precedent that Congress could compel action to regulate it. But now that I know he things horse-trading votes is a role for SCOTUS decisions, it's not.

I'm pretty sure between the two the Supreme Court has ruled we can commit genocide on citizens, so this should be a piece of cake. IIRC, there was a Supreme Court decision on this. It used to not matter so much when the voting wage was 21, but once it was 18 it did.

For the record, back when CA was still salvageable, I always kept my permanent address at the old San Jose ancestral homestead even when I was a student at Berkeley, because I knew voting in Berkeley would be hopeless.

But then San Jose changed too, once the defense contractors folded up. :-(

I did think about that - you're right, NO ONE wants to breathe a word about the infamous 3/5 clause. "Free persons" has always been understood to mean "anyone who isn't a slave". And iirc, all of the issues surrounding American Indian citizenship status were resolved in a massive bill passed by Congress in about 1920.

The issue in the present instance is that congress said the subpoenaed person couldn't have WH counsel present during the interrogation, whereas there are a number of Justice Dept. Office of Legal Counsel rulings/memos saying that unless the WH can have counsel present to protect the president's prerogatives, then the subpoenaed witness need not appear.

Cummins insisted no counsel present.

Based on the 3/5ths compromise, yes. Slaves had no vote or rights, but were counted for the purposes of representation. So in theory a whole colony of only slaves could live in a district and have representation without having a single vote. No idea how you'd select the representative, though.

It always chaps people to hear the Constitutional niceties, but the
Constitution mandates that the Census count all PERSONS, not all
citizens. Article 1, Section 2. It's language dating from long before
the 14th Amendment, where Citizenship was addressed for the very first
time, but it's still there.



Bottom line - until it's changed, the Constitution demands that
Congressional Seats be apportioned on the basis of all Persons counted,
not all citizens.



Why the Dems are mad about the question is that they think including
the question will scare off illegals from answering, and thus will make
their representation drop. But there's no question that if they're
counted, they count towards Congressional Representation, no matter what
their citizenship status is. Them's the rules, until we amend the
Constitution.

I'm calling BS on that; as the article was originally written, I would argue that illegals would not count towards their (the state's) number of free persons. The language of the 14th referring to reducing proportional representation of citizens not allowed to vote and removing the 3/5ths language reinforces that, as does the utter lack of practical reason to allow tens of millions of foreign criminals to help determine representation.
I'll further put forth that this is worth going to war over.

Illegals, by definition, are not residents.

What we have are
-citizens
-immigrants
-LPRs
-non-residents (who are not counted)
-non-immigrants (who are not counted)

- and invaders. Who the prog-cong want to count for representation... and shifting federal tax dollars from states with relatively fewer invaders to states with more. Sactuary cities and states are deliberately trying to boost their census count to suck money from others.
