All Charges Against Jussie Smollet Dropped. Sentenced to Community Service Only.
KIM FOXX, ALREADY ACCUSED OF DOING FAVORS FOR JUSSIE, DOES ONE MORE FAVOR.

Sorry for the stompenating -- I'll bump the Morning Rant back to the top in a bit. But everyone's going to be talking about this, so might as well make it official.

Listen: There are no legal consequences for filing a hoax report of a hate crime.

None. Zero.

If you're in a Protected Class, you can break the law to "raise awareness" to your heart's content.

Jussie Smollett will not be prosecuted for allegedly faking a racial attack, because all charges have been dropped!!!

Jussie and his lawyers ran to court Tuesday morning in Chicago, where he was facing 16 felony counts of lying to police in the alleged racial and homophobic attack.

Jussie will surrender his $10,000 bond. We're told he has agreed to perform community service. But that's it. The case is over.

TMZ claims the prosecution case "disintegrated" because the check Smollet paid to the brothers can't be proven to be in exchange for participation in the hoax, but can be claimed to be for workout coaching.

This "reporter" quotes this statement, which I'm going to assume is from Jussie Smollet's fixers, though it's not identified as such.



Here's an alternate possibility: The friends who called in to the Chicago DA's office to get special favors for Jussie got a new favor.

The head of the Chicago Police union has previously called for a special investigation into the Cook County State's Attorney.

Last week, the president of the Chicago police union asked the U.S. Department of Justice (DOJ) to investigate whether Cook County State's Attorney Kim Foxx interfered in the police investigation of Empire star Jussie Smollett. Further reporting suggested Foxx may have interfered after receiving a text from Tina Tchen, former chief of staff for former First Lady Michelle Obama.

"It seems a totally inappropriate thing to do, to ask a prosecutor to get involved in a case that early on," Martin Preib, 2nd vice president at the Fraternal Order of Police (FOP), told PJ Media on Friday. Tchen urged Foxx to bring the FBI into the case on February 1, three days after Smollett claimed to have been attacked in a racist hate crime.

Foxx had recused herself from the case, but Fraternal Order of Police (FOP) President Kevin Graham demanded an investigation last week.

Graham sent a letter to U.S. Attorney John Lausch, asking for an investigation into Foxx's interference in the Smollett case and her role in several exonerations of convicted killers.

"Such conduct merits a review by your office. Private attorneys are not allowed to interfere with ongoing police investigations, particularly at the request of private individuals associated with subjects being investigated by the police, in this case, a subject later determined to be the offender, not the victim," Graham said in the letter.

"According to the media reports on public documents, one of Smollett’s relatives was communicating with Ms. Foxx about her request to transfer the case to the FBI," he added. "Ms. Foxx ultimately recused herself from this case as a prosecutor based on those communications with relatives of Jussie Smollett. That recusal is wholly insufficient. In order for Ms. Foxx to properly charge and try this case, her entire office should have recused itself and a special prosecutor been appointed."

The request for the DA to get involved was, obviously, an attempt to get the police to focus on finding the "real attackers" and not spend as much time wondering if Smollett's story was true, obviously.

Special government favors for special government friends.

UPDATE: POLICE SUSPECT KIM FOXX IS DOING FAVORS FOR A FRIEND! TMZ has updated, and yeah, it's all about Kim Foxx.

We're told the State's Attorney, Kim Foxx, told Chicago police she was dropping the case because Jussie would have only gotten community service if convicted and she said he has already performed community service so there is no point in prosecuting him. We could not find any record of Smollett doing community service.

We're told Chicago police are "furious" and feel something untoward is going on with Kim Foxx.

Sooo...

Kim Foxx is offering you a buffet of explanations: Either they can't prove what the check was intended to pay for or Smollett's already done the community service work he would be sentenced to serve so why bother noting he broke the law at all?

When someone gives you several explanations and invites you to choose the one you find the most plausible, you know that person is telling the truth.

Update: This isn't new news, but I missed it: Commenters are underlying the records in this case have also been sealed. As if the people involved were minors.

So now with the records being sealed, there is less risk of digging into the case and further negative stories about Smollett -- or Foxx.

We'll see if any annoyed cops want to do some unofficial unsealing.

I do not see how not being able to prove the payment was for the fake attack undercuts the case that it was a fake attack and Jussie knew it and therefore his police report was false. If the case is based on conspiracy all you have to show is that there was an agreement and an act in furtherance. Are we supposed to believe that there was no agreement just because the payment purpose is unclear? Money exchanged is not needed for an agreement. Clearly there was an agreement - to meet at 2:00 in the morning on a historically cold day. And, the parties played their part in the agreement. Something else is going on here.

No, it just means that prosecutors decided not to go forward with the case.

Nolle pros's are super common. Like if you get picked up for a misdemeanor, and have an otherwise clean record, it's really common for the State to continue a case, demand you do community service, then assuming you do the community service and dont get arrested again within 6 months or a year, nolle pros the case.

Procedurally, it's weird. I describe the normal process above.

But the outcome is about what I'd expect.

If I were a prosecutor and saw a complaint from the cops that included 16 felonies when the underlying behavior was filing a false police report, the deal I'd probably offer would be pleaing to a misdemeanor, and some community service... and maybe paying some kind of fine due to the amount of resources the cops wasted.

Which is kind of what he got, although it's procedurally weird how they got there (I assume politics were involved)

I've never heard of that. Granted, my criminal justice experience is limited to interning in a prosecutors office during law school, but... at least in the state I was working in, bonds were most definitely not used as punishment. And the only time anyone ever forfeited their bond was if they left the state to avoid going to court and had to get picked up and extradited back.

Even just missing a court appearance or two wouldn't necessarily mean a bail forfeiture (which pissed off some people in my office)

There was an aggravating factor - Jussie simply lied to the police in furtherance of the bigger fraud. Whether that fraud was perpetrated to enhance his personal fame and finances, or to incite hatred of an opposing political faction, or both of those things at once, is anyone's guess. But "lying to the police" was the least of this, and just so happened to be the chargeable offense.

It's not illegal to tie a noose around your neck or hire your friends to hit you.

The only actual crime he committed was lying in a statement to the police. Which, well, happens all the time. Many people, believe it or not, are not honest to police officers.

Cops have a range of what I (somewhat sneeringly, I guess) call "contempt of cop" charges that they can charge people with if they so desire, but rarely do unless in combination with other charges, because those charges rarely hold up in court and they bog down the whole system.

This is close to the outcome I expected, but I am most certainly outraged about it.

This was not minor infraction against cops like "no officer, I wasn't speeding", this guy probably spent millions in police resources, created an elaborate fraud, and basically tried to start riots around the country.

All that Harry did was to tell the truth - of course they overcharged, he lied to the police and make a false report, that's one offense of lying, not 16 offenses because his report had 16 sentences in it (or something like that)

But we've all gotten used to that kind of thing, because EVERY prosecutor on every level in every jurisdiction in this country now routinely overcharges, because the game is always pleading down and the prosecution always insists on dealing themselves a strong hand to start with.

Between 90% - 95% of all criminal cases in this country are now decided that way, if you didn't know. If you want to call that corrupt, then sure, I can't argue against you - it's also The System, everywhere now. And if you look at it honestly, the Prosecution is usually more corrupt than the Defense. (E.G., See Robert Mueller)

As the old saying goes, you don't want to look too closely at how the sausage gets made, because you're not going to like what you see.

The criminal justice system isn't really the correct venue to express outrage over his actions though, as the crime he committed is usually (in the jurisdiction I'm familiar with) a class b misdemeanor, which usually means the charges get nolle pros'ed after some community service or other minor slap on the wrist type stuff.

What he did was morally outrageous, but not ... super criminal, if that makes sense.

Although the Nigerians are no longer going to be around to question, apparently, it was always quite easy to point out why the story of them doing it on their own wouldn't wash. Smollett was 30 miles away from their home, after a flight that had been delayed for hours, in a place and at a time when no one could have predicted the would have been there. How could the brothers have found him, unless Smollett called them and told them where he was? It just wasn't possible.

I think all I was trying to say that this is exactly how the criminal justice system works. Cops routinely vastly overcharge a suspect, prosecutors plea it out.

Now, you can have problems with that system, but you also shouldn't be surprised when the system does exactly what you'd expect it to do.

As I said, the criminal justice system is not an appropriate venue to want to punish this dude for what he did, since the outrageous parts of what he did weren't crimes.

The only crime he actually committed (putting aside the mail stuff) was a minor process crime of lying to the police.

Which, unless you're Martha Stewart, is not something most people go to jail for.

Fast forward to March and following a FOIA request we come to find out that the "facilitated connection' was actually undue influence on the investigators and possibly obstruction of justice:

2. March 14, 2019 Chicago Tribune reported -- "After being approached by a politically connected lawyer, State's Attorney Kimberly Foxx asked Chicago's police Superintendent Eddie Johnson to turn over the investigation of jussie Smollett's reported attack to the FBI [...]" it continues "Foxx reached out to Johnson after Tina Tchen, former chief of staff to first lady Michelle Obama, emailed Foxx saying the actor's family had unspecified 'concerns about the investigation."
Those emails between Foxx and Tchen began on February 1, 2019.

Now we are at March 26, 2019 and Kim Foxx has dropped all charges against Smollett (after previously recusing herself from the matter back in February) and trying to pass the investigation onto the FBI.

There needs to be a federal investigation into:
1. why Kim Foxx recused herself in February but suddenly intervened by dismissing charges in March
2. why Superintendent Eddie Johnson went along with this and for what reasons
3. who wanted this deal made for Smollett,
4. why that deal was made
5. what was the payoff or quid pro quo for completing such a deal
Federal DOJ needs to send investigators into that office IMMEDIATELY and open an investigation into this madness.

That's really weird to me.

As I said upthread, the only time I ever saw people forfeit bonds was when they fled the state and the prosecutors office had to pay to transport the assholes back from wherever it was they got picked up on a bench warrant. Mayybe once or twice for people who no showed on a court appearance, but even then...

the idea behind bail is not supposed to be punishment, it's supposed to be an incentive to show up for court.

Yeah, the procedure was very odd. It was designed so that his PR people / lawyers can say "he was exonerated."

But prosecutors have a lottt of discretion in how they handle their jobs and cases.

If something inappropriate happened here on the prosecution side (and it very well might have), that would be a separate issue.

I really don't think so.

Incitement is a very specific crime, I don't have the elements of it for my state, let alone Illinois, in front of me, but basically anything short of saying "YOU IN THE ANGRY MOB, GO MURDER THOSE TWO PEOPLE OVER THERE" is pretty much protected by the 1st amendment.

There has to be an element of imminence to it... There's some SCOTUS cases on this subject, I don't remember all t he details though.

I think corrupt is a strong word. There are certainly issues with the criminal justice system in particular, but I think overall our court system functions pretty well and english common law is, over all, a pretty solid system.

The problem is that it's easy to criticize the judicial system, it's just really hard to come up with something that would work better.

As a lawyer, you have a duty to zealously advocate for your client. If you're a criminal defense attorney (which I'm not), that means doing everything you legally can to defend your client, who may be horrible person who does horrible things.

It's not the system, itself, that is the problem. The system is generally good and important. It's the scumbags who infest the system and pervert it, at the moment, that is the problem. It's the laughable mockeries of the system that are allowed to live in the system that are the problems. It's the people who take all meaning out of English within the system and are accepted by others in the system that are the problem.

It all comes down to a lack of courage - a dearth of courageous people - people with integrity - in the system. This is always an issue in government and is why the Founders took such great pains to limit the government's (all governments') powers. Well, the fact pattern in that case was kind of weird. NH had a law at the time against speech that intentionally offended people. A law which I don't think would ever pass 1st amendment muster in this day in age.

A dude called a cop a fascist or some such nonsense and was arrested for that.

The supreme court upheld NH's law on the theory that some things are so offensive that they aren't protected by the 1st amendment.

It's a REALLY weird case, and a really weird outcome.

Keep in mind that this was the 40's, post Lochner-era court, and a lot of FDR picked / progressive nutjob justices were on the court.

Checks and balances, right? The problem is, the balancing forces are completely co-opted. If not for one brave man in the Presidency, the American people would have no elite advocates at all. Which is FINE, the Revolution made do with some planters, a brewer, and whatever Patrick Henry did. But right now the American people would be unquestionably better off if Donald Trump ordered the Marines to gun down the House of Representatives. Even the Republican side. Especially the Republican side.

The system is not designed for a foreign, totalitarian influence that malignantly permits incompatible minorities to usurp the American people. It is wholly incompatible to rule a people without God or a common culture.

Yeah, I highly doubt that NH law would be upheld in todays day and age on 1st amendment grounds (NH has subsequently repealed that law, by the way.)

on more mundane matters it works OK. But a necessary cog in the machinery is where the people rise up when little mafias/cartels form and protect their own. Chicago comes to mind, but many cities have versions of complete double standards and corruption that is rotting the country, taken as a whole.


So the people in time, need weapons to remove mafias when they take control of the system. The mafia got control in many places, by using just that sort of carrot/stick approach. Reversing it takes the same kind of "sovereign will power".

In the old Westerns, the white hat came along and killed the black hat bad sheriff. Doesn't happen now ... so we flail ... and fail, and descend into control by the cartels and special groups. The guild protects its own.

2) Kim Foxx is reputed to have had political ambitions above her current office. She was an up-and-coming Democrat. Those ambitions are likely dead.
