McConnell: Trump Will Sign Spending Bill, But Then Declare Emergency to Build the Wall

I don't think he should sign it, not yet at least. No one knows what is in this thing -- it could have a dozen poison pills forbidding Trump from declaring an emergency, or empowering liberal officials to block the wall, empowering the EPA to block the wall, limiting detention bed space, empowering local officials to create sanctuary jurisdictions without consequence, etc., etc., etc.

Artisinal 'ette brings up one such trap:

As @JessicaV_CIS notes, there is a serious amnesty/sanctuary provision snuck into the spending bill.

Section 224(a) would make it so ICE cannot detain or remove anyone who has effectively any kind of relationship (even just as a "potential sponsor") with any unaccompanied minor:

Here's a gem from the spending bill. Section 224 (a) says that ICE may not remove any sponsor or *potential sponsor* or *member of a household*
of a UAC [Unaccompanies Alien Child]. That's de facto sanctuary for anyone near a UAC.

Ridiculous. 30-40% of MS-13 arrests have been UACs.

The budget also provides $30 million to hire pro-migration groups that will guide migrants towards winning asylum:

Take the time to read this thing, for crying out loud.

And don't count on Republican congressmen to have stripped the poison pills out -- they probably schemed with the Democrats to put them in.

I can forgive Trump failing, given that he's up against so much opposition, but if he signs this thing knowing in advance it is another exercise in Failure Theater, then I'm all done here.

If Trump's also going to be an actor in DC's long-running production of Failure Theater, then what is the use of him?

McConnell, however, is now saying he will support, rather than oppose, the declaration of a national emergency.

Seems like some negotiation happened, at least on that front. But if McConnell is agreeing to "support" a national emergency in order to get Trump to sign a bill he knows has a poison pill that prevents it -- what kind of victory is that?

President Donald Trump is ready to sign compromise spending legislation that would avert another government shutdown and will declare a national emergency to get additional funds for a border wall, Senate Majority Leader Mitch McConnell said.

McConnell said the Senate will vote on the plan at 3:30 Washington time Thursday. The House is set to vote later in the evening.


The president "has indicated he’s prepared to sign the bill," McConnell said on the Senate floor. "He also will be issuing a national emergency declaration at the same time. I indicated to him I'm going to support the national emergency declaration."

The Freedom Caucus wants to just pass a one-week spending bill at current levels to give them time to read this monster bill and strip out all of its poison pills.

If McConnell refuses this -- this means McConnell is refusing precisely because he doesn't want those poison pills stripped out.

1) The alternative is going to be some kind of disaster. Shutdown of aviation, civil war, whatever. I would like the President to ignore Congress, but for whatever reason that isn't his style.
2) Congress -hates- the American people, regardless of who is temporarily in power, and things like this only make us hate them back.

In other words, he would shield his caucus from *any* votes on the big issues. Not aware of any comparable move by a majority leader, in my lifetime. Sounds inside-baseball, is actually a stunning open declaration that "we're hiding on this, and we don't even care if you know".

Yeah, never understood the whole lengthy immigration/deportation proceedings. Once you are picked up you have a set time to show you are in the country legally or you are escorted to the border or put on plane. If it is a matter of dependents, they can be sent with you and a bill sent later. That should be the extent of these deportation proceedings.

Other contingencies in the spending bill include a provision dictating what type of a border wall can be used. None of the prototype border wall designs built for testing in the San Diego desert are permitted for use by DHS. Instead, the wall must continue to be steel bollard-style fencing that both the Bush and Obama administrations used at the southern border.

If it hasn't passed both Houses already and been signed into law, I don't see how he couldn't veto it. That is his job. To either approve legislation passed or not approved it in which case Congress has to override his non-approval to make it law.

He can veto it and make them go through the effort of overriding that veto. There is nothing in the Constitution (that I know of anyway) that says he can't veto if they already have enough votes to override.

And as noted by ace and others, over-riding Trump veto on this would be far from certain. It would, in effect, be the GOP's open declaration of war on Trump (and his voters) - so brazen that even American voters would notice.


Been many years since we've had genuine veto fights. Back in the 80s/90s, when they did happen, over-rides were rare, and an uphill thing for Congress. As noted earlier I don't really know what country I'm looking at any more, but if I have to bet right now, I'd say over-ride of veto on *this* incredibly disastrous bill would be a long-shot.

Here is another reason why:

The bill could be cleverly self-referential.
That is, they could use vague wording in a tediously obscure and seemingly innocuous section of the bill that 'suggests' that some other remote section of the bill be 'consulted'. And that remote section of the bill could then address some seemingly trivial issue BUT THEN vaguely refer to yet another remote section of the bill which would use vague/obscure language to undermine any and all presidential authority to build a border barrier without further congressional approval.

In other words, they could have vague and subtly layered self-referential triggers that LEGITIMATELY result in the repeal the president's authority to declare an emergency.

I am EXTREMELY worried about this shit-burg of a bill that's about to be jammed through without carefully analyzing it.
The fucker is over ONE THOUSAND PAGES LONG!

They could totally fuck the president up with this damn thing.

If Trump declares an emergency and THEN signs the fucked up bill, then his emergency declaration should not be effected by whatever fucked up poison pills are contained in the bill.

If he fails to at least declare an emergency BEFORE signing the shit-bill and then the shit-bill fucks up his action: THEN ITS ALL ON TRUMP.

I've been reading all week about his wanting more foreigner workers here. He's a liar as far as I'm concerned.

That was not what was promised on the campaign trail. He's lied about DACA and now is wanting to screw over Americans for cheap labor that brings in their families, lives off govt. programs, and never leaves, drop their anchor babies who get to call all of us white people (you know actual Americans) racist.

It's amazing. A white kid, American can't check a government application box for but a Hispanic or Indian or Nigerian kid can. It's absurd.

I bet all those white ancestors are sure glad they sacrificed and went to war after war after war for Somalians and Indians to be able to tell their grandchildren, great grandchildren, great great great grandchildren their racist in their own country. That their descendants are only here to pay for non-white people and non-citizens.

Sorry guys, if Trump were serious about this, he would have done all of this while the Republicans still controlled the House.
He would of still would have failed but he would of have had a better chance than trying to do this with Nancy in charge.
The only difference is that the voters would have blamed the Republicans.
