Yay!!! Andrew Cuomo's Pro-Infanticide Abortion Law Spares a Murderer an Additional Charge of Also Killing His Girlfriend's Unborn Baby

The second charge was not for murder; New York law, I guess, never allowed for that.

But they did have a law against "second-degree [unlawful] abortion," a law violated by this guy when he deliberately murdered his pregnant girlfriend.

But that charge has been dropped now, because New York no longer has any laws against abortion at all, even inflicting one on a completely unwilling party.

Queens District Attorney Richard Brown sent out a press release saying Anthony Hobson, 48, would be charged with second-degree abortion as well as murder in Sunday’s fatal stabbing of Jennifer Irigoyen, 35.

But a DA spokeswoman later told The Post that the abortion charge "was repealed by the Legislature, and this is the law as it exists today."

...

It faced fierce opposition, with the New York State Catholic Conference warning that it "removes accountability for those who would harm unborn children outside the context of medical termination of pregnancy."

Cuomo's office did not comment on the murder case.

28 Watched Gosnell movie last night. It's the perfect compliment to the lunacy in New York and the comments by Northam. This law in New York sounds great to soft leftists (Women's Rights! Light up the Empire State Building pink!) but when they are confronted with the reality of late term abortion, it's not at all what they thought they were doing. In fact, it's appalling to all but the most hard core (nearly psychotic) pro-choice fanatics. What this guy is NOT being charged with now is so mild compared to what this law really allows - which Searcy did such a fine job explaining in that film.
Encourage your liberal friends to watch it. If you can get them to do so, we may yet turn such lunacy around.

Regardless of Cuomo's Catholicism, the law was passed by the entirety of the state's legislature and signed by him.

149 I have had several female bosses and they were uniformly not great. One was fixated on hiring women and getting men out of her department. However, that's a pretty limited sample and I don't doubt there are some good ones out there. I had my share of crappy male bosses too.

However I do think that, whether its cultural or inherent, men do take to positions of power better than women do, on average. That it takes a pretty extraordinary woman to be in power and handle it well.

That was later rolled back somewhat by making it available for "special circumstances". And illogical ruling since it did not remove the cruel and unusual punishment categorization.
But one of the "special circumstances is "multiple murder".

Absolutely true NGU and I am a Catholic. I also remember that when I served in the military one of the things I was rated on in my OER was Moral Courage. And I was nothing but a grunt but that rating had an impact on my career. The Roman Catholic Church seems to be singularly lacking in this regard. Maybe they should consider incorporating it into whatever their version of an Efficiency Report is. You'd think it would be at the top of the list. You would think.

Sure - it really is one where I can see both sides, though.

I don't actually have a moral/intellectual objection to it. We're not talking about an innocent person here, in fact, it's quite the opposite.

My qualms are practical - the government is so incompetent that I don't really trust them with this power even if their hearts are in the right place.

Which, all too often they're not... there are prosecutors out there who will most definitely lie, withhold exculpatory evidence, bribe witnesses, whatever they have to do keep up the conviction rate and get maximum penalties.

On the other hand, some crimes cry out for blood, and some cases have such a preponderance of evidence that there can be no doubt.

It's a tough one for me.

More than half the problems this country faces - that cannot be fixed - are because of the courts (the federal courts, mostly) making totally insane and frivolous rulings about very serious and clear issues. It is a real problem and one of the reasons why things will never be fixed without actually breaking the system and starting over - i.e. national divorce.

And of course there's the insidious rot that has corrupted its upper levels.

I'm sure a lot of Protestants are enjoying this, but if we fall, you'll be next and you won't last half as long. The Methodists, Presbyterians and Anglicans have all succumbed, as have a number of Lutheran denominations. The Southern Baptists are starting to feel pressure.

Handing out excommunications is a drastic step that can backfire in a big way. It is also likely to prove completely ineffective if not counterproductive.

Yah, when my ex and I went to the meetings for interested foster or foster-to-adopt parents (held in each major county AFAIK), it was really eye-opening. Only two couples out of 30 odd were interested in taking the risk of foster to adopt, bonding with the kid, only to have Messed Up Mom potentially want the tot back in the future. The rest were just there for that sweet sweet stipend, and if you are on General Assistance and staying home anyway, as many AFDC Welfare Women are, hey, why not?

What really chafes my butt is that the "cruel and unusual punishment" clause was directly aimed at "drawing and quartering" which was a punishment meted out to those who were alleged to have committed treason against the crown. So a simple execution was judged to be the same as torturing someone for several hours prior to cutting out their intestines and beheading them.

This one happened in NY (of all places). A Brooklyn man, who'd been in a 9-year relationship with the woman, had her assaulted and beaten when she was 7 months pregnant, killing their baby daughter.

The man was angry because the woman had refused to go to several appointments he'd made for her with an abortion doctor, and also because the woman had threatened to tell his fiancee' that she was pregnant by him.

Shortly before the assault, the man had researched "can being hit in the stomach cause a miscarriage?" and similar type questions on the internet.

Among the charges he was found guilty of were assault, and "forced abortion." This was in 2015, before the new law was passed in NY.

What annoys me is that no punishment is innately cruel and unusual. It is in relation to the crime committed. Of course, it's cruel and unusual to jail someone for 5 years for stealing a stick of chewing gum, but only in the wildly disproportionate relationship between the crime and punishment.

Drawing and quartering is a perfectly reasonable punishment for someone who drew and quartered an innocent victim.

Reciprocity dictates what is fair and what is just. Reciprocity is the very foundation of fairness, and every human knows this intuitively. And with a crime there is a punishment added to the reciprocity (since the criminal forced his actions on the victim).

The SCOTUS has the reasoning ability of a 9th grade girl, generally. Most of our judges are pretty awful, which is why it ticks me off so completely that they are never even threatened with impeachment for being total anti-Constitutionalists and idiots, while they have lifetime appointments. It's just crazy.

The Founders really shit the bed on this one - lifetime appointments don't remove politics from decisions, it makes those in such positions more brazen and nakedly political.

The price of adopting in the US is more expensive than going overseas and adopting and it's permanent.

But crisis can bring renewal and resurgence, and that's the historical pattern with the Church.

People who don't want to admit to the existence of Evil like to make the insanity claim - because to accept that those two men (and others who carefully and deliberately do horrible things, like Ted Bundy or Stephen Paddock) are sane overturns their entire worldview.

But look at the facts - Both Dylan Roof and Nidal Hassan, (and Paddock and Bundy and many others of that type) carefully planned their deeds in advance, took care to gather weapons, took care to make sure their victims would be vulnerable, made sure that no one would stop them, and at all points were very clear in their own minds about what they were about to do.

That's not insanity; those perpetrators were completely sane. That is simply pure Evil. Our ancestors knew that, and knew how to deal with it. How come so many of us don't????

Strangely, their song "Madness" was NOT on their album called "Madness," but was on an earlier album.

Also, semi-disqualifying them: The song "madness" that they do is just a cover version of an old ska song, and so wasn't their own original song -- in fact, they named their band after the old song, so it's kind of cheating to include them on the list. It's equivalent of there being a Led Zep cover band that calls itself "Stairway to Heaven," because that's the signature song. Doesn't really count.

The Catholic Church does indeed "presume" to know God's will. (And of course every Christian church has the teachings of Jesus, which are pretty clear about various aspects of God's will, Jesus being God and all.)
The RCC has the Magisterium as well, interpreting the biblical texts and previous magisterial writings. Add in papal infallability.
The Magisterium teaches that the communion host and wine are literally the Body and Blood of Christ. It seems reasonable, though I don't know the official position, that taking communion while in an unrepentant state of mortal sin would be committing the sin of blasphemy. If that were so, the a priest knowingly administering the sacrament would be aiding blasphemy.
So I don't know about excommunication, but refusal to administer any sacrament other than confession or last rites would, again, seem reasonable.
No teachings, AFAIK, about brackets.

Just my two cents' worth.
