Trump: We're Reopening the Government for Three Weeks; If After Three Weeks There Is No Deal for a Wall, The Government Will Either Shutdown Again or I Will Use Emergency Powers to Order The Wall Built

Video here.

Can I ask a favor? I know some people are in End of the World mode but can I ask you to use the words "Temporary reopening" if that's what it is?

It's beginning to seem trollish when people deliberately ignore this part of it and/or do not explain how a temporary reopening changes things. It changes things for a few weeks. Then right back to shutdown.

If it's a full cave, that's one thing. But if it's a temporary reopening, that's another.

18 A temporary reopening takes all the pressure off the Dems.

They know that Trump will eventually cave IF he shuts down the government again.

Especially as he has caved on this exact point with the last 2 years of Republican congresses, who could have funded the border wall if they had wished to.

Remember this is not happening without a lot of history of already broken deals, from both Democrats AND Republicans.

Slats are important for the outermost barrier as it allows the defenders to see an approaching enemy. If multiple layers are allowed the second fence/wall can be solid so the enemy cannot observe the defense.

There's the SOTU and, as somebody just mentioned, the Super Bowl.

He'll never go the "declare an emergency" route. It's a loser and he knows it. That's just big talk - empty threats. The 9th Circuit would shut that down immediately, and it wouldn't be overturned until his next term (which might not happen without some significant progress on The Wall). In other words, it's not a power move - it's a surrender.

It's an old tried and true tactic and Trump has let it happen.

I think 3 weeks is too long.

And it's far, far from "trollish" to be bearish on all of this. Anyone familiar, actually familiar, with the reality, substance, and politics of these issues for the past 3 decades has very good reason to be pessimistic.

Posted by: Froderick Wonkensteen at January 25, 2019 02:22 PM (SW5SE)

There's the SOTU and, as somebody just mentioned, the Super Bowl.

He'll never go the "declare an emergency" route. It's a loser and he knows it. That's just big talk - empty threats. The 9th Circuit would shut that down immediately, and it wouldn't be overturned until his next term (which might not happen without some significant progress on The Wall). In other words, it's not a power move - it's a surrender.
=====
The Hawaii judge is waiting with a preliminary injunction in his pocket.

It'll be appealed. But the record will be better if they tried to everything they could before declaring an emergency. It would set terrible precedent but I'd not be surprised to see the Deep state do it to Trump - I don't trust Roberts at all and I'm not completely sure of the new guy yet.

Also in three weeks it'll be hard for them to hide that Ruth is room temperature.

I know I'm not perfect, not sure about anyone else.

As far as I am concerned, Trump has shown good faith in fulfilling his promises, and I didn't even vote for him.

I am willing to cut him some slack. Almost the entire political and media establishment, including people in his own party, are arrayed against him.

424 One thing we don't know is how many Republican senators are in the surrender caucus and what role they may have played. Trump may have had to make a deal with them to reopen in exchange for future support, or he may have added up the numbers and saw the Dems were going to win at some point once all of the quislings defected.

We will have to wait and see how everything plays out. I know there were Dem senators bitching that Pelosi wouldn't go ahead and fund the wall, so now there is maneuvering room on both sides. The one thing we have to guard against is giving up too much just for a partial wall. And of course the Dems have a bunch of radical freshmen who will make them pay for any deal. This will be interesting.

This is in no way a cave. It's Trump picking up the Shutdown rock so he can drop it on them again. Three weeks removes the pressure from him, but NOT from the Democrats, because if they don't deal then this happens all over again. The happy talk about the Democrats being so reasonable is exactly what he always does in order to put pressure on the people he's negotiating with. And it works, very well. From the rope-a-dope of the "shutdown has ended" to "...for three weeks" it's setting the Democrats up for another punch.

459 When dealing with news and internet outrage, I try to wait 72 hours to let the dust settle before reacting.

Whether this is mainly a tactical retreat/defeat or a strategic one depends on what happens during the next couple of weeks. The problem with bi-partisan deals is that the Dems have traditionally rolled Republicans in such things by getting what they want and nothing of what the Republicans in Congress claim they want thus the initial BOHICA reaction to any sort of deal in threads like this.

There are some other confounding issues is that crises such as Venezuela, intelligence of possible terrorist strikes, and the possible need of replacement of RBG, might also require funding at some level or there might be evidence that it is beginning to impact the economy through declines in corporate investment, etc. Not having POTUS sources of intelligence about things to come might affect us. We also have no idea of Mueller's operation and what it is doing which the White House probably does.

The media provides air cover to the Dems and much of the alternative Republican media are creatures of Chamber of Commerce which hate DJT and emerging nationalism with a passion. DJT's support in the House and Senate is shallow because most of them have goals to avoid any confrontations in order to win reelection.

Few, if any, have any real principles to speak of instead of personal enrichment, media coverage by being a maverick, and power. Just look at the despicable Senate Intelligence Cmte's bi-partisan behavior for example.

Thus, DJT may feel that a SOTU address that allows him to speak unfiltered to the public may be his best option politically. It has worked in the past, namely Reagan's speech before Congress after surviving an assassination attempt.

The wall really ain't about the wall. I mean, yeah, it kinda sorta is, but there are two crucial tasks ahead of Trump: 1. Destroy the Democrats and tame/kill the Gopes, and 2. Protect the border.

Can't really do the second unless you do the first, and if you don't do the first, no wall is going to stand high and tall and long enough to accomplish the second.

He's done that for 2+ years. President Trump has done magnificently with his executive power, but the largest Republican failings- exploding deficits, Obamacare, Mueller witch hunt, the ongoing coup- are down to extending chances to people who do not deserve it.

There are a lot of things demanding the President's attention, but few are quite as important as having a functional government with good border enforcement.

Either he gets some Democrat votes in the Senate and gets Nancy to pass a bill with wall funding or he has to go nuclear. This has always been the case. And when he goes nuclear he will need as much public support as he can get.

If he looks petty or like a dictator he will lose public support. If he appears reasonable in the face of overwhelming political resistance he may get more.

There never were any great options, he has to try shape the battle space in his favor to the extent he can. He just did that by giving them one more shot and told them they either negotiate a deal he can sign or they will force him to do it on his own.

It's only 3 weeks. The world isn't going to end. And then he will either do it or lose re-election.

Unless the Senate is going to pass a House bill that is already approved... ie a Nancy Bill.

The house needs to be in session... and they took the weekend off, many are out of town.

So, unless they come back, Monday is the earliest they could vote on a bill, and unless they pass a bill directly from the Senate, it will then have to go to a conference committee....

Don't see that happening by Tuesday.

If he delivers a calm, measured SOTU devoid of attacks on Democrats and long on what he wants to accomplish and why, he'll capture the peak of the high ground and ultimate victory will be his.

If anything, it calls her bluff. Even a temporary re-opening will mean nothing. I have my doubts as to whether Nancy will OK the SOTU, since it isn't a permanent re-opening - good ol' fashioned moving of the goal posts.

Of course, Nancy LIED about it being about security, and it ought to be blindingly obvious to anybody that she LIED when she claimed that her problem with The Wall was that it was a waste of money. Nobody should believe that this disruption in government function was to save a few billion dollars - especially from a Dem, for cryin' out loud.

This is a Marbury v. Madison issue that goes back to 1803.

Jefferson said that SCOTUS couldn't issue him a writ of mandamus, they said "yes we can, but we happen to agree with you on the merits of the case." and thus began the concept in the US of judicial review (to be fair, it existed in England.)

There is no legal theory that I know of that says that certain laws are out of bounds to judicial review.

Congress could, theoretically, limit federal court's jurisdiction, as per article III, but they have not.

695 There is a general tendency for the individuals to overvalue potential and actual losses and undervalue potential and actual gains. Outliers either overvalue losses or gains accordingly or riverboat gambler types do not care as they live for the thrill of living on the edge.

If we apply that to this situation, what have supporters of DJT actually lost? What if any are the potential gains/losses of DJT's punt on this for three weeks? Not seeing much evaluation of this.

Jackstraw, among others, has laid out that this is a considered political strategy to show DJT's good faith that Congress will address the issue or he will fund it anyway through emergency funding. The key variable is whether the public cares enough about the situation to support his subsequent actions. For that reason, the SOTU address could be the best way to pursue support. That might or might not be true depending on the situation and events of the next three weeks. My crystal ball is cloudy on that one.

Naysayers like Chi-town Jerry argue the conventional case against DJT that he doesn't care one way or another about the wall and will cave. Again, three weeks will tell us one way or another.

The long and the short of it is that we will simply have to wait and wait, and wait--just like those poor bastards trapped in Casablanca trying to get exit visas. If I was the White House, truly build in their website something like a Doomsday crisis clock with a countdown of 3 weeks on it and provide a day to day summary of events proving the need for border security. One place shopping for wall supporters.

BTW, a uniparty booby trap in the 3 wk CR could be a ban on reprogramming funds to build a wall under an emergency declaration. DJT should be prepared to torpedo any such provision via a veto and name names on who did it.

720 Wednesday 10,000 new migrants requested Mexican visas to travel thru on way to US border. Where will they be in three weeks?

Posted by: Ever at January 25, 2019 03:14 PM (1Zh0U)

721 What I heard was the acknowledgement that the entire border does not need a barrier, because is many places the terrain is a natural barrier.

The first government program to limit itself? That would be sort of funny.

722 BTW, a uniparty booby trap in the 3 wk CR could be a ban on reprogramming funds to build a wall under an emergency declaration. DJT should be prepared to torpedo any such provision via a veto and name names on who did it.

Congress can't legislate away executive powers without a constitutional amendment.

723 There is no legal theory that I know of that says that certain laws are out of bounds to judicial review.

Sure there is, its called "the constitution is the law of the land, not judicial review"

Its not a POPULAR legal theory, nor is it one that judges tend to subscribe to, but it exists.

724 Interesting, reading that it sure sounds like Congress has the whip hand over what the Supremes have authority over...

If they would just use it.
Posted by: Don Q at January 25, 2019 03:07 PM (NgKpN)

The Congress kind of surrendered that whip hand after they let Marbury stand. Huge freaking mistake, that. It made the Judiciary the supreme branch, which is why we need a total rewrite of Article III. Or a war. Their choice.

725 What I heard is Trump backing away from fencing, slatting, or walling the entire border. Just the most problematic areas, as pointed out to him by the Border Patrol. So he budged a bit. Perhaps necessary to get the (D)'s to budge a bit.

Which justifies what I said when I committed my vote for him. He gets us the closest we are going to get.

This wouldn't be an issue with Clinton or Sanders as president--assuming the Dems *didn't* screw over their own.

It probably wouldn't be an issue if Kasich was pres. And almost anybody but Cruz would have crumpled a lot earlier, or never have made a stand at all--and I'm not even that sure about Cruz.

726 Considering none of us really know the inside ball at this point everything is pure speculation. The real question is why the three week truce?

If someone wanted to do a complete cave a three week truce just prolongs the agony. Nothing is Trump's past proves he is that kind of personality. So why the truce?
Here are some possible reasons:

1. They are actually negotiating something and need space to make it happen. That could be either bad or good depending on what gets done.

2. This is a tactic to make a national emergency more reasonable to the public or certain senators in his own party.

3. Trump needs time to actually prepare what a national emergency would look like and organize the resources to do it. Just signing some paper without the prep work would be silly.

4. Considering where many government employees politics are, don't be surprised if some them attempt to half ass their jobs into a place crash, let us say. Paying them during this truce, would end that b.s. propaganda story when government re-closes and/or a national emergency is declared.

4. Never take our eye off Venezuela. I know I keep beating this. There is some reports of Russian mercenaries in Venezuela now. God knows who else. I don't care about Russians in Syria, or Central Asia, but in Latin America my cold war flame relights. Any national emergency Trump declares, I think, must use this at least as a useful pretext for wall construction considering any conflict there will create at the minimum a refugee flood, and more important - The migrant caravans are funded by someone, if a foreign actor really did want to screw America that would be the best way to do it. Not some idiotic election meddling the Democrats and Rinos are dreaming of. In other words of scream of "Russia" is a double edged sword that can be turned against the Democrats and Rinos.

Note: The reason why I keep harping on Venezuela is it seems odd this crisis would break out right at the same time we have this shutdown and border wall fight happening. I am not sure what it means yet, I just don't think it is a fluke either.

727 PS, I would trade the wall for medieval grade punishment for employers that hire illegals and for politicians who enact sanctuary policies. Send the owners/CEOs/executive board members to prison and seize their personal assets. Make politicians and bureaucrats who vote for/sign/implement sanctuary policies personally liable to crime victims for any crimes committed by illegals in their jurisdictions. Make welfare illegal for non-citizens.

Start making these people feel the consequences of their actions, make illegals not worth the risk of employment, strip away all incentives to jump the border, you'll see illegal immigration come to a screeching halt and the ones who are already here will start self deporting.

...Then nothing is open to judicial review, but that ship sailed 200+ years ago, and absent a constitutional amendment, isn't going to unsail itself.

730 Chillax friends, please. Temporary with an end date. Now he'll be giving the SOTU in Nancy's house and saying to the country what needs to be said. Now the Fed workers will be paid for the past month of work. Three weeks for congress to negotiate something successfully or it's back to shutdown and declare State of Emergency. Looks reasonably reasonable to me.

AYFKM? I want to believe that this was a power move by Trump.

Does this feel like the day Trump cancelled Nancy's plane ride?

No.

This was a concession from Tump, because he said he wasn't going to do it until there was funding for the wall. He did it. He did not announce that there had been any concession on the other side. Maybe he got something, maybe not.

733 Harry,
You might want to research political question doctrine. There are frequent Supreme Court decisions that duck judicial review and state the question in non-justiciable because it is a political question best resolved by the other two branches.

The key here is the Justice Jackson concurrence in Youngstown Sheet and Tube which lays out the three different conditions to resolve emergency issues such as seizing steel mills. The first is when both the President and Congress agree on the issue and it does not go beyond their combined enumerated powers--e.g. the Military Commissions Act. The second, is when Congress fails to act but is not hostile and the president has existing constitutional or statutory authority from Congress to act. The last is when the President acts and Congress is actively hostile by barring via statute presidential actions. The Foreign Powers Act is one such law passed over presidential veto and denounced as unconstitutional encroachment on the commander in chief power by every president up to Obama (guessing even here too). Neither Congress nor the President have ever pursued litigation of this because both are probably afraid of how the court would rule.

If the Court treats the Southern border as an actual incursion, then even hostile action by Congress may not overcome the president's constitutional powers as commander in chief. There is also a lot of laws that grant authority under different statutes to often do quite a bit of action if triggered by a presidential declaration. Congress could only act via cutting off funds which Trump could veto.

My personal guess is that the Scotus would duck directly addressing such an issue by overruling any lower court injunction on standing and ripeness issues. Ripeness dealing with potential eminent domain issues which have not been adjudicated and standing--e.g. California nor potential illegal immigrants nor organization supporting such do not have standing for a TRO which argues irreparable harm will occur if the action occurs. A wall is not irreparable harm as it can also be taken down if the action itself was illegal.

The whole travel ban cases dealt with immigrants coming here with an argued vested right to come here via a visa etc. States such as Hawaii argued that both the families expecting the arrival of visits, the refugee orgs, etc. would suffer funding losses and irreparable damages by not allowing the "legal" entry into the U.S. Not really present in this case with a right for illegal immigration--higher courts would probably slap that one down pretty quick.

734 I think the Superbowl date falling within this three week re-opening hiatus is a big part of the consideration. An attack of some sort on or at the Superbowl before a worldwide TV audience would be immediately spun as having happened because there was not normal security.

Oh, and there is no provision in the national emergency law for judicial review. ... No judge can issue a TRO on a national emergency.

Posted by: AZ Hi Desert (Si Vis Pacem, Para Bellum) at January 25, 2019 02:47 PM (XJktg)

*****

Of course they can. It would be a bullshit TRO, and the greater shame would be on Congress and the Executive branch for submitting to it...

But they would. I don't know why, but our country has taken the position that any decision by the judicial branch has to be obeyed / submitted to.

Telling the judiciary to piss up a rope? Heavens to Betsy! We couldn't do that.

Better to allow some rogue judge to issue an illegitimate world wide injunction, rather than just say, "no."

It's what makes us a nation of "laws", not men.

Yeah, right. "Law."

Don't make me laugh.

Rule by judicial whim is what it is.

740 For those that want precedent to ignore district court judges, as a technical rule, that injunction only applies to that district, not nationwide. A district court judge holding the president in contempt in California for actions in Arizona probably would be overruled by a higher court. Even more, the ruling technically only binds parties in the case and even a court's consideration of such can be appealed as an interlocutory appeal to the Courts of Appeal or even the SCOTUS.

These things have been done in the past, my wild guess is that the Dems want to do him to do this for impeachment purposes to argue he is acting unlawfully.

741 From here in the cornfields, it makes Trump seem like the reasonable party in the negotiations - especially with the flurry of bills that got shot down over the past few days.

I agree there won't be another shut down - in three weeks, if congress doesn't figure it out, he'll just declare emergency and go forward with construction.
