They know that Trump will eventually cave IF he shuts down the government again. I kind of get why people are treating this as permanent, though. Once the government's up and running again, there's a lot of inertia not to shut it back down, and it's hard to do from a practical standpoint. Trump could do it if anyone could, I guess, but there's definitely a risk there.

One thing we don't know is how many Republican senators are in the surrender caucus and what role they may have played. Trump may have had to make a deal with them to reopen in exchange for future support, or he may have added up the numbers and saw the Dems were going to win at some point once all of the quislings defected.
We will have to wait and see how everything plays out. I know there were Dem senators bitching that Pelosi wouldn't go ahead and fund the wall, so now there is maneuvering room on both sides. The one thing we have to guard against is giving up too much just for a partial wall. And of course the Dems have a bunch of radical freshmen who will make them pay for any deal. Whether this is mainly a tactical retreat/defeat or a strategic one depends on what happens during the next couple of weeks. The problem with bi-partisan deals is that the Dems have traditionally rolled Republicans in such things by getting what they want and nothing of what the Republicans in Congress claim they want thus the initial BOHICA reaction to any sort of deal in threads like this. There are some other confounding issues is that crises such as Venezuela, intelligence of possible terrorist strikes, and the possible need of replacement of RBG, might also require funding at some level or there might be evidence that it is beginning to impact the economy through declines in corporate investment, etc. Not having POTUS sources of intelligence about things to come might affect us. We also have no idea of Mueller's operation and what it is doing which the White House probably does. The media provides air cover to the Dems and much of the alternative Republican media are creatures of Chamber of Commerce which hate DJT and emerging nationalism with a passion. DJT's support in the House and Senate is shallow because most of them have goals to avoid any confrontations in order to win reelection. Few, if any, have any real principles to speak of instead of personal enrichment, media coverage by being a maverick, and power. Just look at the despicable Senate Intelligence Cmte's bi-partisan behavior for example. Thus, DJT may feel that a SOTU address that allows him to speak unfiltered to the public may be his best option politically. So then what would you suggest? He has a maximum of 53 votes in the Senate for the wall. He needs 60. I'm no AmishDude but 53 is less than 60. Either he gets some Democrat votes in the Senate and gets Nancy to pass a bill with wall funding or he has to go nuclear. This has always been the case. And when he goes nuclear he will need as much public support as he can get. If he looks petty or like a dictator he will lose public support. If he appears reasonable in the face of overwhelming political resistance he may get more. There never were any great options, he has to try shape the battle space in his favor to the extent he can. He just did that by giving them one more shot and told them they either negotiate a deal he can sign or they will force him to do it on his own. It's only 3 weeks. The world isn't going to end. I think its a strategic move to set the battle-space for when he does trigger the National Emergency... he's already winning this episode of Shutdown Kabuki Theater... the Dem's totally own this debacle, and by agreeing to temporarily suspend the shutdown in order to give the Dem's a final chance to come to the negotiating table, Trump can point to their eventual temper-tantrum as final justification for moving forward his way. National emergency declarations are actually outsdide that for good reason. The law put it under Congree to review the validty of such a declaration. If someone wanted to do a complete cave a three week truce just prolongs the agony. Nothing is Trump's past proves he is that kind of personality. So why the truce? Here are some possible reasons: 1. They are actually negotiating something and need space to make it happen. That could be either bad or good depending on what gets done. 2. This is a tactic to make a national emergency more reasonable to the public or certain senators in his own party. 3. Trump needs time to actually prepare what a national emergency would look like and organize the resources to do it. Just signing some paper without the prep work would be silly. 4. Considering where many government employees politics are, don't be surprised if some them attempt to half ass their jobs into a place crash, let us say. Paying them during this truce, would end that b.s. propaganda story when government re-closes and/or a national emergency is declared. 4. Never take our eye off Venezuela. I know I keep beating this. There is some reports of Russian mercenaries in Venezuela now. God knows who else. I don't care about Russians in Syria, or Central Asia, but in Latin America my cold war flame relights. Any national emergency Trump declares, I think, must use this at least as a useful pretext for wall construction considering any conflict there will create at the minimum a refugee flood, and more important - The migrant caravans are funded by someone, if a foreign actor really did want to screw America that would be the best way to do it. Not some idiotic election meddling the Democrats and Rinos are dreaming of. In other words of scream of "Russia" is a double edged sword that can be turned against the Democrats and Rinos. You might want to research political question doctrine. There are frequent Supreme Court decisions that duck judicial review and state the question in non-justiciable because it is a political question best resolved by the other two branches. The key here is the Justice Jackson concurrence in Youngstown Sheet and Tube which lays out the three different conditions to resolve emergency issues such as seizing steel mills. The first is when both the President and Congress agree on the issue and it does not go beyond their combined enumerated powers--e.g. the Military Commissions Act. The second, is when Congress fails to act but is not hostile and the president has existing constitutional or statutory authority from Congress to act. The last is when the President acts and Congress is actively hostile by barring via statute presidential actions. The Foreign Powers Act is one such law passed over presidential veto and denounced as unconstitutional encroachment on the commander in chief power by every president up to Obama (guessing even here too). Neither Congress nor the President have ever pursued litigation of this because both are probably afraid of how the court would rule. If the Court treats the Southern border as an actual incursion, then even hostile action by Congress may not overcome the president's constitutional powers as commander in chief. There is also a lot of laws that grant authority under different statutes to often do quite a bit of action if triggered by a presidential declaration. Congress could only act via cutting off funds which Trump could veto. My personal guess is that the Scotus would duck directly addressing such an issue by overruling any lower court injunction on standing and ripeness issues. Ripeness dealing with potential eminent domain issues which have not been adjudicated and standing--e.g. California nor potential illegal immigrants nor organization supporting such do not have standing for a TRO which argues irreparable harm will occur if the action occurs. A wall is not irreparable harm as it can also be taken down if the action itself was illegal. The whole travel ban cases dealt with immigrants coming here with an argued vested right to come here via a visa etc. States such as Hawaii argued that both the families expecting the arrival of visits, the refugee orgs, etc. would suffer funding losses and irreparable damages by not allowing the "legal" entry into the U.S. Not really present in this case with a right for illegal immigration--higher courts would probably slap that one down pretty quick. For those that want precedent to ignore district court judges, as a technical rule, that injunction only applies to that district, not nationwide. A district court judge holding the president in contempt in California for actions in Arizona probably would be overruled by a higher court. Even more, the ruling technically only binds parties in the case and even a court's consideration of such can be appealed as an interlocutory appeal to the Courts of Appeal or even the SCOTUS.
