Yeah I'm skeptical that people own uncontested private land straight up onto the border of the USA, not without some kind of "if we need it" clause at the very least. States don't own easements on State Lines, and unless one was expressly reserved, the Feds don't own any either. Now Texas is a unique case, since the actual border is in the middle of the Rio Grande River, and riparian rights are their own field of law. What is going to happen for any border fence construction is that the Feds will offer to purchase the land used, the offer will be either accepted or denied, and if denied they will go through the Eminent Domain process to get whatever land is needed. It's mostly a Texas thing, and the property rights issue gets a little more complicated in areas along the river 'cause it's not so obvious how far back you need to go for logistical purposes; not just wall construction, but vehicle access. Plus, many of those landowners would prefer to retain the right to shoot any trespassers they damn well please, and take offense at the idea that they can't adequately police their own property. Mostly they get around it by getting permission from the land owners, who mostly would rather border patrol be on their property then dangerous drug smugglers. But there have been incidents on both borders where the landowner withheld permission and border patrol ignored that request and still patrolled peoples property. I hope Trump builds whatever is most effective now that he is going this route. I had worries that the kind which consisted of just stakes could be scaled by various methods. And I think he needs to authorize it for the whole border and not just $7 billion or so. That way we only have to have this fight one time.

On the plus side for building a wall in Texas, Texas law is full of precedents about eminent domain and land seizure due to all of the oil and gas pipeline work. (I can't remember how many thousands of miles of pipelines exist in Texas, saw a map once, looked like a map of blood vessels in the human body) Anyway, sad to say for landowners, good for the government, precedent is pretty clearly established that if they can show any kind of Public Use or Benefit that requires it (and security is one of the highest), then the Government always wins and not only can take the land, but can pretty much pay the landowner whatever they feel like paying.

Shapiro said he didn't vote for Trump in 2016 but will probably vote for him in 2020.

From my experience, that's about the time that people who handle weapons very frequently get lax about safety because they feel like they really know what they're doing. While its true some judge will inevitably declare this plain constitutional power of the president to be somehow unconstitutional, what will happen is that the government will no longer be shut down because that takes the funding for the wall off the "budget." Then, when the Supreme Court goes "you dipstick he can do that" the wall gets built -- and if it truly is an emergency, he can ignore the court and build it anyway.
I feel like I read about that at one point. Didn't the governor of Oklahoma call up the national guard to face off against TX or something ridiculous? Probably in the 9th circuit, since they're super left-leaning and have a busy docket and can take a long time to hear the appeal. Then it'll be an en banc appeal. Then it'll wither while we wait for SCOTUS to grant or not grant cert. Then maybe it gets to SCOTUS down the line. So... Trump has two options -- try to fast track this to SCOTUS through political pressure, OR just ignore the district court judge. Both approaches have their pros and cons. There will definitely be a district court judge who puts a stay on this. No doubt. Probably in the 9th circuit, since they're super left-leaning and have a busy docket and can take a long time to hear the appeal. Then it'll be an en banc appeal. Then it'll wither while we wait for SCOTUS to grant or not grant cert. Then maybe it gets to SCOTUS down the line. So... I watched Trump's Q&A with reporters. I really liked what he said about the SOTU, that he could very easily, with a day's notice, get 25k people in an arena but he said "that would be disrespectful to the State of the Union". He even said Nancy was correct to say it should wait until the shutdown is resolved. It was refreshing and it shows that Trump is not a big baby throwing tantrums, he puts the country above his ego. Apropos Ace's sidebar reference to the Bulwark podcast, do you know who Molly Jong Fast is? Her biggest achievement is a couple of chick-lit novels. Her mom is Erica Jong, who wrote The Fear of Flying, one of the seminal (no pun intended) feminist novels. Her grandfather is Howard Fast, an actual Communist Party member who did time for being a Commie.
I know you shouldn't judge someone by their parentage, but she hasn't demonstrated any separation between her beliefs and theirs, as far as I can find. POTUS declaring a national emergency is much different than the pipeline issue ... how does a judge get to overrule "national emergency, opioids/murders/human trafficking" with "we the judges will decide what is an emergency"?
They will surely try, and ninth circus may have to be overruled ... but it is a completely different situation, imo. SCOTUS could quickly rule that POTUS has the constitutional authority, end of story. (just my non lawyerly view ... but seems obvious ... e.g. Trump responds to war with action ... can a ninth circuit judge overrule? of course not. For me, Ben Shapiro got exposed during the Kavanaugh hearings. He was doing livestreams during the day after Ford and Kavanaugh's day in the Senate hearings and after Ford finished her testimony, he proclaimed Kavanaugh done and it was only after Kavanaugh made his stand that he jumped on the Kavanaugh bandwagon. Then and only then. Before that he was treating the smears as something worth listening to.
