Quiet Preparations Being Made In Case of Ruth Bader Ginsburg Vacacy

Quiet preparations are underway within conservative legal circles and the White House counsel’s office in the event that Supreme Court Justice Ruth Bader Ginsburg retires, two sources familiar with the process tell The Daily Caller.

The 85-year-old Ginsburg did not appear for oral arguments at the Supreme Court on Monday, missing the first session in her 25 years on the court for reasons of ill health....

"Gingerly preparations are underway, not just for Ginsburg but for any SCOTUS retirement," a source directly involved in the Supreme Court nominations of Justices Neil Gorsuch and Brett Kavanaugh told TheDC.

She said she was asked by the Secretary to assist Agent Ethan Hunt with an urgent IMF mission involving the recovery of missing nuclear warheads.

I ask for everyone's understanding on behalf of Justice Ginsburg. She's not required to accept these missions, you know, and if things go poorly there is a possibility the Secretary will disavow any knowledge of her actions.

She said she will keep me informed as to what her vote is on all matters before the court.

I am certain. In medicine, quite a few residents do great work , then have the attending sign off on it. But the senior in a profession has to add some value, otherwise what are they there for? If they only verify the results with the weight of authority, fine. But. If a resident forged the signature of an attending, even if they 100% knew the attending would approve, there would be jail time and lawsuits.

The legal profession should either be held to the same standard, or exposed as a sham.

With the possible partial exception of trial level opinions, most opinions and research are done by clerks. It would be damned near impossible for one judge to do all of that work on his own and carry any kind of respectable case load.

I personally think McConnell is more transactional than the President- he has to be, given his job and the history of the Senate. In addition, he hasn't pushed for justice against the coup plotters the way Trump has. But I do agree that Mitch knows where his bread is buttered, and would never risk his chance for magic beans.

"Should be" is the operative phrase. But it isn't, that's the rub. In our system, under the Constitution, NO ONE is allowed to apply any standards or rules to the Supreme Court, or its justices, except the Supreme Court itself. Good point to bring up to anyone who thinks the Constitution doesn't have any gaping flaws - it does.

(the single exception being impeachment, which has already been pointed out is a ridiculous option - although I should point out that West Va. has been impeaching a good part of their State Supreme Court, which is encouraging)

And it could be more strategy then anything else... I don't know much about the plaintiffs involved or what the actual ruling on the 9th circuit was or what the legal arguments were at the trial court level, or what objections and arguments were and weren't made, etc. etc.

I commented back when Trump was deciding on the last SCOTUS justice that Barrett might be a good pick as a nod to his religious supporters. Actually coming through for the socons would be an amazing thing to see and a tangible get for them.

I've since come to distrust her, though. I think she'd cuck out on immigration because of the adopted Haitians. Frankly we can't afford to make mistakes (and may already have done so with Kavanaugh).

Hmmm. I think I see the problem here. I don't want impeachment against RBG, or for there to be an official process of removing justices or even clerks. I do want Trump to humiliate liberal lawyers by exposing RBG as a comatose shell who can't even read the opinions she supposedly authors. Eventually public pressure will force Roberts to speak out against her, or be further revealed as a liberal shill.

I think clerks should be jailed for fraud if they represent a judge's opinion even when the judge is in a coma, but clearly the Supreme Court and its servants are above petty laws. Not the best look, to put it mildly.

Adopting kids in this country is a huge pain in the ass. Years and tens of thousands of dollars only for heartbreak. The foster care cartel make it difficult. Kids spend years moving from foster homes to neglectful parents and back before they're finally taken away for good. In many cases they have severe issues due to drugs and abuse. Child Services agencies in many parts of the country are corrupt, and social workers will place kids with workers' relatives who then kick back a portion of the assistance money.

Hence why many couples adopt from overseas.

Have heard that it is harder to adopt US kids? For example, a lot of birth moms are scared off by various state adoption disclosure laws that ensure that their kid will eventually find them. The Constitution actually is a document that embraces some of English Common Law, but also rejects large portions of it.

They were careful in it to talk about States suing other States... or citizens suing the Government of another State... yet nothing about Sovereign immunity itself.

The same is true for international adoption. Also, why did she feel she must adopt to begin with? She has five bio kids, one of them with special needs. She is not a stay home mom, obviously. If she had to help a child in this manner (why?) she could have fostered domestically.

She either 1) felt soft for these 2 kids (saw them somewhere) and adopted them against her better judgment or 2) this is a part of her broader belief system which entails treating foreigners as US citizens (this is more likely). Neither bodes well for her tenure on SC.

Everyone is pushing for this basically unknown judge with a huge red flag to own the libs through abortion. But that's not the only important issue. This will be David French on the bench.
