Of Course: Provision to Give Monster Tech Companies Neutral-Platform Immunity Even If They Behave Like Publishers Snuck Into... NAFTA Replacement Trade Bill

I want to know which corrupt corporatist Republican on Google's payroll snuck this in.

Less than two weeks ago, President Trump signed the U.S.-Mexico-Canada Agreement intended to be the successor to the North American Free Trade Agreement, which Trump has attacked for decades. The White House says the agreement will "better serve the interests of American workers and businesses" and "includes the strongest digital trade... provisions of any United States trade agreement."

Unfortunately, an obscure article in one provision of the agreement only serves the interests of the largest tech monopolies by granting them special privilege to censor conservatives. Congress should demand the removal or amendment of this article before giving consent to confirm section 230.

How did this happen? Big Tech lobbyists orchestrated the quiet insertion of a seemingly innocuous provision (Article 19.17) into the deal that is based on Section 230 of the Communications Decency Act. Section 230, much beloved by big tech, and an essential building block of their monopolistic dominance, holds that platforms like Facebook cannot be held liable as a "publisher or speaker" of their users' content.

The law was not intended to permit media platforms from censoring whatever they deemed "objectionable" -- which would be something a publisher does. The law was written to permit the censoring/moderating of objectively objectionable stuff, stuff that could get you in trouble with the law, slander, threats, etc.

But this new language someone snuck into the trade bill changes that.

According to Candeub, these changes will "likely lead courts to interpret it to mean whatever the platforms object to -- which has thus far included the word 'illegal alien,' pro-life advertisements, videos defending 'Israel's Legal Founding,' and President Trump’s own immigration advertisements."

This means courts would likely throw out any action to stop censorship under state law or an executive order, which Trump reportedly wants to issue.

The provision can still be stripped out of the bill -- but I'll bet you any amount of money it won't be. Google employees like Represenative Goodlatte will see to that.

The problem with the nevertrumper types is not that they were saying this is legal and a price of freedom -- it is -- but that they weren't then saying BUT ITS WRONG AND YOU OUGHT NOT DO IT. They didn't follow up with the proper and correct position that their alleged principles would demand.

Because if you love liberty its a double edged sword: it allows certain things which are not good and ought not be left unopposed. Liberty means you're legally free to do it, without government stomping on you. But it also means that you have to protect liberty by not allowing people to abuse it and damage it.

It comes down to judgment and discernment rather than legalities. It comes down to ethics, to right and wrong, rather than who has the power to do what. And when we call upon government to fix our problems, each time we do so, we surrender a bit more of our power as citizens, and a bit more of our liberty.

Regardless of whether or not the US has been developing "tech", I agree this particular case really isn't about "monster tech". It's more like "monster social media". There's not much tech to these sites, which are like blogs with a few bells and whistles added.

What's appalling about these cases is that they are approaching something like a phone company eavesdropping on your conversations (or texts) and then cutting off your connection the moment they heard you saying things they disapproved of. It is about stifling communication and censoring data.

Apparently they gave him lines, which he didn't think were very good -- kind of harsh, mechanical lines. And he went home and thought about it, and came up with the single most powerful scene in the movie that makes sense of everything that came before. Without that final speech, the film is uncertain and just an action movie about killing robots. With it, suddenly you understand the conflict, the moral quandary, and the confusion that the Blade Runner is going through: is this even right? Should I do this?

Plate readers out the wazoo, tracking capabilities via anything wireless, facial recognition, etc. NYC has vans driving around blasting vehicles and structures with backscatter xray equipment looking for contraband and weapons. More cities are starting to install automated acoustic gunfire-triangulation equipment.

It's also been several years now since software was available on the commercial market to monitor camera feeds and automatically ID people or vehicles engaged in usual activity.

In days of old when US manufacturing was a thing, manufacturers would overbuild inventories in anticipation of inflation, then suddenly pull back in unison. We haven't seen that as a cause in about two decades. It's been some stupid predictable government action -- like zero down, zero doc mortgages or something else entirely predictable as the cause.

Of course the government can run out of money, or the world can suddenly no longer trust the US dollar, but that's more on the 'gradually then suddenly' longer term horizon. For now.

I believe this is totally challengeable under law. Congress is not just allowed to stipulate that a Publisher isn't a Publisher. So when somebody wants their day in court against the Big Tech companies, if they don't get an Obama-judge, it will be up to the court to determine whether Twitter and Facebook act significantly like publishers to be considered publishers.

We've never had a "class" of oligarchs that have controlled communication and culture like we do now.

Usually business titans were people that were say in oil, transportation, mining, etc. They didn't control "culture"
the way Facebook, Twitter, Google, etc do.

In my state it's housing. House building slowed during the recession and we never caught up, and now with the economic boom, not enough houses for the demand. It's a seller's market, with house prices grossly inflated. Not San Francisco bad yet, but something has to give. The education bubble has also been mentioned here this week as a balloon desperately in need of popping.

Looking at the economic situation as a whole, the thing that is going to trigger financial trouble is the unfunded government pension bubble. In the bluer states, pension promises are impossibly high, and there isn't any money to pay them. Even with the stock market making tremendous gains after Barky & his pals did their best to kneecap us, the market has recovered.

But current taxes have to be raised significantly to pay those pensions and fund the things that taxpayers actually expect from government, like roads, bridges, schools, public safety, etc.

Just like in France, the point will come that people can't pay more and all that papering over of the pensions bombs will be exposed. The bond houses keep lending money to governments to keep the lights on, but those muni bonds come due and the middle class will eventually run out of money.

So a local unit of government says, hell no we ain't payin'. Those collecting that pension, or their union, files suit. Suit eventually winds up at State Supreme Court. All of whose members are in line to collect a big fat government pension as soon as they retire. State Supreme Court rules against the local unit of government and orders pension payments to continue, because local units of government have taxing power and can always raise money that way.

Eventually the power to raise taxes to pay pensions means that pensions crowd out the things people think they are paying taxes for but aren't getting. But it's going to take awhile to get there, people have to get mad enough to put on a yellow vest and march in the streets.

This raises an interesting point, something that occurs to me. Paradoxically, the left's Mail Megacorp hero and its business model could be one of the strongest forces for anti-urbanization, ever. Brick and mortar store presences are one of the main drivers of "Urban Convenience", having everything easily within reach. If physical mail networks replace so much of that with more rurally based (due to cheap land costs) warehousing, the jobs leave the city and the urban center loses access advantage to the suburbs and beyond.

I remember a prime minister of Jamaica who once said in response to US complaints about marijuana smuggling that 'we would not export, if you would not import'.

Not quite the same, but I imagine it's become a bidding war to get an Amazon facility. Amazon may not be showing up, hat in hand, but the 'importers' are looking to 'win' the facility.

Actually, many years ago I calculated the start-up cost per employee hired in equipment and facility at over $100,000 dollars. It's a ton of money to create a job anymore. Unfortunately, only the biggest target sees any of that sweet paydown of costs.

363 This has been true for years now with most Silicon Valley Municipal Governments, when the monopolies tell them to jump, they not only ask 'how high?' but also where to land. Expect to see this level obedience at the Federal level in 3-5 years.

367 This raises an interesting point, something that occurs to me. Paradoxically, the left's Mail Megacorp hero and its business model could be one of the strongest forces for anti-urbanization, ever. Brick and mortar store presences are one of the main drivers of "Urban Convenience", having everything easily within reach. If physical mail networks replace so much of that with more rurally based (due to cheap land costs) warehousing, the jobs leave the city and the urban center loses access advantage to the suburbs and beyond.

Very interesting point. Even though I live in the furthest reaches of 'the boonies' the fedex, ups, usps trucks all go past my house daily. Even my supermarket will deliver for free, or almost.

Do we even need a second car? I can get whatever I want in a time frame of hours to mere days. Uber is clicks away.
