Twitter CEO Jack Dorsey Appears to Have Lied to Congress, and Congress Is Asking Questions About That

Top House Committee investigating Dorsey's testimony for lies.

A top House committee that oversees the U.S. telecommunications industry is now reviewing whether Twitter CEO Jack Dorsey lied to Congress during a hearing about Twitter’s controversial history of arbitrarily censoring content published by the site, an aide for the House Energy and Commerce committee told The Federalist.

"The committee is aware of Twitter’s actions and is currently reviewing Mr. Dorsey's testimony," the aide said after Twitter suddenly banned Jesse Kelly, a Marine combat veteran, writer, and popular radio talk show host, without explanation.

As The Federalist reported on Monday, Dorsey was not truthful about his or his company’s response to death threats against prominent conservatives -- including against Meghan McCain shortly after the death of her father, former Sen. John McCain (R-Ariz.) -- nor was he truthful about whether Twitter policies discriminated against users based on their politics. It is a federal crime to provide false testimony to Congress.

During testimony before the committee, which has broad authority to oversee and regulate telecommunications companies and social media publishers like Twitter, Dorsey repeatedly claimed that neither Twitter’s policies nor its algorithms took users’ political views into account when censoring content published by the site.

"I want to start by making something very clear," Dorsey testified on September 5, 2018. "We don't consider political viewpoints, perspectives, or party affiliation in any of our policies or enforcement decisions, period."

"Our policies and our algorithms don't take into consideration any affiliation, philosophy, or viewpoint," Dorsey claimed again later in the hearing.

A review of Twitter's so-called hateful conduct policy, however, shows that the company has explicitly codified political views into its policies. For example, the social media publisher states that it will ban users if they accurately refer to the biological sex of "transgendered" individuals who believe without evidence that biological men can become biological women, and vice versa.

Unfortunately, the NeverTrump rich suburban white women and other liberal Republicans/RINOs gave the House to the Democrats, so the House will take no action on this matter.

But incoming Senator Jack Hawsey of Missouri is interested in examining Twitter's claim of exemption from lawsuits based on third-party speech, given that that exemption is only available to "neutral" content platforms and not "publishers" which peddle their own editorial line:

The #MuhPrivateMonopoly conservative shills, who think their favorite Tech Giants should have all the special advantages the law entitles them too as well as the special advantages they are not entitled to -- because being a conservative means, it turns out, claiming that monopolies should have the benefit of laws without satisfying the actual requirements the law sets for obtaining that benefit -- are all shrieking hysterically.

They're not conservative. They're just pansies who worship corporate executives but who never had the stones or drive to actually try climbing the corporate ladder themselves. So they're just corporate jock-sniffers. They have the sort of idealized image of what Corporate Life must be like that only a naive outsider could have.

The older guys, I think, have some weird Alex P. Keaton fantasy life going on somewhere inside their heads.

I didn't get into conservatism so I could service corporate desires like I'm a six-dollar hooker who does the dirty stuff for three buck more.

At some point, people should maybe matter too, a little bit -- just a little bit.

47 I'm just going to come out and say it.

I think political speech is FAR more important than deregulation of mega corps.

Even if you can't find a law that enforces this principle, I'm 100% okay with drafting new ones to make sure a Republican can have a Twitter account. If that seems "heavy handed' or not "free market", we passed that rubicon a long time ago.

Half the country not being able to participate in the free exchange of ideas because of a few oligarchs who fancy themselves to be mini-Stalins want to shut down political speech they don't agree with is a MUCH bigger deal than some sort of wish casting of pure capitalism that hasn't been with us in over a 100 years.

58 So many defenders of big tech seem to assume that everyone on the right is *libertarian* regarding regulation.

Conservatism does not mean "no regulation is ever good."

Conservatives can believe that government has a role in creating fair marketplaces, and that includes for ideas. In fact, conservatives can believe that regulating actions in order to preserve a healthy society is necessary and good.

Even most libertarians believe this. It is only the anarcho-libertarians that think all regulations are bad, and those people are so far off the edge they pop up on the other side of the screen over by the marxists.

If Trump seized even one media megacorp, the others would fall into line amazingly quickly. More: most of the media's power absolutely depends on deplatforming opposition. If even one free outlet exists, and no Fox doesn't count, it's a fatal blow to them. Right Side Broadcasting and Infowars do steady trade: imagine what would happen if they weren't constantly suppressed by the "free" market.

And there's the rub - and it won't just be tech.

When it comes here, it'll all be "Constitutional" because our major corporations are almost uniformly in bed with government Leftists.

So, when the Moron Horde is assigned a low social-credit score by Google (presumably) it won't be the government refusing you permission to travel by air or rail, or to take out a mortgage, or to have access to the internet - it'll be private companies doing it.

And Conservacucks will be screaming that it's their right to do so.

114 And the difference between modern tech and printing presses is that if a newspaper publisher was biased, it was transparently so.

The other difference is competition.

Big tech can be biased, but no one can see it since everyone's news feed, or search, or whatever, is only visible to them. This is another level of power. This is scary.

And they have effective monopolies (built on public infrastructure) which is obviously true since there is only one facebook, twitter, google, amazon,....

Saying that laws written for freedom of pamphleteers to print whatever they like should apply to big tech is absurd.

A private company absolutely has the right to discriminate based on politics.

If these liberal pieces of shit want to censor on their platform, fine, THEY LOSE THEIR LEGAL PROTECTION AS PROVIDERS.

I disagree and think that the likelihood at this point is very high. All it will take is a few innocent and/or law abiding normals on the receiving end and one or two people with a cell phone camera to catch it.

It could be overreach from the left's amateur goons, or it could be overreach on the part of their professional goons if they get back into power. But it's probably going to happen.

Fight Club (1999) -- ''a generation of men raised by women''. Remember?

Now we're seeing the ramifications, twenty years later, of a generation of women raised by women without male influence. They're afraid of a future devoid of a nanny state hovering over them. The (D)'s put the fear of 'pre-existing conditions' into them good and hard and they fell for it hook, line, and sinker.

A generation of women devoid of the ability to perceive a 'Department of Motor Vehicles' level of healthcare. Take a number and come back next month.

Free. And worth every penny it costs them.

I'm about half Trump's age and I rarely engage on social media.

If Twitter banned him though, shit would get real. It really would be the best thing on Earth if Twitter banned Trump. He would see the issue front and center

Twitter II: The Tumblring

Posted by: Yudhishthira's Dice at November 27, 2018 04:53 PM (AzW6q)

194 Here's what I see as the problem with the "but they're a private company!" mantra:
1) They own the public square. Hell, they *built* this new public square. They did this by constructing - deliberately - a platform - not a library or a newspaper.
2) If you're a platform, then you have to be neutral - no censorship unless it's a criminal act. If you do censor, you're exercising editorial control.
3) Editorial control comes with consequences - legal liability. These companies are *shielded* from that because they maintain the fiction that they're a platform not exercising editorial control
4) Even if they *were* platforms (they aren't), they are actively colluding in restraint of trade. Individually, they'd be platforms, but together they're a cartel - and cartels are illegal.
--> This is the big problem. The American Way is to go build your own if you don't like it. Okay, cool - so people did (Bit Chute, Gab, etc.) and then the cartel ices them out by other means.

Pull the other one. The argument doesn't hold water on its face because these firms clearly exercise editorial control. Even if they didn't, they cartelized. In either case (or, realistically, both - they are editorially-controlled cartels), it's flatly indefensible.

Strip them of their platform status and let the lawsuits roll in and destroy them, or regulate them, or both. Go after them under Sherman and Clayton while we're at it, and dismantle their cartel. No one with any consistency or honesty can play the "but they're a private company" card because it doesn't apply to editorial organizations which are shielded from liability and even private companies aren't allowed to restrain trade. These people are transparent to the point of tedium.

Don't think that's it.

People have a strong tendency to personally invest in the "goodness" of organizations. For Republicans ... thats usually Party, Law Enforcement, or Church. For for many - on both sides of the aisle - its Companies. They just differ on what types.

Until that behavior stops - organizations will keep taking advantage of the rubes. Because organizations are amoral - by definition. And the people that rise to the top of them usually don't get there by morality or merit.

People typically rise to the top via a ruthless pursuit of power. Exactly the types who should never wield power in the first place.

230 There's no inherent property right to not be held liable for publication or republication of defamatory statements etc. That's a matter of legislative grace. No one has a God-given right to the statutory protection afforded by Section 230 of the Communications Decency Act. Frankly, the world might be a better place if no service providers enjoyed its protection.

Today, it finally came to him that Twitter is a publisher and should be subject to the same libel/slander laws as any other publisher. They're making editorial decisions about what to publish and who to de-platform, so they're not a neutral party. Not sure if he's been hanging around here, but it sure sounded exactly like what I've been shouting at my phone for weeks at him.
Anyway, if any of you would like an easy 1 hour podcast from somebody who thinks like we do, and has a bunch of inside information from being in the swamp most of his life, check out Bongino.

OK, policy wise and algorithm wise, Dorsey is clear. He may be lying but he is clear. But what about whim wise? Like he and his team ban people on whims that just so happen to be anti-conservative. It's not written policy, it's just understood by the gestalt of the organization that conservatives be whimsically removed. Technically it's not a lie even though it really is.

308 >>Ok. But it's a statute. Why not repeal Section 230. Or amend it to explictly require neutrality?

You could amend it. There are reasons not to, since it might create more of a grey area than you would like. And how would the neutrality work, anyway? Would all blogs have to be viewpoint neutral to claim the immunity? Would service providers have to allow rank spam posts, explicitly nazi posts, etc. in order to claim the immunity?

It might be worth debating whether CDA 230 should be amended, but there are a lot of issues to think about. In any event, nothing in current law requires viewpoint neutrality to claim the CDA 230 immunity.

The argument is that they can not get the protections of being an open platform for all, and thus not responsible for content put ot there, while at the same time selectively editing content and accounts. They currently have it both ways, and that cannot and should not stand.

Posted by: Calm Mentor at November 27, 2018 05:11 PM (ffYR/)

I am not a fan of companies being held responsible for the speech of individuals using their services, to begin with. My issue is more with the stupid laws that somehow try to limit property owners' rights by holding them responsible for stuff that they clearly shouldn't be. But then, we have been infringing on property owners' natural rights for many, many years with some of the most insane laws imaginable ... holding a property owner responsible for anything that happens on his property, even if someone illegally trespassed in order to commit other crimes.

I guess the classic example, now, is the guy who lost his ranch on the border to illegals because he held the poor, widdle invaders at gunpoint while waiting for the cops or border patrol to pick them up (after which they probably would have distributed through the country and set free, anyway).

Twitter shouldn't be held responsible for the twits of the twats who use it. Twitter should be allowed to disallow anyone they want, for whatever reason.

Let Twitter do that and you can be pretty sure that a competitor will be up running eventually that will drive them out of business.

384 This whole idea that corporations ARE people is ludicrous.

They are not people, they are legal constructs that do not exist outside of a legal structure.

A corporation has no speech, it is a method of amplifying the speech of those who run it.

So why should a company whose business is peoples speech, be allowed to censor that speech?

Just as why should a bank be able to NOT give service to a legal company, based on them selling a legal product (guns and such).

We need to clamp down on this whole thing, as people ARE being legally and politically disadvantaged by the very corporations that are allowed to exist, by the people who are being disadvantaged.

399 I wonder how many human censors does twitter utilize? Might be fun to try to overwhelm their system with barrages from throwaway accounts or bots.
Posted by: Steve and Cold Bear at November 27, 2018 05:35 PM (/qEW2)

The larger question, is who ARE those censors?

Do you really think they are Americans? or are they like most companies Help Desks now... ie sitting in India or Pakistan or some other Nation..

How can someone not raised in our culture, and in the American system, be ALLOWED to limit the speech of Americans?

431 If the MFM can't put Melania and her projects on covers of style magazines, then they have no business being in business. If any FLOTUS has earned cover material, it's Melania. She's a bona fide model, still looks spectacular, and has style oozing out of every pore. And this is almost universally crap I couldn't give a flip about. But no way on God's Green Earth have her predecessors outclassed her.

MFM delende est.

I know that Melania didn't actually *design* the gingerbread house or the other stuff, but I think that she provided direction for the overall Christmas decorations. They're very different, more yuge and luxurious, than previous ones.

I think it reflects her style.

Bio

John Hawkins created Rightwingnews.com in 2001; built it up to a top 10,000 in the world website; created a corporation with more than 20 employees to support it; created a 3.5 million person Facebook page; became one of the most popular conservative columnists in America; was published everywhere from National Review to Human Events, to Townhall, to PJ Media, to the Daily Wire, to The Hill; wrote a book 101 Things All Young Adults Should Know that was at one point top 50 in the self-help section on Amazon; did hundreds of hours as a guest on radio shows, raised $611,000 in a GoFundMe for Brett Kavanaugh's family and has been talked about everywhere from The New York Times to Buzzfeed, to the Washington Post, to Yahoo News, to the Rush Limbaugh Show, to USA Today. Today, John Hawkins runs a men's website, Brass Pills and his Planet Hawkins podcast.

Been reading Conservative publications for over a quarter century and never heard of this guy. So who wrote the epic bio above that tells the brave story of this bold and very busy Nevertrumper commando?

Posted by: kallisto at November 27, 2018 05:42 PM (kD8Fh)

Fair enough. I try to give these people as few clicks as possible so I had to hunt down pictures. None of us have to just invert leftist arguments: it is sufficient that Melania shows intense attention to detail and an eye for beauty.

You are 100% right on one thing though: Michelle Obama has no taste, none at all, and her creations look awful. As for the "playful" Hillary Clinton house reflecting her personality... my theory of luring children with it becomes increasingly plausible.
