It's Official: Federal Judges Have Decided That There Are Special Rules In the Constitution That Say Trump Doesn't Have the Basic Powers All Other Presidents Have

A judge -- appointed by Trump, actually -- decides the president can not deny a press pass to a non-reporter who physically pushes away an intern and declares that Jim Acosta now has his press pass back.

The judge said the government could not say who initially decided to revoke Acosta’s hard pass. The White House had spelled out its reasons for revoking his credentials in a tweet from White House Press Secretary Sarah Huckabee Sanders and in a statement after CNN filed its lawsuit. But the judge said those "belated efforts were hardly sufficient to satisfy due process."

The judge also found that Acosta suffered "irreparable harm," dismissing the government's argument that CNN could simply send other reporters to cover the White House in Acosta’s place.

The suit by CNN alleges that Acosta's First and Fifth Amendment rights were violated by suspending his hard pass. While the judge didn't rule on the underlying case, he signaled they were likely to prevail in their claims.

This is an emergency injunction, not a decision following a full trial, but the judge found a substantial likelihood that CNN would prevail on the merits (which is necessary finding for granting an injunction).

The judge's reasoning seems to be that credentialing the press pool creates a first amendment right, but that's asinine. Credentialing is merely crowd control. You have limited space and so some system must be used, no matter how arbitrary.

273 Trump doesn't have to do press conferences at all. He should announce that since Acosta wastes everybody's time by behaving like a preening asshole and trying to debate Trump at press conferences, he's decided to stop holding them for the media.

But Trump understand that the public has questions about some of his policies, and he wants to answer those questions directly, so he will begin holding Q&A sessions in the White House for members of the public, who will be selected at random and cleared by SS.

This way the public gets its questions answered, and it doesn't have to get them filtered through the hostile, left-wing bias of the Dim-controlled media.

And Trump will have a list of rules drawn up in advance for how public questioners should behave in the conference room, and one of those rules will be that once the president has signalled that he has answered the question, the microphone must be relinquished and the questioner must take his/her seat and not attempt to debate the president, thereby wasting everybody's time.

- change the format. Written questions only. That preserves their ability to ask questions and prevents them from grandstanding and acting belligerently.

I'm still not sure how it's a freedom of speech issue. No one is stopping these reporters from expressing themselves in writing or on the air. 350 I'm not 100% on this, but I think the judge has to look at the facts in the light most favorable to the moveant during a TRO, and if those facts support the argument, decide if failure to act could cause irreparable harm. Or something like that.

I'm too lazy to look this up in the rules of federal civil procedure, so I could be wrong.

But if that's true, this doesn't mean much about the merits of the case.

If I'm wrong, I'm sure someone will correct me.

But, again, probably not a ton of case law, since no one can ever accuse the federal government of not giving enough due process to their unionized employees before firing them.

His liberty is being curtailed because he was unruly. But if a criminal trying to rob a government office were stopped, his liberty would also be curtailed.

You are being equivocal about your use of the word liberty.

And what sort of "property" interest does Acosta have? His pass is a physical expression of a courtesy extended to him, but to say that that is "property" is to conflate the physical expression with the courtesy itself. 487 To clarify the "Trump Apointee" aspect that the media is GLEEFULLY pushing:
When Trump accelerated his pace to appoint judges at all levels, he has to "horse trade" for the lower-level (sub-circuit-level) judges to get his desired judges in place. So this judge was probably the result of such a horsetrade, where Trump got two of his desired judges and the Left got this idiot in place. Incidentally, all presidents have had to do this, and it's usually a 2 to 1 deal, sometimes 3-1 or 4-2, but rarely worse than a 2:1 trade.

At the federal circuit level, and of course SCOTUS level, there is no horsetrading. It STILL sucks, but if this didn't happen then the judges wouldn't be approved and the dockets would remain open. The only way to overcome this fiasco, of course, is to have a huge senate majority, which ain't gonna happen soon.
