Jim Acosta Bears Most of the Blame

Precisely no one actually thinks that Acosta is a good news journalist. He might be good entertainment, for some, but he doesn’t break news or accurately report it. He's a pundit who loves to offer his opinions all day, every day.


Even among his colleagues he’s known as a preener rather than a reporter. He doesn’t break stories or dig into facts. He preens on camera and does it in a way that makes it harder for legitimate press corps members to hold the administration accountable .

Every second that Acosta uses to preen and whine at a press conference is a second that a real journalist can't use to ask questions or elicit information the American people need to know about. His behavior doesn’t just damage his own reputation, it hurts CNN’s and the entire journalism profession.

His behavior last week crossed a line when he physically refused a young female intern attempting to provide the White House microphone to another reporter. He then doubled down and falsely claimed without evidence that he didn't touch her. In fact, video evidence showing he did touch her is incontrovertible.

A commenter had a great idea (which is just a sort of revenge fantasy) should a Hawaiian judge rule that Jim Acosta does have some special penubraic right to a hard pass:

Trump should declare that if Acosta has a personal constitutional right to a hard pass, so does every citizen in America, given that no queeny drama volcano has special rights over any other citizen.

Therefore, he should announce that one-week passes will be available by the lottery system, and news departments must sign up for the lottery like any other citizen. 40 names will be drawn each week and if the media's names aren't called, so be it!

Now, before anyone says, "But you'll have a bunch of partisan crazies cursing out Sarah Sanders...!"

How is that any different than the current system? At least around half of the lottery winners would say things like "MAGA!" and "CNN SUCKS!"

Start with using voter rolls. If that adds 100,000 or so dead names, so be it.

And the pass can only be used by the person named on it. Not selling, trading, giving away, etc.

As I recall it, Obama tried to have Fox News excluded from WH briefings, and a ton of other news orgs, including CNN, backed up Fox, believe it or not. I think they said if Fox couldn't be there, they wouldn't either.

None of these presstitutes seemed to mind back when Barky wouldn't give any press conferences and mostly forced them all to get their info through one pool reporter. They loved that. Obviously if everyone had the right to refuse to surrender the microphone at press conferences the result would be fewer members of the press corps having an opportunity to ask questions, not more.

But there's something special about Mr. Acosta and about CNN, at least according to the lawsuit. The suit argues that special White House access not available to the general public is "essential" for reporters like Mr. Acosta, and that CNN is suffering from his absence, even though many other CNN staff still enjoy such access.

There are no doubt myriad online producers and reporters who would love to have the privileges enjoyed by CNN and its star commentator. But are Mr. Acosta and his network entitled to such privileges?

The Journal's Jacob Gershman reports:

A similar question confronted a federal appeals court in Washington, D.C. more than 40 years ago. That case was brought by a Washington correspondent for the Nation who was denied White House press credentials for vague security reasons.
The appeals court in the 1977 ruling, Sherrill v. Knight, said the public doesn't have a right of access to the White House and that a president can grant one-on-one interviews to whomever he chooses.
But the court said there were "important First Amendment rights implicated by refusal to grant White House press passes to bona fide Washington journalists" and that at minimum, a journalist shut out of the White House has the right to a lodge a formal protest and get a written explanation for a denial.
UCLA law professor Eugene Volokh said the White House doesn't necessarily need to have a powerful reason to keep Mr. Acosta out. More recent First Amendment case law suggests that the president could win by convincing a judge that the decision was merely reasonable, according to Mr. Volokh.
The key for the White House, he said, is showing that it took action against the CNN reporter not based on his reporting or critical views about Mr. Trump but because of his conduct at news conferences.
His conduct last week was reason enough. Yet again and again the suit demands special constitutional treatment for Mr. Acosta.

The MSM picks their narrative - let's say, "Trump's firing of Mueller is imminent!" - and then tools like Acosta badger Sanders (of whoever is there that day) with loaded questions about it. "Will Trump's firing of Mueller cause a Constitutional crisis?" "What is Trump's response to [Democrat leader] who has said he/she will impeach Trump after he fires Mueller?" etc.

In fact, Barky used to have press conferences (of the few he had) where he'd call on a reporter and then have to look around the room to find them or see if they were even there.

Levin was on fire last night about this lawsuit. He knows Ted Olsen personally and Olsen refused to answer his calls asking him to appear on his show. Instead, Olsen appeared on CNN who is his client.
Levin is strongly urging the WH to fight this lawsuit. He says this is just one more lawfare against the constitution, in which there is nothing requiring the president to answer unlimited questions from a freak reporter. He said there is no way Acosta would be allowed to behave like he does in a courtroom or a classroom or anywhere there are rules for decorum and equal opportunity.

So I'm sure Mark is not happy his hosting network of his show is supporting what he considers to be an illegitimate lawsuit.
