Former Trump Lawyer Michael Cohen Pleads Guilty to Campaign Finance Violations;
Claims He Paid Off Mistresses at Trump's "Direction" with "Purpose of Influencing Election"

Strange way to describe what would be seen in other contexts as "paying off a potential or actual blackmailer."

US President Donald Trump's former lawyer Michael Cohen has pleaded guilty in a Manhattan court to violating campaign finance laws.

He said he did so at the direction of "the candidate" and that he acted for the "purpose of influencing election".

Mr Cohen's admission was related to hush money paid to Mr Trump's alleged mistresses.

The 51-year-old admitted eight counts, including tax and bank fraud in a plea deal with prosecutors.

In the court on Tuesday he said that he had been directed by "a candidate for federal office" to break federal election laws.

In other news, Hillary Clinton deliberately concealed the purpose of her Fusion GPS payments as run-of-the-mill "legal services" payments to Perkins-Coie and hardly a word about that has been mentioned in the media, let alone by any federal prosecutor or DOJ staffer.

Apparently some violations of FEC laws are good and just, so long as you're a Democrat; then no one can say what your "intent" is.

Speaking of intent, that's pretty important here. The reason Cohen claimed Trump did this with the "purpose of influencing the election" is 1, because that's what prosecutors wanted him to say for his deal and 2, candidates do not have to disclose non-campaign expenditures for everything. They don't have to disclose that they spent money to see a Broadway show, for example.

Even if they were photographed there and that, somehow, wound up making the news and advancing their campaign.

So this payment is only of any legal consequence if it was made with the primary intent of influencing the election.

And not, say, avoiding embarrassment and marital strife.

In Trump's case, he can say, and probably will say, "I didn't make that payment to advance my campaign, I made it because I felt that these women would try to cash in and talk about this, which would harm my relationship with my wife."

Which, obviously, it would. In fact, the media has been making just this case, by breathlessly reporting that Melania wasn't staying at the White House and was deliberately avoiding appearing in public because she was upset by the betrayal.

So: How do you establish his intent was actually to "influence the election" and not just "avoid a strain on my marriage"? One can say that both are in play, but you'd have to prove he had the primary intent of doing one rather than the other.

Because there's no law against paying hush-money to someone who might want to damage your reputation.

Now, maybe Cohen has tapes of Trump specifically tying this to his election campaign. But maybe we just have to take his word for it.

And again, if this is now a Very Serious Offence: It's been known for a year that Hillary Clinton deliberately hid the purpose of her payments to Perkins Coie as "legal services" when in fact a big chunk of that money went for oppo research.

Rather than simply omitting mention of them, she filed a deliberately false report for the purpose of disguising the nature of the payment.

Why is Trump required to disclose the purpose of every nickel he spent in 2016 while Hillary Clinton is permitted to straight-up file false reports with the FEC without any criminal investigation whatsoever?

Yeah ... though it's clear he meant this as anyone taking care of a possible problem would "influence an election", not in any silly Russian sort of thing. But the MFM is running with the "purpose of influencing election" as if Mueller's witch hunt has hit the jackpot.

Of course, in this context, everything someone in a campaign does is with the "purpose of influencing election". After all, they're trying to win the damn thing. Have to influence it to win it, generally.

57 As I mentioned on another thread, one hires and pays big money to lawyers to ensure that whatever they are involved in is kept legal. So when one's lawyer knowingly breaks the law, then blames the client, I think the client has a pretty good lawsuit going against the lawyer. Which is why lawyers I would imagine carry professional liability insurance, in case they commit an error or omission, etc.

In Cohen's case, he simply taped his clients.

I hope Trump and maybe Hannity sues this asshole for malpractice.

Posted by: occam's brassiere at August 21, 2018 06:11 PM (cCsPW)

100 Donna, think it's actually the other way around.

First of all, Manafort's FARA stuff relates to Ukraine, years and years before Trump ran for president (so, again, no connection), but beyond that, as I understand it, Manafort was linked up with the pro-EU membership element in Kiev - i.e, the *archenemies* of Moscow in Ukraine.

Haven't bothered to dig into it, so might have it wrong, but that's my understanding.

And as I noted in last thread, actually prosecuting a FARA case like this is actually the biggest F U to the country and the non-corrupt Beltway from Mueller, to date. Such cases exist in their thousands, have never been prosecuted - so selectively prosecuting this one is outrageously punitive and political.

183 This is not about guilty or not guilty, it's about getting some religious voters, such as Mormons, and women voters to stay home or vote against Trump.
It's an attempt to make Trump seem like an uncool and libidinous old man who cheats on his wife and has to pay for sex. The other narrative they're pushing is that he's alone and deluded, abandoned by his former associates and soon by his wife. They're trying to make an example of anyone who stands by him or defends him in public, so that nobody will want to work for him in the future. That's all.
Getting a conviction right now is not important for them, preventing Trump from achieving too much is. Then they can also charge him with being all talk. And when they get back into power due to voter apathy they can take revenge at their own pace.
Hopefully Trump has some counter-measures planned. So far he has emerged victorious from these ambushes, but it'd be good to see some pushback.

259 This Cohen thing is full of puritan terms. I remember a time when the media and our elites referred then Stormy Daniel thing as a one night stand, now they refer to her as Trump's mistress.

I remember reading reading in those long ago "enlightened" times that everyone you slept with was to be referred to as simply a sex partner.

Those were the days my friend
Thought they'd never end

And the came a president who must be deposed and his voters swapped for the imported illegal ones who have no compunction in voting illegally or killing innocent girls out for a jog.

317 "Without mentioning names, I really want to hear the explanations from the Sessions defenders about why his instantaneous recusal will, in effect, lead to the reversal of the counterrevolution back to pre-1913 days"

To play devil's advocate, how is Sessions recusal relevant to either of these prosecutions? Neither of them have anything to do with Russia. Manafort and Cohen were on the Democrat's enemy's list form the start and they would've been targeted by a prosecutor somewhere even if Mueller never existed.

In fact, I suspect the only reason for having Mueller's name associated with these was to allow his team to take credit for something so as to keep the left's hopes afloat.

Oddly enough after all this time absolutely nothing has come of any of the Russia stuff that Sessionzzzz has supposedly been so snoozily incompetent about. To the contrary, every breathless Russia story from the Democrats has instantly blown up in their faces and repeatedly made them look like desperate crazy people. Weird.

324 Most of the screaming headline stuff proves to be meh the next day or the next week. I doubt that this ultimately will result in much one way or another. Who remembers Johnny Chung after all?

Furthermore, I suspect a large number politicians on both sides of the aisles have fixers and under the table payments for "indiscretions". All payments could be considered attempts to "influence the election". Just look at how much taxpayer money was spent on sexual harassment claims against Congress critters. They are spending public money to "influence an election". HRH and the spending on Bill Clinton's bimbo eruptions will also be revived.

It it possible that Trump actually is the SMOD that brings down the temple on all of it. Just imagine the fun if all of the NSA intercepts, security clearance questionnaires, and IRS tax records for all people holding public office, all registered lobbyists and lawyers, and the media were released in a searchable google like database.

After all the Chinese have a large portion of it via the leak during the Obama years regarding security clearance questionnaires on their self reported behavior. Why can't we have a peek?

In defeat he will become a heroic martyr, or he will win and be a victor, but nothing will be the same again. Too much has been seen and said to go back to the conservatism of yesteryear. Those Never Trumpers who still believe that if Trump is taken out via political legal warfare it will vindicate their approach will be seriously mistaken. No Mueller, no Manafort trial. Simple as that. I still have yet to hear exactly how a trial over taxes and bank shit from years before Trump announced has ANYTHING to do with "muh Russia".

I think it more dire. Trump is a proxy. The forces don't hate Trump; they hate us. Before Trump became the voice of the people, all these forces loved Trump. He entertained them, financed some of them, and rubbed shoulders with them in an epicenter of American power. Alas, he's now their gorilla in the midst because he sided with forgotten and abused Middle America.

But their ire is against us through Trump. It is as simple as that.

Yea, hating white people and being for open borders means I'm a little less outraged. I still feel bad she died, and feel bad for her family, but my outrage level decreased. It was at eleventy. If you are killed bcz of policIes you advocated for, and hate people who are trying to protect you, I can't get as outraged. I still think what happened was awful. She did not deserve it. At the same time, she believed in these policies. Which makes me wonder if her family did too. I would think that'd make the pain even worse.

So another day ending in y.

What else does Mueller have because if today was the day he fired his big guns against Trump that ain't gonna get it done.

He's been after Manafort for years, wanted to prosecute him when he was running the FBI. The same FBI that had a FISA warrant against Manafort for the 2 years before he worked for Trump and then restarted right after the election.

The same Manafort that worked for Oleg Deripaska who you should become aware of if you aren't already.

Cohen might be able to tie Trump to a FEC violation. Obama was fined hundreds of thousands of dollars for millions of dollars of FEC violations. I'd like to see how Congress justifies an impeachment.

Mueller is winding down his investigation. This is not going to amount to any real damage against Trump. His supporters never thought he was Jesus and his detractors have nothing to really go after him with.

I'm pretty sure Cohen isn't a Russian spy.

Actually, I think the claim is that paying someone off with your own money to keep a scandal from damaging your campaign is a 'campaign expenditure.'

Which means that basically any personal expense could be claimed to be a 'campaign expenditure,' whether it uses campaign money or not.

Posted by: Mr. Peebles at August 21, 2018 06:56 PM (oVJmc)

399 Going to repost this because this tweet mysteriously disappeared today. Very quickly. It was a long list of reasons why paying off someone does not mean guilt. But she was doing it to cover for someone else, not Trump obviously.

Nancy Leong: I'm troubled by one response I'm seeing to the allegations about Asia Argento, which is, "she made a payment to him, so she must have done something wrong." Any lawyer will confirm that paying money to settle a dispute doesn't necessarily indicate wrongdoing. 1/

Kurt Schlicter had replied: So that's the rule again?

And then POOF!

Leong continues in multiple tweets to explain that a payoff does not meant guilt listing reasons and details why.

After all, legal fees can add up.
After all, it can give her unwanted bad publicity.

Deleted fast. No need to wonder why.

Nancy Leong is Professor of Law at the University of Denver Sturm College of Law, where she teaches and studies Civil Rights, Constitutional Law, and Criminal Procedure.

Maximum advantage to release the redacted stuff in unredacted form the last week of September, up to the first two weeks of October. No later because of so much early voting.

It would kill the Commies and #Nevers timing perfectly and bigly.

And run as a campaign ad, Mollie Tibbet's and Kate Steinle's pictures a thousand times, split screen with leading Dems saying "we want open borders" and "eliminate ICE".

So many reasons not to have social media. However, knowing what she believed brought my blood pressure down. My grief for her and her family still there, and my disgust at her killer. But that is all.

Yep.
And the Cohen language is so vague its pretty suspicious. If Cohen is claiming his client instructed him to break the law, and he didn't advise his client of the illegality, that's on him, not his client.

But it sounds like what he did wasn't even illegal.
And who is he claiming intended to influence the election? Him or Trump?

They'll use this to break the a/c privilege by claiming crime/fraud but it looks very weak-- and bizarre.

Posted by: LASue at August 21, 2018 07:03 PM (Z48ZB)

430 I won't speak ill of Mollie Tibbets, may she rest in peace and her family be comforted. Her tweet was misguided and dumb, but I thank God there was no social media around when I was that age because I said and did a lot of stupid shit myself. Let's not be like the people we mock on the left. This young woman is dead at the hands of someone who should have never been here. It happens far too often. I will focus my wrath on the scum that killed her, she didn't deserve any of this.

The Jon Edwards precedent is in play here. He was charged in a case
where he directed his top campaign contributors to pay off his mistress,
during his campaign - and he was found innocent.
In this case these aren't even contributions, Trump paid the money himself.

During a campaign, holding a press conference is an attempt to
"influence the election". Kissing babies is an attempt to "influence
the election". Everything a campaign does is an attempt to "influence
the election".
In this context the phrase is utterly meaningless.

It's called "spin."

Posted by: S at August 21, 2018 07:57 PM (zgX3V)

452 According to a former FEC commissioner who spoke with Mark Levin the potential problem would have been had Trump used campaign money for this purpose, not that he didn't EVEN IF it helped him in the election.
If you got plastic surgery, bought new suits, a new car and said these were to help me get elected they are still not directly related to campaigning hence use your own money. So spending money to keep someone quiet is ALSO not a campaign expenditure. Trump had to use personal money which he did.

Even if Trump knew this money would possibly help him get elected it STILL is not campaign related.

Posted by: Krystal Slider Enthusiast at August 21, 2018 08:53 PM (GoLZO)

455 454, well, no - cuz that requires evidence. And there's none, not of any crime.

Tell you what, tho: I am impressed - no, MIGHTY impressed with the way you and the rest of Ace's morons go about the PROCESS of denial.

Cohen pled guilty to conspiracy - CRIMINAL conspiracy - with "Individual-1" as his co-conspirator.

"Individual-1" is Trump. So, this felony charge is, by definition, one in which Cohen has UNDER OATH stipulated he committed in criminal conspiracy with the POTUS.

This is new. This has never happened before in the entire history of this country.

But of course the AoSHQ is, this means nothing and nothing will come of it.

Riiiiiiiiiiggggggttttttt.
