European Court Smashes Google With $5 Billion (With a B) In Fines; Also Directs Google to Stop Bundling Its Own Services in Android OS, or Face Even More Fines

Steven Green thinks the last part is the most important:

As I wrote yesterday (linked above):

That Android phone in your pocket is a virtual spy, reporting back to Menlo Park on your every click, swipe, app, data, photo, email, physical location, etc. All in the name of showing you ads, which Google sells for a LOT of money. And it doesn't matter whether your phone is a Samsung, Huawei, LG, or one of Google's own Pixel phones. Because Google controls the default apps, which is what most people use.

Apple has spent the last couple of years touting (and improving upon) iOS's privacy features. Android phonemakers like Samsung have a hard time competing on privacy, because Google's default apps are, as I described yesterday, digital spies. But now Samsung, Huawei, LG, et al, can ditch Google's apps in favor of their own, and if they choose, take on Apple directly when it comes to protecting consumer privacy.

I'm not saying they necessarily will, but now at least they have the opportunity.

So this decision is a big win for Android OEMs, it heats up the competitive pressure on Apple (which has grown lackadaisical on some of its software quality), and gives Android owners the chance to perhaps take some of their personal privacy back from Google.

40 I have an iPhone (as opposed to a Google phone) for this very reason.

Also: The phone is OFF at all times unless I know I will need it.

Most importantly: Go to your iPhone settings and DISABLE the "background activity" and "push notifications" and "share your location" and all that for ALL your apps, except for the very few that NEED them.

Do all these things combined, and your phone will spy on you much, much less.

I use my phone only for three things, mostly: Uber, Airbnb, and Maps. On rare occasion, other apps.

Smart phones drain power way more than flip phones. The issue is not restricted to the iPhone 6, it's with all smart phones. The big bright screen is the main power-user, and then all the high-power-requiring chips inside. Flip phones and tiny dim screens and many fewer chips.

You just have to accept that you need to recharge smart phone daily if you use them daily. Unavoidable.

Wasn't in the 90's that Microsoft was the target of all kinds of govt lawsuits that would be crippling to any other firm?

And it didn't even put a dent in Microsoft.

Posted by: Soothi at July 18, 2018 02:23 PM (lJDJ/)
-----------------
Thing is, the 90's monopoly lawsuits by the government changed them. Probably for the worse - instead of focusing on business and getting things done, now they had to focus on politics. And remember, this was the era of the Clintons. Microsoft wasn't 'donating' their revenues to Democrat causes, and they got treated similar to the more recent Gibson Guitars.

With Europe, that 'Monopoly' lawsuit forced them to spend time and energy pulling free, useful products (Internet Explorer, Windows Media Player) out of their systems. The Windows "N" editions were that, and they were a joke.

Nowadays, both Apple and Google have their own lock-ins to their own ecosystems. Doing the same, or even worse, than Microsoft did. Only now, they're collating all your data, gathered willingly or unwittingly, to either sell or use for other revenue streams.

This is several years delayed, but needed. Equality under the law and all that.

293 An article by Ben Shapiro is making the rounds asserting that the DNC did not hide their server from the FBI, but in fact, turned it over. The only problem is that if you read the article, its clear that the DNC did NOT turn over their server- they supposedly asked Crowdstrike to make a copy (or what portion, I don't know) and then that copy.

I have no idea how much mischief could go on in the "copying" process, but I suspect there would be enough room for doubt that a copy would not be admissible in court.

Shapiro also argues this is common practice, but if that is so, all computers seized in criminal investigations (including DWS/Awan computers) would just be "copied" and quickly returned to their owners. Im pretty sure that's not what happens.

The question is -the FBI was given "a copy" of the original server. How does anyone know if it truly was a copy? What proof/assurances did they provide that it was an exact duplicate? If they can't provide this-- here is all the reasonable doubt needed.
When a computer is seized by LEO due to criminal activity -yes they will copy (image it) the server. This preserves the original computer and LEO can always go back to get another original copy of the hard drives. Key here is that LEO has possession of the computer itself, plus the copies (images) they made.
The FBI does not have possession of the orignal server. only what was provided by CrowdStrike.

Yeah well Ben Shapiro is a tool, so there is that.

There are still requirements for chain of custody, etc.

FBI has industrial strength copiers, that copy EVERYTHING. Even the stuff you can't see.

However, there is this problem with virtualized or cloud systems - you can't get the access to that stuff, normally.

It seems HIGHLY unlikely that relying on third parties - other than say through the legal departments of hosting providers - is allowable under the rules of evidence.

337 One of the secrets of Trump's success is having really, really stupid enemies, enemies who are so tone-deaf and out-of-touch that they simply cannot adopt commonsense positions that resonate among normal Americans. The establishment instead insists on telling Americans that up is down, black is white, and girls can have penises. Nope. No wonder the Normals have gotten militant, and no wonder a leader like Donald Trump came along with the vision to exploit the opening the establishment left for an outsider to rise and prevail by embracing the obvious.

Posted by: Rush at July 18, 2018 03:19 PM (y8Foj)

418 This is much adieu about nothing, IMNSHO.

Lemme explain. Or, sum up.

Phone manufacturers / vendors have always had the option of shipping Android phones without Google services, including push services, ads, tracking, etc. There are a number of 'mods' (such as LineageOS) of Android out there (remember, the base OS is Linux, including the Linux kernel, and it's all open source) that they could ship, instead, and not include Google's apps. In fact, it's a separate zip file that can be installed on top of some of these mods. Normally, the mods don't include the Google apps, but provide instructions on how to install them if you want them. And I believe there is even a set of open source apps that do most of what the Google apps do (maybe excluding the tracking, etc.).

Are there downsides? Sure. But I don't see how a court ruling is going to change this.

Without Google apps, you don't get Google Play, which means you are cut off from the most accepted repository for apps. There is Amazon, but Amazon is on its way to become just as evil. There are 'free' repos, as well, the one I trust being F-Droid, but most of them are breeding grounds for other spying organizations (muh Russians ). And none of them likely are what developers focus on, so if you end up finding the One Killer App you want for your Android phone, you'll likely also find that it's severely out of date on your repo of choice. Or if it's not a free-of-cost app, then no payment infrastructure, hence no legitimate way to use/pay for it.

Point is, Android phone vendors have always had the option of providing a build of Android (the base, which, remember, is covered by open source licenses) that does not include Google apps, but also does provide their own apps that are tailored to their own repos, their own ads, and their own spying predilections.

They've just all chosen not to do that.

My guess for the reason for that is that most decision makers at those companies just have no clue about the open source world. And that Google relies on that. I haven't read anything regarding this case or the ruling, but if that were true, it doesn't explain why Google wouldn't bring it up as a defense. However, 5 billion may be a reasonable price for them to pay to keep the vendors in the dark. Except that doesn't explain it, either. Since they are now forced to 'allow' vendors to not ship Google apps, even if that was possible before.

So, bottom line is that this whole thing makes no sense to me.

Heck, the could have even rebranded it if "Android" is trademarked (which I suspect it is).

420 The root cause is advertising and the selling of same, and the advertisers lust for consumer demographics.

Ultimately, it should be the consumer's choice, to exchange personal information in exchange for relevant advertising. And the real sinners are the advertisers who broadcast ads that appeal to only a very narrow demographic.

Also, if the only thing Amazon knows about me are the books on my Kindle, then Amazon doesn't know about my need for a pencil point digging bar, and Lowe's doesn't know I want one, nor do I know that Lowe's has exactly what I need.

***Quietly and in the middle of the night, or early morning, the City of Pittsburgh came and removed a statute of Stephen Foster, beloved and famous songwriter of "My Old Kentucky Home" "Oh Suzannah!" "Beautiful Dreamer" and "Jeanie with the Light Brown Hair" - among many, many others
Why? Because of a black slave in the composition, sitting on the plinth, at Fosters knee, playing the banjo. Symbolizing the fact that Stephen was the first commercially successful composer to be heavily influenced by black Americans' music and also to place black people in a positive fashion in his songs, portraying them as the human beings that they obviously are.
Unfortunately, to the average leftard it was " black guy depicted as a slave . . . . below white guy . . . . bad!! Eleventy!!!!

I supplied the information and they sent me a letter saying they understood and would send me my refund. Since the rate is 4.63%, they were fighting over $5.65. I wonder what those letters cost.

He's a good 'un, that Ed. Goes way back. He was DA during the confrontation with MOVE - had to blow up/burn down/shoot up a big ass chunk of Philly, in order to save it from their ordinance violations. It was a scrimmage for Waco.

When he was mayor, he pulled off the greatest art theft in American history (Barnes Foundation in Lower Merion).

True and total POS.

Isn't it actually like, 60 miles away from the Yellowstone volcano?"

But what if cracks and holes opened up all over, and stuff like
boiling water from underground started bubbling up and even shooting up
into the air??? Shouldn't we all freak to the max if that happens?
