OIG Report, Thread Two
Plus: Another Mueller Prosecutor Finally Removed Over Anti-Trump, "Viva La Resistance!" Texts

See below for the earlier stuff we've collectively found.

Here's some new stuff, starting with faulting McCabe and Peter Kadzik for not recusing themselves from these matters.

With respect to these investigations, we agreed with the
FBI's chief ethics official that McCabe was not at any
time required to recuse under the relevant authorities.
However, voluntary recusal is always permissible with
the approval of a supervisor or ethics official, which is
what McCabe did on November 1. Had the FBI put in
place a system for reviewing campaign donations to Dr.
McCabe, which were public under Virginia law, the
sizable donations from McAuliffe's PAC and the Virginia
Democratic Party may have triggered prior
consideration of the very appearance concerns raised in
the October 23 WSJ article.

Finally, we also found that
McCabe did not fully comply with this recusal in a few
instances related to the Clinton Foundation
investigation.

Former Assistant Attorney General Peter Kadzik:

In Chapter Fourteen, we found that Kadzik
demonstrated poor judgment by failing to recuse
himself from Clinton-related matters under federal
ethics regulations prior to November 2, 2016. Kadzik
did not recognize the appearance of a conflict that he
created when he initiated an effort to obtain
employment for his son with the Clinton campaign while
participating in Department discussions and
communications about Clinton-related matters.

He didn't recognize this, or he recognized it and decided to help Clinton anyway?


Kadzik also created an appearance of a conflict when he
sent the Chairman of the Clinton Campaign and a
longtime friend, John Podesta, the "Heads up" email
that included the schedule for the release of former
Secretary Clinton’s emails proposed to the court in a
FOIA litigation without knowing whether the information
had yet been filed and made public. His willingness to
do so raised a reasonable question about his ability to
act impartially on Clinton-related matters in connection
with his official duties.

Additionally, although Department leadership
determined that Kadzik should be recused from Clintonrelated
matters upon learning of his "Heads up" email
to Podesta, we found that Kadzik failed to strictly
adhere to this recusal. Lastly, because the government
information in the "Heads up" email had in fact been
released publically, we did not find that Kadzik released
non-public information or misused his official position.

From the Daily Caller: Viva La Resistance, writes one of Mueller's Murderers Row of partisan I'm With Her Democrats:

An FBI attorney who worked on the special counsel’s Russia investigation until earlier this year sent anti-Trump text messages to a colleague, including one exclaiming: "Viva le Resistance."

The attorney's comments are revealed in a Justice Department inspector general’s report released on Thursday.

The lawyer is not identified, but he worked on the Hillary Clinton email investigation and was the FBI’s lead attorney on the investigation into Russian election interference. He was assigned to special counsel Robert Mueller's investigation soon after it began in May 2017 and left in late February of this year after some of his private messages were shared with the special counsel.

"I am numb," the attorney wrote on Nov. 9, 2016, the day after President Trump's election.

"I am so stressed about what I could have done differently," the lawyer continued, apparently referring to the FBI’s handling of the Clinton email probe.

The attorney's messages show that the was distressed at the FBI's decision in October 2016 to re-open the investigation into Clinton’s emails. Democrats have claimed that decision hurt Clinton at the polls.

The FBI lawyer also suggested that he would work to resist the Trump administration.

"Is it making you rethink your commitment to the Trump administration"” one FBI lawyer wrote on Nov. 22, 2016.

"Hell no. Viva le resistance," the future Mueller attorney responded.

This isn't the only IG report that will come out but yeah this one seems to be a shit sandwich. We see lots of political bias, but what we wanted to see was this political bias being the catalyst for blatantly illegal actions and hence having the need for criminal referrals. Instead it's just a "concern" for a lack of professional conduct.

Pasting into notepad and copying/pasting back into the HQ usually works, but there might be some hangups even then. Super fancy curly quotation marks and commas will get you, as will the double hyphen punctuation that I can't remember the name of right now but that acts sort of like a parenthesis.

I bet there's a website that strips all of that stuff out and puts the dumbest characters back in, but I've never looked for it.

Except in the Clinton case, they lied. Less than 10% of expenditures were for charities, if my recollection is correct, and all the remainder was for Clinton Foundation "programs". programs like "Chelsea Apartment Program" and the "Elect Hillary President Program".

1. I would have expected it to at least point out the bias of Comey, especially the deciding way early to not prosecute even before the hillary interview

Pasting into notepad and copying/pasting back into the HQ usually works, but there might be some hangups even then. Super fancy curly quotation marks and commas will get you, as will the double hyphen punctuation that I can't remember the name of right now but that acts sort of like a parenthesis.

I bet there's a website that strips all of that stuff out and puts the dumbest characters back in, but I've never looked for it.

Cut and paste it into Notepad (if you're on a PC machine) to render it into plain text; and then cut and paste the plain text into the comment pane.

You'll still have to remove all "smart punctuation" like 'genuine', bent quotation marks and apostrophes, and en -- and em --- dashes or it won't post or give you black diamonds instead. Commas and periods are okay though; they don't have to be retyped.

SSBN, it is almost always caused non-"standard" punctuation. As someone mentioned above, pretend you're living a couple of decades ago and stick to basic characters if you can. Finding the offending item can be tough, but the red screen of death will help. Look at the final line. For example:
UnicodeEncodeError: 'latin-1' codec can't encode character u'\u2018' in position 0: ordinal not in range(256)

This tells you which character is acting up. In this case, it is unicode character 2018. You can then look up that code somewhere like https://tinyurl.com/ydzyn8aa, which has most of the common unicode characters you find in general use. In this case, it is a "left single quotation mark" and so almost certainly is a single-quote or an apostrophe.

You can also do a "find on page" in your browser and paste in the character from the link above, and jump right to it since browser in-page searches are usually character compliant.

Pixy is less than illuminating, but the error message *will* tell you what's wrong and it's pretty easy to find the offender if you have a place to look up the rune that corresponds to the code that the error message vomits out.

I pity the FBI employees who simply want to do their jobs in a professional manner. Anything less than an expression of total fealty would be the end of their career path.

The spin in the report, from everything I've seen in it so far, is to give FBI/DOJ personal every benefit of every doubt possibly offered.

Even so, the milquetoast conclusions made by OIG are damning.

Where the FBI was not incompetent, they were in fact biased (although OIG says that they can't *prove* bias with the docs and testimony they collected).

Have not read the whole report, obviously. But the summary/recos repeatedly absolve the "team" of making calls based on bias. Which, given the underlying facts of the case, I find astonishing.


Meanwhile - and I'm certain there will be a festival of little nuggets like this in the IG report - Page 89, footnote 75 confirms that Obama was one of 13 people corresponding with Clinton on her unsecure, illegal email system.

I think people are misinterpreting what the IG does and what his limitations are. He is not a prosecutor, all he does is gather evidence and lay it out. He doesn't even make criminal referrals as part of the report.

He can recommend that employees be turned over to their internal oversight groups which is what Horowitz did with McCabe and today 5 more FBI employees. Criminal referrals can come from that, just like it did with McCabe.

Further, we have no idea what Huber and his team are doing in parallel to this whole process. And nobody has even fully read this report today which includes all sorts of gems which could be predicate for criminal prosecutions.

Horowitz made a very detailed report and from what I've seen so far there is plenty of goodness to justify lots of criminal actions.

There's something very weird about the text of the document. It doesn't cut-and-paste properly -- most of the letters evaporate - -and can't be searched for text-strings. But look again without a search -- those words are definitely on page 416.

The October 6, 2016 declaration that there was evidence of Russian and US "political organizations". Comey rightfully deferred from signing on to the statement. From the IG Report (p. 347):

"The U.S. Intelligence Community (USIC) is confident that the Russian Government directed the recent compromises of emails from US persons and institutions, including from US political organizations." The statement then described the nature of these compromises and urged "state and local election officials to be vigilant."

There is ample evidence now to indict McCabe for perjury and lying to a federal agent, to cite one example. Unless prosecutions follow indictments Huber obtains, cynicism will lead invariably to an actual, real resistance that will include routine jury nullifications in federal courtrooms. There is no question crimes were committed. The issue is whether there in enough semblance of the Rule of Law left in the United States for justice to be possible.

I don't think there is. Note that in one of Page's texts Horowitz quoted she writes Trump's election would not be good for "our organization." That's sort of perfect. We have an Administrative State with trappings of a democracy as things now stand.

I hope to be disabused of this opinion, but quite doubt it will happen.

At roughly the same time, DHS' Jeh Johnson asked the states to allow the federal government to handle vote tabulations. It was inexplicable at the time, now not so much. The Obama Administration was going to steal the election if necessary and apparently weren't so cocksure things would turn out as they had planned. Imbedded there is the raison d'etre: Russia.
