IG Report Released

It's here.

It's 500 pages so... I don't know, I guess I'll rely on Twitter and your posts in the comments for a roadmap.

It seems like a whitewash.

Comey claims that he was not alert to the importance of the emails on Anthony Weiner's laptop because he "doesn't know that he knew" that Anthony Weiner was married to Hillary Clinton's Gal Friday Through Thursday Huma Abedin:

Comey said that he recalled first learning about the
additional emails on the Weiner laptop at some point in
early October 2016, although he said it was possible
this could have occurred in late September 2016.
Comey told the OIG that this information "didn't index"
with him, which he attributed to the way the
information was presented to him and the fact that, "I
donít know that I knew that [Weiner] was married to
Huma Abedin at the time."

That. Is. A. Lie.

On the Delay In Getting a Warrant to Bring the Weiner Emails to the DC Office:

As we describe in Chapter Nine of our report, the
explanations we were given for the FBIís failure to take
immediate action on the Weiner laptop fell into four
general categories:

* The FBI Midyear team was waiting for additional
information about the contents of the laptop
from NYO, which was not provided until late
October;

* The FBI Midyear team could not review the
emails without additional legal authority, such
as consent or a new search warrant;

* The FBI Midyear team and senior FBI officials
did not believe that the information on the
laptop was likely to be significant; and

* Key members of the FBI Midyear team had been
reassigned to the investigation of Russian
interference in the U.S. election, which was a
higher priority.

We found these explanations to be unpersuasive
justifications for not acting sooner, given the FBI
leadership's conclusion about the importance of the
information and that the FBI Midyear team had
sufficient information to take action in early October
and knew at that time that it would need a new search
warrant to review any Clinton-Abedin emails.

Moreover, given the FBIís extensive resources, the fact
that Strzok and several other FBI members of the
Midyear team had been assigned to the Russia
investigation, which was extremely active during this
September and October time period, was not an excuse
for failing to take any action during this time period on
the Weiner laptop.

The FBI's failure to act in late September or early
October is even less justifiable when contrasted with
the attention and resources that FBI management and
some members of the Midyear team dedicated to other
activities in connection with the Midyear investigation
during the same period....

In assessing the decision to prioritize the Russia
investigation over following up on the Midyear-related
investigative lead discovered on the Weiner laptop, we
were particularly concerned about text messages sent
by Strzok and Page that potentially indicated or created
the appearance that investigative decisions they made
were impacted by bias or improper considerations.
Most of the text messages raising such questions
pertained to the Russia investigation, and the
implication in some of these text messages, particularly
Strzok's August 8 text message ("we'll stop" candidate
Trump from being elected), was that Strzok might be
willing to take official action to impact a presidential
candidate's electoral prospects. Under these
circumstances, we did not have confidence that Strzok's
decision to prioritize the Russia investigation over
following up on the Midyear-related investigative lead
discovered on the Weiner laptop was free from bias.

We searched for evidence that the Weiner laptop was
deliberately placed on the back-burner by others in the
FBI to protect Clinton, but found no evidence in emails,
text messages, instant messages, or documents that
suggested an improper purpose. We also took note of
the fact that numerous other FBI executives--including
the approximately 39 who participated in the
September 28 SVTC--were briefed on the potential
existence of Midyear-related emails on the Weiner
laptop. We also noted that the Russia investigation was
under the supervision of Priestap--for whom we found
no evidence of bias and who himself was aware of the
Weiner laptop issue by September 29. However, we
also did not identify a consistent or persuasive
explanation for the FBI's failure to act for almost a
month after learning of potential Midyear-related emails
on the Weiner laptop.

A New Investigation Into FBI Leaks And Even Taking Benefits from Reporters?

Improper Disclosure of Non-Public Information

As we also describe in Chapter Twelve, among the
issues we reviewed were allegations that Department
and FBI employees improperly disclosed non-public
information regarding the Midyear investigation.
Although FBI policy strictly limits the employees who
are authorized to speak to the media, we found that
this policy appeared to be widely ignored during the
period we reviewed.

We identified numerous FBI employees, at all levels of
the organization and with no official reason to be in
contact with the media, who were nevertheless in
frequent contact with reporters. Attached to this report
as Attachments E and F are two link charts that reflect
the volume of communications that we identified
between FBI employees and media representatives in
April/May and October 2016. We have profound
concerns about the volume and extent of unauthorized
media contacts by FBI personnel that we have
uncovered during our review.

In addition, we identified instances where FBI
employees improperly received benefits from reporters,
including tickets to sporting events, golfing outings,
drinks and meals, and admittance to nonpublic social
events. We will separately report on those
investigations as they are concluded, consistent with
the Inspector General Act, other applicable federal
statutes, and OIG policy.

9 Throughout all this, the major and most startling fact is the FBI heard
some drunk talk in an English bar from a campaign volunteer claiming
Putin had damaging material on Hillary, and they opened a fully staffed
counter-intelligence investigation, including inserting spies into the
campaign and illegally starting up full electronic intercepts, while--
at the same time -- they possessed actual evidence Hillary had committed
gross violations of the Espionage act and did everything they could to
avoid investigating the crimes, handed out immunity like candy, and
tried to shut down any reports the Russians had hacked the accounts.

It's the different treatment that speaks to obvious bias, and the IG isn't charged with speaking to that bias.

"We were deeply troubled by text messages exchanged by Strzok and Page that potentially indicated or created the appearance that investigative decisions were impacted by bias or improper considerations. Most of the text messages raising such questions pertained to the Russia investigation, which was not a part of this review. Nonetheless, when one senior FBI official, Strzok, who was helping to lead the Russia
investigation at the time, conveys in a text message to another senior FBI official, Page, "No. No he won't. We'll stop it" in response to her question "(Trump's) not ever going to become President, right? Right?!", it is not only indicative of a biased state of mind but, even more seriously, implies a willingness to take official action to impact the presidential candidate's electoral prospects."

90 It appears that the report, much like the investigations, are not actually interested in looking at the gross violations of the law, but rather at some side issues that may or may not be provable, and thereby determining that nothing at all went wrong at any point.

Sort of like saying that yes, the team did lose the game, but boy howdy they were snappy dressers.

Also this report was initiated by Obama and his Justice Department because they were upset the Comey may have swung the election with his antics. The investigation just carried a year and a half into the Trump Administration. Being in the dreaded private sector all my life the time line seems a bit excessive for the results presented. Not sure what to make of that.

The conclusions in these things are always a whitewash. The
explosiveness is in the details like the Strok texts. That and the fact
Hillary's secret emails were compromised are huge deals

Posted by: Jollyroger at June 14, 2018 02:34 PM (+087i)

Full Disclosure - I haven't read a word of the document.
But from what I gather from a smattering of searching through online reactions is this: Not everybody who's business it is to read it is looking at it like a whitewash.
As Jollyroger says above, these kinds of documents are not supposed to read like a Mike Hammer episode. Reports like this are always dry and very technical, so as to be the opposite of dramatic. Just the facts, ma'am. They are not going read like a Breitbart headline. If you were expecting "HILLARY AND FBI EXPOSED!!!!!!111eleventy! yes, you're going to be disappointed.

The devil is in the details. For legal purposes, they are enough.

FBI interviewers referred to Hillary as "The President" in July of 2016

here is the statement

15:07:41, Agent 1: "...I'm done interviewing the President -- then type the 302. 18 hour day...."

and

On July 6, 2016, four days after Clinton's interview, Agent 1 sent an instant
message in which he stated that he was "done interviewing the President," referring
to Clinton. We asked Agent 1 if he thought of Clinton as the next president while
conducting the Midyear investigation. Agent 1 stated, "I think my impression going
into the election in that personal realm is that all of the polls were favoring Hillary
Clinton." We asked Agent 1 if he treated Clinton differently because of this
assumption. Agent 1 stated, "Absolutely not. I think the message they said that
our leadership told us and our actions were to find whatever was there and
whatever, whatever that means is what it means."

135 "Although there is evidence of potential violations of the statutes regarding the handling of
classified information, our judgment is that no reasonable prosecutor would bring such a case.
Prosecutors necessarily weigh a number of factors before bringing charges. There are obvious
considerations; like the strength of the evidence, especially regarding intent. Responsible
decisions also consider the context of a person's actions and how similar situations have been
handled in the past."

I'm mildly disappointed that no criminal referrals were indicated, but then OIG reports rarely have them.

Peter Kadzig, Peter Strozk, and Andrew McCabe had better watch their backs, though. This report was hardly indemnifying.

Agreed. But what is the IG's purview regarding recommendations? For the commerce department, the IG job is to make administrative type recommendations to promote efficiency and deter abuse, fraud, etc. So while the findings are dramatic, the recommendations will almost always be mundanely administrative.

Page 10 - Comey's 10/28 letter to Congress wasn't politics, but he shouldn't have done it.

We found no evidence that Comeys decision to send the October 28 letter was influenced by political
preferences.

Much like with his July 5 announcement, we found that in making this decision, Comey engaged in ad hoc
decisionmaking based on his personal views even if it
meant rejecting longstanding Department policy or
practice.

With respect to these investigations, we agreed with the FBIs chief ethics official that McCabe was not at any time required to recuse under the relevant authorities.

Finally, we also found that McCabe did not fully comply with this recusal in a few instances related to the Clinton Foundation investigation.

Also Page 13 - Kadzik has been a bad boy, but not THAT bad ...

Additionally, although Department leadership
determined that Kadzik should be recused from Clinton related matters upon learning of his Heads up email
to Podesta, we found that Kadzik failed to strictly
adhere to this recusal. Lastly, because the government
information in the Heads Up email had in fact been
released publically, we did not find that Kadzik released non-public information or misused his official position.

reporters, and were the guests of journalists at nonpublic social events. We will
separately report on those investigations as they are concluded, consistent with the

302 In assessing the decision to prioritize the Russia
investigation over following up on the Midyear-related
investigative lead discovered on the Weiner laptop, we
were particularly concerned about text messages sent
by Strzok and Page that potentially indicated or created
the appearance that investigative decisions they made
were impacted by bias or improper considerations.
Most of the text messages raising such questions
pertained to the Russia investigation, and the
implication in some of these text messages, particularly
Strzok's August 8 text message ("we'll stop" candidate
Trump from being elected), was that Strzok might be
willing to take official action to impact a presidential
candidate's electoral prospects. Under these
circumstances, we did not have confidence that Strzok's
decision to prioritize the Russia investigation over
following up on the Midyear-related investigative lead
discovered on the Weiner laptop was free from bias.

354 weft I think the latest bombshell text was only recovered/discovered recently - no time to tell Congress. If true, the "hidden from Congress" thing will be a nothing-burger.

Peebles, this report is just about the "investigation" of the improper handling of communications by the Clinton team at State.

Just skimming and commenting mode now, but at several points in the exec summary the IG repeats that investigative decisions were based on the team's conclusion that no prosecutable crimes were to be found. WTFF? Isn't *THAT* precisely the whole point of this review - to look at why such a massive and obvious and undeniable pattern of crimes were *not* investigated and prosecuted?

It's completely, pristinely, idiotically circular.

And I'm wondering if the report looked at the jaw-dropping edit in the investigative report that just brazenly changed the conclusion there was evidence for a charge under the recklessness provision of the Espionage Act for language using made-up concepts having nothing to do with the law.

That's public, that is unambiguous, cannot see any way that could be found normal, lawful, or sane - but since Comey has essentially blessed the IG report, I'm assuming the IG simply didn't examine it. Amazing.

417 Improper Disclosure of Non-Public Information
In addition, we identified instances where FBI
employees improperly received benefits from reporters,
including tickets to sporting events, golfing outings,
drinks and meals, and admittance to nonpublic social
events. We will separately report on those
investigations as they are concluded, consistent with
the Inspector General Act, other applicable federal
statutes, and OIG policy

No Court was ever going to stick its own neck out and bust down the FBI without some external prompting. And only Massive Public Outrage was going to fuel that. So what did this report just do ?

First - chilled that Outrage by putting almost two years between the events and the report. Second - turned any remaining Outrage into Confusion.

So - go ahead Justice Seekers. Go through every one of those pages. Find all the evidence you want.

Then tell me ... who's going to do anything about it ? Not the FBI. They're going to do some training. Not the DOJ. They helped come up with the training.

But look on the bright side ... you still got Order.

one of the emails, including those that were found to contain classified information, included a header or footer with classification markings. As we discuss further in Chapter Seven, this absence of clear classification markings played a significant role in the decision by the Midyear prosecutors to recommend to Attorney General Lynch in July 2016 that the investigation should be closed without prosecution. According to the LHM, the FBI, with the assistance of other USIC agencies, identified "81 email chains containing approximately 193 individual emails that were classified from the CONFIDENTIAL to TOP SECRET levels at the time the emails were drafted on UNCLASSIFIED systems and sent to or from Clinton's personal server." In other words, the USIC agencies determined that these 81 email chains, although not marked classified, contained information classified at the time the emails were sent and should have been so marked. Twelve of the 81 classified email chains were not among the 30,490 that Clinton's lawyers had produced to the State Department, and these were all classified at the Secret or Confidential levels. Seven of the 81 email chains contained information associated with a Special Access Program "SAP", which witnesses told us is considered particularly sensitive. However, following the October 23 WSJ article and discussions with Comey, McCabe recused from the Clinton-related investigations on November 1, 2016. Once McCabe recused himself, he was required to cease participation in those matters. Voluntary recusal is always permissible with the approval of a supervisor or ethics official, even where the elements in section 502a are not present. Excellent! The old George Costanza defense.
"Was that wrong? Should I not have done that? If I knew that that sort of thing was frowned upon.."

542 534 This is not a game. It's a propaganda war to win the
minds of The People away from The Deep State which has owned them since
the end of WWII. Rushing things doesn't help.

Dragging it out for 5 years is what doesn't help.

Trump is been in office for 18 months. That's 3.5 years short of 5 years. Things are moving forward. You have to be blind not to see this and see how this IG report hurts the credibility of the Deep State.

543 To keep some things in perspective, I really want to be seeing some special interest posts/items on examples in the past where the FBI came down on various nobodies like a ton of bricks and ruined their lives over relatively minor / chickenshit infractions.

545 The matter of the Justice Department's independence is
particularly salient right now given that, according to multiple
reports, at least two current FBI employees held over from the
Obama administration and possibly several other FBI associates are
currently under federal investigation for improper activities as relates to long-standing DOJ policy.

548 >>"81 email chains containing approximately 193 individual emails that were classified from the CONFIDENTIAL to TOP SECRET levels at the time the emails were drafted on UNCLASSIFIED systems and sent to or from Clinton's personal server."

The worst part is this still never addresses WHY Hillary was using the personal email server and passing around classified docs - some she was not authorized to even read - like freakin' party favors. Was she selling this information? Was she passing it to others to sue for their personal business/gain, which then resulted in a kick-back to the foundation? Was she illegally running a shadow intelligence operation?!?
