Judge to Mueller's Team in Manafort Case: "Come On, Man," You're Just Trying to Railroad Manafort to Get to Trump
A federal judge on Friday harshly rebuked Special Counsel Robert Mueller’s team during a hearing for ex-Trump campaign chairman Paul Manafort -- suggesting they lied about the scope of the investigation, are seeking "unfettered power" and are more interested in bringing down the president. "You don't really care about Mr. Manafort," U.S. District Judge T.S. Ellis III told Mueller's team. "You really care about what information Mr. Manafort can give you to lead you to Mr. Trump and an impeachment, or whatever." Further, Ellis demanded to see the unredacted "scope memo," a document outlining the scope of the special counsel’s Russia probe that congressional Republicans have also sought. ...This CNN article has some extended quotes:
The special counsel argues that Deputy Attorney General Rod Rosenstein granted them broad authority in his May 2, 2017 letter appointing Mueller to this investigation. But after the revelation that the team is using information from the earlier DOJ probe, Ellis said that information did not "arise" out of the special counsel probe – and therefore may not be within the scope of that investigation. ... Mueller's team says its authorities are laid out in documents including the August 2017 scope memo -- and that some powers are actually secret because they involve ongoing investigations and national security matters that cannot be publicly disclosed. Ellis seemed amused and not persuaded. He summed up the Special Counsel's Office as, "We said this was what [the] investigation was about, but we are not bound by it and we were lying." He referenced the common exclamation from NFL announcers, saying: "C'mon man!"
"You don't really care about Mr. Manafort's bank fraud," Ellis said to prosecutor Michael Dreeben, at times losing his temper. Ellis said prosecutors were interested in Manafort because of his potential to provide material that would lead to Trump's "prosecution or impeachment," Ellis said. "That's what you're really interested in," said Ellis, who was appointed by President Ronald Reagan. Ellis repeated his suspicion several times in the hour-long court hearing... "We don't want anyone in this country with unfettered power. It's unlikely you're going to persuade me the special prosecutor has power to do anything he or she wants," Ellis told Dreeben. "The American people feel pretty strongly that no one has unfettered power." When Dreeben answered Ellis' question about how the investigation and its charges date back to before the Trump campaign formed, the judge shot back, "None of that information has to do with information related to Russian government coordination and the campaign of Donald Trump."In other words, how can an authorization of power written in 2017 to investigate crimes that supposedly happened in 2016 reach back to include 2005 crimes? How can 2005 crimes be said to have "arisen" out of the 2017-2018 investigation? That's what he's talking about when he talks about "unfettered power." These prosecutors are saying they don't care what the "scope memo" says their powers are, they have All the Powerz. Which just further impugns the propriety of the SC operation under DOJ regs - it doesn't in itself justify (substantively) the Manafort tax stuff.
Tax/finance stuff should be turned over to the local US attorney. In DC Manafort faces the somewhat dubious charges over FARA. How that can be seen as anything but punitive and frivolous, given the decades of FARA enforcement practices, I don't know.

The thing is, this is basically true. A DC judge could rule that Meuller has to stop his investigation because of the Good 'n' Plenty clause and it would probably stop instantly until another judge pointed out how ridiculous the ruling was.

no, the judge is not being political with his ruling that he has to have access, under seal, to the redacted parts of the memo. he is making the point that nothing in the unredacted documents presented so far gives you any authorization to do what you are doing to manafort.

How can a crime committed in 2005 be prosecuted. I've been told here numerous times that Hillary can't be prosecuted because the statute of limitations on crimes she committed as late as 3 years ago have expired.

Did you read McCabe's lawyer's statement after McCabe was fired. And he was fired.
He said that they were only given access to some of the information in the report and not on any evidence given in grand jury or other criminal matters.
Now why would he say that? What grand jury? What criminal matters?
There is an assumption among many that just because he isn't running a public prosecution like Mueller that nothing is happening. I'm not making that assumption and I'm going to wait to see what happens once the report is released.

A couple of years ago I actually saw a judge handling domestic cases take off her earrings when a guy told her in open court "I don't gotta pay that bitch, I don't care what you say." Everyone else in the courtroom, including me, tried to make themselves invisible when she started yelling. Needless to say, Mr. Cockypants discovered right quick that, lookie there, the judge can have the guy standing over there come and physically haul me out of the courtroom and off to jail.

Alex, you've pointed right at the basic issue with the Judge's action. I've seen judges say "Do this. Now. Right now." and mean it. Ellis gave Mueller two weeks, which can only mean he is giving Mueller plenty of time to object and he (the judge) can then reconsider. Maybe my cynicism is overtaking rational thought here, but I hope Judge Ellis was sincere in his entirely warranted comments to Mueller, and this wasn't just for show.
