Parkland Survivor Kyle Kashuv Interrogated by Broward Police for Non-Crime of Safely Shooting a Legal Gun Inside a Licensed Gun Range; "Treated Like a Criminal"

The Broward Cowards don't like confronting criminals with guns. They make up for it by getting tough with law-abiding citizens with guns.

Although Kashuv was a 2nd Amendment supporter, he'd never actually fired a gun before. So this past weekend he went to the range with his dad.

He posted about it on social media:

When a parent of a slain student objected to Kashuv's tweet, he responded in this sensible, polite way:

Despite making it clear that he was not following the path of Nikolas Cruz, this tweet allegedly "traumatized" some fellow students.

So the Broward Cowards decided to treat the non-threat Kaschuv much differently from the actual live, multiply-reported threat Cruz.

Probably because they knew he wasn't a threat.

Near the end of third period, my teacher got a call from the office saying I need to go down and see a Mr. Greenleaf. I didn't know Mr. Greenleaf, but it turned out that he was an armed school resource officer.

How did you find him, given that he was certainly hiding in a stairwell?

I went down and found him, and he escorted me to his office. Then a second security officer walked in and sat behind me. Both began questioning me intensely. First, they began berating my tweet, although neither of them had read it; then they began aggressively asking questions about who I went to the range with, whose gun we used, about my father, etc. They were incredibly condescending and rude.

Then a third officer from the Broward County Sheriff's Office walked in, and began asking me the same questions again. At that point, I asked whether I could record the interview. They said no. I asked if I had done anything wrong. Again, they answered no. I asked why I was there. One said, "Don't get snappy with me, do you not remember what happened here a few months ago?"

They continued to question me aggressively, though they could cite nothing I had done wrong. They kept calling me "the pro-Second Amendment kid." I was shocked and honestly, scared. It definitely felt like they were attempting to intimidate me.

I was treated like a criminal for no reason other than having gone to the gun range and posted on social media about it.

Motherf***ers.

It's the problem of government writ small. Power inevitably attracts those who want to abuse it. The Founding Fathers understood that and gave us a constitution. The Broward County Sheriff's Dept apparently doesn't and won't because it would interfere with the frisson of power.

Maybe if they'd put the slightest effort into actually following up on the shooter's blatant and repeated posting about wanting to murder people they could have stopped him.

But... this guy is clearly not a lunatic wanting to murder people. He's obviously learning responsible gun use and training rather than posing and threatening. And he's obviously a vocal critic of the Broward County sheriffs department and school administration so this looks more like retaliation and punishing a kid for holding the wrong positions.

Christy had to pardon those and others caught up in NJ fascist prosecutors zealotry against otherwise law abiding gun owners while they let hardened repeat criminals roam the streets.

This is all part of the plan.

He said that Kanye West-(who, like me Steyn said that "he wouldn't know if he came into Starbucks and stayed too long without buying anything and I was the barrista") said the attempt to badger and coerce people who express a different opinion than the SJW groupthink is "mental slavery". Good choice of words, Kanye. Next thing you know, Kyle, you'll be banned from Twitter and Facebook by the tolerant left.

If I were trump I would direct the US Attorney's Office to investigate the unlawful imprisonment and intentional deprivation of rights as well as harassment of this boy by all these people, state officials/county employees immediately. 132 41 This just another reason to be wary of the cops and their motives. Some have really let the power go to their heads.

It's the problem of government writ small. Power inevitably attracts those who want to abuse it. The Founding Fathers understood that and gave us a constitution. The Broward County Sheriff's Dept apparently doesn't and won't because it would interfere with the frisson of power.

Remember, the idea is to remove all parental rights from their children and give them to the state. At age 17, he doesn't have the same exact rights as an adult, but is certainly old enough to completely intimidate.

The school and the sheriff's department would be receiving a letter from my atty. if this happened to my kid.

With that said, this kind of thing didn't happen years ago because years ago, we didn't have twitter,Instagram, youtube, and facebook to put photos of every single thing we do all day or say.
Kids and adults, this one included do not understand how privacy being valued and protected by the constitution was to prevent this exact kind of crap from happening to an individual. I can't imagine what it must be like, to be a parent of a murdered child.

However... the impulse to turn one's personal grief into a political cause, this early after the death, strikes me as suspect.

Further, it is NOT uncommon for family of crime victims, or other tragedies, to view themselves as completely innocent, where any action they take must be considered morally defensible, because their loss is all-consuming. This of course is not true either.

So one or the other is likely in effect here. Or both.

No, what I mean is that its easy to come up with the perfect smartass crack we'd say now at 29 years old, but at his age, alone, surrounded by big cops and school admins? Probably not going to be firing off witty rejoinders. He admits he was scared, and that's what they fully intended.

So, you are saying I'm talking a big game here, but at that age I would have been cowed into silence and manners. Well, yea. Of course. Although, in my day things were very different.

In today's day and age, if I had lived thru that school shooting, I may well have smarted off. Even back in my day I did some things that surprised even me. So put me in the current environment, and yea, I could see me smarting off, especially if I knew I had my parents backing. But we'll never know.

It's necessary. Much as I support police officers stopping violent crimes and patrolling the streets, a blanket love for law enforcement (bootlicking to use an overused term) never goes in a good direction.

The fact is while there are many cops out there with good morals that do well by their communities who I support wholeheartedly, there are plenty of scum sucking bureaucrat bullies that wear the badge. Not hard to guess which one of the categories the cops in this story fall in.

It always pays to remember that while many police are good people, they look out for themselves first and foremost (as their union activities demonstrate) and you do not want to gamble on any of the ones you interact with being good people. Assume the worst for your own sake.

I wonder if one of the several lawyers on this blog would be so kind as to point to a primer or write something up.

Some questions I've seen:
1. Does an officer of the court in the course of their duties have to give consent to be recorded, or are their official actions always public record?

2. If you publicly announce you're recording, and that anyone who doesn't wish to be recorded can feel free to stop talking, are you now safe from two party consent laws?

3. Are there any other details we should know about recording audio in a two party consent state that we might need to know?

In that sense, yes, but the policy of pulling in kids to talk to them when they are acting odd on social media is a good one. The technique is valid. Nothing about it was unconstitutional nor did it violate any rights to do so.

Children are unable to consent to a lot of things (and teen agers), but they're also presumed to be under authority, particularly while in school. That authority has the power to talk to them when they deem it necessary or when the child is in violation of some rule or code.

Thus, the action was an abuse of this power, but not in its self wrong, if you know what I mean.

Thus, the action was an abuse of this power, but not in its self wrong, if you know what I mean.

I hear ya Chris. I know in my day when we were called to the principals office we went. I just could not imagine growing up now with social media. We would never want the principal or teachers to know what we were doing or thinking out of their eyesight lol.

409 Dude...Fifth Amendment. Ever hear of it?

Which part of this applies:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

410 Questions are fine. The expectation of an answer is not.

Right, they do not have the power to make you answer. They can intimidate and cajole or trick you, but they cannot make you answer, legally and by your rights. You have the right to refuse to say anything (and if you're smart, you will take advantage of that right).

I can't believe you're asking this. "nor shall be compelled in any criminal case to be a witness against himself" Also colloquially known as the right against self-incrimination. It's where we get the whole right to remain silent part of the Miranda warning from.

Posted by: Insomniac at April 24, 2018 02:57 PM (NWiLs)

413 404 As I undestand it, the police have the power to
question people in an investigation, or if they have reasonable cause to
believe something illegal is taking place.

But NOT a minor. Not without a parent or attorney present.

And there was nothing illegal taking place. He was under adult supervision at the range.

I haven't looked into this other than a quick read of Ace's post, and I don't plan on doing so. But I think the question here is whether these people were acting as police or school personnel. I think they were out of line because it did not happen in the school, but times have changed. People get called out for social media all the time, it is de rigueur.

Posted by: Quint at April 24, 2018 02:57 PM (n13/j)

Actually, I think the cops began to trod upon shaky ground with the part about "nor be deprived of life, liberty or property, without due process of law" when they went beyond asking him for the background story behind his tweet.

Very shaky, possibly quicksandy ground.

He wasn't compelled to do any such thing. he was asked, and could choose to answer or not. There was no penalty for not answering, any more than in court if someone asks. If the Mob Boss is asked if he ordered his boys to kill Jimmy "slats" Jacuzzi, and he answers, nobody has violated his constitutional rights.

418 Discussing Miranda or the Fifth Anendment is pointless. If a person doesn't get on a gut level that 3 officers hauling a kid into a room to question him about a facially legal activity is outrageous, no amount of law-talk is going to make a difference. Some "conservatives" are authoritarians.

419 Kyles mistake was talking to them. His 2nd mistake was not walking out. His 3rd mistake was not calling his father.

Never talk to cops. Especially when they're being dickish.

420 He was unlawfully detained and subjected to a custodial interrogation without being advised of his rights. This is a clear violation of the Fifth Amendment under longstanding SCOTUS precedent. Just because you don't get beaten with a rubber hose doesn't make it legally kosher.

"I know you are but what am I" is ALWAYS an avaliable response to any question from law enforcement.

Not saying it's a GOOD response, mind you . . .

424 This is beyond outrageous. After they started in with their interrogation, what would have happened if he had just got up and walked out? Would they have forcibly detained him?

Shame on all of them. They have blood on their hands.

428 This is a small example why Trump needs to take violations of civil rights under color of law very seriously and issue policy for DoJ to aggressively pursue and prosecute even the shadow of civil rights violations with a pre-emptive goal (not slam dunk successful prosecutions) of making power hungry civil servants think before they harass people for being free.

429 It wasn't his going to the range. It was his "memorializing" it on social media, where his enemies, Hogg and Sinead Gonzales and the others could view it, and wearing their victimhood shawls, rat him out for violence upon their persons.

It is where we are. Our words are violent threats to them, and we must be silenced by the armed agents of the state.
