Sean Hannity: I Asked Michael Cohen For Legal Advice But He Has "Never Represented Me In Any Matter"

Hannity's statement:

Michael Cohen has never represented me in any matter. I never retained him, received an invoice, or paid legal fees. I have occasionally had brief discussions with him about legal questions about which I wanted his input and perspective.

I assumed those conversations were confidential, but to be absolutely clear they never involved any matter between me and a third-party.

In response to some wild speculation, let me make clear that I did not ask Michael Cohen to bring this proceeding on my behalf, I have no personal interest in this proceeding, and, in fact, asked that my de minimis discussions with Michael Cohen, which dealt almost exclusively about real estate, not be made a part of this proceeding.

I'm not sure if that should have had any legal distinction regarding the current hearing. (Though it probably did-- Kimba Wood rejected Cohen's request to review the seized documents before the FBI did.)

I assume Cohen brought up his "third client" because judge Kimba Wood (remember her? Google "Nannygate") was questioning whether Michael Cohen was a bona fide lawyer or just Trump's business partner with legal expertise.

Giving someone legal advice is something a lawyer does, routinely; not all lawyer interactions involve "representing" someone in a court case or business deal involving a third party.

And I think Hannity is wrong to say that "representing" must involve a third party; I think any lawyer who gave you advice, as a lawyer, would say he's "representing" you, as he's representing you as far as your legal interests, researching the question, analyzing the precedents, etc.

I'm not sure if payment matters, either.

This looks like Hannity is throwing Michael Cohen under the bus, and so also Trump then, because I think it hurts Michael Cohen's position the fewer clients he actually has. (At least in Kimba Wood's mind it seems to hurt his position.)

Not sure why Hannity is making this distinction.

I guess he's making this distinction because reporter Gail Sherman is claiming that Hannity hired Michael Cohen to advise him regarding the Media-Matters-led boycott of Fox, which Hannity himself denies:

Noting that Hannity had come under pressure from left-wing groups -- Media Matters, for one, targeted Hannity's advertisers over the Seth Rich story --Sherman said he was told that Hannity "got paranoid" and hired Cohen to look into those groups.

"This could be interesting because oftentimes private investigators are hired by law firms because it allows attorney/client privilege to be maintained," Sherman added. "So there is a scenario in which if they seized Michael Cohen's documents inadvertently we might be able to learn to what degree did Sean Hannity try to go after his enemies with shady tactics like private investigators."

You mean like the way both Obama and Hillary Clinton hired Fusion GPS through a DNC lawyer? Something you in the media haven't found to be a compelling or "interesting" storyline at all.

In any event, Hannity called up MSNBC (of course this was on MSNBC) to deny it.

If French is now a bear on full disclosure -- Can I ask, did David French, perhaps, take a meeting with Bill Kristol's donors? Maybe a get-to-know-you coffee?

Are any of those donors active in funding FusionGPS? Were they active in first funding FusionGPS to dig dirt on Trump (and Ted Cruz)?

I don't know if that happened. But since no one's asked yet: I'm asking now.

In case it wasn't obvious before, it's very obvious now: The government/media class is extraordinarily incestuous with lots of little connections here and there.

Doesn't seem fair that the rule of Full Maximum Disclosure of every single contact that might compromise one's objectivity only being inflicted on the Garbage People the Establishment's Minions Don't Like. Seems the same rule should be applied to them.

In the meanwhile, former Clinton appointee to be AG Kimba Wood (she was never confirmed) ruled that Cohen has no right to review the seized documents before the FBI does.

Sort of related: Page 6 claims that Michael Cohen helped kill an US Weekly story about an affair between Don Trump, Jr., and former attention-seeker Aubrey O'Day.

Also during the height of the investigation, Hillary turned over all of the communications that were under subpoena, the lawyer, who did not have the necessary security clearences to even look at the communications was allowed to decide on his own what communications were responsive and which were not and was allowed to destroy the rest.

So this whole fucking line of reasoning that Cohen doesnt meet some nebulous fucking standard to be considered a lawyer is absolute bullshit.

The difference is that Perkins-Coitus certainly should have been raided before this. There was more than enough evidence of serious criminal action by the firm - as the actual operation of the firm, itself - to have warranted shutting that place down and examining their books, first, for the known crimes and then, after that, extending the investigation to the entire operation of the firm.

There was a case, seems like yesterday so it was probably twenty years ago, in which an attorney was just bullshitting in an internet chat room with a pixel person about a potential cause of action. She later sued him because he didn't mention limitation of actions, she delayed filing for whatever reason, and when she did file, she was time barred. She won Big Bucks and scared the hell out of a lot of people.

1. Payment or lack thereof has no bearing on whether the attorney/client privilege attaches;

2. All litigation inevitably involves third parties as defendants or plaintiffs, as do perhaps most civil matters;

3. This is the most grotesque attack on the Sixth Amendment in our lifetimes;

4. Kimba's failure to do an in camera review of the documents in question indicate she is unfit to serve as a judge;

5. And 4 doesn't matter because we basically are a police state now with no moral authority to lecture Syria or anyone else.

177 In my life time I've had a need to hire several attorneys in different areas of law. I get that most people never really do this at all...or rarely...so let me give you my perspective...

When you have something in your life that possibly needs an attorney, the first thing you do is call attorneys in the area of law you need. You ask questions. Maybe you spill your guts a little...especially if it's a divorce or child custody issue. Then, once you get a feel for the attorneys, you pick one.

At no time would I consider an attorney who gave me advice or input over the phone as an attorney who I 'retained.' Neither do these attorneys consider me a 'client.'

I even had one experience where I gave out a lot of personal information and got feedback on my case, only to have that particular attorney call me back and say they could not represent me due to a conflict of interest. I am certain he also would not have considered me a 'client.'

So, I think there is something really weird here. If Hannity asked for some advice from Cohen, but never paid him anything and never asked him to represent him, I cannot see how he is a 'client.' Something about this stinks, in my opinion.

But not sure what.

If there is an attorney out there who can explain to me how Hannity can be a 'client' without any retainer paid or hiring done on his part, I'd love to know.

Whether we are talking about it or not doesn't impact whether the communications are privileged. The only issue is whether the privilege can be set ovecome due to a limited set of circumstances, none of which would appear to apply based on what we know. They just simply violated the privilege and based on what was said in court, from what I've read, no rationale has been provided that passes the smell test.

I'd propose the Boeing Chinook, merely because of it's capacity in both lift and volume. More drops per hop, so to speak.

But a secondary purchase of Sikorsky Sky Cranes might also fit into the plans. Sure, single passenger hoist and all that... but it's ideal to maximize the Entertainment of the Spectators!

Just think, the cargo to be dropped, flailing futilely in full view, visible from multiple camera angles, from takeoff to....well... "landing".

And yes, all cargo will be equipped with faceward and outward aimed GoPros, just because.

Bet we could recoup expenses...

1. Raffle off tickets for those who want to serve as "groundcrew" to help load cargo.

2. Appropriate all assets of said cargo, and apply against operating expenses.

Myself, I'll volunteer to work the check in counter. "Any checked baggage? No? Fuck you, get in the helicopter!"

342 Might have been pointed out already - it's not "Gail Sherman", it's Gabriel Sherman, long time national political news feature idunno reporter but for sure writer for Vanity Fair magazine. Gabe Sherman some time ago reached that in betweener celeb status where journamalism types become something like as famous as the celebs they write about.

For example, Sean Hannity - who, I'm thinking, probably more people know who he is than know who Sherman is by some factor of between 10 times and a 100 times.

The way the whole thing has unfolded before now and in Monday's court hearing, I gotta say, I'm not fan of Hannity but this is too little to go on to start suggesting Hannity's in with the same mobbed-up company as Cohen and Trump. I even think it's possible this is some big freaking smokescreen going on here.

If some mobbed up type like Cohen is being squeezed in court, being chased down like by a bus driven by a methed out manic because let's face it he's now gonna be picking raw indictment slivers out of his wazzoo for years, AND thinks for sure he's got some understanding with the president of the freaking United States of America not to do stupid self-serving things that ultimately screw over said president, that dude's gonna wanna grab the first person he can think of to throw under said bus, REGARDLESS the damage to that person.

Is that what's really going on here? Some mobbed up fixer using Hannity as a squirrel to point at in some desperately ill-conceived ploy to distract from his own imminent demise?

I think we gotta seriously consider that.
