Lawless: California Judge Rules That Obama's Illegal DACA Executive Order Is Not Only Legal, But Constitutionally Mandatory; Rule DACA Must Remain In Place

As DrewM. commented, we're about six months away from a judge ruling that every single person in the world has a constitutional right to be a US citizen.

A federal judge in California late Tuesday temporarily blocked the Trump administration's efforts to end the Deferred Action for Childhood Arrivals program.

Judge William Alsup also said the administration must resume receiving DACA renewal applications.

But the ruling is limited -- the administration does not need to process applications for those who have never before received DACA protections, he said.

The judge based his ruling on the YOLO Doctrine.

The White House reacted furiously:


White House press secretary Sarah Huckabee Sanders is protesting a late night Monday order by a Clinton appointed federal judge in California that preserves the DACA program.

"We find this decision to be outrageous, especially in light of the Presidentís successful bipartisan meeting with House and Senate members at the White House on the same day," Sanders said in a Tuesday statement. "An issue of this magnitude must go through the normal legislative process. President Trump is committed to the rule of law, and will work with members of both parties to reach a permanent solution that corrects the unconstitutional actions taken by the last administration."

President Trump himself weighed in with a Tuesday morning tweet, in which he claimed the ruling shows just "how broken and unfair our Court System is."

Always remember: The NeverTrumpers supported Hillary Clinton, who would have perpetuated the Imperium style of governance of Obama, and appointed more judges beholden to the Empress who would have supporter her moves to take us to a full tyranny.

Btw - Will Congress begin to realize the ridiculousness of this all this and start with the required work of limiting current circuits and courts to jurisdiction in only local matters in certain areas - so, like the 9th circuit could be given jurisdiction of ONLY Laws and disputes that involve matters local to Los Angeles, SF, Seattle and Portland. All other matters would need to be sent to another circuit, newly created and staffed by Trump appointed justices. Same with district courts

The Constitution is clear that ONLY the Supreme Court is required to exist. The other courts are left to the Congress to decide as far as number, make up scope and jurisdiction. See Article III - US Constitution

Lastly the Congress could make it a federal felony crime to intentionally and repeatedly interfere with the constitutional rights and powers of Congress such that these judges could be impeached.

You know the Constitution is quite clear that the Legislative Branch is the first and foremost of the branches and was envisioned as having the ultimate duty to set policy and be the senior branch to all others - but - well . . . there I go again getting all limited constitutionally on ya.

Federal judges salaries are Constitutionally protected is my understanding for this very reason.

Even if you could bypass every federal court except the Supreme Court for every issue, what do you do when you have a rogue Supreme Court? We're one vote away from that.

I really think the only fix is nominating good judges or a new Constitution that has things like elections for judges instead of lifetime appointments.

And ignoring judges from time to time like in this instance.

Agree with Rhomboid on this. Why whine about how this ruins Trump's advantage on DACA? Who cares? The overriding serious concern with this is a judge ordering the executive branch to maintain what has previously been legally determined to be an illegal EO because those who have signed up for DACA were given all kinds of privileges through that illegal program.
Someone up thread said that if you are here illegally, you can't get a mortgage. People who signed up for DACA and were approved, are no longer here illegally despite the program being illegally created. They are considered to be here lawfully, and like any other lawfully visiting foreigner, they do have the ability to purchase real estate, obtain a mortgage, buy products, etc.
Apparently, this is what this judge based his ruling on.

Congress should pass a law stating that no lower court my stay or otherwise hinder the executive or the legislative branches from doing anything. All the lower court can do is refer a case to the SC. I'm not a lawyer or constitutional expert so I don't know if that's possible, but it should be.

What process is there when a judge and appeals court consistently legislates from the bench and Congress does nothing?

Does the president have to obey a blatantly illegal order from a court in a situation where the court doesn't even have jurisdiction to hear the case? What is the process? If it goes to SCOTUS does that magically make it right?

There are Constitutionally designated solutions that don't include going rogue including winning more elections, impeaching bad judges, appealing, etc.. Our system was built on checks and balances specifically because it was anticipated that branches of the government would get out of their lanes from time to time and need to be put back in their place.

We may get to the point where we have become an ungovernable country but I don't think we've quite hit that point yet. Trump proved we can indeed vote our way out of this even if it everything doesn't turn around with the counting of the votes of one election.

WalMart self checkout is really quite efficient... honestly the local WalMart had 18-20 checkout lanes, with about 5 open, at any given time... the help just walked around the aisles, doing.... stuff... and studiously avoiding eye contact with the rabble... I mean, customers...

Maths: $15/hr for a shift a year. 30k. 4 shifts to open a week 24/7. 4x30k=120k. Any piece of equipment that eliminates one position for a year and cost less than 120k is a FUKN deal. The process for dealing with even a blatantly illegal order by a court is to appeal that ruling to a higher court - that's what appeals are all about. And then to the Supreme Court. The SCOTUS doesn't stand for challenges to its authority, and they won't in this case.

But if you lose at the Supreme Court, then the executive can either choose to live with the loss and work slowly to change the membership, or he can call out the tanks and bring on the Civil War. Although it may be coming some day, I'm not ready to fight Civil War 2.0 just yet.

This is the Constitutional process. Judges make rulings on executive action and legislative actions. That's how it works. And if the executive branch doesn't agree they appeal. Frankly, I'd like to see a lot less executive actions but I have no problem at all with Trump using one to overturn a previous one I didn't support. I would like to go back to presidents letting Congress do the legislating and not pens and phones.

This was a stupid ruling not based on law or even commonsense. News flash, not the first time it's happened and sure as hell won't be the last time. I don't have to agree with every decision or approve of every judge, which I can assure you I don't anymore than you do, to say I would rather work within the process than start having Trump just say "Fuck you, I think you're wrong and I'll do what I want".

I'm not quite ready for a full blown Constitutional crisis right now because I kind of like the way the country was meant to work and there is zero reason to think going rogue now is the solution to getting back to it.

(Judge began sleeping with a defendant in a divorce case, then proceeded to rule against defendent's husband regarding child support, etc. When this was discovered, he was impeached, as he had a record of some other blatant abuses in his court.

And the families of the hundreds of thousands of dead on the Federal side wished they would have had their sons and husbands back as well. Civil War only sounds good when your country hasn't had one in living memory.

If casualties were incurred at the same rate as they were in that war, there would be about 10 million dead before it was over. And don't discount, once it got ugly enough, one side or the other getting at least one nuke and using it. We got way too many of those sitting around for no one to try.

Please don't make the case that that because we can err too far in one direction we can't err too far in another.
