Early Drafts of Comey Exoneration Memo Said That Hillary Clinton's Secret Serve Was "Likely" Hacked and Accessed by Hostile Powers;
This Was of Course Omitted By the Time Comey Publicly Exonerated Her, Softened to "Possible"

Sen. Ron Johnson, R-Wis., chairman of the Senate Homeland Security Committee, released copies Thursday of the edits to Comey's highly scrutinized statement.

One showed language was changed to describe the actions of Clinton and her colleagues as "extremely careless" as opposed to "grossly negligent." This is a key legal distinction.


Johnson, writing about his concerns in a letter Thursday to FBI Director Christopher Wray, said the original "could be read as a finding of criminality in Secretary Clinton’s handling of classified material."

"The edited statement deleted the reference to gross negligence – a legal threshold for mishandling classified material – and instead replaced it with an exculpatory sentence," he wrote.

The edits also showed that references to specific potential violations of statutes on "gross negligence" of classified information and "misdemeanor handling" were removed.

The original also said it was "reasonably likely" that "hostile actors" gained access to then-Secretary of State Hillary Clinton's private email account. That was later changed to say that scenario was merely "possible."

If you took it at face value it would seem to exonerate Hillary, but if you read between the lines, the things unsaid, Comey was quite clearly announcing, in public, a long list of serious federal violations that she was guilty of, and that she would not be prosecuted for them because she was a democrat candidate for President.

It was an amazing statement, intentional or accidental, I have no idea.

111 Strzok re-writing everything for the FBI director is interesting. Strzok isn't a lawyer. He has a fairly recent masters in government or something. In no way is he qualified to be determining something of this nature because he is an investigator only. His work is referred to lawyers to review and then decide to prosecute. And the reason for Rosenstein's recommendation to fire Comey was Comey (who is a lawyer at least) determining that Hillary didn't intend to break national security laws which is not his bailiwick but rather that of DOJ lawyers. I think it turned out that he had emailed hillary at her clintonemail.com account, not that he had utilized her server.

semi plausible deniability, since it sounds like the IT people at state had set that up as her official, federated, email address (so if you typed "Hillary Clinton" then pressed alt-k, it would go to her clintonemail, not her state.gov email.)

There is little difference between extremely careless and gross negligence - If a police report said someone was extremely careless, they could still be sued for (or I assume charged with) a crime or tort requiring gross recklessness. However, I've already eaten it, so it's moot point by now.

I'm actually pretty skilled at the old technique of sloowwwwllly breaking it into pieces along natural fault lines, and then shaving off clusters of seed at the base using one's bottom teeth. Didn't splatter myself at all -- but the whole process is such a time-consuming hassle that it's not worth it.

372 When Comey made his statement back before the election, I was one of those people who thought he was doing the equivalent of piping out Morse Code by blinking his eyes to let us know it was under duress. We heard him basically detail how Hillary Clinton broke the law. Of course, he stated that "no prosecutor would pursue a case." But, I took that to mean he was given his marching orders and had no say in the matter, but was spilling some of the beans anyway.

BUT...what it comes down to is that the violation of law was so blatant, obvious and exact...that the only way to get past it was by making it seem less damaging and egregious than it actually was. That is what Comey was doing. He was applying the lipstick to a pig on national television. And, he was part of the faction that thought it to be the right thing to do.

I like that this is exposed, but I doubt things change... Trump will keep tweeting and making it hard to support him, Candidates like Moore will win Primaries, dooming Republican chances, there will continue to be those on the right who hate the right more than the left, and Democrats will lie themselves back to power.

The whole distinction between "gross negligence" and "intent" is itself a distraction.

Hillary, entrusted with classified information (of the highest level, including her own communications as SOS with POTUS) intentionally caused that information "to be removed from its proper place of custody" i.e. removed from government servers to her own server.

Comey was basically mischaracterizing the crime itself as giving information to the enemy. The crime is removing classified information from its proper place of storage, full stop.

She did that, not "negligently" but intentionally. There can be no clearer violation of the law unless she claims she didn't know that the server was in her bathroom.

Insurance policies...esp when a mention is made in the next notes about something...someone not living over forty.

I think this was a suggestion that if all else failed, the nation might be "saved" by a few stalwart people from the FBI or otherwise.
