New York City DA Scrambles to Blame NYPD for Not Prosecuting Harvey Weinstein; NYPD Says They're Lying

A hot enough fire soon starts sparking off dry and rotten wood all around it.

There's a lot of corruption in government and big institutions like Hollywood. Everyone knows that. There are fixers who donate to key people to keep their clients out of jail, or who threaten witnesses to make them quiet.

It's practically begging to be exposed.

But it takes a major event to disturb the status quo and get people to start talking about it.

I think -- or at least hope -- that the Harvey Weinstein bombshell is going to have enormous collateral damage and be the size of scandal that actually gets written up in future high school history books, like Teapot Dome.

In March 2015, model Ambra Battilana Gutierrez told the NYPD that Weinstein had sexually assaulted her. The New Yorker published a recording obtained during the investigation in which Weinstein is heard admitting to groping Gutierrez.

Weinstein, in conversation with Gutierrez, admits to groping her. Here’s the audio: https://t.co/zSQbK5NV0c pic.twitter.com/vmrrSUp43w

-- The New Yorker (@NewYorker) October 10, 2017

...

The NYPD said it investigated a misdemeanor sexual abuse complaint against Weinstein at that time and referred the case to the Manhattan District Attorney’s Office.

The DA's office ultimately decided not to file charges.

A statement issued by Tuesday by Chief Assistant DA Karen Friedman read in part, "While the recording is horrifying to listen to, what emerged from the audio was insufficient to provide a crime under New York law, which requires prosecutors to establish criminal intent."

The DA's office claimed that the Special Victims Unit hadn't coordinated with the DA to learn what needed to be proven in the case -- like that you needed to establish "criminal intent" in a case about a guy grabbing a woman's tits.

Apparently the DA is claiming that you need Harvey Weinstein admitting on tape, "When I groped your breasts without permission, I had criminal intent to do so." Apparently it's not the sort of thing that can be inferred from circumstances or the common sense dictate that you do not grope a woman's breasts without permission.

Nope: The DA is claiming you need to get Weinstein on tape announcing his criminal intent, and also, that the SVU doesn't understand what it takes to prove a sex crime case. Because apparently this is their first rodeo.

A fair number of people are arrested for rubbing up against women on subway rides. Sexually. Is the DA claiming you need a confession of criminal intent to prosecute those cases? I would imagine they don't have that most of the time -- I would imagine that the facts alone, that a guy with an erection kept pushing up against a woman's butt, would prove the criminal intent behind them.

But not for Harvey Weinstein.

Cyrus Vance Jr. received $10,000 from Harvey Weinstein's lawyer David Boies shortly after his office declined to prosecute Weinstein. FYI.

The NYPD fired back, saying, "the case was carried out by experienced detectives and supervisors from NYPD’s Special Victims Unit."

"The detectives used well established investigative techniques. The recorded conversation with the subject corroborates the acts that were the basis for the victim’s complaint to the police a day earlier. This follow-up recorded conversation was just one aspect of the case against the subject," the statement continued. "This evidence, along with other statements and timeline information was presented to the office of the Manhattan District Attorney."

It’s something Pace University Law professor Bennett Gershman backs up.

"You are listening to a sexual pervert ply his trade," Gershman told CBS2's Brian Conybeare. “It’s so easy, and for a prosecutor to say there’s no proof of say there’s not proof of criminal intent? That's what the prosecutor Vance said, that's just so, so wrong."

Yes, because it's a lie. When a flasher exposes himself to a woman, you don't need a tape recording of him saying "When I showed this woman who I do not know my penis, I did so with the criminal intent to expose myself to an unwilling woman." The facts and circumstances prove the intent themselves.

Via Hot Air, reported by the New York Daily News, an anonymous NYPD source comes pretty close to alleging criminal intent on the part of the DA:

Members of the NYPD familiar with the case were furious at the suggestion that their work was subpar and said prosecutors were responsible for the softball treatment afforded the Hollywood bigwig.

"Ask the DA if they would have made the arrest if the guy's name was Harvey Schmuck," one police official said.

I like how the DA made sure he had a female subordinate putting his bullshit spin out.

51 You know the more I keep hearing about this I keep going back to all the accusations against Trump. There you had a man that the left and media absolutely hated and sought to destroy by any means necessary, and who does have a womanizing history and the best they could do was a tape of him joking about starfucking groupies and striking out when he made a pass at a married woman.

And here is Harvey Weinstein a man that they have sought to protect and all of this behavior is coming out and their are women going on record and even to the police about him. Just makes it look even more like there really was nothing to the Trump stuff because if there was this is what it would have looked like times 100.

Well ok there were apparently a couple women that Weinstein's lawyer represented to attack Trump, but I never heard any names and now I'm left wondering if that was some false anonymous accusations in the hopes of flushing out some real ones that never materialized.

Luckily, I never wanted to be an actress or 'make it' in Hollywood. After hearing that tape, I would NEVER encourage any young woman to step foot in the movie business. Sick, disgusting people all around who thinks it's funny to demean women for a part in a movie or tv show.

Worst part of this, to me, is that Rose McGowan posted an email from an AGENT sending a young actress directly to Weinstein's hotel room. As if that were normal business. An actress trusts that her agent SHOULD have her best interest in mind (we can argue about the money that gets thrown around Hollywood, but at the very least an agent should have SOME kind of decency and live up to some kind of code regarding his/her clients) and it is sick to see the agent acting as if this were how it works in Hollywood and should be nothing to question.

Shame on the DA. He should get fired and prosecuted.

287 Notice how they skip right past the fact that the witness--having already taken the time to file a complaint and, further, spent more time in an agreed recorded conversation--was still available to "prove criminal intent."

You see, the statement clearly reads, "If only we'd had a criminal prosecutor sit in on the recording, we could have gotten the evidence of intent."

Oh?

So, the witness--taking all that time and risking going on the record--was, what, dead?

You couldn't pick up the damned phone and dial one of the many contacts in the file and schedule another interview with the witness?

Gee, phones out of order?

Next, you're going to tell me that the criminal sexual assault statute presumes criminal intent if the witness says the touching was unwanted.
I mean, it's only right there in 130.05 "Sex Offenses, Lack of Consent" of the New York Penal Code.

But, I'm sure a "seasoned prosecutor in the Sex Crimes Unit" would NOT know that.

295 Hey, I also listen to the tape, and if you don't think he admitted to it, you are blind. He very specifically reacted to that statement. He never said "that didn't happen." or "you are lying" rather he said a brush off statement.

Additionally, the tape very specifically shows that he lured her up to the hotel room with a bad intent and when she wouldn't go along with it, pretty much said their relationship (business) was over. Very clear sexual harassment to me. If the idea was she was there to discuss work and he wouldn't discuss the work without her coming into his hotel room while he showered or whatever he wanted to do.

Serious answer... sex offenders are generally required to undergo treatment, even after they complete whatever prison sentence they serve. It's mostly about being able to relate to one's victims, the theory being that once you relate with empathy you will be less likely to commit the offense.

It's an effective treatment... but it needs a catch. The catch being the "or else" aspect of it. Go to treatment, do the work, demonstrate some change in your behavior, or else it's back to the joint.

What little I know of people who are not court ordered however, this concept of "sex addiction" treatment, or impulse control nonsense, it's utterly ineffective, mostly because it's about trying to AVOID those consequences in the first place.

Forcible touching.
A person is guilty of forcible touching when such person
intentionally, and for no legitimate purpose:
1. forcibly touches the sexual or other intimate parts of another person for the purpose of degrading or abusing such person, or for the purpose of gratifying the actor's sexual desire; or
2. subjects another person to sexual contact for the purpose of gratifying the actor's sexual desire and with intent to degrade or abuse such other person while such other person is a passenger on a bus, train, or subway car operated by any transit agency, authority or company, public or private, whose operation is authorized by New York state or any of its political subdivisions.
For the purposes of this section, forcible touching includes squeezing, grabbing or pinching..
Forcible touching is a class A misdemeanor.

But especially the stars that claim to "stand up for women."

These are the only people that could have stopped this. Them, and the victims, but they were victims because they needed him for their careers, so they had no power at all. The stars were the ones.

Yeah, about how I see it. If she would have been working for him, had a contract, then employment law and its various provisions would apply.

But if they're just talking about the terms of potential employment? He gave her the terms, she (rightly) said no, that's it. It's crappy, it's sorry, it's loathsome, but there's nothing illegal, or even actionable in that transaction.

Not everything that is wrong is against the law. In fact there's a pretty large range of bad behavior that the law cannot touch. People tend to forget that.

Or a third thing, which I can't quite foresee.

I think it's either getting rid of the Clintons for good by drying up that money or Harvey's brother, tired of this shit.

The flaw in these theories is that his brother has plenty of skeletons in his own closet, and should technically be worried that Harvey would release that Kracken, and all Dems needs that Hollywood money and celebrity backing. And access to fresh meat to abuse.

I also wonder if someone is getting out in front of something even uglier about Disney, or the open secret about Dan Schneider at Nick, and using this as distraction to write checks and get rid of people. while the focus is elsewhere.

Latest story to come out is Uncle Harvey tried to force some model/actress to have a threesome with him and some other bade, who sounded like a hired professional.

He cornered her and ordered her to make out with the other gal. She said she started singing loudly.....which pissed Uncle Harv off.

542 It feels like people want to believe she was alone with him, or she wanted to be alone with him. It's rather sick.

God, I hope she never was alone with him. For me, it just further erodes any goodwill I ever had for the Obamas. Weinstein's disgusting behavior was an open secret, and they sent their barley legal daughter to intern with his company. Never would I knowingly send my kid into that situation. Hell, I spoke with some gals interning during the summer on Capitol Hill. I wouldn't send them there either. *shudders with revulsion*

That is an interesting theory. Why now at this precise moment? It isn't as if the Weinstein story couldn't have waited a little longer before it broke.

No freakin' way Weinstein approached an Obama daughter but in the most respectful way to ingratiate himself with Obama. Inconceivable.
_________________

That's what I thought initially. But after hearing from Gwyneth Paltrow, I'm not so sure anymore.

Paltrow's parents, actress Blythe Danner and producer Bruce Paltrow, were friends with Weinstein at the time he came onto their daughter. Gwyneth said one of the reasons she was so shocked by Weinstein's behavior is that she had always thought of him as "Uncle Harvey."

If he would behave that way with the 21-year old daughter of his friends, it's not that much of a stretch to think he may have propositioned Malia Obama too.

The man's a pig. A pig with no boundaries.

IMHO, girls who are raised in religious, conservative households have a very different attitude towards sex than girls in an ultra liberal household.

Consequently, something that would be really, really traumatic for a girl from a religious household who was still a virgin at 18 might not even be worth mentioning to girl raised in a liberal household who has been experimenting with sex since she was 9 or 10.

I don't know where most of these women fall in the above categories.

Only problem with your theory is that the people that Weinstein molested wanted an acting job. Malia didn't. She was an intern, aka a gopher, in between her senior year in high school and college.

And she already had the job. What was Weinstein going to offer her that her extremely powerful father couldn't?

Well, maybe, but I was raised in a politically liberal household with no religious background and yet my mother always thought people living together was wrong, and though sex before marriage was a not a good idea-at least for women. My sister started having sex at age 16 with her first boyfriend. She always regretted it. So what I'm saying is that it depends on the household

630 Miley was a really nice girl until Harvey. There is a cause, of sorts, for monsters. I wonder what priest used Harvey, or maybe it was a coach, or a step-mother. How IS a monster created? My sorrow at his misfortune does not overrule my desire to see him burn, however. ISIS skydiving school maybe??

Yes.

Although the household doesn't have to be all that religious. My parents were older, army, and had gotten sick of church (corruption). However, my dad was so flippin up tight that going on a car date might as well have made me the same as a whore in Singapore. I was a virgin at 18 and at 19. I didn't want to get "used." Hell, when I finally decided to lose it, I ended up marrying the guy. In contrast, all my college friends entertained many guys and I remember a hilarious "morning after" when she got names mixed up and had sex with the wrong guy, ie not the one we had been saying was 'cute."

I don't think any of these women were naive. They knew exactly what would further their careers.

So why did Obama send her to him in the first place? Why not some other Dem big donor?

And why someone who is a big freakin Hillary donor?

And Obama with entire intelligence and LEO agencies at his disposal knew NOTHING of Harvey's proclivities?

Bull. Shit.

Weinstein requested her. Because that's what he does. He wanted to add her to his tally.

And Obama's true native culture allows for the auctioning of women for profit.

633 Obama HATES the Clintons.

Why would he apprentice his kid to her biggest donor?

634 359 Did Weinstein ever meet Einhorn?

Perhaps in France?

636 This is the same DA's office that couldn't convict Sean "Diddy" Combs of gun possession ata club in which a patron was shot and nearly killed.

The assistant DA nearly put the jury to sleep with a six hour closing argument. In a gun possession case.

639 >>So why did Obama send her to him in the first place? Why not some other Dem big donor?

Because he could and it would be a fun way to spend a year before college, making movies.

I hate Obama as much as anyone but there was nothing for him in this transaction. Weinstein wasn't going to give him any more money than he has been for years.

Posted by: JackStraw at October 11, 2017 06:15 PM (/tuJf)

640 Personally, I don't thing Obama gives a damn about his daughters, or anyone else. He would, however, regard disrespect shown to them as really being disrespect to himself, and thus unforgivable.

But no one will ever convince me that he is not a complete solipsist; far beyond the usual level of narcissism we see about us.

641 If I'm a criminal, or a criminal defense attorney, I'm all over this. I didn't have criminal intent when my fist landed on his jaw. I didn't have criminal intent when I drank 10 shots of Jack Daniels, then plowed into a storefront. I didn't... . If it is a crime to grab breasts without permission, and I raise my hands, shoot them out, and clutch a big bosom in each hand, then I intended to perform the act defined as a crime.

Let's face it, the NY prosecutor either loved the benefits Weinstein could provide him, or feared the money Weinstein could throw at his defense team.

642 Gee who do I think is lying? A bunch of lawyers or a bunch of cops? I'm really leaning towards the lawyers. I mean , cops may lie, but it isn't what they do for a living. Lawyers LIE professionally. all the time.
