Fifth Circuit Court of Appeals Overturns Injunction Against Sanctuary City Bill Put in Place by Lower Court Judge, Permitting Most of the Law to Be Enforced
Until a full hearing on the merits, at least. But for now, the law is mostly now in force.
A three-judge panel of the 5th U.S. Circuit Court of Appeals temporarily stayed on Monday key portions of the injunction issued in September by a federal judge in San Antonio that prevented the state from implementing major parts of the law... The core parts of the law ban Texas cities from prohibiting or “materially limit[ing]” local law enforcement from: 1. Notifying federal immigration officials that an illegal alien has been arrested. 2. Cooperating with immigration authorities (including honoring detainer warrants on illegal aliens issued by federal authorities). 3. Allowing federal immigration officers to enter local jails to conduct investigations of criminal illegal aliens. The lower court federal judge had enjoined Texas from implementing the second and third provisions. However, the 5th Circuit issued a stay of that portion of the injunction. Holding that Texas was likely to succeed on the merits of those two provisions, the 5th Circuit lifted the injunction until the appeals court has a chance to consider the merits of the case....The panel found that local authorities don't have to honor and fulfill every detainer request, but -- and I don't get this distinction myself -- they must honor and fulfill ever detainer request consistent with current ICE practice. It gives the example of local authorities being free to ignore an ICE detainer request... if the arrestee provides proof of legal presence in the country. I'm not sure why ICE would issue a detainer in that situation, but, whatev's. Hans Von Spasky (who wrote this news item) had previously blasted the Clinton-appoointee prog judge's injunction as "absurd" -- and it looks like the appeals court agrees.

They have no understanding of the difference between morality and an ethical system. If it's right once, it must always be right and you must be made to do it. If it is forbidden once, it must always be opposed and subject one to the highest penalties.
At their core, they want to do whatever they want and to control what you do, and have rules for that... because they can't cope with not having external codification.
This is a combination of sollipsism and selfishness, along with a self___ issue. Normally you cannot sue a Government Official if you 'injured' by their actions. They are granted Sovereign Immunity.
However, if they break the law by doing said action, they can be held liable.
Now, knowingly aiding and abetting an illegal to stay in this country is still a felony, although the Government clearly has not intention of enforcing said law.
Could someone, who is injured by an illegal, sue the Government officials BECAUSE they clearly broke the law by aiding and Abetting???

Sure they do. And so do the local cops. If they have picked up somebody that ICE has a detainer on, and they can confirm that the person really is a legal resident, then by all means let that person go. I'm just saying that it's not always easy to determine if the "proof" that the person offers of their legal residency is actual proof, since so many illegal aliens have multiple types of phony residency documents, and multiple aliases.

This type of thing is another indicator of America being finished. This happens with everything the law touches. The law isn't the law anymore. Every ruling is nuanced and wordsmithed in absurd legal gymnastics in an attempt to not run afoul of previous rulings, also crafted with the same type of tortuous twistings and needle-threading. By the time the sausage comes out, it's unrecognizable garbage.
Basic principles aren't that complex and it's a symptom of how sick this country is, that even "wins" have to go through this process.

As someone who has almost no knowledge of how this works... let's say that Texas simply *ignored* the injunction instead appealing, how would the ruling be enforced? I can even tell you what the judge will say, since it will basically be a cut and paste job using the last case. He'll say the same things he said about Trump being an Islamophobic bigot who issued the ban because he hates muslims, as proven by his campaign statements. And he'll also say that the inclusion of Venezuela and North Korea in the permanent travel ban order was clearly pretextual (i.e., that Trump put those countries in solely to disguise his real intent, which was to discriminate against muslims).

Lifetime appointments require stricter oversight than normal positions. Congress has the DUTY to take judges like this off the bench and throw them back onto the street , where they belong.
The Congress has as much a DUTY to protect and defend the Constitution as the Judiciary, and when the judiciary attacks the Constitution it's up to Congress to exercise its power to remove the Constitution-hating judges from the feral courts.

Seriously. Talk to any random leftist about who's to blame for OCare's failures. Republicans will be front and center for "taking out the good parts that everyone liked" or being "the obstacle to the ACA being single payer".
I'm surrounded by these nits in Seattle. There are precisely two camps. Camp one says Obamacare has been nothing but good. Camp two says Obamacare's flaws are due to Republicans, but that doesn't matter. Obamacare is just a transition step to single payer, which will be when America finally has a healthcare system.

Full repeal has NEVER been tried. NEVER. One guy proposed a simple repeal and it couldn't even make it anywhere. It wasn't even discussed publicly. The bills the Vichy GOP keeps calling "repeals" are nothing of the sort. THey are just variations on the old "bait and switch" ploy.

Facebook has claimed that russian based groups (no idea how they determined that) bought political ads on facebook.
