Supreme Court Sides With Trump on Injunction; Orders Full Ban on Refugees Under Trump Order Until They Decide Case on Merits

Apparently the Supreme Court doesn't think this is the slam-dunk case that the Ninth Circus does. Story at the Washington Examiner.

Meanwhile, Seattle's mayor has resigned after a fifth man accused him of sexually abusing underaged boys.

And Kid Rock may announce his Senate plans tonight.

No. Kennedy yesterday put a temporary stay on the 9th circuit's injunction that nullified Trump's ban on refugees. Today, the entire SC, including Darth Bader, unanimously put a full stay on until they hear the merits of the entire travel ban case.

This was all Trump's DOJ asked for. They didn't ask for a stay of the injunction on deciding who is a close relative. No one seems to know why, however, my guess is that they will simply call them refugees.

I'm against executing pedophiles. Not out of sympathy for them, but because imagine if you're one of those people & you just molested a kid. If you're ever caught, you get executed. What would you do? You'd just as likely kill the only witness - the kid - to save your hide.

That was also one of the main features of the Sandusky case. Sandusky found his victims through a charitable organization, which he'd started himself to help underprivileged kids. Kids who wouldn't have anywhere to turn for help, and who would be easy to dismiss if they tried to talk to the authorities. (It makes perfect sense, actually.)

One of the big scandals *there* is that nobody ever went after the charitable organization, who must have been at least as complicit as the Penn State administration.

I think it goes like this. The 9th circuit issued a mandate against the Executive Branch EO travel ban regarding refugees and close relative definition and the DOJ went to the SC for relief from that mandate. Justice Kennedy oversees the children at the 9th circuit and yesterday he personally put a stay(stop) on the mandate and then referred it to the entire court as he can only put a temporary stay when acting alone. The entire court today rubber stamped the stay along with Kennedy, which means Trump's EO can proceed forward until the court rules otherwise.

The case against the travel order moved from the 9th to the SC last June when plaintiffs ran to the 9th circuit and picked apart the new travel ban. The 9th had placed a temporary injunction against the new travel ban in it's entirety, then the SC stayed that temporary injunction, but added the unfortunate little phrase, "close relatives" which even some on the SC said was a door for court mischief. And it was. Plaintiffs ran back to the 9th to complain that refugees were NEEDED in CA and Hawaii and they were being hurt by not having refugees and close relatives mean everyone.
9th then put a mandate on the travel order that refugees could not be banned and close relatives means everyone.
The DOJ went back to the SC and the first paragraph has happened.

The legal eagles I've heard from are simply aghast that a lower court would dare challenge a higher court's initial ruling in this manner. Like this is how lower court judges get sanctioned.

189 Re executing pedophiles. I've mentioned this before, so forgive the rerun but the Supreme Court has mooted that, saying basically the death penalty requires a life to be taken. Applying the death penalty for some crime less than taking another life is "excessive".

They way the word these things, it's not completely general, and there are still federal statutes that apply the death penalty for treason and espionage (remember the Rosenbergs).

But they haven't been tested under the new doctrine, and the way the last one (which Kennedy wrote, BTW) was worded, it's a good bet they would fail when challenged.

The history was that some states had the death penalty for rape (usually very severe, brutal forms of it). The Supremes threw that out in the '70s after the death penalty was reinstated.

So, some ofthe states responded by making rape of a child under 14 (puberty trying to define roughly) as death penalty worthy. The SC threw that out in 2008 with that Kennedy opinion.

Me, I would apply the death penalty for rape of a prepubescent child. Post puberty up, just severe jail time and all that, sort of a scale based on age differences and brutality of the crime. But a child, kill their ass if proven.

I ordered these from Lowe's when we updated our kitchen for all the bottom cabinets and the corner upper and lower cabinets. I love them. Money well spent. No more having to sit on the floor to find a pot lid.

One of my BiL's has been a commercial driver all his life. As he gets close to retirement, he drives for a bus line part time. He was driving the Indians from their hotel to Great American Ballpark (Cincinnati) during interleague play last year.

He said they were a great bunch of guys, very friendly.

And Terry Francona is one of the genuinely nice guys in baseball, too.
