Sefton: sefton at cutjibnewsletter.com | Lawyer: Nope, Donald Trump Junior Is Not Guilty of an Improper Campaign Solicitation from a Foreign NationalA lot of Twitter Lawyers and/or People Who Play Internet Lawyers on Twitter are making the claim that any willingness to accept information from a foreign source is violation of campaign finance laws -- the claim is being made that this is either a solicitation of something "of value" or else a solicitation of an "in-kind" contribution. A trial lawyer writes at Dan Abrams' Law Newz site that this is just the chatterings of non-lawyers or lawyers yapping outside their fields of actual expertise -- because campaign finance rules specifically permit any foreign national to volunteer services, including, specifically, information. The only forbiddance is that such volunteers cannot be compensated, which would make them non-volunteers.The Twitter Legal Brigade is big on reading that "of value" caveat expansively, claiming it means pretty much "anything helpful to you." But actual lawyers fluent in the field know it means cash or cash-equivalents, and specifically does not include volunteered services or information. The hystrionic partisan Jake Tapper is claiming, meanwhile, that these emails demonstrate "collusion" without any possible counterargument. Collusion means "cooperation with a corrupt purpose," and cooperation includes the idea of "working together" or, second definition, "rendering aid." Trump Jr. did not offer to work with Russians, nor to render them aid. He stands accused of being willing to do what the media does as its daily trade -- listen to a source with possibly interesting information. The fact that the leftists in the media see this so easily as "collusion" is due to the fact they can only see this from their own vantage point. Consider: To them, those who voted with all their girlish might for Hillary and who cried when Pennsylvania's votes were counted, of course Trump Jr. must have been acting on behalf of Russia. Their Narrative is that Russia wanted Hillary to lose; ergo, if Trump Jr. is willing to hear information about Hillary that the media would itself cover up, his only motive would be to help Russia. The "aid" that he would be rendering Russia is only that of beating Hillary, which they assert is Russia's whole Nefarious Scheme. It doesn't seem to dawn on them that Trump Jr. would have reasons to want to beat Hillary that have noting at all to do with wishing to "help Russia in its scheming." Jake Tapper plainly wished Hillary would win -- and so did Iran, knowing that Hillary would carry on Obama's pro-Iran-nuke legacy. Does that mean all the negative stories that Jake Tapper has run on behalf of Hillary means that he was in "collusion with Iran" -- agreeing to cooperate with Iran for a corrupt purpose? Did he refuse to even mention the Ben Rhodes "Echo Chamber" story so as to further his collusion with Iran? No, of course not. Iran had an interest in helping Hillary, and Jake Tapper had his own independent interest in helping Hillary. Jake Tapper refused to run the Echo Chamber story, which had the effect of being an "in-kind donation" to Iran, for his own partisan political goals, not specifically to "aid Iran." This fixation on seeing things only in terms of whether they help or hurt Hillary -- and not, as Trump would see it, whether they help or hurt him -- is the basic psychological defect they have of seeing Donald Trump Junior's mere willingness to receive oppo against his opponent as "collusion with Russia's schemes," rather than rather basic campaign 101 stuff. Meanwhile, while the media continues huffing and puffing over Trump Junior being willing to hear oppo on Hillary from a foreign national -- and not actually getting to hear it, as she had none -- they continue ignoring completely the fact Democrats did in fact receive oppo from a foreign country against Trump, from Ukraine. From Politico -- from January. A story that plopped into the news pond and barely made a ripple. Ukrainian government officials tried to help Hillary Clinton and undermine Trump by publicly questioning his fitness for office. They also disseminated documents implicating a top Trump aide in corruption and suggested they were investigating the matter, only to back away after the election. And they helped Clinton’s allies research damaging information on Trump and his advisers, a Politico investigation found. If that's legal -- and no one seriously suggested it wasn't -- why can't Trump Jr. listen to some oppo information about his opponent? By the way, don't answer that with the #ButRussia nonsense. There is no #ButRussia exception in the law. And for those who'd say #ButRussia -- then, #ButIran. Iran wanted Hillary to win. Those who "colluded" to help Hillary win by publishing claims of Iranian advocacy groups are guilty of colluding with an enemy of America, too. And also, Ukraine might be America's ally, but foreign nationals all have their own national interests for offering information. Adnan Chalabi was an unimpeachable patriot for an Iraq free of Saddam Hussein's despotism. He was an "ally." But this ally infected US intelligence with all sorts of misinformation, and possibly straight-up lies, to get the US to take out Saddam Hussein. Chalabi was a patriot for his own nation-- but in the end, he was no particular friend of the US'. Certainly he did the US no favors by bringing very fake "informants" to us like CURVEBALL and convincing us Saddam was a threat to us. A threat to Chalabi's fellow Iraqis, definitely. But he convinced us he was a threat to us as well. As the left pontificated endlessly -- He lied us into war. So no, I'm not willing to entertain a #ButRussia extra-legal caveat as to why it's fine for DNC officials to sit down with Ukrainian operatives with their own nationalistic agendas but Trump Jr. can't sit down with a Russian lawyer -- just a lawyer -- promising some dirt on Hillary (and turning out to have been yet another con artist who bluffed her way past the door claiming to want to talk about something that interested Don Trump Jr. when actually having only her own agenda to discuss). And also note that the only thing the liberals seem to find bad about Russia is that they tried to influence this one election. (They've never cared that Russia has been interfering in our politics, on the left's behalf, for decades upon decades.) Whether the Ukraine is "an ally" or not, they tried to interfere in our election -- which is the only thing CNN can find fault with Russia about. So: same thing. It's just that the liberals and the NeverTrumpers (a distinction made with decreasing credibility) are angry at Russia for interfering on the wrong side, whereas Ukraine interfered on the right one. I think the buried lede here is that the Dims (my name for the unholy alliance between the Democrats and the media) keep coming back to the Russia well over and over again, even though the water is sterile and brackish everytime they do so. They literally have nothing else to talk about to distract the hoi polloi from Trump's accomplishments or Democratic obstruction, and so we have to have these Russia stories waved at us day after day.
It's as though all these media and communication experts have no idea what fatigue is. The American people got fatigued by World War II, for crying out loud (that's why the Iwo Jima flag photo was hyped so much - to reinvigorate patriotism). If people more serious than our generation could get tired of a huge world crisis, won't easily distracted smartphone addicts have tired of nothing-burgers a long time ago? The Dims seem oblivious to this. Posted by: TheLowerDepths at July 11, 2017 04:00 PM (PMt8D) 47

I have a "violation of campaign finance laws" observation for ya: When the media is 90+ fucking % in the tank for one of the two parties in an election, does that perhaps constitute "violation of campaign finance laws" in the sense of making unreported campaign contributions to one of the Party's? Hmmm? (I know I'm not a lawyer and I'm sure someone could split legal hairs with me all day long on this but I think we passed the point of the law meaning anything a little while back, donchathink?).
Evan Thomas (of Newsweek I believe) stated that media bias/support was worth 15% points in elections to the Democrats. And he said this back in 2004, when the mask of objectivity was still partially on (with the exception of lying propagandist Dan Rather). Lacking that 15% bump Democrats don't get elected to fucking dogcatcher anywhere in this country. D'Nesh D'Sousa went to jail for giving a friend $20K for her failed Senate run. But the heads of all the networks are walking around without a care in the world while their companies poison our information stream on a daily basis. This is most definitely not the country I grew up in. And for anyone that's in any doubt - we lost the Cold War. The Soviet Union fell but they infected us with their Marxist totalitarian mindset. If President Trump is the monster they say he is, then their reaction is reasonable: I'd fight this hard or harder to stop Pol Pot or Napoleon from reaching high office, lets say. But if he's not, if President Trump is not the monster they claim, then their actions are at best insane. And they need this cover to justify their attitude and actions. Lest we forget...
Something remarkable happened at 44 Henry St., a grimy Chinatown tenement with peeling walls. It also happened nearby at a dimly lighted apartment building with trash bins clustered by the front door. And again not too far away, at 88 E. Broadway beneath the Manhattan bridge, where vendors chatter in Mandarin and Fujianese as they hawk rubber sandals and bargain-basement clothes. All three locations, along with scores of others scattered throughout some of the poorest Chinese neighborhoods in Queens, Brooklyn and the Bronx, have been swept by an extraordinary impulse to shower money on one particular presidential candidate -- Democratic front-runner Hillary Rodham Clinton. Dishwashers, waiters and others whose jobs and dilapidated home addresses seem to make them unpromising targets for political fundraisers are pouring $1,000 and $2,000 contributions into Clinton's campaign treasury. In April, a single fundraiser in an area long known for its gritty urban poverty yielded a whopping $380,000. http://preview.tinyurl.com/ya6l5cav Posted by: WhatWhatWhat? at July 11, 2017 04:22 PM (ul9CR) 163

Putin has done some terrible things, like murder opposition figures...but during the 2010s Obama was arming ISIS. Yes he did, and he would have had a lot more; he sent them across the border to Syria while we were building up for the invasion. Where do you think Assad got those chemical weapons he has used? It's only been 80 years. But with 23 weeks of winning through trump, we finally get an effort to comply with the law, it's great. Now, while we try to prosecute trump jr for treason, everyone of us has a list of lefties that have implicated themselves times 100 in for real treason. #Winning. 206 Africa needs better dick washing and more condoms, not children.
Posted by: steevy In biological science, there are two identified "strategies" for parenting: "r-selection" strategy, which is to have a lot of offspring but not invest much effort into raising each one, on the hope that some percentage of them will survive to adulthood. "K-selection" strategy, which is to have a small number of children, and to devote an immense amount of parenting effort into raising them, to protect them into adulthood. Generally (but not universally), the larger the species, the more "K-selection" their parenting strategy skews, e.g. elephants have very few offspring, but spend years and years mothering and protecting each one. Smaller animals, like rabbits or small fish, often give birth to dozens or even hundreds of offspring each year, and let them fend for themselves after a brief nurturing phase. Humans used to be more r-selected, which each woman would pump out 14 kids over her lifetime, and maybe two or three would survive to adulthood, and the average lifespan was 29 -- even in "civilized" nations. But as time has progressed, we've become more K-slected, with fewer kids and more parenting. However, to this day, different human groups employ different strategies, and it has always been a "colonialist" confirmation bias that Westerners assume and expect third-worlders to have the same "K" strategy now commonplace in developed nations. We can't wrap our minds around the notion of dropping a big pile of squirming newborns over the years so that perhaps a few will survive. But in areas with bad conditions, this actually is not a bad survival strategy. It just seems grotesque and almost unacceptable from our moral framework. I'm sure the point's been made many times, but I question the whole narrative that Russia wanted Hillary to win. How did Russia fare during the Obama years? Did the "Reset" symbolized with much fanfare by the media with a cheap gag gift, and orchestrated by Hillary, help Russia or hurt her? Has Russia's stature in the world stage, vis-a-vis America's, increased or decreased?
I think we all know the answers to those questions. So, if you were Putin, would you rather continue on the trajectory of the previous 8 years, or would try to get elected a shoot-from-the hip cowboy who promised to be the next Ronald Reagan? As many have said, I think Russia's intent during the election was to diminish the person who they thought, as everyone else did, would surely be the next President. If they had any inkling at all that Trump might win, then their efforts could only be seen as hedging their bet. Posted by: Average Guy at July 11, 2017 05:01 PM (LMcFk) 315

Question: Does anyone care about this in America outside of Washington, New York and a few other big cities?
There is major a irony to the Bill and Hillary Clinton odyssey. We have seen them go through one crooked scandal after another, and yet they never were seriously punished. That may annoy us, but it also protects us from the typical leftist smear on our people. The only people who continue to hold on to the we "must be better than them" argument are Never Trump people. They are they kind of "conservatives" that Saul Alinsky loved. The left can smear a conservative and other "white knight" conservatives will take that person down for the left. However, the left can break every rule and law possible and all they will get disproving looks from those same "white knight" conservatives. You cannot win anything like that, or survive. There is nothing Trump, or his son, have done that is illegal by the letter of the law. As for the spirit...LOL. That ended a long time ago, if it ever existed. Wait a second. Are you telling me that Donald Trump wanted his father to win the election?

I met a British MP once at a GOP candidate's campaign stop. Gave me his card even. It will be useful evidence in his treason trial, colluding with that evil foreigner. How dare he.

So everyone I hate is still super pissed off and butt hurt about losing the election?
Still not tired of winning. I'll muster concern when the Left is happy. Posted by: MJ AOS at July 11, 2017 05:18 PM (zZiJ2) 351

Still not tired of winning. I'll muster concern when the Left is happy. *** also, the left has finally put down a firm line in the sand regarding treason. Guess what, they're against it. Another DJT #Win Posted by: andrew jarbacka at July 11, 2017 05:19 PM (AU4SY) 352
Poor old Hillary can't get a fair shake from you Russian-loving thugs who would do harm to an innocent, vulnerable babushka with a traumatic, stress-induced thirst for vodka.

Of course, we should start with the treason at the DNC over the
collusion with Ukraine. Those involved should be stripped naked and dragged through DC behind a Segway. Then hanged, drawn and quartered -- strangled by hanging, but released while he was still alive, emasculated, eviscerated and their bowels burned before them, beheaded, then cut into four parts each. Their heads (dipped in tar) was placed on a pike atop the Key Bridge. Posted by: undocumented illegal SMOD at July 11, 2017 05:44 PM (e8kgV) 358
So who exactly paid for the 'Pee-Pee Dossier? That would have been Fusion GPS, no? Acting on behalf of the Hillary campaign? Having been paid by the Hillary campaign? Or Comey and the FBI?

Wait a minute, you mean some Russian insider offered proof that a candidate for president was engaged in illegal collusion with the Russian government, the holy grail of the entire anti-Trump "resistance," the very thing they demand every rock be overturned to uncover, but now suddenly such information is to be eschewed? To even think of looking at it is the highest treason and scandal? I wonder what could possibly account for this 180 degree flip? Such a mystery.

Whats the big deal. I thought government leaks were all the rage. This was not even from our government. If a leaker wants to give him damaging info on his opponent is he supposed to be the only guy in DC to say no?
Posted by: RustyG at July 11, 2017 06:25 PM (1Mft0) 362
Even if the info were a "thing of value," the solicitation here would have been coming from the Russian lady to the campaign and not the other way around.
It's been years since 1st-year Crim Law, but the way I remember the analogous hypothetical: A offers to perform an act of prostitution on B. B says "Maybe, let me see the goodies." A pulls up her shirt, B doesn't like what he sees and says "Nah, I'll pass." A is guilty of solicitation of prostitution. B didn't accept the offer despite showing potential interest. If he'd accepted, even if he changed his mind when they got up to the hotel room, then both might have been guilty of conspiracy to commit prostitution. Here, A is the Russian lawyer and B is Don Jr.(assuming for purposes of argument that the info would have been something illegal for the Russian lawyer to provide to the campaign in the first place). I accepting information from a Russian national is Collusion, or a violation of campaign finance law, what then are we to make of Clinton and the British provided Oppo research that led to the Pee Pee papers?
