Wisconsin Bill Would Expel or Suspend Students in the University of Wisconsin System Who Attempt to Shut Down Public Speakers

Nice.

Under a new bill approved Wednesday night by the Wisconsin State Assembly, such student protesters in the UW system could be suspended or even expelled if they repeatedly disrupt campus speakers they disagree with.

The Republican-backed legislation, called the Campus Free Speech Act, is part of a national effort by conservative groups to crack down on protests intended to silence controversial speakers on liberal college campuses. Similar measures have been enacted in Colorado and introduced in Michigan, North Carolina, Virginia and California.


Demonstrations like the one that interrupted Shapiro’s speech last fall have become an increasingly common sight at universities around the country as debate has roiled over how to curb hate speech while protecting free expression and intellectual diversity. Some demonstrations have turned violent, like the recent protests and riots in Berkeley, Calif., that shut down a planned lecture by conservative provocateur Milo Yiannopoulos.

Bizarrely, this law (should it become one) will probably be successfully challenged on free speech grounds, with plaintiffs arguing their shutting down of free speech is their own free speech. The fact that the state is an actor here will be held against the measure.

But it shouldn't -- the UW system is itself a state actor, and is therefore obligated to defend free speech rights itself. It isn't doing so -- and therefor the "state actor" is already acting against free speech. This is more correctly seen as a corrective to that illegality.

A better option is simply to defund any universities -- for, say, a year per offense -- that don't vigillantly protect speech rights.

Wouldn't be easier to fire whoever the head of the college system and the head of the college in question, without their pensions, for gross negligence for allowing this to happen on any state college campus?

Iterate on this enough times and you'll eventually get someone that cares more about their cushy job (and really does it get any cushier then lead academic bureaucrat?) more then virtue signalling.

The progressives were for academic freedom of speech back when they were first setting out on the "long march through the institutions". They needed it to shield themselves and their own speech as they slowly infiltrated and obtained power.

With the "long march" concluded successfully, and the groves of academe now dominated by 1960s New Left campus radicalism that has obtained tenure, the progressives don't want academic free speech any more. They're gripping the megaphone tightly and have no intention of letting any other voices speak through it.

So, after reading some of the comments above, I see no reconciliation possible because it is not a zero sum game. The left is playing for a different victory condition than we conservatives are.

It's not about free speech, it's not about freedom of religion, it's not about public safety, it is about political power.

Not if it's worded properly.

The state can place reasonable time, place, and manner restrictions on speech.

And a university rule that prohibits students from, say, swarming a stage on which a conservative is speaking, would be a perfectly reasonable restriction.

Antifa and their allies in academia are not only trying to make is physically dangerous for conservatives to come on campus, but to make it well-known that it is dangerous for conservatives to come on campus. This is an important distinction because when the inevitable happens -- conservative speaker schedules appearance on campus, left threatens violence if he appears, university defends his appearance and it happens as scheduled, Antifa literally kills someone during the subsquent riot, parents of the dead person SUE the university (as the easiest deep-pocket defendant) for negligence and damages -- the university will have to fork over countless tens of millions, because it can be proven that the university WAS AWARE of the potential for violence, and yet let Antifa murder someone anyway.

This issue has ALREADY been decided on conclusively by the Supreme Court in the all-important "Skokie v. the KKK" case (forget its official name) in which it was ruled that even the KKK is protected under the First Amendment, which has no limits and no criteria for what counts as "hate," which is an irrelevant concept.

After that ruling, it is set in stone forever that everyone in the US has the right to say anything, no matter how "offensive" someone else may deem it.

I had two roommates in college that went down there one summer for internships. They actually took two that applied to what they wanted to do in the future, one at the Smithsonian the other at the Library of Congress. They actually gained some skills from it.
They could party with the best but actually had to go to work in the morning, so their partying got limited to the weekends. But they lived in the dorms with the congressional interns and, yes, that about covers it.

Yeah, that was called "OWS".

Actually, when I was in school there was perpetually some kind of sit in near the school library. The reasons changed every day, but it was always the same people and their tents stinking up the place.

So the school made it illegal to sleep on school grounds. The cops would swing by and try to catch them sleeping so they could be arrested.

One night during finals week they complained there were students sleeping in the library, so the cops went in and arrested a guy who had fallen asleep studying for a final the next day.

249 You know, it used to be there was the crime, the physical act. Then there was intent, which mitigated the crime. Manslaughter versus murder.

At some point we decided to do away with the crime entirely and just have intent. That is what hate speech is - it is just "intent" with no associated crime. The we decided to define hate speech down ever further, to it being normal speech but with some sort of hateful intent to be derived later in a kangaroo court.

We need to prosecuting only actions and using intent to magnify or reduce sentences, and get rid of crimes that are intent only.

Alternately start fucking prosecuting radical leftists and Muslims in this country for intent every day, because they intend to murder us, and are certainly not shy about saying it.

Preceding this will be numerous articles in local papers about how boy howdy that tuition just has to go up again we need more money. The tuition increase is the threat to shake out more tax dollars. Then when the payoff is made, the tuition goes up anyway (just not as much as threatened).

Yep. This is the state that, once upon a time, elected Ronald Reagan governor. Where I grew up the local area was very conservative - when I left Orange County we had our first Democratic representative in ages. Back then Southern California had a lot of relatively well paid defense and manufacturing jobs. They used to make cars in Van Nuys.

But the demographics are much different now. The middle class left with the middle class jobs. The part of the "working class" that actually works left as the state was overrun with illegals willing to work under the table for half the price.

Now it's just illegals, retired people, a handful of techies, and a bunch of the super-rich. That's a Democratic voter base. It's also a recipe for bankruptcy.

Meanwhile, up North, defense jobs also folded up and military bases closed. In a way that was karmic--liberal Demunists like then Congresswoman Barbara Boxer deserved to have her Hamilton Air force Base close--but it had the effect of making Commiecrat districts that much more Commiecrat.

At one time, Silicon Valley made hardware rather than software. And the loss of the former meant also a lot of Patriots bailing out of the area.

Meanwhile, the poisonous ideology of "multiculturalism" meant ethnics subject to leftist indoctrination at the very least, and 5th column dubious loyalty at the worst.

Pass legislation that makes it a requirement that university administrators and employees affirmatively act to protect free speech and other rights. Ensure that failing to do so is a termination offense. Make sure it is actionable as a tort, and further that said individual - acting outside of the express will and policy of the legislature - shall be personally liable, and no public money used for their defense. And that any money the school has to pay out will be deducted from bonuses and severance, if any.

You can extend this to mandate they defend viewpoint neutrality, freedom of religion, speech, assembly, formation of clubs - and by threatening their sinecure, thes4e assclowns will shape up tuit suite.
