Democrats and NeverTrumpers Worry: What If There's No Scandal for the FBI to Find, After We've Staked What Remains of Our Credibility on Suggesting There are High Crimes in Play?

Bluffed called, assholes.

Eli Lake is right: The DOJ's appointment of widely-respected former prosecutor Robert Mueller to lead the special inquiry into the Trump campaign's potential collusion with Russia is a reprieve for a Trump Administration in crisis--a reprieve that it will almost certainly squander, but a reprieve nonetheless.

How do we know? Because the responses from Trump’s most dogged critics on the Russia question betray a kind of anxiety about the Mueller appointment--an anxiety that the no-nonsense law enforcement wise man will lower the temperature in Washington without actually uncovering enough damaging material to bring down the President.

Take, for example, Josh Marshall declaring that while he has confidence in Mueller to identify and expose any criminal activities undertaken by Trump or his associates, he won’t be able to prosecute the real Trump-Russia wrongdoing: a labyrinthian "conspiracy" which may not even involve any illegal behavior.


It is critical to understand that the most important details we need to know about the Russian disruption campaign and the Trump campaign’s possible collusion with it may not be crimes. Indeed, I would say that the crimes we’re likely to discover will likely be incidental or secondary to the broader actions and activities we're trying to uncover. Just hypothetically, what if Russia had a disruption campaign, Trump campaign officials gave winks and nods to nudge it forward but violated no laws? That’s hard to figure but by no means impossible. (Our criminal laws are not really designed for this set of facts.)...

And here’s David Frum in the Atlantic making a similar objection:


The special counsel will investigate whether people in the Trump campaign violated any laws when they gleefully leveraged the fruits of Russian espionage to advance their campaign.

By contrast, what happened in plain sight --cheering rather than condemning a Russian attack on American democracy--will be treated as a non-issue, because it was not criminal, merely anti-democratic and disloyal.

Since the summer before the election, Trump's critics have been suggesting or sometimes stating outright that Russia is involved with a criminal conspiracy that reaches to the highest levels of Trump’s inner circle. But now that an unimpeachable bulldog prosecutor has been named to probe these very allegations, the critics seem to be trying to move the goalposts, saying that the real problem isn't criminality, but the sleaze and outlandish behavior of the Trump campaign more generally...

Indeed. One question I keep asking -- and which I encourage people to ask of these assholes -- is this: "What specific crime, including what specific acts, are you accusing Trump of?"

Note that in Hillary's case, critics were quite specific about what crimes she had committed: She violated the Espionage Act by transferring classified information to non-authorized users. She also set up this system precisely to avoid her FOIA obligations -- repeatedly telling people there were no responsive documents, when she was deliberately not searching for such documents on the secret serve she knew they were on.

I don't know if that last one is a crime, but I can definitely make that specific description of the bad conduct I'm alleging.

What similar specifics can these assholes offer re: Trump? They keep citing "contacts" -- but it's not a crime to have a "contact" with anybody. Literally, there is no person in the world, not even Osama bin Ladin's Satan-raped ghost, that it's illegal to have a "contact" with.

They also use the very vague word "collusion" to mask the fact they have no idea what Trump and Putin "colluded" about, or how. What quid pro quo are they alleging? How was this contract formed? Who negotiated this contract?

They have no idea, because they don't even really believe such a thing happened.

If they really believed such things happened, they would specifically say "Trump Aide X, with Trump's knowledge and permission, negotiated to trade American policy Y to Russia in exchange for Russian act Z."

They don't ever say that, because this is all bullshit. They just keep talking about the non-crime "contacts" and the deliberately vague, purposefully elusive word "collusion."

65 I saw a periscope yesterday from some pol who went on an almost hour long rant about this. He said he got a call from the WH and bringing in Mueller is Trump calling their bluff.

Of course, if Mueller is establishment and not an honest actor who knows what could happen.

He also said the word coming out of the WH is Trump's going to clean house to get rid the egos. Bannon, Conway, Spicer, Priebus are all going soon.

We'll see. I can't remember the guy's name and I'd never heard of him before but he has worked in Washington for some time so we'll see.

But now they have the power to investigate and prosecute pretty much anything they want to with an unlimited budget, an unlimited time horizon, their choice pick of Clintonized FBI agents and young, ambitious swamp lawyers.

I blame Sessions, who got punched in the face and in a rare moment of weakness, recused himself when he strictly was not required to by ethical rules.

This moved the power to Rosenstein, a DOJ lifer who selfishly and cowardly chucked this tar baby exactly where the Dems/NeverTrumperGOPe wanted it. He saw this as a no-win situation from the perspective of his personal legal career, and decided to personally get as far away from it as he could.

And instead of at least explicitly limiting the jurisdiction of the Special Counsel to alleged Russian-Trump campaign conspiracy, he delegated them the power to prosecute anything at all they come across in the course of their investigation. He should have specified that anything they came across NOT specifically having to do with the alleged Trump-Russia conspiracy needed to be referred back to main Justice and not have an open-ended roving anti-Trump investigator/prosecutor.

IIRC, you have a laptop. One of the most common things causing overheating in a laptop is that the cooling fan and/or its exhaust vent gets clogged up with dust. And, unlike a tower, it's not quite as simple a matter of removing the cover and blowing out the dust.

But, it can be done. You don't have to disassemble the whole thing, just enough to get at the fan. Go online with your exact model number and look for the instructions on how to open your model up. You will likely just need some small screwdrivers, like the larger ones in the eyeglasses sets. You will also need some object to slide in the seams of the case once you have removed the screws. And, instead of just blowing on the dust once you get to it, use a can of compressed air.

I've tried to explain the difference between sending an email to someone and making a direct solicitation both as someone who has run marketing and fundraising campaigns and as the FEC sees it, as the FEC describes it on the FEC's site.

It doesn't matter. You can "literally" watch the blood drain from the parts of our collective brain that are responsible for higher tasks like discourse as we prepare to fight. Everyone's shouting and teaming up.

I looked at Rosenstein's order. Not sure how to read it, and how it compares to other Special Prosecutor authorizations:

"any links and/or coordination bet ween the Russian government and individuals associated with the campaign of President Donald Trump; and (ii) any matters that arose or may arise directly from the investigation; and ....
If the Special Counsel believes it is necessary and appropriate, the Special Counsel is authorized to prosecute federal crimes arising from the investigation of these matters."

I would read "arise directly" and "arising from"as only covering things like destroying evidence, not authorizing a frolic.

The lead in says "The Special Counsel is authorized to conduct the investigation confinned by then-FBI
Director James 8. Corney in testimony" which isn't an authorization to prosecute.

The grant of jurisidiction is to "any matters arising directly from the investigation" NOT to "any matters directly related to the matter identified above."

So evidence of ANY CRIME that is directly from their investigation may be prosecuted by them.

And if this is how Mueller interprets the grant of jurisdiction, there is really no way to rein him in, because you would have to fire him.

Politically, you can't fire a special counsel, or at least a Republican cannot.

I never expected anything but.

I used to fantasize about "a Donald" taking on the establishment before "The Donald" actually came along. While I figured it would be an epic crapstorm where at least the first 2 years would be spent fighting the swamp, and hopefully moving beyond that after a supportive midterms. I never imagined this specific scenario. I always figured it would be more open GOPe revolt and more subdued MSM attacks at least trying to protect their image a bit.

There's specific mention that the Special Counsel can go after things like perjury, evidence destruction that come up in his investigation. Nothing more.

e.g., Fitzgerald went after Scooter for alleged lying in the course of Fitzgerald's investigation.

Mueller can only go after things in his mandate, else he has to go back to the AG (now the #2, because of Sessions' recusal).

Which is a big difference.

I don't think Mueller can go after the leakers, because it's not in his mandate. That's for Sessions and the new FBI head.

To make a long story short, I finally told them about the Biden Rule. They first refused to believe it existed. After a quick Google, they then refused that it had been mentioned only once on NPR, and that by Orrin Hatch interjecting it into an interview where the host promptly changed the subject. An NPR search confirmed that. They they started bullshitting about how the BR was probably not applicable, but I reminded them that the bet was that they HAD NEVER EVEN FUCKING HEARD ABOUT EVEN ONE REPUBLICAN ARGUMENT, not what they thought of it now that a conservative had told them about it!

I come out the opposite on both points. The only person who decides how much of a leash Mueller has is Mueller. I would bet anything that Trump and Bannon consider the appointment of SC Mueller as a disaster.

And I think this helps Trump's legislative agenda in the short-term, as he can try to push away attempts to distract Congress onto Russian conspiracy by pointing to the Special Counsel. But it is a potentially mortal problem in the longer term for his presidency.

And I neglected the statement of Vice President Mike Pence, February 12, 2018: "I am fully convinced of the innocence of President Donald J. Trump in these allegations of corruption of government officials. President Trump is a good man.
