Democrats and NeverTrumpers Worry: What If There's No Scandal for the FBI to Find, After We've Staked What Remains of Our Credibility on Suggesting There are High Crimes in Play?

Whoops.

Bluffed called, assholes.

Eli Lake is right: The DOJ's appointment of widely-respected former prosecutor Robert Mueller to lead the special inquiry into the Trump campaign's potential collusion with Russia is a reprieve for a Trump Administration in crisis--a reprieve that it will almost certainly squander, but a reprieve nonetheless.

How do we know? Because the responses from Trump’s most dogged critics on the Russia question betray a kind of anxiety about the Mueller appointment--an anxiety that the no-nonsense law enforcement wise man will lower the temperature in Washington without actually uncovering enough damaging material to bring down the President.

Take, for example, Josh Marshall declaring that while he has confidence in Mueller to identify and expose any criminal activities undertaken by Trump or his associates, he won’t be able to prosecute the real Trump-Russia wrongdoing: a labyrinthian "conspiracy" which may not even involve any illegal behavior.

It is critical to understand that the most important details we need to know about the Russian disruption campaign and the Trump campaign’s possible collusion with it may not be crimes. Indeed, I would say that the crimes we’re likely to discover will likely be incidental or secondary to the broader actions and activities we're trying to uncover. Just hypothetically, what if Russia had a disruption campaign, Trump campaign officials gave winks and nods to nudge it forward but violated no laws? That’s hard to figure but by no means impossible. (Our criminal laws are not really designed for this set of facts.)...

And here’s David Frum in the Atlantic making a similar objection:

The special counsel will investigate whether people in the Trump campaign violated any laws when they gleefully leveraged the fruits of Russian espionage to advance their campaign.

By contrast, what happened in plain sight --cheering rather than condemning a Russian attack on American democracy--will be treated as a non-issue, because it was not criminal, merely anti-democratic and disloyal.

Since the summer before the election, Trump's critics have been suggesting or sometimes stating outright that Russia is involved with a criminal conspiracy that reaches to the highest levels of Trump’s inner circle. But now that an unimpeachable bulldog prosecutor has been named to probe these very allegations, the critics seem to be trying to move the goalposts, saying that the real problem isn't criminality, but the sleaze and outlandish behavior of the Trump campaign more generally...

Indeed. One question I keep asking -- and which I encourage people to ask of these assholes -- is this: "What specific crime, including what specific acts, are you accusing Trump of?"

Note that in Hillary's case, critics were quite specific about what crimes she had committed: She violated the Espionage Act by transferring classified information to non-authorized users. She also set up this system precisely to avoid her FOIA obligations -- repeatedly telling people there were no responsive documents, when she was deliberately not searching for such documents on the secret serve she knew they were on.

I don't know if that last one is a crime, but I can definitely make that specific description of the bad conduct I'm alleging.

What similar specifics can these assholes offer re: Trump? They keep citing "contacts" -- but it's not a crime to have a "contact" with anybody. Literally, there is no person in the world, not even Osama bin Ladin's Satan-raped ghost, that it's illegal to have a "contact" with.

They also use the very vague word "collusion" to mask the fact they have no idea what Trump and Putin "colluded" about, or how. What quid pro quo are they alleging? How was this contract formed? Who negotiated this contract?

They have no idea, because they don't even really believe such a thing happened.

If they really believed such things happened, they would specifically say "Trump Aide X, with Trump's knowledge and permission, negotiated to trade American policy Y to Russia in exchange for Russian act Z."

They don't ever say that, because this is all bullshit. They just keep talking about the non-crime "contacts" and the deliberately vague, purposefully elusive word "collusion."

97 Still think the whole outrage up to 11 thing came from Comey being canned, but not because of that. It's because they're absolutely fucking terrified Trump is going to get an attack dog appointed and he'll go after all of these cockholsters. Establishment told the media to ratchet it up.

Also, Seth Rich. Story comes out that he was in contact with Wikileaks and suddenly the sky fell with Muh Russians and Muh Comey.

It's all a giant distraction from the laws these cockholsters have been breaking for the last couple of decades.

98 Bluffed called, assholes.

I'm sorry, I hate to be Debbie Downer. But this is not bluff called.

Look, everybody knows that neither Donald Trump nor Mike Pence nor Jess Sessions nor KellyAnne Conway nor Ivanka no, not even Jared, conspired with Russian intelligence to hack into John Podesta's and the DNC's computers.

These are not stupid people we are dealing with here. Robert Mueller knows this. Chuck Schumer knows this. The MSM knows this.

They know there is no actual crime here. The whole purpose of this fake news narrative was to accomplish exactly what they got, the appointment of a special counsel consisting of a lawyer with longtime political connections to the Dem/GOPe establishment.

The Dems and the Never Trumpers had no other way to legally attack Trump. In the minority, they do not have the power to control congressional investigations and wield the subpoena power.

But now they have the power to investigate and prosecute pretty much anything they want to with an unlimited budget, an unlimited time horizon, their choice pick of Clintonized FBI agents and young, ambitious swamp lawyers.

I blame Sessions, who got punched in the face and in a rare moment of weakness, recused himself when he strictly was not required to by ethical rules.

This moved the power to Rosenstein, a DOJ lifer who selfishly and cowardly chucked this tar baby exactly where the Dems/NeverTrumperGOPe wanted it. He saw this as a no-win situation from the perspective of his personal legal career, and decided to personally get as far away from it as he could.

And instead of at least explicitly limiting the jurisdiction of the Special Counsel to alleged Russian-Trump campaign conspiracy, he delegated them the power to prosecute anything at all they come across in the course of their investigation. He should have specified that anything they came across NOT specifically having to do with the alleged Trump-Russia conspiracy needed to be referred back to main Justice and not have an open-ended roving anti-Trump investigator/prosecutor.

there is a special appliance, similar to a 'merkin'. You get it in flesh tone, so the tape, in that area, doesn't contact bare skin.

103 Apologies for bad blogging today -- My computer keeps turning off due to overheating. I'm working on closing the literally 150+ tabs I've managed to open in the past few weeks in hopes that that will reduce CPU demand.

++++

Weren't you going to replace that thing?

IIRC, you have a laptop. One of the most common things causing overheating in a laptop is that the cooling fan and/or its exhaust vent gets clogged up with dust. And, unlike a tower, it's not quite as simple a matter of removing the cover and blowing out the dust.

But, it can be done. You don't have to disassemble the whole thing, just enough to get at the fan. Go online with your exact model number and look for the instructions on how to open your model up. You will likely just need some small screwdrivers, like the larger ones in the eyeglasses sets. You will also need some object to slide in the seams of the case once you have removed the screws. And, instead of just blowing on the dust once you get to it, use a can of compressed air.

Or, just but a set of tools like this:

http://www.ebay.com/itm/1-Sets-Opening-Repair-Tools-Laptop-
Phone-Screen-Disassemble-Tools-Set-Kit-USA-/361502341089

Under $7 and free shipping.

If you really don't want to open the case, you can try blowing the compressed air into the exhaust vent and maybe dislodge the dust that way.

Another thing. You can also improve your laptop's air circulation by raising it up off of whatever surface you have it on so that the air will flow better through the vents and just circulate around the laptop. They sell laptop coolers that are made for just that, even with built in fans.

w/o Fan:

But, even some little doohickeys that just lift the laptop up a bit off the desk will help.

I looked at Rosenstein's order. Not sure how to read it, and how it compares to other Special Prosecutor authorizations:

"any links and/or coordination bet ween the Russian government and individuals associated with the campaign of President Donald Trump; and (ii) any matters that arose or may arise directly from the investigation; and ....
If the Special Counsel believes it is necessary and appropriate, the Special Counsel is authorized to prosecute federal crimes arising from the investigation of these matters."

I would read "arise directly" and "arising from"as only covering things like destroying evidence, not authorizing a frolic.

The lead in says "The Special Counsel is authorized to conduct the investigation confinned by then-FBI
Director James 8. Corney in testimony" which isn't an authorization to prosecute.

174 I think the Dems have shot themselves in the feet. If there had been a "there" there, Comey and the dead-enders would have leaked it already. When Trump uses their lines of reasoning to investigate the Clinton campaign's collusion with PAC's and the press, along with influence peddling and the e-mails, and Obama's dealings how can they object? They will'of course, but it will come off as unpersuasive and hypocritical.

175 We are at an inflection moment.

We KNEW this was going to happen. You guys think that the establishment would just let an outsider walk in and start draining them of their grip on power without a struggle? Especially when they were SO CLOSE to permanently transforming the country into their socialist utopia?

Since before Trump even took office, we have had planted bureaucrats from both sides leak, undermine, and spread false info in collusion with the msm. The deep state has been out to take him down from the beginning. Obama specifically took actions to make it easy for his goons to sabotage Trump since day one.

Of course, the deep state has always conducted this behavior when someone threatens the status quo. The difference now? They are exposing themselves in their rabid and unhinged behavior.

They are only acting like this because Trump truly IS removing them of their influence. They've spent 2 years trying to destroy Trump, and have failed every step of the way. They are becoming unhinged, both at their failure to stop Trump, and at their loss of power.

It always gets worse before it gets better. The swamp creatures are flailing hysterically for anything - even making stuff up when they can't find it. And yes, they'll manage to fool some people - probably about 40% of the population.

But the truth is, the American people have wizened up the media corruption and bigotry. If they hadn't, Trump never would have won. Remember that. These people are losing. They're getting destroyed in elections. They're losing the courts. They're losing their grip on public influence and culture (thank you internet).

They are acting like this because they are losing. All I see in this conspiracy garbage is a last ditch attempt to cling onto their slipping power.

----------

This language: "any matters that ... may arise directly from the investigation"

and this

"If the Special Counsel believes it is necessary and appropriate, the Special Counsel is authorized to prosecute federal crimes arising from the investigation of these matters."

The grant of jurisidiction is to "any matters arising directly from the investigation" NOT to "any matters directly related to the matter identified above."

So evidence of ANY CRIME that is directly from their investigation may be prosecuted by them.

And if this is how Mueller interprets the grant of jurisdiction, there is really no way to rein him in, because you would have to fire him.

Politically, you can't fire a special counsel, or at least a Republican cannot.

"Mueller's purview will include all FBI investigation into:

(iii) any other matters within the scope of 28 C.F.R. 600.4(a).

Regulation 28 C.F.R. 600.4(a) is part of the federal regulations
authorizing special counsels. It expands a special counsel's
jurisdiction to all crimes, such as perjury or obstruction of justice,
that interfere with his original named responsibility."

Right? Trump has kept on plugging along, with the frequent tweet. Karen Tumulty was on Fox and suggested Trump likely couldn't compartmentalize like Clinton did. Total bullshit. 262 Indeed. One question I keep asking -- and which I encourage people to ask of these assholes -- is this: "What specific crime, including what specific acts, are you accusing Trump of?"
...
They also use the very vague word "collusion" to mask the fact they have no idea what Trump and Putin "colluded" about, or how. What quid pro quo are they alleging? How was this contract formed? Who negotiated this contract?

This is exactly what I keep bringing up. If you press a leftist long enough they google Talking Points Memo or Matt Yglecias until they find some stuff to say, but even that is never criminal just at its worse kind of unsavory. And there's no evidence of any of it.

They know its all BS. They know it. They don't care because its leverage, its a way of toppling the hated Republican in office at any and all costs. They do not give a damn about the truth, logic, or consequences. They do not care what happens to the country. They want their wubbie back. They were so close to utopia with Hillary in charge to punish the evil right wing and destroy white men. They were sooo close.

263 "So evidence of ANY CRIME that is directly from their investigation may be prosecuted by them."

Not sure about this. It's under 28 CFR 600 et seq., which got adopted after Whitewater and appears to put a leash on a Special Counsel:

"in order to fully investigate and resolve the matters assigned, or to investigate new matters that come to light in the course of his or her investigation, he or she shall consult with the Attorney General, who will determine whether to include the additional matters within the Special Counsel's jurisdiction or assign them elsewhere."

There's specific mention that the Special Counsel can go after things like perjury, evidence destruction that come up in his investigation. Nothing more.

e.g., Fitzgerald went after Scooter for alleged lying in the course of Fitzgerald's investigation.

Yeah, but Rosenstein explicitly gave them jurisdiction into any crimes they directly come across during their investigation, which is in addition to the matters in 600.4(a).

Statement of Special Counsel Mueller, February 12, 2018:

"In the course of our investigation into possible financial or other relationships between President Trump and Russia, our investigation into the business dealings of the The Trump Organization has uncovered probable cause to believe that members of The Trump Organization gave something of value to County Zoning Board member Joe Bumfuk in order to obtain a zoning variance for a Trump golf course.

"We offered immunity to such person in exchange for evidence in the form of testimony that Donald Trump personally knew and participated in a conspiracy to obtain a zoning variance.

"Nothing can be more important in our nation of laws than the confidence that decisions of government officials, even at the level of a zoning board, remain free of criminal conspiracy and corruption.

"Speaker Paul Ryan was saddened and disappointed to learn of the evidence of these crimes, and my office has provided this evidence to him for use by the Impeachment Managers in the US House of Representatives."

Posted by: Scalia's Ghost at May 18, 2017 07:25 PM (m5dkR)

277 " into any crimes they directly come across during their investigation,"

This is actually a big fucking deal. And I'm not 100% sure I'm right, but the more I look at it, the more sure I am.

Mueller can only go after things in his mandate, else he has to go back to the AG (now the #2, because of Sessions' recusal).

It's not "crimes they directly come across" (which was the Watergate standard). It's crimes directly arising from the investigation.

Which is a big difference.

I don't think Mueller can go after the leakers, because it's not in his mandate. That's for Sessions and the new FBI head.

That part gives me a woodie. Someday, hopefully a Schadenboner

Posted by: E at May 18, 2017 07:33 PM (WiPBb)

279 The problem is that as a technical reading the term "the matters assigned" includes evidence of any crimes directly arising in the investigation. Those would not be "new matters" as opposed to "matters assigned."

And it matter little how you or I come out on this. Mueller gets the last word on how he interprets his jurisdiction, and neither Sessions nor Rosenstein will get involved in any second-guessing for fear of being accused of obstruction of justice.

282 I metaphorically cold-cocked a couple of liberals today. They were on about how they only get their news from reputable sources like NYT and NPR. I pointed out that I use those too, but I also get things from other sources that they leave out. Ended up taking a bet for $20 that I could show them that their gold-standard sources filter out essential facts.

I simply asked them how many stories they had read or heard about the Republicans' refusal to conduct hearings on Eric Garner. Multo. Then I asked them to tell me all the justifications the Democrats had used to claim this was wrong. Multo again.

THEN I asked them what were the counter arguments the R's made. Just tell me one. Take your time. They tried lame shit like "because they wanted to thwart Obama", to which I responded that is not an argument, that's like me saying I want a pony, and my parents saying we can't care for one, and my counter-argument is WAAAAAAA!!

So finally they couldn't come up with one. I asked them if they really thought no Republican even made a counter argument. At this point they began getting nervous. To make a long story short, I finally told them about the Biden Rule. They first refused to believe it existed. After a quick Google, they then refused that it had been mentioned only once on NPR, and that by Orrin Hatch interjecting it into an interview where the host promptly changed the subject. An NPR search confirmed that. They they started bullshitting about how the BR was probably not applicable, but I reminded them that the bet was that they HAD NEVER EVEN FUCKING HEARD ABOUT EVEN ONE REPUBLICAN ARGUMENT, not what they thought of it now that a conservative had told them about it!

I have their two twenties in my pocket. Try it, it's fun!

285 I'm more firmly of the belief that this has been war-gamed by the likes of Trump and Bannon.

Casualty in the near-term is Trump's legislative agenda

--------

I come out the opposite on both points. The only person who decides how much of a leash Mueller has is Mueller. I would bet anything that Trump and Bannon consider the appointment of SC Mueller as a disaster.

And I think this helps Trump's legislative agenda in the short-term, as he can try to push away attempts to distract Congress onto Russian conspiracy by pointing to the Special Counsel. But it is a potentially mortal problem in the longer term for his presidency.

And I neglected the statement of Vice President Mike Pence, February 12, 2018: "I am fully convinced of the innocence of President Donald J. Trump in these allegations of corruption of government officials. President Trump is a good man. But in the unfortunate circumstance that I am called upon to exercise the duties of the highest office, I am fully prepared to meet those responsibilities and to unify our country, and will seek to heal our differences through a new period of prosperity based on America as a land of immigrants and the goal of worldwide free trade."

The downside of the outsider is that people tend to believe those they know over the outsider.

But already the investigation has morphed. It seems that the Russian part of it is forgotten entirely. Flynn is accused of lobbying for Turkey... not Russia. And the obstruction is a sideline of that.... not Russia.

Are they even considering collusion with Russia at all, not a peep about any criminal activity directly involving Russia.

Trump needs space to make errors. He didn't get even a break between the election and taking office. He's right that no President has had to deal with that.
