Joe Manchin: Democrats Shouldn't Block Trump's Supreme Court Pick

Hmmm.

As you've probably heard, the 2018 Senate battleground map is terrible for Democrats. 2016 was terrible for Republicans, but they weathered it. 2018 is the Democrats' time in the fire, with five Democrat Senators up for re-election in states where Trump demolished Hillary:

Republicans are targeting a quintet of senators from conservative states where Trump walloped Hillary Clinton: Montana, Missouri, Indiana, North Dakota and West Virginia. The GOP could amass a filibuster-proof majority by running the table in those states and other battlegrounds.

To prevent that, Schumer will need to mine his fellow leaders to accommodate vulnerable Democrats with profoundly different ideologies and political circumstances -- from Wisconsin's Tammy Baldwin, who also was tapped for a leadership spot, to West Virginia's Manchin, who has gone out of his way to align himself with Trump voters this week.

On Election Night itself, Joe Manchin told reporters that he couldn't necessarily be counted on to vote with the Democrats to maintain control of the Senate if it shook out as 50-50. (I took that as a major sign that maybe Trump was actually going to win.)

Now Manchin is talking about making nice-nice with Trump on Supreme Court picks.

"We have to be careful how we go down this road," Manchin said during a panel discussion at a centrist "No Labels" conference in Washington.

Manchin was referring to Senate Democrats' willingness to use the filibuster to try to block Trump's high court pick and cautioned against doing so.

"If my Democrat friends just hunker down and say, 'No, no, and hell no'…I can understand that [Republicans] are gong to say, 'Wait a minute, we have a pretty good person here. We need to give him a fair shot,'" he said. "Those types of things, I hope we're going to avoid before we get into this dysfunction that we've been in."

As the article notes, Manchin is also being considered as a pick for Secretary of Energy, which would give his seat over to Republicans, as the governor who'd select his replacement is a Republican.

9 Elect the youngest most conservative choice available (of course want to ensure he will remain conservative too). This is first pick in first year with control of Senate and to replace the Scalia seat. This battle should be easy, and if Dems want to filibuster, nuke it now. The next pick (if there is one) will be tougher just because it could upset the relative balance - e.g., the Ginsberg seat, or the AK swing vote. Be nice to already have a nuked filibuster and you can play the identity politics card then if necessary.

I say dislike but admittedly I haven't really thought through the alternative. I just don't like the courts present power to overturn the will of the people based on tortured logic.

51 Someone suggested this genius strategy for Trump, and I heartily endorse it:

Fir every judicial nominee, announce not simply to nominee him- or herself, but also the backup nominee if the first one gets rejected.

And in every case, make the backup nominee MORE CONSERVATIVE than the original nominee.

So if a Supreme Court seat opens up, Trump should say, "I am nominating this solid conservative for the seat. And if you reject him, then the next person in the queue is TED FUCKING NUGENT and I will ram him through with a recess appointment if necessary. Your choice."

53 Judicial Review has been around from almost the beginning but you would think if that's what they intended it would have been included in the powers listed in the Constitution.

--------------

Judicial review is an inferred power that was there from the get go - and under the Supremacy Clause must be. Judicial supremacy and substantive due process are not judicial review. Marbury v. Madison was a much more narrow holding than most people think. It would take another 75 years before the Court held that it was the final arbiter of things - i.e., judicial supremacy.

68 Judicial Review has been around from almost the beginning but you would think if that's what they intended it would have been included in the powers listed in the Constitution.

The founding fathers said and wrote extensively that the people had the final say on constitutionality, as represented by their government and whenever they voted. Madison wrote extensively on this and pointed out that the SCOTUS was never supposed to be the final say.

"The question whether the judges are invested with exclusive authority to decide on the constitutionality of a law has been heretofore a subject of consideration with me in the exercise of official duties. Certainly there is not a word in the Constitution which has given that power to them more than to the Executive or Legislative branches."
-Thomas Jefferson

"But the Chief Justice says, 'There must be an ultimate arbiter somewhere.' True, there must; but does that prove it is either party? The ultimate arbiter is the people of the Union, assembled by their deputies in convention, at the call of Congress or of two-thirds of the States. Let them decide to which they mean to give an authority claimed by two of their organs. And it has been the peculiar wisdom and felicity of our Constitution, to have provided this peaceable appeal, where that of other nations is at once to force."
-Thomas Jefferson

"The Constitution... meant that its coordinate branches should be checks on each other. But the opinion which gives to the judges the right to decide what laws are constitutional and what not, not only for themselves in their own sphere of action but for the Legislature and Executive also in their spheres, would make the Judiciary a despotic branch."
-Thomas Jefferson

"The particular phraseology of the Constitution of the United States confirms and strengthens the principle, supposed to be essential to all written constitutions, that a law repugnant to the Constitution is void; and the courts, as well as other departments, are bound by that instrument."
-Chief Justice John Marshall

The boners keep coming. Did you see Trump's tweet about Boeing being "out of control" on the costs for the new Air Force One planes? Boeing's stock dropped over 1% on the mention of that. So did Lockheed-Martin who has a contract to build some new Marine One helicopters.

Up with all this ridiculous padding of government contracts, Trump is not going to put.

The little piggies at the federal trough are going to squeal.

Of course they are complete idiots. They are also stuck in the Bargaining Stage. The media, by slanting everything so hard for Hillary and the Democrats, created a cognitive expectation for these people that could not last when reality barged into their little worlds. Dissonance isn't quite the word to describe this, upending is better but not quite descriptive when it comes to how everything was shattered.

Think how the NeverTrump contingent in the Republican press and political lamprey class went, with each new "plan" to stop Trump getting ever more elaborate. What the NeverTrump contingent went through between the Iowa Caucus and New Hampshire Primary and the GOP convention these people are going to have to go through. They less than three months to complete it and are only one month in. Expect ever greater silliness until January 21st.

170 People say Hillary should have won because she supposedly got the popular vote margin.

Look at the map and see how much of it voted for Trump and how little for Hillary. If people count, why not land mass? If 90% of the nation votes for a candidate doesn't that count as well?

She won the west coast, Illinois, and New York, a few scattered counties. That's not a national victory.

Man him would be replaced by the DEM WV gov for 2 yrs-- likely by an

So from the standpoint of improving the GOP narrow Senate majority,

Yes. Late 19th century saw an influx of Italian emigrees to the various mining operations, so much so that by WWI the Italian government had a section office in Clarksburg, WV.

Should I relocate for a job in Boulder, CO? Currently, I live in central Maryland. I like it here, but am not finding a lot of interesting job opportunities (mostly in Govt. sector).

I've for a long time wondered what it would be like to live in a winter wonderland ( I LOVE SNOW). But from what I understand, Boulder is in the drier part of the state. ( I also own a mortgage, making a move almost impossible).

I actually accidentally applied for this job. I agreed to a phone screen and now they want to have a video conference 2nd interview. I think I need to back out before I waste any more of their time.

Times like this I wish I had a wife, which would make moving away from home easier.

You say you're from Maryland, are you absolutely sure about that snow thing. We have a bit around these parts and it gets old very quickly. Getting out to play in it alleviates some of the pain, but nowhere near enough. A winter being cooped up in a house is very long, particularly if the only time you can get outside is to shovel the damn stuff.

You see, to be truly enlightened you must look at the world through the eyes of a SJW, always interpreting what you see in terms of oppressed and oppressor and with an understanding of fairness. This is the "equity lens."

Suppose you see a couple of 20 yr-old black women beat up an 80 yr old white man in a veteran's cap right after he draws money from an ATM. You might think these chicks are thugs. But if you put on your equity lens, you can clearly see this is the heroic rise of women of color against the white, patriarchal regime of militarism and capitalism.

359 OT, but I need to vent about this...

The process of holding an election is, let's be frank, astoundingly simple.

1) You qualify the people who are eligible to vote
2) Qualified people register to vote
3) Registered voters fill-out a ballot
4) The ballots are counted and the results tallied

That. Is. It.

No complicated math, no heaving lifting. Simple. Basic. I'd be willing to bet elementary school students, given these simple guidelines, could figure-out how to do it, even in today's environment of low standards and "everybody gets a trophy" schooling.

And yet, in every fvcking election, in virtually every Democrat-run-for-generations 3rd-world sh*t-hole in this country, nominal adults utterly fail to properly administer this painfully simple task - a task the the "hicks" and "hillbillies" in "fly-over country" seem to be able to pull-off year after year without incident.

And to top it all off, these cities, with their Austrian-precise bureaucracies, have massive departments who have precisely ONE. FVCKING. JOB. - and that's to run an election 1 or at most 2-3 times a year.

Still can't do it without fvcking it up.

So I ask you - is it because these nominal adults are simply incapable of completing this routine, basic, simple task?

Or because the inability to successfully complete this routine, basic simple task is built into the cake so they can cheat?

Because I can't think of any other reason.

And I also can't believe we have put-up with this shiite for as long as we have.

As for the snow, yes, it doesn't so much melt, it evaporates, at least in the city areas. The sun comes out and you can watch the white stuff steam off the pavement. But it's been said that snow has been recorded falling somewhere in the state every single month of the year, so you can find some.

371 Be careful about being too presumptuous. I'm of the firm belief that Trump did not win, but rather, Hillary lost.

If the dems field a competent candidate, I would not hesitate to worry about losing that senate seat. This was not a referendum on the democrat party, or liberalism in general. It was just people looking at Hillary and being unable to stomach voting for her. She's a skunk.

If she weren't a skunk, the dems likely would have mopped the floor with Trump.

Reason I say this? There wasn't really a big change between who voted for Trump and in what numbers, white men turned out in about the same numbers they did for Romney. There were just about 10 million less voters that turned out, and those that didn't turn out were almost all the types who would've cast a vote for Hillary, but just couldn't, because holy shit - who could?

To a certain extent I agree. But add in a couple of factors: 1-a sense of optimism. That things could change. America could make a comeback. Not unlike the first Reagan win. 2- a sense that we don't have to take this anymore. My son texted me that night. He said - "something's happening. It's almost like the Silent Majority again."

And yes, she was a cow.

Yup. Technically, I lived in NEPA the longest and it never once felt like home.

I do like it in NC, particularly that winter is like 10 weeks long and if there's an inch of snow everything shuts down, but Michigan is still home.

And as the tree-hugging outdoors-nut conservative hippie I am, I really love the enormous variety of flora we have here. Being in the Eastern Deciduous-Laurentian Mixed transition tree zone, we have such a huge variety of trees here and the wild food foraging can't be beat.

Whenever I'm in the Rockies or the high desert, much as I love 'em, it seems to this Easterner like there's only a half dozen kinds of trees! Which isn't far off the mark, comparatively. And the wild foods foraging sucks compared to here. But I can make adjustments.
