Second, cross-pollination between the sites probably increases ad traffic slightly, which generates more income. And finally, if one site posts on a controversial news topic, the other sites can cite the first one as a source instead of looking like they're just making stuff up. They used to have -- fifteen years ago anyway -- some website where you punch in a url and it would calculate the value. I had a blog at the time, good links to from, decent traffic for a lowly blogger. 25, 000 - 50, 000 views per month. They valued it at $15, 000. I will never agree with a system that can award millions to a guy based on banging his best friend's wife on film away from his own private residence. I may personally like that Gawker was destroyed but I don't think the Hulk deserved a dime. Further it really bothers me that Hogan fought to only pay a pittance in comparison to the guy who was crippled by his son.

Gawker and their sites was kind of a guilty pleasure for me, but I don't know if the court got it wrong here. Big difference in some celebrity making a tap on purpose and "leaking it" and then objecting to it for a payment/settlement, and someone who was taped against their will and has no recourse when it goes public because they are famous. Second of all, the case isn't even about free speech, it's about freedom of the press. Furthermore, the entire basis of the case is based on the violation of Hogan's privacy and the Gawker profit motive in publishing it. The fact is, civil court is not based on someone "breaking the law". The court that ruled in Hogan's favor didn't rule that Gawker broke the law, but that they violated Hogan's privacy and were liable for damages due to Hogan's anguish and potential lost business interests. The only way "freedom of the press" enters this is not because the court is somehow enforcing a law that diminishes that freedom, but only in that they are enforcing a civil judgement that can be argued is an affront to that freedom. The truth is, however, that it was the publishing of the video that was an affront to common decency. The fact is that freedom of the press doesn't even really protect the press from fault if they impact another private party because it doesn't involve any law that Congress has made that restricts freedom of the press. It is only a general deference by the courts towards the press that they voluntarily restrain themselves from passing judgement against the press. In this case, however, there was no compelling public interest in Hogan's sex tape, and therefore, no shade from "freedom of the press" for Gawker to hide behind.
