Gawker.com to End Operations Next Week

Univision bought six of the Gawker company websites for $135 milion (are you kidding me?).

But I guess Gawker is a damaged brand that Univision won't be continuing.

Gawker announces the end of business here.

After nearly fourteen years of operation, Gawker.com will be shutting down next week. The decision to close Gawker comes days after Univision successfully bid $135 million for Gawker Media’s six other websites, and four months after the Silicon Valley billionaire Peter Thiel revealed his clandestine legal campaign against the company.

Nick Denton, the company’s outgoing CEO, informed current staffers of the site’s fate on Thursday afternoon, just hours before a bankruptcy court in Manhattan will decide whether to approve Univision’s bid for Gawker Media’s other assets. The near-term plans for Gawker.com’s coverage, as well as the site’s archives, have not yet been finalized.

I see him as neither a good guy nor a bad guy. He's a guy in a feud with Nick Denton, and used lawfare as a tactic. Denton is reviled, so people are happy to see him lose. But, I'm not so sure Denton won't prevail in the end.

There were many people who were happy to see Larry Flynt lose against Falwell, but Flynt came out on top of that legal battle when all was said and done.

A few reasons.

First, it allows them to set up slightly different websites that appeal to different target demographics. Second, cross-pollination between the sites probably increases ad traffic slightly, which generates more income. And finally, if one site posts on a controversial news topic, the other sites can cite the first one as a source instead of looking like they're just making stuff up.

It's actually worse than that. The character you're playing doesn't actually have a rendered model in the game, from what I'd heard. And in the current patch, even when you're on the same spot of the same planet with another player, you can't see them.

They used to have -- fifteen years ago anyway -- some website where you punch in a url and it would calculate the value. I had a blog at the time, good links to from, decent traffic for a lowly blogger. 25, 000 - 50, 000 views per month. They valued it at $15, 000.

Now I don't know who and the hell would buy it, but it was kinda nice to think it had some value.

Not so fast.

First, the $135 million generated from the sale of Gawker Media's assets to Univision in August will go into a fund overseen by the bankruptcy court. Secured creditors, including Silicon Valley Bank, will be paid about $22 million-but then the rest will sit there until the appeal is sorted out.

When the NYT published the pentagon papers, they were in the clear because there was no evidence that they were involved in the break-in where the papers were stolen.

When various outlets published that phone call of Newt Gingrich, they were in the clear because they were not the ones who violated the law when the call was illegally recorded. They just published it when they got their hands on it after the fact.

It's a real grey area in this case though, my understanding is that Hogan wasn't aware he was being filmed, and Bubba the love Sponge is kind fo a degenerate who I guess would have his wipe sleep with people, and film it without there knowledge.

The Gawker defense was that Hogan made his sex life public so it was fair game, if it's true thought that he was filmed without his knowledge, than I think he had a fair case. I guess the issue is did Gawker know this at the time, I guess they didn't, but when Hogan lawyers asked them to take it down they refused.

Then it all devolves into is there a difference between the public character of Hulk Hogan, and the real person of Terry Bollea. I think that's even murky because of the reality shows.

Then there is the whole racist rant he went on that they caught on tape by accident while filming him. Which destroyed his reputation further and seems to have ruined his relationship with WWE.

Gawker and their sites was kind of a guilty pleasure for me, but I don't know if the court got it wrong here. Big difference in some celebrity making a tap on purpose and "leaking it" and then objecting to it for a payment/settlement, and someone who was taped against their will and has no recourse when it goes public because they are famous.

First of all, despite hating the cliche, the free speech exemption for yelling "Fire" in a crowded theater isn't mentioned in the Constitution, either, but is pretty well recegnized as not being allowed under the first amendment.

Second of all, the case isn't even about free speech, it's about freedom of the press. Furthermore, the entire basis of the case is based on the violation of Hogan's privacy and the Gawker profit motive in publishing it.

The fact is, civil court is not based on someone "breaking the law". The court that ruled in Hogan's favor didn't rule that Gawker broke the law, but that they violated Hogan's privacy and were liable for damages due to Hogan's anguish and potential lost business interests.

The only way "freedom of the press" enters this is not because the court is somehow enforcing a law that diminishes that freedom, but only in that they are enforcing a civil judgement that can be argued is an affront to that freedom.

The truth is, however, that it was the publishing of the video that was an affront to common decency. The fact is that freedom of the press doesn't even really protect the press from fault if they impact another private party because it doesn't involve any law that Congress has made that restricts freedom of the press. It is only a general deference by the courts towards the press that they voluntarily restrain themselves from passing judgement against the press.

In this case, however, there was no compelling public interest in Hogan's sex tape, and therefore, no shade from "freedom of the press" for Gawker to hide behind.
