Peter Thiel Secretly Funded Hulk Hogan Lawsuit As Vengeance for Gawker Outing Him as Gay

Vengeance is expensive, but worth every damn penny.

A billionaire Silicon Valley entrepreneur was outed as being gay by a media organization. His friends suffered at the hands of the same gossip site. Nearly a decade later, the entrepreneur secretly financed a lawsuit to try to put the media company out of business.

That is the back story to a legal case that had already grabbed headlines: The wrestler Hulk Hogan sued Gawker Media for invasion of privacy after it published a sex tape, and a Florida jury recently awarded the wrestler, whose real name is Terry Gene Bollea, $140 million.

What the jury -- and the public - -did not know was that Mr. Bollea had a secret benefactor paying about $10 million for the lawsuit: Peter Thiel, a co-founder of PayPal and one of the earliest investors in Facebook.

A 2007 article published by Gawker’s Valleywag blog was headlined, "Peter Thiel is totally gay, people." That and a series of articles about his friends and others that he said "ruined people’s lives for no reason" drove Mr. Thiel to mount a clandestine war against Gawker. He funded a team of lawyers to find and help "victims" of the company's coverage mount cases against Gawker.

"It's less about revenge and more about specific deterrence," he said on Wednesday in his first interview since his identity was revealed. "I saw Gawker pioneer a unique and incredibly damaging way of getting attention by bullying people even when there was no connection with the public interest."

"It's not like it is some sort of speaking truth to power or something going on here. The way I’ve thought about this is that Gawker has been a singularly terrible bully. In a way, if I didn’t think Gawker was unique, I wouldn’t have done any of this. If the entire media was more or less like this, this would be like trying to boil the ocean." Mr. Thiel said he had not targeted any other media companies.

Apparently there were rumors about this previously, which were dismissed as just conspiracy theories. But the rumors began when Hulk Hogan's legal team specifically did not mount an allegation for which Gawker's insurance company would be compelled to cover their losses -- that is, the lawsuit was designed not to suck money out of an insurance company, but specifically to deliver a lethal blow to Gawker.

Well, had I known that, I would have bought into the conspiracy theory too. That is a very strange decision.

It looks like the rumors were right, but you don't need a conspiracy theory for your legal team to decide on this tactic.

Preventing the defendant from claiming on its insurance policy means that the defendant needs to front the costs of the litigation itself -- that can be valuable settlement/bargaining leverage, particularly where (as here) the plaintiff is seeking something other than a monetary recovery.

Gawker's insurance was structured in such a way that some claims were covered and some weren't, but the defense against all claims would be paid by the insurer if there were covered claims at issue in the trial.

In a beautiful move, Hogan's lawyers subpoenaed a copy of the policy and immediately dropped the claim that obligated the insurer to pay Gawkers trial costs. Then Gawker immediately tried to settle the case, offering "substantial sums" to make it go away and avoid paying lawyers, and Hogan said "no thanks".

All in all, this was crafted to inflict maximum pain on Gawker and Denton.

80 Yeah, this puts it on Gawker to collect indemnity from their insuror--Bollea isn't a party to that discussion. I know these insurance companies--they'll claim outing Bollea was "not a part of Gawker's daily work activity" or some shit and make Gawker battle their lawyers for every dime.

If Theil and Hogan had asked the insurance company to be a party to this, they'd have been wrapped up for years trying to keep the insurance in the case, 'cause that's where the big money is. But they don't care about max payout as much as max pain.

Production of insurance coverage info is routine in a civil lawsuit.

To be fair, most conservatives have been conditioned to think that any discussion of the gay lifestyle/rights/marriage, is merely a foil used to push a liberal worldview. Tends to make people a bit edgy and wary.

On the other hand, I think people do not really understand that for the left, gay people are no more important than black people. They are merely a way to get people to destroy the establishment- whatever that might be. If there was a monolithic gay conservative movement, then they would be against them too. And they are in the case of log cabin republicans or people like Milo.

You have to be able to complete the loop, which is to say, if you are able to identify the common attributes that predominate a group, you also must be able to identify the outliers, or in some cases, not just outliers, but the sometimes large minority.

I can see how that would be a temptation, because of how frustrating things can be but... people are always individuals, not groups. The left really wants everyone to perceive each other only as groups, but we're not. Even each of us in the horde have different opinions and can get into nasty fights over stupid little stuff (and misunderstandings that grow).

There's no "gay" group out there, there's no "black" group. There's just folks.
