Harvard, Columbia Law Students Demand Postponements of Winter Exams, Citing Heart-Ache Over Michael Brown and Eric Garner Decisions

I'm sure there are things that are more disqualifying in terms of future employability than the claim that one is so psychically discombobulated by happenings in the national news that one cannot do one's job without incurring unacceptable levels of mental hazard, but I'm quite sure I can't think of any right now.


The push to delay law school final examinations in light of the Michael Brown and Eric Garner cases has spread to Harvard Law School, as administrators at Georgetown University Law Center said students could seek delays on a case-by-case basis.

Columbia Law School was the first to allow students to ask to postpone their exams.
Students calling themselves the Harvard Law Coalition sought the delay as well as discussions about inequality....

Columbia's decision hasn’t gone over well with some people, and conservative publications including the Daily Caller and the New York Post ran critical stories.
George Mason University law professor David Bernstein said the delay infantilizes law students and is unfair because some students will have more time to study for exams than others.

"I can't imagine why any law student would admit that hearing about a seemingly unjust legal decision incapacitates them; how would such people function as lawyers, given that many verdicts deeply disappoint advocates for one side or the other?" he said.

Indeed. So like when one of their motions is denied on a case that has emotional resonance for them, they're gonna do what, refuse to show up for trial until the judge adopts a more understanding posture?

Those Harvard students have produced an open letter in which they demand that their examinations be delayed. "Like many across the country," its authors claim, students "are traumatized" and "visibly distressed" -- to the extent that there is now a "palpable anguish looming over campus." The "national crisis" that has been provoked by the cases of Garner and Brown, they argue, has left them with no choice but to "stand for justice rather than sit and prepare for exams." And, like their brethren at Columbia, they contend that their "being asked to prepare for and take our exams in this moment" amounts to their "being asked to perform incredible acts of disassociation" -- requests, which taken together, have led them "to question our place in this school community and the legal community at large." The bottom line? That students must be given "the opportunity to reschedule their exams in good faith and at their own discretion."

Ugly as the Brown and Garner cases were, one can't help but feel that what constitutes a "National Emergency" or a "personal crisis" is being rather dramatically defined down here -- possibly to the vanishing point.

We huddled over our hornbooks, dumb-struck, mouths agape, barely able to string together phrases like "sufficiency of the evidence." Final exams were breathing down our necks, a mere 6 weeks away, but they mattered not, for our legal souls had been wounded.

These were dark days indeed, I can assure you. None but those who endured it can speak of it truthfully, but SOMEHOW we managed to pull through. With grit, determination, a few cocktail parties, and the help of a recipe book for specialty New Orleans-style drinks that I bought from a bookstore in the lower Garden District, we soldiered on.

And we drank. Drank well we did.

Fairly sure I got laid, too. The bartender always gets laid.

I was teaching a large sophomore class. We had an exam scheduled for that evening. I wanted to postpone it a day or two, but my co-instructor (who was course director) wouldn't. We had a couple of students who had family in the Pentagon. They received postponements, obviously.

Kids seemed to do no worse than usual, btw. So I guess Big Ten sophomore biology majors are made of sterner stuff than Ivy League law students.

To postpone a final exam, and to allow the students to individually schedule the makeup exam, is a BFD.

89 I was a third year law student at UC Berkeley in the spring of 1968. Bobby Kennedy was assassinated the night before my conflicts of law final exam. The professor--a good lefty--told the class at the start of the exam that anybody who was "too upset" by the RFK assassination didn't have to take the exam--and she would see that the "non takers" would get a fair grade. Some took her up on the offer. I didn't. I was prepared, and I was ready to take the exam. I checked my carcass--didn't have any bullet wounds, so I was good to go as far as the exam was.

Fast forward several years and a trial that I'd spent two years preparing for and working on came out with a result I didn't like (my client was awarded significantly less than I had asked for--but OTOH significantly more than the other side had offered). Now that was a blow--and for a few hours I really didn't know where I was. However two days later I started working on the appeal. I read an article a while back about the 1% and how that term is kind of meaningless since a 30 year old in the 1% is different than a 60 year old or if you live in Kansas vs San Francisco.

Anyway they had the breakdown of what 1% meant by age over time. And it turns out I was an evil 1%er back when I was in my late 20s/early 30s. I ruled the world but was too drunk most of the time to realize it. Damn it!

And I too went to a top MBA, but the 1% money really came because of where I went for my undergrad, which led to my first job out of college at the "right" company, which led to knowing the person who hired me post-MBA.

The MBA is a requirement of sorts to get those types of jobs, but usually you don't get the jobs BECAUSE of the MBA.

219 When I was in the ninth grade a girl in my school was killed in a car accident. The school got a bus so anyone in the class who wanted to go to the funeral could. I didn't know her, but went to the funeral anyway. It was that or go to Algebra.

Law students at elite schools using the deaths of people they don't know (and, frankly, wouldn't want to know) in order to get more time to study for exams reminds me of that.

(And, yes. I fully expect to go to hell for going to a child's funeral just to get out of Algebra.)

I failed anyway, but I remember thinking I was benefiting from the tragedy by getting a few extra study days, who could have studied. This was at a federal academy that was prepping to take triage patients all day, we never got any. I was supposed to direct ambulance traffic at the gate.

I've had to do that. My father was in the hospital and wasn't expected to live (thankfully against all odds he did), during finals week for both my sister and me. We both had finals delayed, but it was serious enough that we probably would have taken an incomplete and taken the classes again if need be.
