It highlights perfectly a now baffling appeal to trust, as well as dipping into "ends justify the means" territory and supporting it with strawmen. It starts out with the appeal to trust, right in its sub-headline: Should we dismantle a super-valuable law enforcement tool just because it's theoretically possible to abuse it?Set aside for a moment that the risks are demonstrably not merely theoretical. The position itself is baffling. If anyone has not learned over the past decade that there is no daylight between a potential risk and a realized risk when it comes to government operations, that person is engaged in self-delusion. But the article doesn't jump right in. In traditional fashion, it starts with a harrowing tale of a violent crime where the offender was found thanks to an ALPR system. There has to be some gut-tugging pathos right up front if the reader can be expected to ignore all of the problems to follow. If it saves just one life, dotchyaknow. After the emotional hook comes the false equivalence: that this is really no different from running a plate during a traffic stop, it's just a teeny little bit broader: ... Officers routinely consult computer-aided dispatch records; driver and vehicle databases; the National Crime Information Center (NCIC); the Interstate Identification Index (III); and various local, state, and regional intelligence systems. These resources allow officers to perform a wide array of investigative tasks. Officers routinely use them to identify wanted persons, locate stolen property, review criminal histories, and share intelligence with other agencies. An ALPR database performs a very similar function. At its most basic level, it records that a publicly displayed license plate, attached to a particular vehicle, passed a particular location at a particular time. ... Thus, consulting an ALPR database is not fundamentally different from querying a license plate or driver's license during a traffic stop or checking a suspect for warrants. Each task involves access to information for a legitimate law enforcement purpose. ...Sure. Pull the other one. It jingles. These things are obviously not the same. One usually involves a traffic stop or, at least, human effort. That requires either a reason to engage in the query (the traffic stop) or enough desire to manually collect and run license plate numbers. Throwing out acronyms and drawing false equivalencies doesn't help the argument, but it does help confuse the issue - and so the tactic is useful. Much later in the article comes the acknowledgment that these things are in fact different, but with an assertion that the difference should be ignored and can be obviated through arbitrary distinctions: A routine license plate check begins with a vehicle that is already encountered by an officer. By contrast, ALPR cameras automatically collect the plate information of all vehicles that pass by. A network of cameras can then assemble those observations much more efficiently than individual officers watching traffic. One concern that has been expressed is that ALPRs can be used to reconstruct one's location and activity history. This is a legitimate concern, and the solution is to adopt rules suited to the scale to which an ALPR system is used. Although a single ALPR hit is not the same thing as GPS tracking, broad or prolonged tracking should require a higher level of approval. In some cases, warrants should be required. However, short-term searches for a stolen car are not the same as reconstructing months of someone's movements.In this case, they are the same. The dragnet is there and the panopticon is built. Setting a time limit on queries that needs a rubber stamp to override it is not a solution. To think it could be a solution is to still be burdened by institutional trust. That the writer has this burden is obvious from elsewhere in the article: Every useful technology comes with risks. An officer can misuse a driver's license database to obtain an ex-girlfriend's address. A dispatcher can access criminal history or CAD notes without a legitimate reason. A detective can leak confidential information to a friend. Such conduct is already prohibited, and many officers have lost their law enforcement certifications and have been prosecuted for improperly accessing restricted information. The problem with the "misuse" objection is that it proves way too much. If possible or actual misuse is enough to stop the public implementation of some technology, then it would apply to almost every government tool or power that has ever been used (whether in a criminal, civil, or administrative context). ...Your terms are acceptable. Getting rid of ALPR systems would be a good start on a wider stand-down of mass surveillance technologies. The more the merrier. None of it - and none of its operators - can be trusted. "Misuse" (which I increasingly think is the wrong word, since these systems appear to be designed to be used in the "wrong" way) is not a risk, it is an inevitability - and it occurs almost immediately. The entire class of thinkpieces from "conservatives" trying to rationalize mass surveillance technology with a rich history of egregious behavior by its operators is baffling. What about mass surveillance is suddenly rock-ribbed? Nothing. It comes from, I think, two sources. The first is vestigial trust, the belief that the system can be "safeguarded against abuse." It can't. Recent and more distant history does not show any success in safeguarding any system against abuse, which is why good systems design aims for systems that are smaller rather than larger and decentralized rather than centralized. Outside of a poorly-construct and weak appeal to non-existent trust, I think there may be something more pernicious involved in some this: short-sighted faith that it's okay because "we're in charge." If you didn't click the links, go read the EFF and ILJ reports I referenced just below the fold. EFF in particular chose to cherry-pick specific abuses that are mostly around communist agitators like "No Kings" and abortion clinics while the ILJ focuses more on immigration and personal abuses like stalking, with no mention of any of these dragnets going against conservatives. Reports like these help provide a false sense of security to the "other side" - these systems are working for you! Comfort in advocating for these systems simply because "your side is in charge," if that is part of it, is short-sighted and foolish to the point of stupidity because even if it's true - and it isn't, as the last decade thoroughly demonstrates - "your side" will not be in charge forever. Articles like this one that extol putative benefits but not the record of abuses, choose "safeguarding" and "rules" as a solution, hearken back to a world of trust that no longer exists, set up strawmen and drift into "the ends justify the means" territory on the back of bloody pathos are themselves prime evidence of core weakness of argument. Universal mass surveillance dragnets are a bad idea, are designed to be "misused" and are antithetical to liberty - and mental gymnastics in weak thinkpieces can do nothing to change that Comments(Jump to bottom of comments)1

I think a warrant should be required every time any agency conducts a data base search of the traffic cameras. While no one is entitled to privacy outside of their home we have the right not to be surveilled by the state when we go about our business unless the police have a reasonable suspicion that we have committed a crime. I get the argument that Flock is merely a tool, and we should trust the police because - well, just because. One could say the same thing about the potential for abuse by having ANY police department. The only real solution is to have draconian punishments for abuse of the public trust, but we've seen how that's worked out over the last 10-20 years. That's why trust has been lost.

As I mentioned upthread; many of the database searches from outside agencies have "no reason given" as the, you know, reason the search is being conducted in the first place. Why? If there's no legit reason to browse a cities' Flock or other security camera network's data... why are they allowing it?
And then have the municipal government entities who approved the surveillance systems to explain the placement criteria. Why is a camera pointed at a kiddy pool? At a gun store? At a night club? Wouldn't those places have their own security devices inside the perimeter? That the municipalities are unwilling to discuss any of that in public is sort of telling. We need a.new national discussion on privacy (ha!!) that focuses on penalties for misuse of the various ways.modern technologies have voided the traditional expected availability of a private life.
One strike and you are out, whether local cop with a jones or a clique of upper level national security or FBI types. All the focus on privacy should be on punishing those who violate it, thus inhibiting the victims clear constitutional rights. And Judicial authorizations should be subject to same scrutiny and punishment. You should be able to sue judges and officials, and burden of proof should be on them. Better-half once got a ticket from Tucson, our jeep driven by our son got caught by a photo radar trap. The ticket came to her with our son's picture and a copy of her license with the F crossed out an and M hand written. She ignored it, got a subpoena, went to court, the judge says you aren't male throws the ticket out and tells her to pay for the cost of the subpoena. She objects on the grounds it shouldn't have been issued in the first place. The judge attempts charge for additional BS, she stands her ground and judge all waves fees (while the court recorder smirks). She asked about the original fraud but couldn't get anywhere. sigh. I don't buy the privacy argument because when you are in public you have no expectation of privacy. However the abuses of the technology is the problem. Stories about cops stalking their ex's and present girlfriends makes a strong argument against these cameras. I live on a main street and there is a school diagonally across from me about 100 yards away. The city installed cameras to monitor speeding in the school zone for 'safety". I don't see it being any safer, but the city makes a lot of money from tickets. The cop is expected to make at least an attempt to provide notice that they believe you have broken the law immediately at that time. You know immediately what you will need to compile to prove otherwise. Even if you cannot prove otherwise or the courts do not later accept that proof, you personally know the truth of what happened.
None of this is true when you receive an accusation a month later, or two months later, with nothing but a few photographs at best documenting the crime. Unless you are someone who thinks constantly in terms of alibis, there is rarely anything you can recall from that specific moment and place to successfully counter the accusation even in your own mind, let alone that of the court. Any tech used by law enforcement can be abused. It doesn’t mean we shouldn’t use its it means put better guardrails to prevent abuse. It will never be 100% but no system is. As a society we routinely tolerate negatives from a system/process because the positives vastly outweigh them. 40k people die in car crashes every year but we don’t get rid of cars as an example.

Another consideration with surveillance systems is this; when an erroneous "hit" on someone is used to issue a ticket or summons, it typically requires the target to prove otherwise.
For example, a license plate with an "8" on it that is confused with a "B". Imagine the mistake leads to thinking the person in question, or the vehicle, is involved in something other than a speeding or parking violation. The speeding or parking is minor. Yet, if you're compelled to appear in person, your time is consumed with arguing about the validity of the data used to issue the citation in the first place. Not whether it's your fault or not. So everyone knows where I'm coming from, I have often felt that license plates on cars are a violation.
In CA they have a law (had?) that you get (I think) 6 months before you have to put a real plate on a car. 6 months of no plate for new cars. So tech billionaires would buy a new car every 6 months to keep their car anonymous. I don't mind cops being able to ID a car ***after**** it is found suspect of a crime (speeding or whatever) but the plates reveal ID *before* hand and that feels like a violation of the 14th. They get around that of course by claiming that driving is a "privilege" and not a right. Fuck them. That may have been true in 19th century but it is now a necessity to live. Better-half once got a ticket from Tucson, our jeep driven by our son got caught by a photo radar trap. The ticket came to her with our son's picture and a copy of her license with the F crossed out an and M hand written. She ignored it, got a subpoena, went to court, the judge says you aren't male throws the ticket out and tells her to pay for the cost of the subpoena. She objects on the grounds it shouldn't have been issued in the first place. The judge attempts charge for additional BS, she stands her ground and judge all waves fees (while the court recorder smirks). She asked about the original fraud but couldn't get anywhere. sigh. My ideal system would have a constantly changing QR code on every car, revealing a crypto key that allows someone with authorization to query the car for ID but only if (a) they know the key, which expires within seconds or minutes, and (b) they have the authorized equipment which is restricted to trained and licensed authorities only to be used with probable cause.
Use of equipment would be audited and cop would have to explain the probable cause for each use. No one in public would be able to ID a car or see license, just the useless qr code. A routine license plate check begins with a vehicle that is already encountered by an officer. By contrast, ALPR cameras automatically collect the plate information of all vehicles that pass by.
It allows someone to be followed without any sort of limit. Quite simply, if an individual officer followed someone all day, gathering the information a Flock system can gather, unless the officer was actively investigating said person, the officer would be guilty of harassment and possibly stalking. If a department used several officers, stationed around town, to do the same thing, it would definitely be harassment on the part of the department. Talking about "rules" means nothing without a thorough accompaniment of how vigorously those rules are employed and enforced. Every State has robust rules against voter fraud, but without enforcement the fraud goes rampant. I wholly reject the concept of "no expectation of privacy in public spaces." Unless I am in the act of committing a crime, or it is reasonably inferable that I am going to commit a crime, I have EVERY expectation of privacy in a public space. The Constitution says that the government cannot take any interest in me without a warrant. We need to return to that standard. Enforceably.
