Declining Standards

There are many reasons that naysayers looked at the prospect of state-sponsored "assisted suicide" with everything from trepidation to open horror. These reasons range from the religious to the moral to the pragmatic, but there have been many objectors wherever such notions have been floated. In this country, it's a state-level consideration. In other countries, like Canada, it's national. More states and countries every year enable it, and the naysayers now have the records of places where it has already been done to point to.

One thing that state-sponsored "assisted suicide" has demonstrated is that on this particular topic, the goalposts aren't merely mobile, they have wheels and powerful engines to propel them down the field. Yesterday, Ace posted an ad from Canada, encouraging that country's flavor of euthanasia (called MAID) by extolling the virtues of offing yourself. In his Morning Rant yesterday, CBD mentioned the legal battle over what became Spain's youngest person killed through its euthanasia program.

In Canada, MAID's goalposts have been moving rapidly. It took just five years for Canada to mash down the accelerator on MAID. When passed in 2016, MAID required a 10-day "reflection period" before a person could be eligible. This was repealed for terminal patients in 2021, and they installed a MAID express lane. There is still a waiting period for MAID's "Track 2" participants - which is for those without "forseeable death" - but it can also be waived. From "death as a mercy" to express-lane, state-sponsored killing in five years. Impressive.

But it doesn't stop there for MAID. MAID still doesn't kill citizens suffering only from mental illness. That is changing. It was supposed to change last year, but there was enough objection that it's been deferred until 2027. But they will get there, and open a whole category of people who can be killed by the state. Sure, it requires consent - but as we see reported frequently, MAID is enthusiastically offered to those seeking medical treatment and - unlike many other medical treatments in Canada - MAID acts fast. The slope is slippery indeed.

Colorado also passed its euthanasia law in 2016. Unlike Canada, it took longer to start moving the goalposts. It wasn't until 2024 that they cut the waiting period in half and added a waiver process to skip the waiting period if the prescriber thinks death is imminent. That same year, Colorado also expanded who can prescribe the drugs to include Advanced Practice Registered Nurses in addition to doctors. This latter change was made specifically to cover doctor-scarce rural areas. Vermont passed its euthanasia law in 2013 and also took longer to start moving the goalposts. In 2022 they "expanded access" by eliminating one of the two waiting periods, allowing remote diagnosis ("telemedicine") and opening eligibility to non-residents. In neither state is it available for mental illness, nor can the doctor administer the drugs - but I will be surprised if it takes more than five years to get there under the banner of "expanded access." After all, neither state made it even a decade before hitting the accelerator.

Then there is Spain. Spain was comparatively late to the party, not legalizing state-sponsored euthanasia until 2021. Spain does still have a waiting period, but also permits it for mental illness. That permission is not explicit, but it is nonetheless permitted. A mere three years after the law's passage, the Spanish parliament attempted to make it explicitly permitted. The attempt failed - probably because it wasn't necessary - but many in Spanish government wanted to make it very clear that they will help you off yourself for mental illness. They learned from their forbears to be expansive, but wanted to make it explicitly expansive just in case they can help shuffle more people into the grave by doing so.

The reason I looked into this further is the same case that CBD discussed yesterday. In that case, a mentally-ill young woman named Noelia Castillo Ramos became the youngest person in Spain to die by assisted suicide, and it was for mental illness that was exacerbated by sexual assault. Her family sued to prevent it, citing mental incompetence. The court ruled that she was competent, and so it proceeded. That makes sense as far is it goes, but I was curious as to why the lawsuit was about competence rather than diagnosis, why the argument was that Ramos couldn't make that choice, rather than because it was for a non-terminal illness. That is when I learned that it needn't be for a terminal - or even physical - illness in Spain. Competence was the only avenue available to fight it.

The press and politicians happily ignored those who objected to these laws. The press wrote off the moral and religious objectors as atavistic cranks, and declared that the pragmatic objectors were arguing in bad faith. The pragmatic objectors to state-sponsored euthanasia are perhaps the most interesting, because they feared exactly this ratcheting expansion even if they didn't have moral or religious objections to the idea of a "mercy killing." The pragmatists were proven correct as everywhere such laws have been implemented, the requirements are subsequently loosened. Wait less. Make diagnosis easier and faster. Expand the list of eligible conditions. Once permitted at all, the steady march toward expansion, acceleration, popularization or - G-d forbid - a mandate immediately began.

Encouraging citizens to die is too great a temptation for the state. Once that door has been opened, it not only can never close, it can only open wider. Whether through misplaced empathy, financial considerations or simple malice, the standards and restrictions always decline and - like abortion - what started as "safe, legal and rare" becomes the heavily-encouraged first choice.

Also, I hope that our Jewish Hordelings have a good Pesach (which begins tonight) and that our Christian Hordelings have a blessed Good Friday and a happy Easter!

In both programs, doctors could prescribe death by removal of all assistance, including food and water, without the family's awareness or consent.

With LCP, it was the doctors that finally revolted. The program was set up with participation goals and bonuses to hospitals that exceeded goals. Hospital administrators were harassing doctors, telling them to kill more and more patients to reap the financial rewards. They were essentially killing senior patients who were annoying, without family to protect them, and those with mental disabilities.

How much of it is really suicide?
When the state controls what medical treatment is available to you, such as in Canada and the UK, they can essentially tell you your only treatment they will approve is MAID.

As with the trans movement, I would imagine a good portion of these participants are vulnerable people being preyed upon by ghouls.

The State is killing someone, albeit one is presumed innocent, the other found guilty of their crimes by their peers.

Interestingly enough -- there is no problem getting the drugs for someone to punch their own clock, but getting drugs to administer in a death penalty execution is......difficult.

I presume those who are all in on assisted suicide -are OK with the death penalty?

Physician Assistants (PAs) and Nurse Practitioners (NPs) are filling the gap because there is a dearth of primary care docs. Both can write scripts and depending on the state, may not require a supervising physician.

I know that there are a lot of things about it that are mere convention, not a mandatory rule, like the "blue slip" approval for nominees in a Senator's state. I think the President pro tem is another one, and Majority Leader Thune apparently just let the Senate go on two-week vacation. So.

As the Constitutional President of the Senate, could Vice-President Vance force the Senate into formal recess, when they don't have a physical quorum present to prevent him? They've been doing some cutesy formal nominal sessions to prevent President Trump from being able to make recess appointments the way every other President has been able to do, and I'm wondering if it's mere courtesy that is keeping the Administration from forcing the issue, or if the President pro tem actually has that much formal power somehow.

As the Constitutional President of the Senate, could Vice-President Vance force the Senate into formal recess, when they don't have a physical quorum present to prevent him? They've been doing some cutesy formal nominal sessions to prevent President Trump from being able to make recess appointments the way every other President has been able to do, and I'm wondering if it's mere courtesy that is keeping the Administration from forcing the issue, or if the President pro tem actually has that much formal power somehow.

When the pain started to get really bad, the doctor prescribed morphine patches. She told Mom she did not want to use them because she did not want to get addicted. Mom asked what it mattered now (she was terminal.) I did not understand then and agreed with Mom.

I understand a lot more what Grandma thought at the time. That kind of decision is one in which you are giving up. You are essentially surrendering to death but still walking and talking.

A friend of mine in the neighborhood is a physician. We were chatting once about my back problems, and he got really exercised about the extent to which non-doctors are now substituting their relatively untrained opinions for those of doctors, who as he point out, have many years more training. It wasn't a matter of money for him; he's retired, and a very moral person to boot, he thought it was unconscionable and risky for people who can't afford more.


And that's why I think AI will soon dominate medicine (in some areas, it sort of already does). I don't worship physicians as our parent's generation did, and I think diagnosis is something that can ultimately do a better job than a human, although you'll want to keep a human in the loop for awhile yet.

There is only so much space to train them, and even then schools are doing everything they can to make sure once enrolled you graduate. The clinical requirements are extensive, you cannot magically create more supply to provide them proper training.

That is why NP's and PAs have become more popular in basics family practice settings. Quicker, less clinical training, work on training on the basic stuff most patients will present with. Once it goes beyond that, the doc should step in.

No insult to NP and PA's, but they're not equivalent to doctors, no matter how much bureaucrats want us to believe.

My dad is a retired doctor (another bias), and in a medical journal (can't recall which one) a few years back, they did a study of a large medical practice that was moving more patient visits to NP's to save money. They discovered that it actually increased costs because the NP's were less sure of their diagnosis and ordered many more tests that the doctors. Totally unexpected result.

175 What's funny about MAID is that there's an ENTIRE huge bureaucracy for mental health here too. Commercials air relatively often. There are plenty of hotlines to call. Suicide for serious stuff and talk lines for others. A lot of them.

I have called. Caregiver PTSD is actually a thing. I'm not a medication guy. I've been to my doctor about twice in 10 or 12 years. But he called and gave me meds. And a lady has come three times as I deal with anxiety that just popped up.

I believe that mental health bureaucracy was already in place. It's a government system designed to help people in crisis so you know it's not getting cut. And you have the medical system and MAID on the other side.

One bureaucracy to prevent suicide. The other to help you accomplish it. Weird.

AI actually will do a poorer job of diagnosis, because they won't be able to take what a patient says into consideration as well as a human. Templates already exist to determine what to do with the diagnosis, I would expect AI to speed up that process and probably reduce the need for back office types. Where AI will excel will be in surgical activities, radiology and such. It will probably wipe out over half the diagnostic radiologists, and will completely change what a surgeon does.

There are good and bad ones as in any profession.
There are legitimate errors and errors because of not paying attention. In our case, it was the latter. My husband's frequent visits with the PA's diagnoses all over the map and nothing working merited his attention. The cancer was found thanks to internal bleeding and him vomiting blood - we were lucky he got to the ER in time. **The doctor and the PA dropped the ball.**

Templates already exist to determine what to do with the diagnosis, I would expect AI to speed up that process and probably reduce the need for back office types.

Agreed, for the time being. My point is that the day is coming when it WILL do a better job than a human, including taking into account what the patient says, and knowing how to prompt them to provide useful information. At least that's what I foresee.

It's not a popular opinion, but I've maintained from the start that Trump will lose the birthright case not because of any of the merits of the issue, but because the President does not have the power to decide an issue like this through an EO. The Court is going to reserve the issue of Constitutional Interpretation for itself, and issue a ruling on that basis.

The Bank of England defaulted during WWI, and everything in modern economics and banking since then has been an attempt to paper over that fact, or get another country to pay the debt back for them.
Even Keynes was just formalizing the practices that the BOE adopted to hide the fact that they were deep in debt and had no way out.

Regardless of any moral stance on self-offing, I'm vehemently against any govt involvement, permission or regulation of suicide. You want to end it all? Do it yourself. Hundreds of thousands of people find a way do it every year all on their own, why should you be any different?

There's something really perverse about setting up a government relationship with suicide where on the one hand they try to talk you into it and provide the means through lethal drugs; and on the other hand they operate suicide crisis hotlines where they try to talk you out of going through with it and getting you the mental health help you need to reduce or eliminate the suicidal urge.

Unlikely. Rule of Four means that four justices had to want to hear the case. If they were comfortable with the status quo, they would have just let lower court decisions stand.

Alito and Thomas are originalists. Kavanaugh is another more or less originalist. That leaves Gorsuch whose textualism is less than originalist at least on statutory interpretation cases, and ACB who claims to be an originalist. Roberts is a judicial restraint type.

My personal guess is that the Courts will strike down the executive order but throw it to Congress to fix legislatively. That eliminates stripping citizenship retroactively from anchor babies and handing Trump a win. Fits in with prior rulings on immigration law--Congress's power is plenary. Also see Indian citizenship statute.

Wrong way to read Wong Ark Kim. Basically both parents were legal residents and the son was born here while that was so. They went back to China and Wong Ark was denied reentry.

The lazy assumption since the 1920's was that the subject to the jurisdiction thereof meant jus soli so anyone could be American if they were born on magic dirt.

What they ignore is that it took an act of Congress to make Indians not taxable (reservations) citizens in the 1920's under Coolidge Administration. Coolidge's VP was actually Native American in part.

The whole impetus of the 13th to 15th Amendments were to get rid of the Dred Scott v San(d)ford decision. Too long to go into all of it but it specifically denied that blacks could be citizens of the United States whether free or slaves. And misread the Declaration of Independence to do so.

I think legislatively it is possible, but not with our current GOP types in the Senate. Public is getting more and more comfortable with sending people back, ignoring Big Business on H1Bs, and the wailing of the Dems to keep despicable people in the US is not helping the open borders cause.

Once deportations become a statistic rather than individual stories, it builds in a new Overton window. Muzzies being muzzies is another sore spot and people are tired of their shit.

I've seen that done on criminal sentencing but not in general application. Creates a lot of work there.

And to some extent, we are in this situation because Congress has abrogated its job pretty much because of the US Senate and the filibuster on any substantial non budgetary legislation.

329 Death Cafes, which began in London, UK, have rapidly expanded around the US as have positions of Death Doulas, of course.

Attended a program through the local library recently to see what it was about. Many in attendance were actually looking for grief services after losing loved ones, others were exploring the availability of hospice services and how they're paid for through Medicare/Medicaid or private insurance. Just a few attendees were looking for answers on how to be prepared for death - theirs or others.

In the end, it seemed to be a business assisting in planning one's death, from coordinating Wills & Estates, helping with Living Wills and Advance Directives, coordinating care and/or respite, assisting in the final preparations, taking some of the burden from the dying and/or their families - depending.

Green burials, etc. were discussed, but also that PA does not yet allow the practices of euthanasia or aquamation.
