We all knew this was gonna happen, there's a whole fleet of Hawaiian judges out there just frothing at the mouth to block Trump but all they are going to do is look stupid. The trick for the Supreme Court is not to overturn all this dumb crap, but for them to rule in such a way that it is clear that the judicial branch may not in any manner interfere with the internal workings of the executive department.

The US Constitution set up a system where the Body Politic, through a series of horizontal and vertical arrangements, exerts power over the government. The take a piece of that government and remove its feedback from the people, the make it apolitical and unyielding to any amount of pressure from the Body Politic, is deeply, terribly unAmerican. "Roberts and SCOTUS can immediately put these lawless judges in their place, or Roberts can watch his caseload go up 1000x and his court's precious perceived legitimacy crater overnight."
_______ SCOTUS controls its own docket and the cases it hears. Other than a few types of cases, the only way a case gets to be heard by SCOTUS is if SCOTUS agrees to hear it. The vast majority of requests to be heard -- called certiorari -- are summarily denied. So I don't think the threat of an increased docket is gonna move the needle much for Roberts. This is essentially an impeachable offense for the judge and that should be pursued. These judges swore to uphold the constitution and are alleged to be expert jurists. Yet in the “opinion” produced in a secret ex parte hearing there is no legal basis for the ruling. That’s because one does not exist. The judicial branch cannot dictate policy to the executive branch. If SCOTUS can’t find the balls to slam this shut, it should not only be ignored, it should eliminate their own raison d’etre for existing.

The judiciary and the bureaucracy are similar in that both have operated beyond scrutiny. Neither are created by the Constitution directly. Gone are the days of a judge having some pride and not wanting to be overturned on appeal. There being no penalty for being overturned ... they don't care and are simply doing the bidding of their ideological masters. The same can be said for the bureaucracy. Both groups are inferior and should be brought to heel.

I told them that the second that DOGE acquiesced to the federal judge's TRO banning them from Treasury data - we lost the momentum. The fact that Trump/DOGE didn't go full "Biden ignoring the supreme court with student loan forgiveness" meant that we had already hit the wall. It's over. We have about 20 months to get done what needed to get done before the Democrats take back either the House or the Senate (as is historically consistent) before the administration has to stave off endless investigations and impeachment hearings all over again. The judical process will get drawn out for months, and when this particular case is resolved, the Democrats will just do the same thing all over again with a different judge/issue.

There comes a time when the point is conceded. If judges have infinite review, then we are not ruled by ourselves, we are ruled by them. This cannot work that way.
So, if as you say, any attempt to fight this means we hand the dems even more power, then the system will never work no matter what we do. A bit more black pilled than I'd like to be. Put the pill on the floor and kick it away. That's not what I was saying at all. I laugh at the “both sides” argument. Lawfare is the sine qua non of Democrats. They’ve prove it time and again. One simply cannot say the same for Republicans. Not only that, but every piece of lawfare and ignoring of judicial rulings has eventually been either overturned or dropped when pursued within the court system. Several of those cases actually formed the basis for dismantling the deep state agencies who have been found either to not possess the authority for powers they pretend to have, or by putting them squarely under the power of the president.

MaddowBlog-After court ruling, Vance and Trump approach a profoundly dangerous line. Vance’s argument “opens the door to a potentially dangerous path. ... What Vance’s wording suggests here, without directly saying it, is that the executive could potentially respond to a court order by saying to the court, ‘You’re unconstitutionally intruding on my authority and I’m not going to do what you say.’
“At that point, the Constitution falls apart.”..... Three weeks ago, Trump and Vance swore an oath to “preserve, protect and defend the Constitution of the United States.” There’s fresh reason to wonder whether they meant it. Trump lives for crossing dangerous lines. It gives him a rush and a high. No one has ever stopped him. Except, maybe Leticia from New York. Project 2025 openly called for ignoring the courts. He's creating a Constitutional crisis only 3 weeks into his term. Just 24 hours after I posted that Trump and Musk would defy the court's orders it has happened. Yeah, don't react, don't fight, just keep doing what you are doing and send your fleet of lawyers out to higher courts to overturn this nonsense.
All that does is reinforce that the Judiciary is not the co-equal of the Legislative and Executive branches. You don't remedy an out of control Judiciary by seeking relief from the Judiciary. And in general, this "don't react, don't fight" mantra is why the GOP has had their shit pushed in since the Clinton Era. Guess what Americans want ? A great big fight. Trump must, if he hopes to accomplish anything, ignore these Federal Courts while giving the Supreme Court the smallest window possible in which to issue their own face-saving reprimands. Anything less is to acknowledge the power grab of the Judicial branch. Its either fight or shut up time for the Trump Administration. Time for Trump to pack the SCOTUS with 99 more literally 19-29-year-old MAGA Justices.
Can you say Chief Justice Big Balls? Posted by: ShainS ====== You have to break the filibuster in the Senate to do that. Basically, people misunderstand Marbury. Marshall disliked Jefferson's actions but if he and the court had issued an order to Madison to pay Marbury, it would have been ignored. So Marshall went back in time to argue that the Judiciary Act of 1789 could not grant Scotus the power to hear writs of mandamus directly but only appeals of them. Marbury relied upon that for his claim and thus Marbury's claim was filed in the wrong court. The evil genius of Marbury was that Marshall pointed out Jefferson's undeniably illegal acts, claimed the power to declare laws unconstitutional, but left no way for Jefferson to retaliate. Marshall did not order Jefferson to do anything which made it impossible for Jefferson to retaliate or make political capital from the decision. The next time a law of Congress was declared unconstitutional was in the Dred Scott case. Posted by: whig at February 10, 2025 03:08 PM (ctrM5) 253

For what its worth (and that ain't much), my read on Roberts is that he has two driving principles:
1) worry about his legacy as chief justice when viewed in history by legal scholars (obviously he sucks to us, but to the scholars?) 2) concern that the judiciary should not overreach or make major, excessive rulings. For example, he voted to support Dobbs, which overturned Roe v Wade. Why? Because Roe v Wade was judicial overreach in his opinion. The United States Marshals Service (USMS) is a federal law enforcement agency in the United States. The Marshals Service serves as the enforcement and security arm of the U.S. federal judiciary, and it is an agency of the U.S. Department of Justice and operates under the direction of the U.S. Attorney General.[4][5] U.S. Marshals are the original U.S. federal law enforcement officers, created by the Judiciary Act of 1789 during the presidency of George Washington as the "Office of the United States Marshal" under the U.S. District Courts.[6] The USMS was established in 1969 to provide guidance and assistance to U.S. Marshals throughout the federal judicial districts.

No one elected them No one voted for them No campaigned for them No one can hold them to account However, that he had to issue a further order hides the fact that Trump understands the game--even if the judge does not: The judge has no authority here. For example, the USAID employees that sauntered up to the office, so confident some order from some unknown judge was more powerful than the President, ready to waltz in and go back to spending our money? They found the doors were still locked. "Access Denied" Maybe they should have waved a copy of the order at the PIV card reader? Posted by: Christopher R Taylor Little more complicated than that. It is apparent that Roberts tried to wrest control over the opinion and make it much more watered down (keeping Roe but diluting it which is basically a stupid move). Warren Burger used to do that as Chief Justice until eventually he lost control over his own court with both liberals and conservatives on the court sick of his meddling with opinions. I think a core of four justices (including Kavanaugh as its left most member) are not enamored of Roberts on the right and the three on the left are merely opportunists seeking to pick off him and Amy Coney Barrett from time to time. Clarence Thomas and Alito have good reason to dislike Roberts intensely for what he has done on the court. Posted by: whig at February 10, 2025 03:15 PM (ctrM5) 292

It would be nice if the Supreme Court would now then issue a ruling that says (a) this lower-court decision is so utterly without any basis in the Constitution that the judge who made it can only be a fool or a criminal, and (b) said judge is hereby removed from the bench immediately and permanently.
Automatic removal of any lower-court judge that has more than two or at most three 9-0 reversals in the Supreme Court would also be a good idea. 270 So, if Trump ignores the order, what happens? Do the US Marshall's arrest Trump, arrest the judge? Someone needs to take charge of the situation and Trump is top dog. He needs to take some kind of action against these weasels and start throwing people in jail.
Posted by: Megthered ======= Nope, civil contempt ensues but even that is a problem in that triggers immediate oversight by appellate courts unlike mere court orders. A judge stupid enough to try to imprison a President on civil contempt is likely to end up having issues in the near future. Criminal contempt requires the AG to agree to prosecute. Dead end there. Automatic removal of any lower-court judge that has more than two or at most three 9-0 reversals in the Supreme Court would also be a good idea. Whether such incompetents should be pushed into retirement, or fired without a pension, is a good question. I assume this is where we're heading within weeks. Roberts will even like that decision b/c he likes the Supremes to have the power and prestige, not some podunk district judge. the funding was already pulled. It's been a while, but IIRC, a TRO can stop you from doing something but not make you do something. So it can stop you from stopping funding if it's still going on, but I thought Rubio already ended a bunch of it.

@TJM, the way I look at it is that yeah, we are going to take some casualties, but you can't let avoidance of casualties stop you from going on the offensive. If Trump issues 100 EOs and 10 of them get enjoined, then we're 90 to the good.

The ruling doesn't have to be legal, it just needs to provide some cover to high-ranking and mid-level public officials in Washington who want to oppose Trump and Musk.
From this point on, they will have these dubious rulings to fall back on when not listening to Trump's appointees. Some judge will confirm that it's legal to disobey an illegal order. Any order they don't like will be deemed illegal, at least for long enough that even if it goes into effect 6 months later it will be inconsequential. End of story? If random Hawaiian judges can issue bogus TROs It seems reasonable that Felonious D should be able to issue countermanding TFOs and plow right ahead doing president stuff. Issue enough TFOs and eventually all the TROs will be moot. This is especially true when all the departments Felonious D wants shut no longer exist a year or so down the road when all this head butting gets sorted out.

Late to the thread, so I just read the comments. I agree with NovaLocal. If the outcome of this is that the power to issue nationwide injunctions is cabined by the Supreme Court, then the leftists would truly have screwed themselves (although in fairness, we used it too, as the Texas judge, Hanen, did against DACA).

A few questions:
1. Who are the plaintiffs and why do they have standing? 2. Based on the denial of TROs challenging 2A restrictions, I thought plaintiffs had to show "immediate and irreparable harm." What's the harm and why is it irreparable? 3. It would be somewhat hilarious if Trump and/or Musk filed a public records request and Trump rolled over and granted it. LOL. 4. Why not impeach judges who seem to have a contrary understanding of Articles 2 and 3 of the Constitution? Isn't this a "threat to democracy?" Posted by: Mr. Barky at February 10, 2025 05:23 PM (H68uY) 518
Leftist judges are always able to do this, because a vast majority of leftists are idiots. I see 100,000 posts of liberals saying how what Trump is doing is illegal, not because these retards have even the slightest of law knowledge, but because they are just regurgitating ther shit they see on diagnose, and then crumble the second you respond to them with actual facts.
Then again most of those people are also probably bitter unemployed government workers who know they have to future. Hopefully the supreme court has the balls to quickly snack these judges (though we know at least 3 of the low iq dipshits will side against Trump and put out a statement that reads like it was crafted by a 6 year old) then the next step needs to be a review of these judges who base nothing on case law, and all on bribes.
