The Morning Rant: Minimalist Edition

The destruction of the idea that women hold a special and vital role in our culture is nowhere more evident than the blurring of the lines between women and men. Women have the unique responsibility for the continuation of humanity. It is the most important thing that we do, and they are the only ones who can do it! But the post-modern insanity that is transgenderism has assiduously eroded that special distinction, and has attempted to destroy the primacy of women in our culture. Suggesting that womanhood is a social construct, and that men can function in all respects as women is obviously lunacy, but it also demeans women's roles in culture. If anyone can bear and raise children, then women are simply another cog in the infernal machine of humanity that the progressive movement has been desperately trying to build for 100 years.

No less demeaning is the use of women as a weapon in the political wars that are roiling America. There is no coherent political or cultural philosophy in the progressive rulebook; women are used interchangeably as victims of an evil patriarchy, and drones to be replaced by disturbed men play-acting as a warped and perverted version of Woman. It all depends on political needs.

But Donald Trump has cut the Gordian knot that the progressive junta has created. It's just not that complicated! While most Americans understand that, the obfuscation that the progressives created around the simple concept of Man and Woman has clouded the issue and allowed the current dangerous ridiculousness of men competing against women on the court and the track and in the pool.

We finally have a true CHAMPION for women in the White House.

Sex-based definitions are already law in 8 states & introduced in 8 more. Today, it will be established at the federal level.

That wasn't so tough, was it!

On one hand, it is absolutely ridiculous that we are spending time on what is axiomatic. On the other hand, Donald Trump just stuck his big thumb in the eye of every Woke idiot and far-left loon.

Hopefully this pronouncement will be followed by real action against the criminal behavior of the trans industry and their surgical and pharmaceutical mutilations of children. Doctors and therapists and social workers who push this vile criminal behavior need to go to jail. And let's toss in Big Pharma for good measure.

Did anyone have "The official position of the United States government is that there are only two genders: male and female" on their dance card for 2025?

I sure didn't, and it is great and welcome news. Let us all look forward to more obvious and simple statements that will propel us back to some semblance of sanity!

No, the most recent Scotus decision was in 2022 where the EPA did not have the statutory power to reduce CO2 emissions at existing power plants. West Virginia v. EPA under the major question

Mass v. EPA was the 5-4 decision in 2007 that EPA could regulate carbon dioxide emissions from motor vehicles.

In between was a 7-2 decision allowing the EPA to regulate CO2 from stationary sources (aka power plants and industry) but only along with other pollutants that come from the stacks. Not CO2 by itself.

Jurisprudence here is a mess due to the scientific illiteracy of Scotus and the prior existence of Chevron doctrine among others.

You are correct as EPA claims authority over matters like Freon, etc. as greenhouse gases. That is why we are banning yet again another refrigerant and now moving to flammable (but supposedly non-greenhouse) refrigerants for all new A/C systems.

HVAC people are pissed about it but the big A/C firms are probably happy people have to replace air handlers and compressors for the older refrigerants.

If I were to make an exception to the rule I stated earlier, this would be it, because of the unique nature and importance of the military. However, there's a big difference between a ground pounder in a group, and a pilot in a fighter (as an example). I know female F-18 pilots who are VERY capable, and I'd hate to see the country lose access to their services.

The gloppy, oozy body-horror movie, "The Substance" is up for the Best Picture Oscar among others.

Not that "The Substance" is a bad movie at all.

It achieves near greatness for a horror movie as a Horror Movie for You Gals only to trip over itself in the during the climax to make sure that you get The Message.

Still, the lovely and surprising Mrs naturalfake actually liked it a lot, which surprised me as she generally is not a fan of horror movies.

The story concerns a fading movie star(read Jane Fonda), played by Demi Moore, who wants to regain her youth, and finds a way to do it. Only to discover the method is suboptimal and has lots of rules to follow, which of course are broken. Hijinks ensue.

TJM, not to get into the weeds but if you read the 2022 decision, it deals with stationary sources (which are different than something like a car--see Mass v. EPA for that in 2007).

The original Chevron decision actually involved EPA rules that decided the EPA could declare an entire plant as a bubble in measuring stationary source pollutants (in the case was a refining plant) rather than each and every emission source at the plant separately which is what NRDC sought.

That is where Chevron deference came into play, Scotus declared they would defer to EPA's 'expertise' regarding how the EPA would regulate pollutants at a plant as long as the total emissions for the entire plant did not exceed Clean Air Act restrictions. The CAA itself was silent over how to implement pollutant restrictions and thus the Court deferred to the EPA over how they regulated stationary source pollutants.

And what will happen when units are replaced in buildings without said enclosures.They will have to go back and build them at huge expense. Not even possible in most cases.

Just wait until one of these these new systems catches on fire anyway as some parts t of the linesets are not protected. It will be like spraying lighter fluid on your camp fire!

I hear this all the time, oh doing so and so is easy, do it yourself don’t pay a pro. Sure anything’s easy if you spend hundreds of hours learning how to do it. But I’m not about to become an expert plumber and electrician and hvac and mechanic.

I’ll pay $500 for someone to fix the problem even though I could theoretically spend a few days on your tube learning how to do it. Time has value.

I am finding myself reaching repeatedly for "audacious" to summarize what President Trump is doing. He is moving to expand the size of the USA and solidify its control over the hemisphere to ensure the USA has abundant resources, is a world leader of low cost energy, has a robust manufacturing base, and extends its technology leadership to name a few categories.

To me, he is clearly anticipating the EU continuing its path from being a central ally to something more akin to being an adversary and gearing up to go toe to toe with an expansionist China. In this speech I am hearing he is redefining the USA's post world war II / cold war constrained relationship with the EU. He seems to moving quickly to diminish being held hostage by the EU and putting the EU in an extractive position relative to the USA. What happens to NATO is not clear except for it is going to change.

Trump is literally redefining the global order with every intention of making sure the USA continues to be planet's dominant super power for the next century.

The 2022 decision does not say what you want it to say. What it did was to strike down a specific EPA Power Plan regulation on existing power plants so the EPA came up with a new one that is currently before the DC Circuit Court of Appeals. Scotus has denied cert for now until that court rules.

See West Virginia v. EPA 604 U. S. ____ (2024) (cert denied).

For statutory reasons, the plan at issue in 2022 was the third air pollution control scheme (one is statewide std of air quality, second is hazardous substance regulation aka arsenic etc.) and the third is the New Source Performance Standards program of Section 111. §7411.

That section directs EPA to list “categories of stationary sources” that it determines “cause[], or contribute[] significantly to, air pollution which may reasonably be anticipated to endanger public health or welfare.”

Existing plants, which is the issue at stake in the 2022 case, are regulated via 7411(d) if the new power sources regulate a pollutant then the EPA must apply that to existing power plants.

I was just listening to Michael Malice this morning in the car and he pointed out the Democrat Party is the oldest continuous political party in the world. And that they've gotten there by only having one principle: the accumulation of power. Everything else is optional in pursuit of that goal. Technically, I believe they ruled that federal law gave the government the power to do so. So their ruling was a legal one, not a scientific one. It's annoying at times but that's their proper role - they have a difficult enough time with that.

They ruled that carbon dioxide emission could be regulated by the EPA as a pollutant. There are three regimens that the EPA applies the Clean Air Act enforcement powers. One is the hazardous substances (things like arsenic are emitted from coal fired plants), the second is state wide limits on Air Quality (affects cars, trucks, etc. as well as stationary sources) and the third is the one affecting stationary sources such as power plants, refineries, industrial plants, a/c systems in homes, and so on.

The 2007 case Mass v. EPA is where Scotus required the EPA to regulate CO2 when emitted from cars, trucks, etc. as a pollutant affecting air quality. Did not do so regarding power plants (so WV v. EPA did not find this controlling authority because Section 202 of the CAA does not apply to power plants and industrial plants aka stationary sources.

It's great that President Trump has put things in motion already, but nothing has been accomplished yet that can't just be reversed when the Democrats take back control of the Executive and Legislative branches of government.
