Supreme Court Refuses to Stay a Lower Court's Blocking of Its Lawless, Unconstitutional Seizing of Taxpayer Funds to Pay the Student Loans of Democrat Deadbeats

The Biden-Harris Administration (I'm trying to tether Harris to the Administration in which she serves as VP! Aaah! Republican disinformation!) was previously rebuffed on this unconstitutional assertion of Executive Robbery. Biden-Harris asked them to pretty please reconsider and let them seize funds without Congressional authorization.

The Supreme Court, quoting Dr. Evil, said, "How about frickin' noo?"

The Supreme Court declined on Wednesday to lift a sweeping block on President Joe Biden's student loan repayment plan that aims to slash monthly payments and quicken the path to loan forgiveness.

The high court turned down a request from the Biden administration to put the plan back in play after lower courts blocked it this summer in a legal challenge to the plan brought by GOP-led states.

There were no noted dissents in the brief order.

Wednesday's order has no immediate impact on the 8 million borrowers currently enrolled in the plan, known as SAVE (Saving on a Valuable Education), which was implemented nearly a year ago. In response to the deepening legal fight over the plan, the Department of Education last month placed the borrowers in an interest-free forbearance during which they are not required to make monthly student loan payments.

The White House, Department of Justice and Department of Education did not immediately respond to a request for comment. The latest information for borrowers can be found on the agency's website.

In an unusual line in a brief order Wednesday, the court said that it "expects" that the 8th US Circuit Court of Appeals, which is considering the challenge to the plan, "will render its decision with appropriate dispatch" -- signaling that it wants the legal proceedings to play out in the lower court before it steps in on its emergency docket.

The fate of the plan, which the Congressional Budget Office estimates would cost $276 billion, remains uncertain as courts consider two legal challenges. Last month, Alaska, South Carolina and Texas asked the high court to maintain a partial block on the program while the states' larger legal challenge to it unfolds. In a separate order Wednesday, the court also declined that request.

Student loan forgiveness was a key component of Biden's 2020 presidential campaign, a concession to progressives who supported more liberal candidates in the Democratic primary. But the White House has repeatedly been stymied, including with an important ruling last year in which the court's 6-3 conservative majority held that Biden had exceeded his authority by attempting to forgive hundreds of billions of student debt.

A federal court on Tuesday blocked the Biden-Harris Administration's lawless plan to issue green cards to illegals until he can sort out this newest power-grab.

This is not "loan forgiveness." This is the unilateral transfer of a liability from the borrower to the taxpayer, without the taxpayer's consent or input.

A *lender* can forgive a loan. I can lend my buddy $20 and then tell him "don't worry about it." I lose the money, but I am willing to do so. I am a direct participant in the deal.

The government cannot. It can only transfer the liability to an unwilling participant.

It's a racket. Student lending was nationalized and totally assfucked in 2009. None of this has anything to do with the borrowers or helping them; nobody is getting a good deal out of this except the services laughing all the way to the bank.

They're also fucking all the PSLF borrowers who taught schools in the ghetto for 10 years to get a write-off - rejection rate for them is about 99% last I heard.

My mandatory test for ballot language will be C-average students from the 8th grade classes of various junior high schools in the jurisdiction. They are presented with the ballot language and then told to summarize - in writing - the effect if it passes and if it does not. Last 4 years of being jerked around by fake-ass "student loan relief" that wasn't optional is probably going to cost us about 80k in interest in the long run.

They rejiggered everyone's accounts bigly about a year ago which most servicers used to scam their way into a capitalization.

This is on top of the years' worth of paperwork hell where the original nationalized loans got sold to more than one servicer at a time... good fucking luck sorting that out. Other than funneling money to cronies the primary Dem goal here is just fucking it all up. You know, just like the ACA and healthcare.

64 I'm in the vetmed field and as you can imagine, most medical professionals (read DVM's) have student debt balances that are catastrophic (upwards of $500k isn't uncommon) when compared to starting and future wages. I can't tell you how many of them I've spoken with who blithely think that after 20 years or so the entirety of their balances will be "forgiven". This SAVE Act is a last gasp to extend the current system for just a little longer before it all collapses under it's own weight IMO.

Yep, that was a good one. It means a lot of failed undergrads and people with unusable degrees wind up handling your tax returns, and working on your business license filings. and a lot of those workers are miserable and feel trapped so they do extra good work for the agencies.

I figure student loan holders should be bankruptable, in a special case, where they have to file individual returns with no write offs allowed, and any refund is seized for 7 years as an attempt to pay something back.

They like that aspect of it, but even if they didn't the government cannot do anything to reduce the cost of higher education because it, like everything else, would involve slaughtering someone's sacred cow.

The government has one answer that doesn't piss anyone off, so it is the answer it uses in *every* scenario: throw money at the problem. But throwing money at the problem drives inflation in the problem area, because suddenly there's more money available.

When the problem is viewed as "cost," then throwing money at the problem is the *worst* thing you can do because the only outcome you can possibly have is that the problem gets worse (even if the government can afford it).

College affordability could be solved overnight, but so many sacred cows would be culled that they'd need to build more slaughterhouses

Actually no. What's going on here if we use a car example is the feds have declared that people are suffering under the weight of car loans, so they've seized all the loans and hired their buddies to service them for 9 figures a year, while altering the loan terms at will.

Then they keep lobbing up half-baked plans to "forgive" the balances and pause payments - to "help" people - which get shot down in court, at which point the borrowers already getting assfucked by shoddy servicing then also get assfucked by interest capitalization.

Other people who don't have cars or who paid theirs off get mad at this, at which point the Dems point at them and call them "mean" to pander to the "I'm finna get my car repo'ed" voter demographic.

I worked hard too, and was rewarded with a very fine position ahead of my peers to some no trivial degree. So maybe that was my reward, now that I think about it.

actually since the Feral gov't really isn't the lender here, it is something they can't forgive or allow to go away.
Although the Federal government wrote the grants for the loan, they didn't actually have the money, they had to issue Treasuries or the like and forced the Fed to buy them, and so they went on the market. The actual lender is whoever bought the treasuries, and if they don't get paid back they will tell everyone, and then everyone won't buy more US Debt.

Remember, in our system, money creation is through lending and then letting the value and interest be paid to the lender to make the amount created by the debt have actual value. It works as long as the money creation matches the ecomonic growth, but when it exceeds it we have monetary inflation. Which we have now.

Probably not, the Federal Reserve is supposed to be independent and the states don't deal with foreign stuff

The one thing that is going on is the Fed has raised interest rates and is not reducing it, which is making everyone scream but it is also slowing the creation of money, since everyone is trying to get out of their need to refinance what were zero interest loans, and can't afford much new debt
at least that is the theory.

Well, we will not (exactly) default, because we can print to infinity. BUT IF we want to maintain any semblance of financial order, we will have to "give a big haircut" to many lenders, and "refinance" our debt.

Not sure on the details, but there must be some restructuring, imo. Trump has spoken on this a couple times. Maria Bartiroma was very interested the first time. Since, I think Trump said "better to get it over with" or something like that.

A one and done haircut (telling bond holders they have to accept a loss?) is maybe a better way than continuing increased debt payments to infinity. Reestablishing "normal practices" would be the preferred "way out".

idk, all kinda fuzzy to me, but for now, MMT (magic money tree, print to infinity) is their path.

It was obvious to me, at the time, the EU was trying to close their markets to US goods without, you know, outright banning American products.

I had a room mate who was pissed off that he had to pay higher premiums, because he'd had a DUI at some point. He didn't understand the concept of insurance, a mutual agreement on a voluntary basis. DUI laws might be stupid, but the idea that bad drivers should pay more to be insured is easy to understand.

Or put another way, I get a discount. Safe drivers, non-drunk drivers. Or just age out. A 24 year old single male in the Air Force who drives a camaro. Or a 54 year old married with 3 kids who works at a factory. One is a risk, one is a lot less of a risk.

Risk pooling. But the room mate thought, I guess, it was his right to get DUI and still get low, low rates. SR22 is what it is called.

A little different. There is actually not a requirement to buy auto insurance, but almost every state requires "proof of financial responsibility", effectively the same thing as insurance.

Nobody on the road without proof of financial responsibility. Seems reasonable to me. Because you know when you read the police blotter, even though they had no license, plates, or registration they were most scrupulous about keeping up their policies.
