Second Circuit Court of Appeals Reinstates Sarah Palin's Defamation Lawsuit Against the New York Times, Reversing the Improper Verdict Engineered By the Lower Hawaiian Judge
Sarah Palin sued the New York Times for claiming that her "target" map spurred the shooting of Gabbie Giffords. She did not sue for the first time they falsely claimed that, back in 2011.
She sued when the New York Times again reasserted this lie in 2017, even after the New York Times had previously retracted the false claim. As many pointed out: The New York Times doesn't even trust the New York Times' reportage. "The Nation's Paper of Record," indeed! The New York Times isn't even the Paper of Record at the New York Times. For a public figure to sue for defamation, he must establish "actual malice" -- the defamatory claim must not only be false, but the defaming party must have known it was false, or was in willful disregard whether it was true or false. In this case, the New York Times itself previously reported their false claim was, in fact, false. Thus, the New York Times as an institution certainly knew it was false, and any NYT "journalist" "reporting" at a later date could (and should) just check the NYT archive to verify whether this claim was true or false. Note: Reading the case, it appears that courts have imposed even further hurdles to find major media companies guilty of liable-- you can't just prove the institution as a whole knew the claim was false or was likely to be false. You also have to prove the specific individual working for that media company knew the claim was false or was likely to be false. The biased Hawaiian judge created a weird new procedure in which he conducted his own "evidentiary review" during the trial and took the case out of the jury's hands, saying that he had decided, on his own, that, as a "matter of law," the Republican Loses and the Democrats Win, the way Satan demands it to be.The Second Circuit Court of Appeals has now reversed this jackass opinion, and reinstated the lawsuit.
By the way: this biased, corrupt judge first dismissed the case on a 12(1)(b) motion, then, when that was reversed, he engineered this new way to dismiss the case, again. And now he's reversed. Again. And even worse: The judge made his "secret" ruling but let the jury deliberate anyway. So that if they returned a "not liable" verdict, his personal ruling would look stronger. But his "secret" ruling somehow leaked out to the press and the jurors got notified the case had already been decided by the judge, who ruled against Palin. Then, they also decided that Palin should lose. Maybe they were slightly influenced by the judge's not-so-secret ruling, huh? Say, maybe it's time to take him off this case, huh? I'm reading the case, here. Did the court demand that a different judge take this case, rather than the one who has time and time again twisted the law to deny justice to Sarah Palin? Of course not:
I've been before the trial judge in the past, and although I have deep respect for him, he played fast and loose with several procedural matters, and contrary to law, held an "evidentiary hearing" at the motion to dismiss stage. A real no-no.
We do not find it necessary to remand the case to a different district judge.Let's see what exciting new procedures he invents this time to make sure his filthy tribe wins again. (By the way, he's also repeatedly excluded evidence damaging to the New York Times' claims that their "reporter" had no idea the claims were false. I expect more of that.)

The so-called 'target' was simply an image that is required in high speed printing - on equipment so fast you need a strobe light to get a half-assed image of what is flying past at a thousand plus feet per minute.

Ace, that's the way it always goes. It's almost impossible to get the case assigned to a different trial judge, no matter how badly the judge fucked up or how biased he seems to be. Other than maybe hard proof of the judge taking bribes, you're stuck with the same judge no matter what.
My clients always found that insane. "You mean if I get fucked over by an asshole judge, and the appeals court agrees that I got fucked over by an asshole judge, I'm nevertheless gonna get stuck with the same asshole judge again?" Answer: "Yes." That's the way it goes.

That last clause seems to be forgotten in many cases. When a judge gets overturned 3 times with the same defendant, the basic rules of fairness dictate that the defendant gets a different judge. When a federal judge gets overruled on Constitutional grounds 3-4 times, at what point does that constitute bad behavior, thus justifying removal?
It should be much easier to impeach and remove a federal judge than a POTUS.

Judges in NYC state courts are elected. The only way to get elected is to be deep in the Democrap machine. That means ideological conformity. That means you do the machine's bidding unless you want to face a challenger next election.

An appellate court is never just going to sua sponte remove a trial judge. There must have been a pending issue in the appeal for them to even comment on it.
