The Morning Rant: Minimalist Edition

New York, New Jersey, Massachusetts, Illinois, Minnesota, Oregon; you are all pikers...pretenders...the real champion of lunacy was, is, and always will be California.

Oceans of tax revenue, courtesy of a fading but still huge tech sector, manufacturing, tourism, etc, yet the state has a $45 billion deficit! Gavin The Greasy claims it is because of rain. It rained in California last winter. Unexpectedly!

California has a bloated state bureaucracy that meddles in seemingly every aspect of its subjects' lives. What they use to mow their lawns, how they cook their food, what they drive...and businesses have it worse! Just try to build a house or open a business, and you will be confronted by a dizzying maze of sometimes conflicting regulations that make it almost impossible.

But this one might be the nuttiest ever! California now wants many rail locomotives to be "zero-emissions." I guess that means either battery powered (hah!), or powered by overhead lines supplying electricity. There are so many obvious problems with this plan that it suggests that the regulators have absolutely no idea how the American rail system works!

Biden's EPA May Soon Greenlight California Diesel Train Ban, Sparking Backlash From GOP

The issue dates back to April 2023 when the California Air Resources Board (CARB), the state's lead environmental regulator, passed a first-of-its-kind rule requiring rail operators to begin transitioning their freight train fleets in the state to zero-emissions technology. CARB chair Liane Randolph said at the time that the rule is part of the California's plan to decarbonize its entire transportation sector.

Under CARB's rule, beginning in 2030, all locomotive engines older than 23 years will be banned on a rolling basis. In addition, the rule requires all new switch, industrial, and passenger locomotives to be zero emissions that same year while requiring new freight line haul to be zero emissions by 2035.

Freight locomotives are massive, incredibly powerful machines that are actually quite efficient. Most of them are diesel-electric, so the diesel engine can be run efficiently while powering the electric engines. 4,000 horsepower, and full torque at 0 RPM. They are amazing. Three or four or five of those can pull freight trains of more than a mile long with ease, and no ugly expensive and fragile overhead power lines needed!

Putting those long trains together in train yards is a complex undertaking, and requires switching engines across the vast spaces and many sidings of those train yards. Yes, there are battery-powered switchers, but they aren't as powerful or as fast as the normal ones. And just how overhead power could be supplied to a massive train yard is a question for Rube Goldberg.

As usual, these pie-in-the-sky plans run generations behind the infrastructure that is required to implement them. Look at the logistical and practical mess of EVs for passengers if you want a hint of the economy-crushing demands of an electric train system.

But that doesn't matter to California. The virtue-signalling emerging from the Mandarins in Sacramento is second to none! They are the unchallenged masters of unworkable plans shoved down our throats. And sadly, because CA is the largest state, their regulations leak into the rest of the country.

I wonder how long it will take for the good people of California to realize that electric trains are a boondoggle that will dwarf the EVs that can't make a 150 mile trip, catch fire, burn forever, and cost many multiples of ICE cars to repair?

Imagine an electric train that unexpectedly stops in a city, cutting off several crossings. And now add a battery fire to the mix.

I'll bring the popcorn.

They don't want diesel powered anything. Trains, big trucks, etc. and probably not even farm tractors. Let them have their way. But everything stops at their border with other states.

21 Overhead powered electric trains work. They work well.

It is only reasonable to design such a system, however. That is, it can be made to work - the economics of it depend on line distance, power infrastructure, etc., but it technically works and works well - if the system is designed for it. Retrofitting is hugely expensive and often totally unworkable. This stuff takes *space.* The towers holding the overhead lines have to go somewhere, which is next to track. In the middle of nowhere, this is pretty easy (if expensive and often requiring corrupt use of eminent domain) but in an industrial area or switchyard? Fuhgeddit about it. Even electrified systems often have fuel-powered switch engines, etc.

And CA isn't known for not having power shortages. Or for having low crime. As usual nowadays, look to South Africa for the future. ZA's rail system has essentially died. The electricity is unreliable and thieves have stolen a lot of the overhead power infrastructure to sell for scrap. Once a line is knocked out and can't be easily or quickly fixed, they even steal the rail to sell for scrap.

CA isn't there yet, but it will be. This will just accelerate the failure of CA railroads.

The California Plan envisions doing away with locomotives altogether. The intend to attach harnesses to the front of a chain of rail cars and require hundreds of whites to pull the cars to the eastern border. This will accomplish several major policy goals:

1. No use of diesel.
2. Show whitey who's boss.
3. Have trains move more slowly to avoid risk of bodily harm to the gangs which steal from them.

Best of all it has no downside since, if the goods cannot be moved from the immediate vicinity of the coast, it's already where all the important people need it.

Supposedly, because CARB pre-dates the formation of the EPA, this state organization gets to set their own rules. Makes sense to somebody.

Irrelevant. Assume otherwise. Assume that the technology is there for all of this. Battery-powered switch engines are here and good and reliable, electric main-line engines are here and good and reliable (this one is actually true), adequate power generation for all of it here and reliable. Assume that all technical conditions are met and satisfactory for operations.

Now, even in the "best case scenario" where everything *works,* is it worth it? Is spending billions of dollars - probably a hundred billion or more dollars - retrofitting rail infrastructure worth it to reduce NOx emissions by a total amount that is likely *less* than the NOx emitted by trucks hauling containers from ports to classification yards and local sort facilities - even with the insane CARB requirements for short-haul trucks in the state today?

Not sure this even reflects the wishes of the California voters. Ballots mebbe but not necessarily voters.

Essentially through a variety of means such as compromised elections, courts, the countless commissions, interest group influence on the bureaucracy, the corrupted initiative process, and so on., voter influence on California state government is essentially nil.

This is the political design sought for the US as a whole--the facade of voting with no real ability to affect any change that would upset the ruling elites. Sort of like how Soviet voters could vote with a rigged candidate list for their Supreme Soviet legislature which would promptly rubberstamp whatever the Politburo wanted to do.

60 Have some military friends that lived in Cali for a while. They wanted to trim some bushes off their property and do some landscaping to beautify and correct some drainage issues.

The state required them to buy a permit, which would then invoke an "environmental study" that would force them to allow an observer to periodically check the property for 6 months to ensure the changes wouldn't effect the 'ecosystem' for the area, which would then ban them from ever changing the property in any way.

The EPA lets them.

CARB is an old agency and there is some grandfathering, but the EPA has to approve it when CARB does crazy shit that could affect other states. The EPA is set to approve this.

CARB is not enforceable outside of California, but it has effects outside of California because of the costs of product design and manufacturing. If you manufacture portable electric generators, for example, you have to decide to either:
1. Ignore CARB, and sacrifice the California market (which is >10% of the US population)
2. Comply with CARB, which is the most restrictive regulatory system, and sell in all 50 states, albeit at higher cost
3. The EPA lets them.

CARB is an old agency and there is some grandfathering, but the EPA has to approve it when CARB does crazy shit that could affect other states. The EPA is set to approve this.

Essentially the EPA, to extend its reach into states, allows concurrent enforcement of pollution laws and shares that power with state agencies. This is to allow some local flexibility and to soothe angry feelings that might upset the EPA's statutory power in DC. But, the EPA explicitly (and constitutionally) reserves the right to 'fire' a state agency and take up formal enforcement in any state that it wishes to. That includes CARB regulations.

Remember the EPA was constructed when essentially the commerce clause was viewed as having no limit. The older 10th Amendment state police powers doctrine was shredded by this idea. So prior court cases have served more or less to confirm EPA power along with Chevron doctrine.

They are also setting laws on how chickens are raised - and claim to be able to force other states to comply, or they cannot sell their eggs in California.

Positive Crankcase Ventilation was introduced in California in 1949. My 57, built in Tarrytown, NY and sold in NJ, still uses the draft tube. Crankcase fumes are exhausted into the atmosphere while the car is in motion.

185 I have a neighbor in Pennsylvania who has a 6-8 acre pond with a stand pipe to regulate the height of the water.

Some years ago, the stand pipe rusted out and most of the pond drained out. At the time he was also doing house renovation and the local building inspector saw the pond and notified authorities.
He ended up dealing with the county conservancy because there were fish in the pond, PA DEP, US EPA, the Army Corp of Engineers because the pond did drain off the overflow. The EPA had no record of the pond but sent out an inspector to look at this “nonexistent pond”. The PA DEP was very interesting as it seems about the time my neighbor filed papers with the DEP there was some kind of labor dispute and most of the state employees quit. This meant instead of getting notice of the receiving of the papers in 90 days, it took 7 months .. and that didn’t actually address the content of the papers. The entire thing went on so long that contractor my neighbor had hired to do the work, died before any work could begin. Eventually, he put together a new stand pipe himself and slapped it back on.

County wanted to fine them the cost of getting a doug fir replacement from a nursery. This was a big tree and would have been expensive to buy a rrplacement (also dumb)

I had to get a medallion guarantee, and the bank required a mask. So I'm in a bank with a gun and a mask, thinking that a few years earlier, I could be legitimately shot for this.
