Liz Magill and the Chairman of Penn's Board of Trustees Resigns

As you probably know, UPenn president Liz Magill resigned, as predicted, on Saturday.

She keeps her job as a professor of Bullshit.

Adam Carolla pointed out something about Magill's answers to the question of whether calling for genocide against Jews was against UPenn's rule -- she repeatedly said that if it crossed the line "into action," it was against the rules.

Well of course if you actually commit murder it's against the rules, Carolla exploded. That's obvious, but that's not what's being asked.

Is that the only thing that's against the rules?

That has certainly not been the only speech violation that's against UPenn's rules. Remember, UPenn told Will "Lia" Thomas' female swim team victims to keep silent about their discomfort about changing with Thomas or else face serious consequences.


Heather Mac Donald argues that conservatives chose the most expeditious path to getting vengeance on the woke left, but not the right one. And that the woke left will weaponize our mistake against us:

Critics of the American university have seized on what they perceive as the most efficacious means for discrediting academia. But though accusations of tolerance for the genocide of Jews guarantees the most media coverage, conservatives are making a mistake in highlighting that alleged tolerance as the main reason to revamp the university. This mistake will come back to haunt them.

Absent a complete turnover of university personnel, a renewed authority to limit speech will be used overwhelmingly against conservatives. Even now, Penn is weighing sanctions against law professor Amy Wax for her challenges to campus orthodoxy. Had the public consensus been that the universities' mistake was in not extending the same tolerance they showed to the pro-Hamas demonstrators to dissenters from leftist nostrums, Wax could have argued that she is entitled to the same protections for controversial speech. Now, with renewed support, even from the right, for student "safety," Penn can argue that its newfound concern for Jewish student safety requires it to intensify its solicitude for the "marginalized" groups whom Wax allegedly jeopardized with her contrarian opinions.

A colleague of Wax's has published an op-ed in the Washington Post unironically headlined: "To fight antisemitism on campuses, we must restrict speech." "Isn't it time for university presidents to rethink the role that open expression and academic freedom play in the educational mission of their institutions?" asks law professor Claire Finkelstein. However fanciful the question's premise--the universities currently honor academic freedom--it is chilling that the answer is increasingly affirmative, even from many on the right.

I think many on the right try to make the argument, which is difficult to make, that they have created this system, which we abhor and would like to see repudiated, but so long as they have this system of Safetyism in place, then Safetyism must be applied equally to everybody.

It's all a bit convoluted, I know. But everything fucking woke is convoluted.

What is the alternative, though? That I'm to support the wokies when they allow calls for genocide against Jews -- or whites or straights or men, for that matter -- and must suffer their censorship and debanking if I say anything that merely hurts the feeling of one of their protected groups?

I think Heather Mac Donald has a point -- but I think she's out to lunch to suggest that there is some strategically perfect play here.

I'm supposed to support these women who have championed the suppression of free speech on campus for their entire terms, because in this one case, supporting calls for intifada on campus, they made arguably the right, principled free speech absolutist call?

Mac Donald is making the point that by demanding Magill's ouster, we're also inadvertently supporting the idea that universities should punish unpopular speech. The trouble is, by supporting Magill, we'd also be supporting the idea that universities should punish unpopular speech, because Magill's entire term has been all about that.

So what are we to do? I just don't see a clean path to full victory here. Is there some way we can actually pressure Harvard, UPenn, and MIT to renounce their entire manner of punishing free speech going forward?

No, there's not.

So to be honest I think just sticking a knife in where you can is the only option open to us.

It is possible to argue two things at once:

1) we should have true free speech on college campuses; and

2) as long as you are going to have and enforce "speech codes" we want them enforced equally to leftists as they are to righties.

McDonald thinks that if you argue "1", you cannot argue "2". That's stupid.It's called arguing in the alternative. Yes, I would prefer "1" in a perfect world, and I will try to fight for 1, but in the meantime i'm going to demand that "2" be applied.

I'm against a lot of the idiocy in the tax code, but I'm going to take advantage of the stuff as long as it's on the books. I'm not paying more in taxes out of "principle". The left never does, why should I?

Which changes what, exactly? The Universities already dismantle anyone and anything that is heterodox. Only a direct and credible personal threat of dire consequences - something the rich Jews delivered - can make them budge. This is true today. It was true yesterday. It will be true tomorrow.

Heather MacDonald is wrong - you take the weapon you are offered and use it when it is offered to you. You do not sit back and wallow in angst and wonder if it is the "right" weapon, or if you should wait for something better.

Precisely. The *real* solution is to dismantle the universities. There is no political will to do so at the moment, so in the meantime I will kick back and enjoy the spectacle of various leftists cutting each other to ribbons.

They will eventually be destroyed or will decay into a rotten corpse. Monocultures always do. Nothing can save a truly rotten institution, and American academia is truly rotten. It can be pushed over into a dust heap or allowed to rot in place. It is choosing to rot in place.

Even that is rarely an option. There are no conservatives (or even any non-progs) anywhere in American academia. There's nobody to plunge the knife in the first place.

Money, and the political will to use money. That political will is not there. It might never be there, but it would be relatively easy to solve this problem with money - or, rather, its absence.

Don't bother regulating the universities. Just cut them off. No more federal dollars to universities outside of narrow defense research activities with defined ends. No student grants, either. No more federal student loans. No more student loan exemptions in the bankruptcy code. No more carve-outs at all, period.

At least two thirds of schools go bankrupt within five years if that happens. Harvard never will, but if the gloves truly come off, the endowments can be taxed.

The problem isn't Harvard or UPenn or MIT, the problem is the entire academic complex. Just cut off the money and let it collapse into rubble. No muss, no fuss.

The only component missing is the political will to do so - because Washington is somehow even more corrupt than Academia

Amazingly, the Congressional hearings and Stefanik's questioning have broken through into the publics consciousness more powerfully than any congressional hearing by either party in years. I have been very surprised by that, it hit a nerve, and a lot of us have been able to say "SEE WE TOLD YOU SO!!!!"

An electrician is more sought after than most of those college graduates (even with a valid degree).

Needless to say, an article has already been written explaining that it is racist to look for evidence of plagiarism in dissertation and academic publications.

Bingo bango. Magill got gone because a donor was yanking back a donation of shares in a limited partnership under the terms of the LP agreement due to discriminatory acts. Those shares were worth $100 million.

Here's some inside both legal and development baseball: after Princeton paid out $90 million to settle the suit by the Robertson family about the abuse of donor intent in how Princeton was using a donation to a foundation in ways that were absolutely against donor intent, more and more high dollar value donors are making explicit limitations in how money can be used and in retaining control of gifts in kind, such as stock shares and the like.

In a way you make my point. Back in the day, they were considered a minority, kind of like Nazis. No real threat. I grew up in Ct probably a community similar to yours and never felt threatened by antisemetism.
This situation is not about free expression. Being able to articulate different viewpoints. This is about the kind of visceral hatred that the left feels for anyone who disagrees with their viewpoint and now it is totally focused on Jews. This is fomenting violence.
Watch the Dr Phil video. The point he makes is that the kind of violence that took place on 10/7 is unique. It was a slaughter of epic proportion and the people commiting it were rejoicing in it. It was up close and personal.
This is not about making a case for free speech because you want to change people'sminds.

I'm not sure which case you're referring to. There are cases about incitement to imminent lawless activity, and "true threats" as being unprotected by the First Amendment but it's usually a difficult case to make. But there could be circumstances in which First Amendment protections would not apply to statements promoting genocide.

In a lot of cases, speech itself is an element of the crime and the severity of punishment--for example fraud, murder, etc. Ditto for civil actions of libel or slander. So there has never been 'absolute' free speech and it is a chimera. Reasonable people argue about what are the outer limits of free speech not whether or not to have absolute free speech.

Brandenburg v Ohio was one of the wiser decisions by the Supreme Court regarding regulation of free speech by government.

The Confederacy went back to a version of the old Articles of Confederation, which was arguably their greatest weakness. They didn't work to hold a country together the first time they were tried, and they didn't work the second time, either. You can make a case that the current EU is the third go-round for the idea.

No, the Constitution does not grant that power to suspend habeas corpus--only Congress has that power and that is an explicit grant of power to them only. Ex Parte Milligan after the Civil War clarified that particular situation. The little reported Ex Parte Merryman where CJ Taney was sitting as a circuit judge came to the same reasoning during the Civil War.

The Civil War Constitution of the Confederacy actually has the Commerce Clause and other ways to assert national power.

Arguably the Confederate Constitution was a mirror image of the US Constitution with a Supreme Court and actually a more powerful in words Commerce clause. However, the states' rights rhetoric and the ensuing confusion during the war ended up with de facto governors running the show over issues like the draft, revenues, etc.

Like it or not, the major purpose of the Confederacy was to keep slavery from being regulated, not to defend states from a national government if that national government was now pro slavery. Same as the South did not pursue secession much until its spread to western territories was threatened aka the Missouri Compromise of the 1820's. Before that, it was the Northeast threatening secession due to the War of 1812 and the eclipse of the Federalist party nationally.

Don't scoff. After a debacle in 2021 over a speech by a non-MIT geophysics professor that was supposed to be sponsored by MIT but was cancelled after his views about DEI vs. merit evaluations were publicized the alumni let the MIT administration (not the current one) let them know that this was unacceptable. Long story short, MIT in 2022 adopted a new free speech policy modeled on the Chicago Principles. A couple days after that protesters chalked some uncomplimentary commentary about LGBTQABCDEF on campus. The LGBTQABCDEF crowd was apoplectic. They got told that the postings were permitted by the new free speech policy.

It turns out that it was in fact some LGBTQABCDEF people who made the chalkings in order to stir up opposition to the new policy.
