It succeeded in driving away untold millions in ad revenue from the platform. But MMFA's latest gambit was based on a malicious, outcome-based scam to destroy Elon Musk's free speech platform. Since Twitter users can curate their own advertising experience, Musk says an internal investigation shows that MMFA used Twitter/X accounts opened slightly more than 30 days ago to "evade content filtering" and then followed only extremist accounts and the platform's largest advertisers, therefore "precision design[ing]" unique pairings of the two in their feed. But, the lawsuit claims, that was still not enough to create the unique and extremist content they wanted to use in their hit pieces. Musk says that to achieve the most damning-looking content, Media Matters had to resort "to endless scrolling and refreshing its unrepresentative, hand-selected feed, generated between 13 and 15 times more advertisements per hour than the typical X user." The lawsuit says this "inauthentic activity" was kept up until MMFA got the desired result: "controversial content next to X's largest advertisers' paid posts."Musk vows he will sue Media Matters' board and even their donors: "all of them."
I'm not hopeful about this lawsuit. Slander and tortious interference with a business contract are supposedly torts that someone can be sued for, but in my experience, judges invoke a range of doctrines to excuse leftwing defamation (while applying a very different standard to right-wing speakers). We will soon have a judge claiming that outright defamation -- with malicious intent -- is just part of Media Matters' free speech rights and we must not burden those rights by allowing a lawsuit over them. But of course Disney could sue me at any time for telling the truth and a judge will let that lawsuit drag on for years. Slander is tough to win against "public" entities because the courts have fucked up the relevant legal standards. You don't even need a leftwing judge choosing sides. Tortious interference with contract is one of those legal doctrines that exists on paper, and plaintiffs put it in their complaints mostly for leverage. If I open a competing pizza business next to an existing pizza business, and sell my pizzas cheaper, I'm definitely intentionally interfering with someone's business, and I am definitely trying to harm their business (at the expense of my business). How do you think a court would like at that case? That said, it exists for a reason -- for example, let's say my neighbor has a landscaping company, and I get pissed at him about something, then go to all of his customers and say "hey, this guy is real shady, unreliable, and a shitty landscaper." In a related matter, this J6 business, there really should be criminal prosecutions against anyone who willfully hid the evidence that people who are now in federal prison, were convicted, when there was exculpatory evidence that they'd done nothing more than walk through a building. And these media entities ought be right there on the line, having to justify calling this thing an insurrection, and these people traitors and terrorists. This is the part that baffles me, about Elon Musk. Let's say I had Elon money, and decided to write a great big check to expose social media. And let's say I still had control of that piece of social media I bought. I'd take ruthless control of that platform, assign the most dogged folks I could find with my general aims in mind - including blatant cash incentives if necessary - and use that honey-pot to cast a net. And collect all the social media statements I could. Not to go to court. The courts are rigged, have been a long time. But to build the biggest social media firestorm possible. Put Cain and Able against each other. Get Peter and Paul fighting mad. And on and on. I suspect Elon, like a lot of his ilk, simply doesn't have the will or attention span to do so.
