Thinking Like a Liberal Supreme Court Justice - Or Not

Soon after the Fourth of July, Francis Menton posted How To Think Like A Liberal Supreme Court Justice -- Part II at Manhattan Contrarian:

Just over a year ago, on July 5, 2022, I had a post titled “How To Think Like A Liberal Supreme Court Justice.” The post was occasioned by the then-brand-new issuance (June 30, 2022) of the biggest decision of the Court’s last term, West Virginia v. EPA. Justice Kagan had authored a dissent on behalf of herself and the other two liberal justices (Breyer and Sotomayor). My post also discussed two other significant decisions of the 2021-22 term where the three liberals had again dissented as a bloc: Alabama Association of Realtors v. HHS and NFIB v. Department of Labor.

And now we have several more big decisions just issued with the same 6-3 voting split (Justice Jackson having replaced Breyer). The most significant is SFFA v. Harvard.

So suppose you want to learn how to think like a liberal Supreme Court justice. If so, I submit that there is no better place to look than the dissents in cases where the three liberal justices dissent as a bloc.

. . you would be justified in coming to these dissents expecting to find brilliant insights into our legal system and constitutional order. If so, you will be greatly disappointed. There is nothing complicated about the thinking of a liberal Supreme Court justice. Each of these dissents follows the same rote formula: the heart of the opinion is an appeal to fear and/or guilt, completely divorced from anything about the law. The basic argument is that because of either some looming menace, or your sins, or both, you must cede infinite power to your betters to run things outside the constitutional order. The law? Somewhere in the thousands of statutes and precedents out there, or maybe just from our superior moral compass, we can find something to serve as a pretext to support our desired result. The desired result is always more power to the bureaucrats and/or liberal elites. QED.

SO SIMPLE. Especially considering how long some of those dissents are. But it seems about right to me. Do you agree?

Examples are given. There are some nice notes in the comment about people thinking like the justices, as well. Particularly in academia.

In a sense, proponents of "social justice" are unduly modest. What they are seeking to correct are not merely the deficiencies of society, but of the cosmos. While the Puritans/Pilgrims get a disproportionate share of the credit, they were far from the only, or even the first, group of colonizers. Church of England in Virginia (well before the Puritans), Catholics in Maryland, etc.

Remember, when the Pilgrims landed, they were greeted by Squanto, an Indian who spoke English and had spent much time in Europe.

It was striking in the affirmative action decision how little attention that the liberal justices paid to the law - their dissents focused solely on the results that were achieved by racially discriminatory admissions policies. What use do cluster munitions have in clearing trenches? They are for cratering roads and airfields, and as an impromptu mine field. They are used as area and movement denial munitions, not for clearing pathways through trenches and barricades.

The video was part of a carefully staged act to create drama for an air show. The wheel of the stricken plane would fall off at takeoff.

They are very useful. Because you don't have to hit a very narrow area (a trench) you can kill lots of the enemy hunkered down in the trench without being as precise.

I was rather unsettled when watching a video about German civilian opinion concerning Allied bombing. (SPOILER ALERT:They didn't like it.) It's easy to justify our bombing given that they started the, they started bombing civilians, and they were evil. But the average German didn't want the war and were lied into it. Now we are being ruled by a criminal regime preparing to cluster bomb our friend's enemies despite the fact that most of the world considers that to be a war crime. To quote that great philosopher John Fogarty, I fear a bad moon rising. What is justice for the German factory worker in 1943 and for us in coming days?

IIRC cluster munitions are not exactly deployed as "stand off" weapons. They're dropped from low flying aircraft on personnel, vehicles and the like. This war between Russia and (let's face it, NATO) has been mostly fought at arms length using missiles, drones and an occasional tank battle.

The use of cluster bombs is a real head scratcher. I mean they potentially could do great damage and kill lots of people, which I guess is the whole point of this shit show right now. But tactically, it doesn't make much sense.

Occupy another country? Like we did in multiple countries in the Middle East for decades?

It is a hell of a position to be advancing on prepared positions behind a Hail Mary suppression of trenches and minefields. How good are CM against prepared bunkers with overhead protection?
Kitchner promised that the wire entanglements would be cut by bombardment. That turned out poorly too.

This is away from the main point, we apparently are sending munitions that the administration considered tantamount to war crimes to be used because they tend to kill a lot of non combatants.
We are sending them because we apparently have sent everything else, and it isn't enough
It isn't enough because there is not enough manpower left, and there is not enough of the munitions and weapons to break through prepared lines.

I hadn't. I just glanced over it now. I noticed this.

Ukrainian forces have used cluster munitions that caused deaths and serious injuries to civilians. Russian forces have extensively used cluster munitions, causing many civilian deaths and serious injuries.

I assume there's a reason that they phrased it as "have used" for the Ukes, and "have extensively used" for the Russians. Regardless, assuming HRW is correct (which I don't) the Ukes should not have done that, and apparently no longer are. The same is not true of the Russians.

The Ukrainians have a variety of mine clearance systems mounted on tanks and other armored vehicles. Modern mine clearance systems do not use flails. Mine designers learned how to prevent flails from triggering anti-tank mines and some anti-personnel mines. To the extent it's been studied, it is assumed there are no real increased in velocity over the course of MLB history. None.

When modern radar guns show all these pitchers throwing over 100 now, they're not really throwing harder than guys like Walter Johnson and Lefty Grove threw in the teens and 20s.

The Babe faced the same fastballs and curves, with dirtier baseballs coming at him. The biggest difference of course, is the number of pitches any pitcher threw in a game, so modern pitchers do throw harder MORE OFTEN in a game.

Problem is much of the electronics from that era are obsolete, so engineers have to use modern equivalents. Depending on how complex a design is, that's equivalent to a brand new design, and with all the testing that's required, much time is needed.

I'm not sure I have this right, but I think that movie, Fastball, concluded Bob Feller's pitch was the fastest ever tested, on the basis of trying to back-engineer the tests that had been done.

It might have been Johnson's, I don't remember what the movie concluded, one or other of them had their fastball compared to speeding motorcycles, whereas modern radar guns measure the velocity of balls just after they're released from the arm of the pitcher, not averaged over the distance between the mound and home plate.

I do enjoy a good dig at New England, but if I'm being completely serious, I really don't understand people from that region. At all.

They tried their counter offensive which barely reached the Russian lines. This is the reason they want the cluster munitions, because they can't advance against the lines as they are now. If the Ukrainians are losing one troop to two Russians, it is not sustainable. This is nothing like the ratio that is being reported, it is much worse.

This is not success, this is not a damned fine job of holding back the Russians. It is not winning a war of attrition with troops, economy or weapons.

Remarkably, when a Democrat is president, anything 'occupied' or 'disputed' is usually ceded without question. Putin is probably irritated that he didn't get Ukraine just like he got Crimea.

418 When Russia first invaded, the universal expectation was that Ukraine would fall within a few days. Now, the Russians are pulling 50s-era tanks out of storage, have had a mass conscription and may have another, and had a mass mutiny by their best outfit. If that's failure, give me more.

The Russians out produce NATO manufacturers of artillery shells and are using them at greater rates than the Ukrainians, and have some pretty useful long range missiles one of which they used on the UKR intellegence building. They are claiming to be meeting enlistment goals without expanding conscription. The 50's tanks appear to be doing better than the German Puma tanks and the French ACPs. That could be because the Russians aren't aggressng against prepared lines, but that is also a major factor.
Ukraine is losing men, material, and using barely trained conscripts on the front line. They are doing it on our dime.

Putin is a fool. He knew he could grab anything he wanted while the FUSA was bogged down in Afghanistan and Iraq.

Once Leviathan solidified and turned over governance of Afghanistan to the Taliban, Putin should have recognized that his window of opportunity was closed.

After taking what precautions he could, including flying around for several hours to empty the gas tank and reduce the chance of an explosion, he landed the plane on one wheel but could not prevent it from flipping over. Anne climbed out perfectly fine, but Lindy dislocated his shoulder. Other flyers of the time were not so lucky. One other thing about the video, which other commenters have noted, is that she was not wearing a parachute - most stunts back then were performed without them, even though they were available, but one slip could have been fatal,.

Yeah, assuming the clip is genuinely vintage (I assume it would be part of a silent film that could be identified if someone searched enough), it's a ballsy stunt, because even with some kind of harness we can't see (I assume it isn't actually there), she's pretty screwed if she slips and is left dangling from a win on the side of the plane that's missing a wheel.

My question, in the age of AI everything is if that clip is at all real, which is why I wonder about the cameras. Either the whole thing is fake, or she did that stunt a couple of times to get footage from the damaged plane.
